Abstract

This study aims to analyze the impact of income disparity between husbands and wives on the development of sakinah (harmonious) families within the framework of Islamic family law. The phenomenon of wives earning a higher income than their husbands is increasingly prevalent, particularly among families in semi-urban areas such as Banjar Agung District, Tulang Bawang Regency. In the context of Islamic family law, the husband is positioned as the head of the household, bearing primary responsibility for financial support and leadership within the family. Thus, it is essential to examine how income inequality influences spousal relations and the realization of sakinah values. This research employs a qualitative approach using a field study design. The informants consist of six women, all wives who work as market traders and earn more than their husbands. Data were collected through in-depth interviews, participant observation, and documentation, then analyzed using data reduction, data display, and conclusion-drawing techniques. The findings reveal that despite economic disparities, most families maintain household harmony by fostering effective communication and cooperative relationships. Domestic responsibilities and decision-making processes are predominantly shared through mutual consultation, although some couples experience challenges due to unbalanced role distribution. In general, wives continue to uphold their husbands’ position as heads of the household and do not fundamentally alter the normative structure prescribed by Islamic family law.

Abstract

In the context of sale and purchase deeds, which are one of PPAT’s primary legal products, the application of prudence should not be limited to formal truth—truth based on fulfilling formal or procedural requirements as stipulated by law—without considering the substance or material facts behind it. These material facts are obtained through the application of material truth, which refers to efforts to ensure that all aspects of the deed-making process reflect actual reality so that the resulting legal product achieves perfection in both substance and future impact. Material truth, which produces material facts, also plays a crucial role in legal reform and legal certainty—two inseparable elements in legal practice. From a legal reform perspective, material truth that produces material facts is an urgent need, as there are currently no specific regulations governing its application in the deed-making process. Meanwhile, from a legal certainty standpoint, material facts have a direct impact on preventing potential disputes, both in the short and long term. Thus, applying material truth to obtain material facts in the preparation of sale and purchase deeds can be a concrete step toward creating legal products that are not only dispute-free but also provide justice and sustainable benefits for all related parties. Therefore, a review of existing regulations concerning the duties, obligations, and authorities of PPAT is necessary.

Abstract

This article aims to describe the position of legal expert's testimony in a formal constitutional review and what is the urgency. The result show that: first, the constitutional court recognizes the testimony of legal experts as one of the evidence as secondary evidence; second, in practice, there is no decision was found the constitutional judges elaborated the evidence of legal expert testimony in the verdict. Rrecommendation: First; to reconstruct the position of legal expert testimony in the formal constitutional review; Second; the Constitutional Court should firmly stipulate that the testimony of legal experts cannot be submitted as an evidence. Abstract

Basically, according to Balinese customary law, an Astra child's legal status will follow that of his father if his parents enter into a legal marriage. In fact, many problems arise in society because of the many incidents of children being born to women who have not experienced legal marriage. Therefore, this research aims to look at Astra children in their legal position after the existence of Law Number 1 of 1974 concerning Marriage and to define Balinese customary inheritance rights regarding the inheritance rights of Astra children. This research was carried out normatively by examining the applicable laws and regulations and relating them to what is happening in the Balinese community. In this regard, the legislation approach is the right approach to take. This research uses primary and secondary legal materials, which are then processed and analyzed using interpretive and systematic analysis. The position of Astra children in this research was concluded that after the enactment of Law no. 1 of 1974, then there is only a civil relationship with the mother's family or the mother herself. If the biological parents enter into a legal marriage in Bali, then the astra child's rights and status are purusa or following his father.

Abstract

The purpose of this article is to examine the lawsuit filed by former Chief Justice of the Constitutional Court, Anwar Usman, and the decision that will be made by the Administrative Court (PTUN) regarding the lawsuit. This research employs a normative juridical method, analyzing the application of doctrines, norms, and legal principles to address specific legal issues. Data is obtained from books, journals, and other legal literature through a literature study. Anwar Usman was dishonorably dismissed as Chief Justice of the Constitutional Court for ethical violations in adjudicating case number 90/PUU-XXI/2023, which allowed his nephew, Gibran Rakabuming, to run in the 2024 presidential election. Anwar subsequently filed a lawsuit with the PTUN Jakarta, requesting the annulment of Suhartoyo's appointment as Chief Justice of the Constitutional Court for the 2023-2028 term, as well as the restoration of his reputation and reinstatement to his position. This article will discuss the two main petitions in the lawsuit, arguing that the PTUN should not grant Anwar Usman's petition because the decision complies with the applicable laws and regulations.

