Abstract

This study examines the legal validity of electronic signatures in blockchain-based transactions within the framework of applicable law in Indonesia. As the adoption of blockchain technology expands across various sectors, including finance, trade, and government, understanding the legal status of electronic signatures becomes increasingly critical. This research employs a qualitative approach, encompassing case studies and analysis of relevant legal documents, including Law No. 11 of 2008 on Information and Electronic Transactions (UU ITE). The findings aim to provide insights into the implications of electronic signatures in enhancing transaction security and legal compliance in the digital landscape.

Abstract

This legal review discusses the violation of the notary's code of ethics in making a deed of sale and purchase of shares, specifically based on Supreme Court Decision 15K/Pid/2020. The notary violated the code of ethics by not initialing the deed by the person appearing, the buyer, and the seller, which violates Article 16 paragraphs 7 and 8 of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notaries and the prohibition of notaries at the Extraordinary Congress of the Indonesian Notary Association. This violation not only damages the integrity of the notary profession but can also cause losses to the parties involved in the share sale and purchase transaction. Sanctions given to notaries who violate the code of ethics can be in the form of reprimands, warnings, temporary dismissal, or dismissal from membership of the Indonesian Notary Association. To improve the integrity of the notary profession, efforts need to be made to improve understanding of the code of ethics and increase supervision of notaries. Thus, this study is expected to contribute to a better understanding of violations of the notary code of ethics and their implications for the notary profession.

Abstract

Many people invest in Indonesia's capital market, requiring companies to protect investors and ensure transparency. This research examines corporate roles in mandatory information disclosure and investor protection under Company and Capital Market Law. Investors face risks like insider trading, market manipulation, and contract breaches, making transparency in financial and operational reporting essential. The Financial Services Authority (OJK) supervises the capital market, influencing investor confidence and market stability. Using a normative juridical method, this study finds that transparency and accountability boost investor trust, impacting market liquidity and company value. Despite the legal protections, challenges and risks in the capital market remain.

Abstract

Anti-corruption is a fundamental principle that serves as the foundation for social movements within society. It emerges from the need to build a safeguard against the widespread concern over massive deviant behaviors that violate the law—namely, corruption. The anti-corruption movement aims to encourage proactive behaviors in preventing corrupt acts. For school students, this movement is introduced as anti-corruption education, which essentially broadens their understanding of corruption as a factual legal issue within society. From the perspective of legal culture, anti-corruption education creates space to instill law-abiding behaviors in specific groups within society, fostering a legal culture that promotes compliance with existing laws. The legal culture approach to anti-corruption through education is adopted because corruption has become a cultural behavior, perceived as normal in various institutions, raising concerns about ethical conduct in society. Embedding an anti-corruption legal culture in schools is a process of integrating early legal compliance with counter-corruption behaviors, aiming to establish a new culture—one that fosters anti-corruption attitudes from an early age. This is the essence of legal cultural acculturation, which intervenes in negative social behaviors to develop legal awareness as a fundamental aspect of a law-abiding society.

Abstract

The increasing demand for technological integration in legal practices has introduced the concept of cyber notary, which enables notaries to perform their duties electronically. This research examines the feasibility of implementing the cyber notary concept within Indonesia's legal framework, focusing on its boundaries and challenges. Using a normative legal research methodology, this study analyzes statutory and conceptual approaches to identify gaps in existing regulations. The findings reveal that while laws such as the UUJN-P and UU ITE provide initial support, significant barriers remain, particularly concerning the physical presence requirement and the recognition of electronic signatures as equivalent to traditional signatures. Consequently, this study highlights the urgent need for regulatory adjustments to enable the cyber notary concept to align with the principles of legal certainty and authenticity. The implementation of cyber notary practices can enhance efficiency and accessibility, provided that foundational legal structures are strengthened.

Abstract

This study aims to determine the perspective of legal politics in relation to the provisions of simple proof in the settlement of debts in bankruptcy law. The research method used in this study is a literature study which is a study that focuses on the analysis of written materials based on their context. The written materials used in this study are in the form of manuscripts, articles, and journals. This study uses a descriptive research nature that prioritizes explanations regarding the object of research. The results obtained are that simple proof is a proof that focuses on examining bankruptcy petition cases. Where the petition for a statement of bankruptcy must be granted if there is a fact that the debtor has 2 or more creditors and has debts that are due and can be collected. In relation to legal politics, the amendment of Law Number 4 of 1998 to Law Number 37 of 2004 is difficult, because there are several obstacles in changing it.

