Abstract

The implementation of consumer protection regulations in Indonesia plays a crucial role in shaping the relationship between businesses and consumers. This dynamic reflects how current policies strive to create a balance of interests, yet challenges remain in their execution. The existing regulations’ inability to fully protect consumers from harmful business practices raises questions about their effectiveness. Therefore, steps are needed to strengthen the consumer protection system, including stricter law enforcement and increased awareness among business actors, to foster fair and sustainable business practices.

Abstract

This research aims to describe the extent to which legal pluralism can run along with the times towards the recognition of customary land of indigenous peoples used as a means of national development. In formal legality, customary land rights of indigenous peoples have a place in national land law, but at the level of law in action they still lack legal protection. Without the availability of adequate land, planned development programs cannot run and ongoing development projects will be stalled. The government must participate in protecting the customary land rights of indigenous peoples who have long occupied their territory. This study uses a qualitative legal study method with a literature study research type. The approach used is customary law pluralism using documentation data collection techniques. The result of this study is that the existence of legal pluralism on customary land makes the law apply side by side for areas where there are customary rights. As for areas where there is no customary right, national agrarian law applies

Abstract

The purpose of this study is to further examine the adoption of mediation as an alternative non-litigation dispute resolution in the realm of conflict resolution or customary law disputes in Bali. This study uses a normative legal research method with a statutory and comparative approach. From the results of the studies conducted, it can be seen that there is an adoption of mediation as an alternative means of dispute resolution in the realm of customary law conflict resolution in Bali which is based on Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution outside the Court (Non-Litigation), besides that it is also based on the Regulation of the Supreme Court No. 2 of 2016 concerning Mediation Procedure in Court which is an amendment to PERMA No. 1 of 2008. In the realm of customary law, there are often conflicts or disputes involving indigenous peoples such as conflicts regarding the issue of fatherhood in traditional villages, village membership, regarding the seizure of village land, and separation from membership of the traditional banjar and of course there are still many problems that occur in the community. The scope of the customary law community, which if resolved through the courts (litigation) will certainly take a lot of time and cost a lot of money. Therefore, it is necessary to adopt mediation as an alternative dispute resolution into a pattern of conflict resolution involving customary law communities regarding customary disputes in the customary village area which will certainly be more efficient, cost-effective and does not take a long time.

Abstract

an international treaty is an agreement made by two or more countries to regulate their relations in various fields, such as politics, economics, security, or the environment. The relevance of an international treaty lies in its efforts to create cooperation, prevent conflict, and ensure that common interests can be realized fairly. If the agreement focuses on trade, it can open up new market access, increase investment, and strengthen economic relations between the two countries. Defense treaties or security alliances help prevent military threats and create regional stability.This study aims to determine the similarities and differences in legal protection related to trademark plagiarism in Indonesia and Singapore and to identify the factors that cause similarities and differences in the legal systems related to trademark plagiarism in both countries. The findings of this study indicate that Indonesia adheres to the Civil Law system with the principle of first-to-file registration, while Singapore follows the Common Law system with a self-assessment approach. Although both countries have ratified international agreements such as TRIPs, real differences are seen in the way law enforcement and dispute resolution are carried out. Indonesia emphasizes legal certainty through formal registration, while Singapore prioritizes efficiency and flexibility in trademark registration and dispute resolution mechanisms. Social, economic, and political factors contribute to these differences, where Singapore as a global trade center creates a responsive and adaptive environment to change, while Indonesia focuses more on protecting local industries with a more conservative approach.

Abstract

Direct and simultaneous Regional Head Elections (Pilkada), which are intended to create political stability and cost efficiency, may result a fragmented and less efficient government. This study shows that local elections in Indonesia have undergone significant developments, evolving from appointment system by the central government, to a direct and simultaneous election system. Nonetheless, Pilkada in Indonesia cannot be said to be concurrent local elections, because they are not held concurrently with the election of regional representatives.. Therefore, the implementation of Pilkada must be synchronized with the election of DPRD members in order to yield a concurrent and more efficient government.

Abstract

The crime of human trafficking has been regulated by Law Number 21 of 2007 concerning the eradication of the crime of trafficking. When the victims have experienced material and immaterial losses, restitution is one of the forms of assistance to victims of the crime of human trafficking. The research method used in this study is descriptive-analytical with a normative legal research type. Furthermore, the research data consists of primary and secondary data. Law Number 21 of 2007 regulates restitution for victims of human trafficking. Decision 322/Pid. Sus/2023/PN Jkt. Sel does not provide restitution, while Decision 667/Pid. Sus/2023/PN Kis does. Judges need to be consistent and objective in handling human trafficking cases so that justice is achieved. Decision 322/Pid. Sus/2023/PN Jkt. Sel is considered to have paid less attention to the facts of the trial, while Decision 667/Pid. Sus/2023/PN Kis is appropriate because the judge creates legal certainty. Legal certainty in a judge's decision must be based on relevant facts.

Abstract

This research aims to understand personnel arrangements related to the efficiency and effectiveness of civil servant performance in the bureaucracy as well as employee recruitment and selection policies between central and regional governments, especially regarding the competency and professionalism of human resources in a decentralized asymmetric government system. The research method used in the research is legal research using a conceptual approach. The results of the research show that the implementation of the asymmetric decentralized system of delegation of authority is not fully in line with expectations, regional government problems include issues of bureaucratic neutrality, service quality, recruitment of prospective employees, salary systems and career development, as well as the role of the civil service commission in the recruitment process for prospective civil servants In the regions, there was a lot of evidence of subjectivity so that the civil servant selection process could not produce competent civil servants. To overcome this, it is necessary to change strategies in implementing employee recruitment accompanied by changes in mindset and organizational culture that are oriented towards improving the quality of public services. Abstract

This study examines the position of the Election Supervisory Agency (Bawaslu) as a third party in election disputes in Indonesia. Bawaslu plays an important role in the supervision and resolution of election disputes, including in handling administrative violations and election crimes. Research shows that Bawaslu faces challenges in harmonizing authority with other institutions, such as the KPU and the Constitutional Court, as well as in increasing public participation in election supervision. Through a normative juridical approach, this study highlights the need for regulatory clarity and collaboration between institutions to realize democratic and transparent elections.

Abstract

This research analyzes the legitimacy of Myanmar's government as an ASEAN member post-2021 military coup through normative juridical research methods. Myanmar's military coup has caused a humanitarian crisis with regional impacts. Research shows that the coup fails to meet defactoism theory parameters and constitutional legitimacy. ASEAN applies the Estrada theory by upholding the non-intervention principle through the Five-Point Consensus, but this approach proves ineffective. ASEAN's non-intervention principle needs reformulation by considering the High Council establishment according to Treaty of Amity and Cooperation, along with strengthened cooperation with the international community in handling coups involving human rights violations

Abstract

This research aims to examine the legal certainty of scientific works produced by ChatGPT. This study uses the type of normative research and the legislative approach to examine various legal rules as the focus of the research. by using primary and secondary legal materials. The results of the study show that ChatGPT cannot be said to be the creator of the Copyright Law in Indonesia and is not entitled to copyright for its work. The current regulation in Indonesia does not mention AI more clearly. However, the law follows human development in the future. So, the government must be clearer and more decisive in setting AI rules in Indonesia, which is growing.
