Abstract

In the administration of regional government, there are symmetrical and asymmetrical regional governments. Regional government with asymmetric decentralization has special characteristics and is different from other regions. This specialty aims to organize effective local government. Effective governance allows the region to maximize its various potentials, where according to the central government's view, both cultural and especially economic potential can be optimized by the region. As times progress and economic development, it is necessary to give certain authorities to regions to maintain the existence of culture and to pay special attention to regions that are centers of economic activity to facilitate the process of transformation of science, innovation and concentration of industry in certain regions. Decentralization is given to provincial regional governments or given to district/city regional governments. The economy is a very important aspect for the region. Because with a healthy economy, regional governments can finance regional government programs for the benefit of the community. Economic progress will be directly proportional to the welfare of the majority of its people. The economic potential possessed by the region includes cultural riches, natural riches, history, industrial areas, trade areas and tourism. According to the author, this potential can be optimized to improve community welfare and also increase income for local governments. With asymmetric decentralization, the region is legally given the authority to carry out regional autonomy in accordance with its potential by bypassing certain restrictions that other regions do not have. Apart from that, because of the central government's plan, developing the region's economic potential can provide stimulus for the surrounding buffer areas.

Abstract

The conflict between Israel and Palestine is receiving a lot of attention from the world community. This calls into doubt the security of every nation, particularly those engaged in hostilities. In order to better understand how Israel's military aggression against Palestine breaches international humanitarian law, this case study will focus on how the UN is in charge of deciding whether or not Palestine is recognized by international law. This study analyzes legal concerns using a normative juridical method. The criteria and tenets of positive law serve as the foundation for this. The concept of the law of war is the foundation of international humanitarian law, which governs armed conflicts in an effort to prevent atrocities and safeguard all parties.

Abstract

This research explores the criteria and standard This study examines the importance of personal data protection in Indonesia within the rapidly evolving digital era. Personal data, such as information contained in Taxpayer Identification Numbers, holds significant economic value and may be misused if it falls into irresponsible hands. While personal data plays a vital role in business strategies and the improvement of products or services, the risk of data misuse—whether on the black market or through fraudulent activities—highlights the urgency of stricter protection measures. Since the implementation of the Automatic Exchange of Information (AEoI) system in 2018, Indonesia has committed to automatically exchanging taxpayer information with other countries to enhance tax transparency and reduce tax evasion. This research adopts a normative legal research methodology and aims to provide solutions for addressing the challenges of personal data protection in an increasingly complex digital landscape. Despite existing regulations, there remains a lack of adequate provisions specifically addressing the protection of taxpayers’ personal data in international information exchange processes. This study seeks to analyze the concept of state responsibility in safeguarding citizens' personal data and to promote the development of stronger policies regarding personal data protection in Indonesia. s essential to ensure that the use of Artificial Intelligence in Indonesia occurs ethically and responsibly. Identifying transparency, accountability, fairness, and data security and privacy as key pillars, the research underscores the importance of integrating ethical principles in all Artificial Intelligence development and deployment phases. Using a normative type of research by analyzing the existing legal and ethical framework and through legislative and comparative approaches, this research provides recommendations for strengthening AI regulations in Indonesia, thereby minimizing the risk of loss and increasing public trust in this technology.

Abstract

In general, property companies in Indonesia utilize the pre-project selling system. However, this system often leads to legal issues, particularly for buyers, as it creates uncertainty and risks. One of the main reasons for these problems is that the objects being traded, whether houses or related facilities, are not yet available or completed at the time the transaction is conducted.This study employs a normative legal method with a regulatory and case study approach. The legal materials used include primary and secondary sources. The analysis is conducted qualitatively through deductive reasoning, and the results are presented descriptively. The findings indicate that the rights and obligations between parties in the pre-project selling system often rely on the principle of freedom of contract, as stipulated in Article 1338 of the Indonesian Civil Code. This provision includes exoneration clauses and grants significant protection to property companies. The official transfer of ownership rights can only occur after the issuance of the Deed of Sale and Purchase (Akta Jual Beli, or AJB) before a Land Deed Official (Pejabat Pembuat Akta Tanah, or PPAT). The study concludes that with the development of modern contract theories and consumer protection law, the primary focus is no longer solely on agreement and formal obligations but rather on ensuring fairness in providing information to consumers through the pre-project selling system. Property companies are prohibited from handing over the property or collecting more than 80% of payments from buyers if the Sale and Purchase Binding Agreement (Perjanjian Pengikatan Jual Beli, or PPJB) has not been executed. Furthermore, the PPJB must be drawn up before a notary to prevent future disputes.

