Abstract

Unregistered marriages create legal uncertainty for Indonesian society, particularly regarding marital status and civil rights. This research analyzes the legal consequences of itsbat nikah (marriage validation) decisions on unregistered marriages in Aceh Singkil Regency using descriptive analytical methods and empirical juridical approaches. The research findings indicate that unregistered marriages are caused by local cultural factors, economic conditions, geographical factors, and weak administrative roles. The itsbat nikah process at Mahkamah Syar'iyah Singkil follows Religious Court Law provisions, resulting in declaratory decisions that provide legal basis for registration at KUA (Office of Religious Affairs), state administrative recognition, and civil rights guarantees, although the status of children born before itsbat requires separate determination. The research recommends improving marriage registration socialization, inter-institutional coordination, and public awareness to avoid legal problems.

Abstract

Abstract Child adoption is a practice that has long been carried out by Indonesian society, generally by married couples who do not yet have children, and is implemented in accordance with customs and laws and regulations. This normative legal research with descriptive analytical nature examines the legal system of child adoption, court validation, and the legal consequences arising using statutory, conceptual, and case approaches with qualitative analysis. The research results show fundamental differences between customary legal systems that sever blood relations between adopted children and biological parents, Islamic law and Law No. 35 of 2014 which do not sever such lineage relations. Child adoption requirements are regulated in Government Regulation No. 54 of 2007 and Social Affairs Minister Regulation No. 110/HUK/2009, where applications are submitted through social institutions then to the court to obtain a court decree if the specified requirements are met. The legal consequences of child adoption through court decisions show that adoptive parents only replace the role of biological parents in caring for, educating, and nurturing without severing blood relations, so that according to the Compilation of Islamic Law (KHI), adopted children are not included as heirs of adoptive parents but are entitled to obligatory bequests according to Article 209 paragraph (2), adoptive parents cannot become marriage guardians for adopted daughters and are not entitled to inherit from each other but may obtain obligatory bequests based on Article 209 paragraph (1), while adopted children still have blood relations with their biological parents and are entitled to inherit from each other according to the provisions of Articles 176-193 KHI.

Abstract

Child marriage is a form of coercion into adulthood that has a serious impact on the mental health, social, and legal development of children, especially women. Children who marry early often experience stress, depression, and anxiety disorders due to the pressure of adult roles that they are not ready to take on psychologically and socially. In addition, this marriage increases the risk of domestic violence, school dropout, and being trapped in an intergenerational cycle of poverty. In a legal context, a child who marries is automatically considered an adult and legally capable, even if emotionally and mentally unprepared, making it vulnerable to exploitation and legal harm. This study uses a normative method with a comparative approach to law, especially against the practice in the Netherlands and the Philippines, which have established an absolute ban on child marriage without a gap in legal dispensation. In contrast, Indonesia and Malaysia still provide dispensation spaces that are often used on the basis of culture or pregnancy outside of marriage. This discussion shows the importance of reforming national laws in favor of the protection of children as a whole, through the elimination of legal loopholes dispensation and strengthening social-based approaches to education and rehabilitation. Synergy between regulation, law enforcement, and changes in social norms is needed to end the practice of child marriage as a whole.

Abstract

This study aims to compare the governance between Danantara, Temasek, and 1MDB. The focus on the study includes legal basis, ownership status, organizational structure, and accountability system. Danantara has a strong legal basis but remains vulnerable to political influence and weak oversight. Temasek has maintained its independence through a strong legal and organizational structure, while 1MDB exemplifies governance failure due to weak oversight and lack of transparency. This study highlights the need for transparency, accountability, and political neutrality to ensure the success of state-owned superholdings and offers insights for developing a sustainable state investment model.

Abstract

This research examines the legal implications of the acknowledgment of illegitimate children within the context of the Indonesian legal system, focusing on the analysis of Decision Number 12/PDT.P/2023/PN.Wng. The background of this study arises from the phenomenon of illegitimate children who often do not receive equivalent legal status, resulting in discrimination within society. The purpose of this research is to understand the legal considerations of the judge in the petition for acknowledgment of the child and the legal consequences of such acknowledgment. This study employs a normative legal method with a descriptive-analytical approach to analyze primary and secondary legal materials. The findings indicate that the acknowledgment of an illegitimate child can change the child's status from illegitimate to recognized, although there are still social and legal challenges that must be addressed. This research underscores the importance of more comprehensive regulations regarding the acknowledgment of illegitimate children to protect their rights within the Indonesian legal system.