Abstract

This study was conducted using normative juridical and library methods. This study shows that disputes over inherited land can be resolved by a civil lawsuit in a religious court without the consent of other heirs. According to this study, each heir must agree with the sale and purchase transaction of inherited land so that there are no problems in the future. Buyers of undivided inherited land can obtain legal protection by cancelling the sale and returning the property they bought. In addition, they found that buyers should be careful when buying undivided inherited land as it may stop the sale and purchase. Keywords: Inheritance, Islamic Law, Buyer Legal Protection

Abstract

law Number 5 of 1960 concerning Agrarian Principles has provided a legal basis for both the government in its duties as the implementer of laws and regulations and for individuals or legal entities who wish to obtain legality in the form of land certificates as proof of ownership of a plot of land must carry out the land registration process. The process of issuing land rights must be based on physical data and legal data that can be legally accounted for. An administratively inaccurate certificate is one type of certificate that is problematic due to administrative defects, so an administratively inaccurate certificate can be submitted for cancellation of the certificate by a party who feels that their rights have been harmed due to the issuance of an administratively defective certificate. The formulation of the first problem in this study is How is the legal basis for the cancellation of a certificate of ownership due to administrative defects and how is the legal certainty of the cancellation of a certificate of ownership due to administrative defects. This study uses a Juridical-Normative research type because the problem will be analyzed by reviewing the laws and regulations related to Law Number 5 of 1960 concerning Agrarian Principles, Government Regulation Number 24 of 1997 concerning Land Registration, Government Regulation of the Republic of Indonesia Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases. The results of the study are that the legal provisions as the basis for the cancellation of land rights, namely the Certificate of Ownership Rights, are Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles, Government Regulation No. 24 of 1997 concerning Land Registration, Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration, Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases and Normatively overlapping regulations on the cancellation of Land Ownership Certificates create legal uncertainty for parties who are harmed due to the issuance or ratification of Land Ownership Certificates that are suspected or known to have administrative data defects such as physical data defects and legal data defects so that there is a need for regulatory codification that provides clear and firm rules regarding the cancellation of Land Ownership Certificates due to administrative defects and there is a need for good system integration in land rights registration as a manifestation of the general principles of good governance and normative sanctions for officials who are involved intentionally knowing that the application for issuance of land ownership certificates has administrative and legal defects but is still issued, normative sanctions regulations function as preventive measures so that officials or government officials do not abuse their authority (abuse of power).

Abstract

This article discusses the legal politics of customary rights (land, rivers and wild animals) by customary law communities in the implementation of national legal development in Indonesia. This study aims to explain the existence of community customary rights, the existence of indigenous peoples' customary rights in the development of national law and about the resolution of problems related to customary rights within the scope of national legal regulation. This research is a category of qualitative research using a method, namely descriptive analysis, namely a method of finding facts, in this case using data sources, books, journals, laws, guidelines for solving customary rights problems in the UUPA and other literature precisely and straightforwardly, the type of data used is in the form ofofficial documents and scientific literature with literature study data collection techniques, then this research uses a normative juridical approach by including theories, principles, and applicable laws and regulations. The results show that the customary rights of customary law communities are still recorded in existence as long as the customary law of an indigenous community is still trusted and carried out in daily life so that it becomes a tipping point for consideration in the development of national law and the resolution of problems related to customary rights law of customary law communities accommodated in various regulations from laws, regional regulations, circulars, as well as other legal rules.

Abstract

Blockchain technology provides exceptional potential for the elimination of the inefficiencies and vulnerabilities in the land registry system in Indonesia. This paper therefore examines the incorporation of blockchain in land registration by use of a legal analysis, while studying the current framework and pointing out key challenges such as data privacy, reliabilities of smart contract enforcement, and liability in decentralized systems. It underlines the need for legal reforms in the amendment of existing land laws and harmonization with information technology regulations such as the ITE Law and the Law on the Operation of Electronic Systems. However, effective implementation enforces regulatory frameworks that respond to the various complexities introduced by blockchain technology in an efficient manner, at the same time offering legal certainty and protection to all the parties involved. Indonesia can modernize the part of its processes related to land registration by applying blockchain, which at some point could reduce fraud and increase public trust in the land records system.

Abstract

In Indonesia, the system of government adopted is presidential, where all policies and supreme command are in the hands of the President. The President in Indonesia holds executive power as well as state power, which means that the President acts not only as head of government but also as head of state. The Presidential System of Government applied in many countries, including Indonesia, does not recognize a republic that holds the highest supremacy. In the context of comparing government republics, Indonesia is often compared with other countries as a benchmark, especially when examining presidential government republics. One country that is often used as a comparison is the Philippines, which is also a member of ASEAN and a republic from colonialism in 1898. The Philippines and Indonesia have similarities in adopting a presidential republic and a unitary state in the form of a republic. The research method in this journal uses a comparative study approach. In this study, there are two problem formulations, namely, How is the Presidential System of Government in Indonesia and the Philippines and How is the Comparison of the Presidential System of Government between the two countries. In Indonesia, the President and Vice President are elected directly by the people for a certain term of office as determined by the Constitution. In the context of comparing republics of government, Indonesia is often compared to other countries as a benchmark, especially when examining presidential republics. One country that is often used as a comparison is the Philippines, which is also a member of ASEAN and a republic from colonialism in 1898. The Philippines and Indonesia have similarities in adopting a presidential republic and a unitary state in the form of a republic.