Abstract

The world is inhabited by people of various and diverse religious beliefs. Indonesia, in particular, embodies this diversity in terms of religion, ethnicity, and culture, which is manifested in the concept of Bhinneka Tunggal Ika (Unity in Diversity). However, this diversity also heightens the intensity of disputes and social conflicts among different elements of society, often resulting in discrimination and societal disintegration. One prevalent occurrence is inter-religious conflict, driven by differing perspectives and teachings, as well as religion-based discrimination, which causes both material and immaterial harm. This research employs a normative juridical method and relies on secondary data. The findings reveal that one of the consequences of such conflicts includes loss of life, destruction of places of worship, and the emergence of social stigma. Therefore, further study is necessary to assess the effectiveness and efficiency of legislation and government institutions or agencies related to the protection and enforcement of human rights.

Abstract

Drug abuse poses a global threat to public health and social stability. Indonesia and the Netherlands face distinct challenges in combating drug trafficking, influenced by their respective cultures and legal frameworks. This study aims to compare anti-drug strategies in both countries to identify more effective approaches. A normative juridical method with a comparative approach was employed to evaluate regulations, policies, and practices. Findings reveal Indonesia's emphasis on law enforcement and rehabilitation, while the Netherlands implements a limited tolerance policy for certain drugs. Indonesia's strength lies in its strict social protection measures, but it struggles with entrenched drug distribution networks. Conversely, the Netherlands has successfully reduced heavy drug users through strict regulations in specific sectors, though illegal trade remains a challenge. In conclusion, a synergy of law enforcement and community education approaches is essential for effective drug eradication.

Abstract

Indonesia is a country with high levels of solar radiation, making it essential for its people to protect their skin from sun exposure during daily activities. Generally, people use sunscreen products to shield their skin. Sunscreen is a cosmetic product containing Sun Protection Factor (SPF) and Protection Grade of UVA (PA), which provide protection against sun exposure. Prolonged exposure to the sun can cause negative effects such as skin cancer and redness, increasing the demand for sunscreen products among the public. With the significant demand for sunscreen, many businesses are selling these products. To attract customers and boost sales, businesses often use advertising as a marketing strategy. However, an issue has arisen in the marketing of these products—businesses engaging in overclaim practices. Overclaim refers to the act of exaggerating the benefits of a product, presenting claims that do not align with the product's actual properties. Such practices violate consumer rights and can harm consumers. Currently, consumer protection is regulated by Law No. 8 of 1999 on Consumer Protection. Articles 7 to 17 of this law prohibit overclaim practices, as they constitute deception toward consumers. Advertising that involves overclaiming may result in consumer losses. Furthermore, in accordance with the law, businesses are required to take responsibility for any harm caused to consumers due to overclaim practices. The adverse effects of overclaiming may lead to a mismatch between the consumer's skin type and the ingredients in the sunscreen product.

Abstract

This research discusses the problems of vulnerable groups who often face various problems accessing justice. The stigma attached to them and various discriminatory treatments from the public and law enforcement officers are two forms of the problems they face. These factors contribute to negative perceptions and a growing reluctance among these groups to seek justice for their legal troubles. Based on the 2022 Legal Needs Survey report for Vulnerable Groups regarding the behavior patterns of vulnerable groups in resolving legal problems, it was found that vulnerable groups in resolving legal problems indicate that there is a problem. The form of problem portrayed is victim blaming, a perception that tends to be pessimistic when accessing justice, misunderstanding regarding informal mechanisms, and a perception that their efforts to resolve legal problems will not maket he situation getting better.

Abstract

Pelaksanaan Kredit Pemilikan Rumah (KPR) sering melibatkan pengalihan hak melalui perjanjian take over kredit di bawah tangan, tanpa sepengetahuan bank dan tidak mengikuti prosedur resmi. Studi ini mengkaji kepastian hukum atas pelaksanaan take over kredit di bawah tangan dan pertimbangan hakim dalam Putusan No. 107/Pdt.G/2021/PN.Kwg. Dengan pendekatan Yuridis Normatif, penelitian menunjukkan bahwa Pengadilan Negeri Karawang memberikan kepastian hukum kepada penggugat sebagai pembeli beritikad baik. Hakim menyatakan tergugat wanprestasi berdasarkan Pasal 1238 KUHPerdata karena tidak memenuhi kewajiban yang dijanjikan.

Abstract

Cases of domestic violence that occur in Indonesia not only result in women as victims, but can also occur in children. The problem formulation in this thesis is: What is the role of the Labuhan Batu District Prosecutor's Office in providing legal protection towards child victims of domestic violence through a Restorative Justice approach; What are the obstacles for the Labuhan Batu District Prosecutor's Office in providing legal protection for child victims of domestic violence through a Restorative Justice approach? The research method used in this journal is the sociological juridical research method. The results of this research can be concluded that restorative justice can be implemented with the following requirements: the threat of a sentence of no more than 5 (five) years, the perpetrator is not a recidivist, there is the victim's consent or desire to make peace, there is good faith from the suspect to fulfill the obligations agreed between the victim and the suspect , and there must be an agreement between the victim, the suspect and other parties