Abstract

The case of PT. Garam (Persero) decided through Supreme Court Decision Number 36 K/Pid.Sus/2019 has become an important spotlight in criminal law discourse regarding liability for placing false information on food product labels. This normative juridical research examines three main aspects: the form of false information placement, the mechanism for proving the element of intent, and considerations in determining the subject of criminal liability in the case. The analysis shows that there is proven placement of false information in the form of stating that salt was produced in Sampang from local raw materials when in fact it originated from Australian imports and was produced in Gresik, violating Permendag No. 125/M-DAG/PER/12/2015. The element of intent has been fulfilled through proof of awareness, consequences of the action, and consciousness in performing the action by Managing Director Dr. Ir. R. Achmad Budiono, M.M. who was designated as the subject of criminal liability based on his position as the highest leader with the application of identification theory. However, there are critical arguments regarding the weakness of evidence and the existence of other salt products in the market with similar errors that were not prosecuted, raising questions about the selectivity of prosecution in this case.

Abstract

Sharia banking in Indonesia faces increasingly complex dispute dynamics. Alternative dispute resolution outside the judiciary, such as mediation, arbitration, or through the National Sharia Arbitration Board (BASYARNAS), is considered more in line with Islamic justice principles. This article uses a normative method to examine the effectiveness of non-litigation dispute resolution in Islamic banking. The analysis shows that out-of-court settlement is more efficient, faster, and consistent with sharia values, although stronger regulatory support is needed.

Abstract

Indigenous land disputes in Indonesia reflect the complexity of the relationship between national and customary legal systems that have not been fully integrated in resolving ownership conflicts. This research employs a normative juridical method to analyze the characteristics of customary land law, legal protection, and unlawful acts in indigenous land disputes in Huta Lumban Gambiri. The research findings indicate that Batak Toba customary land law is communal-spiritual in nature with ownership based on patrilineal lineage through customary symbols such as the Hariara tree, yet faces challenges from legal system dualism. Supreme Court Decision No. 435 K/Pdt/2021 acknowledges the legitimacy of customary rights and historical evidence from Register De Kampoengs, but rejects compensation for the destruction of the Hariara tree, reflecting a lack of understanding of the concept of immaterial loss in customary law.

Abstract

Inequality in the access to justice concept is a fundamental issue in the  Indonesian legal system, especially for poor and vulnerable groups who are unable to access commercial legal services. Pro bono legal aid plays a strategic role as a form of social responsibility for lawyers in responding to this inequality. This article examines the contribution of pro bono legal aid in expanding access to social justice through a legal-normative approach and qualitative analysis of regulations, professional codes of ethics, and practices in the field. The results of the study show that although there is a normative obligation for lawyers to provide pro bono services, its implementation still faces various obstacles, such as a lack of institutional support, low appreciation and incentives, and operational constraints. This situation highlights the need to strengthen policies, budgets, and synergies among stakeholders, including the state, professional organizations, legal aid institutions, and educational institutions. On the other hand, there is also a need to strengthen the monitoring and evaluation system for overseeing pro bono obligations as part of monitoring and documenting achievements or obstacles faced, as part of evaluating and developing pro bono policies in the future. It is hoped that pro bono legal aid will become an effective instrument in building a fair, progressive, and more inclusive judicial system in the future.

Abstract

This research analyzes the legal consequences of deeds with delayed numbering and dating in notarial deeds based on case study of Denpasar District Court Decision Number 530/Pdt.G/2016/PN.Dps. The research method uses normative juridical approach with qualitative analysis. The results show that delayed numbering and dating causes degradation of deed's evidentiary power from authentic deed to private deed due to violation of Article 38 UUJN. Notary's responsibility includes civil aspects in form of compensation, administrative aspects in form of sanctions from Supervisory Council, and code of ethics aspects in form of professional organization sanctions.