Abstract

In this era there are still many notaries who do their jobs outside of their office area. The policy of notarial law and the legal ramifications of a notary performing official functions outside of his or her jurisdiction are the subjects of this research. Using a normative judicial lens, the research reveals that the Notary Law forbids notaries from performing their duties outside of their area of ​​office (Article 17 letter a) and that notaries are only allowed to have one office in their domicile (Article 19). The genuine deed's evidential force might dwindle to that of a private deed due to the legal ramifications.

Abstract

The importance of the curator's role in the process of managing and settling bankrupt assets cannot be separated from the legal actions carried out by the bankrupt debtor to transfer assets included in the bankrupt estate to another party before being declared bankrupt by the court. The problem in this study is regarding the position of the lessee due to the cancellation of the lease deed based on the action Pauliana lawsuit in Decision Number 43 / Pdt.Sus-Other Lawsuits / 2023 / PN.Niaga.Smg and the responsibility of the Notary due to the lease deed being null and void by law based on the action Pauliana lawsuit in Decision Number 43 / Pdt.Sus-Other Lawsuits / 2023 / PN.Niaga.Smg. This thesis, using normative legal research method (library) with qualitative analysis of secondary data to obtain conclusions about the position of the lessee due to the cancellation of the lease deed based on the action Pauliana lawsuit in Decision Number 43 / Pdt.Sus-Other Claims / 2023 / PN.Niaga.Smg, namely not as any creditor (separatist, preference, concurrent) in the bankruptcy of PT. Lanisantoso Setiabudi, Andri Santoso & Lani Haryati. This is because the Panel of Judges decided and stated that Defendant I, Defendant II and Defendant III must return the money amounting to Rp. 2,500,000,000, - (two billion five hundred million rupiah) to Defendant IV in full and immediately. The Notary's liability due to the lease deed being null and void based on the Pauliana action lawsuit in Decision Number 43/Pdt.Sus-Other Claims/2023/PN.Niaga.Smg, can be requested according to the code of ethics with sanctions in the form of written warnings, temporary suspension, honorable dismissal and dishonorable dismissal. Civil, by filing a lawsuit for compensation to the District Court experienced by the tenant due to the lease deed made before the Notary being null and void.

Abstract

The role of PPAT in land registration is to assist the Head of the Land Office to carry out certain activities in land registration, one of which is by facilitating and assisting taxpayers in paying BPHTB. The problem in this thesis is regarding the authority of PPAT in managing the payment of BPHTB tax fees in the transfer of land rights and the actions of PPAT in embezzling BPHTB tax fees which is detrimental to state finances in Decision Number 474/Pid.B/2021/PN.Bks. This thesis, using normative legal research methods (library) with qualitative analysis of secondary data to obtain conclusions about the authority of PPAT in managing the payment of BPHTB tax fees in the transfer of land rights is not regulated in laws and regulations, so it is not the authority of PPAT to make payments of BPHTB tax fees. However, because the PPAT has received the deposit of BPHTB tax fees from his client, the PPAT must be responsible in his position to deposit the BPHTB tax fees, this deposit of BPHTB tax fees is carried out because he has been trusted by his client. The actions of PPAT in embezzling BPHTB tax fees which is detrimental to state finances in Decision Number 474/Pid.B/2021/PN.Bks, namely the PPAT can be held criminally responsible for committing a criminal act of embezzlement, civil there is a loss to another person and the PPAT PP and the code of ethics and committing a violation of Article 26 paragraph (1) of the BPHTB Law and Article 6 of the PPAT Code of Ethics.

Abstract

The Sale and Purchase Binding Agreement (PPJB) is an initial agreement before an official sale and purchase transaction takes place. One form of breach of contract in this agreement is the seller's failure to fulfill their obligations on time. This study discusses the legal consequences and protection for plantation landowners due to the cancellation of the PPJB by the court resulting from the buyer's breach. Furthermore, this study examines the court's legal considerations in declaring the buyer in breach without accounting for the seller’s losses, including damage to coconut trees on the land. This thesis uses a normative legal research method to analyze the legal consequences and protection for landowners whose PPJB was canceled by the court due to the buyer's breach. The cancellation of the agreement makes it legally void, meaning that the cancellation of the PPJB without compensation shows a lack of legal protection for the seller. According to Article 1267 of the Indonesian Civil Code, the cancellation of an agreement should restore the original condition and provide compensation to the landowner. This is in line with Articles 1243, 1244, and 1246 of the Civil Code, which state that a party in breach must be held accountable for the resulting damages. In case No. 160/Pdt.G/2021/PN Ktg, the judge was considered to have erred by rejecting the plaintiff’s compensation claim. Although the land and down payment were returned, the defendant was not required to compensate for the unauthorized use of the land. The judge should have considered the principle of restitutio in integrum, which means restoring the original condition, including compensation for the damaged coconut trees. By neglecting this, the judge's decision is seen as failing to reflect the principles of justice and legal certainty.
