Abstract

The US-China trade war has disrupted the global economy, impacting Indonesia's import-export decline, rupiah exchange rate pressure, and financial market fluctuations. This study analyzes the impact by using a normative-empirical approach with trade and policy data. The findings show that Indonesia is stable through hedging strategies, neutral diplomacy, and diversification of trading partners. The study highlights the importance of an adaptive and resilient national trading system, supported by fiscal-monetary policy coordination. In addition to the evaluation, the study also provides strategic insights to strengthen Indonesia's economic resilience in the face of external shocks in an increasingly complex global trade environment.

Abstract

Interfaith marriage in Islam and Article 16 of the Universal Declaration of Human Rights (UDHR) show significant differences in legal and ethical approaches. In Islamic law, interfaith marriage is strictly regulated, with permission for Muslim men to marry Ahl al-Kitab women (Jews and Christians), but prohibiting Muslim women from marrying non-Muslim men. This aims to maintain the sustainability of Islamic beliefs in the family. Meanwhile, the UDHR emphasizes the right of individuals to choose a life partner without discrimination of religion, race, or nationality. This study aims to find out how the law of interfaith marriage, according to Islamic Marriage law allows marriage between a Muslim man and a woman Ahl al-Kitab, there are certain conditions that must be met, including maintaining Islamic norms and respecting the rights of the couple Various opinions of scholars regarding interfaith marriage, especially related to the different views of madhhab, reflect the complexity and variation in the understanding of Islamic law on this topic. Article 16 of the UDHR, which affirms the freedom of individuals in marriage without discrimination, is contrary to the principles of Islamic law that further restrict interfaith marriage, describing the tension between human rights and religious teachings in the context of interfaith marriage.

Abstract

This study examines community political participation in the 2024 Simultaneous Regional Election Re-Vote (PSU) in Tasikmalaya Regency, based on the Constitutional Court Decision of the Republic of Indonesia Number 132/PHPU.BUP-XXIII/2025, from the perspective of Siyasah Dusturiyah. As a manifestation of popular sovereignty, regional elections must ensure the active participation of the public. The Tasikmalaya Regency General Election Commission (KPU) has attempted to implement a responsive legal approach through outreach activities and stakeholder engagement, in accordance with Article 26 of KPU Regulation Number 9 of 2022. However, voter turnout in the re-vote was only 63.4%, a decline of 4.5% from the previous election. This low level of participation was due to several field implementation challenges, including the re-vote period coinciding with the post-Eid al-Fitr return flow and high urban mobility; the very short KPU socialization period (60 days) with minimal intensity in remote areas; declining public trust following previous election violations; and issues with the accuracy of the Final Voter List (DPT), such as unupdated records of deceased voters. From the Siyasah Dusturiyah perspective, this phenomenon indicates the suboptimal application of the principles of shura (consultation), ‘adl (justice), and ijma’ al-ummah (public consensus), suggesting the presence of a "pseudo-responsive legal system." As an agent of maslahah ‘ammah (public interest), the KPU bears a moral responsibility to ensure inclusive participation as a foundation for substantive democratic legitimacy.

Abstract

One biological parent may have their authority over one or more children revoked for a certain period of time by a court decision. Removing parental control over a child can be done for a number of reasons, such as abuse of authority, grave disregard of responsibilities, misbehavior, and being sentenced for a crime against their child based on a legally enforceable ruling. The Child Protection Law stipulates that parental authority may be revoked or supervision measures may be implemented, that a child may be separated from one parent, that contact between the child and the parent must be permitted, and that care that keeps the child in his family must be prioritized. If the government is given custody of the child, there must be a periodic review to make the separation as short as possible.

Abstract

The marriage ceremony of the Karo tribe is a sacred ritual that must be performed before couples can participate in other traditional ceremonies, with an exogamy system that requires marriage outside the clan (berimpal marriage) but creates complexity in terms of inheritance distribution and property arrangements. This empirical juridical research in Padang Mas Village, Kabanjahe District, Karo Regency analyzes the inheritance distribution mechanism in berimpal marriages and legal protection for heirs through literature study and interviews with descriptive analysis. The research findings show that the Karo inheritance system is patriarchal in nature, granting exclusive rights to male children according to traditional customs, however its legal protection depends on local government recognition and the Karo customary system does not have positive legal force as evidenced by the Supreme Court decision that recognizes the inheritance rights of female children, while inheritance dispute resolution can be conducted through two approaches namely civil law that guarantees legal certainty and kinship system that prioritizes social harmony and maintenance of kinship relationships.

Abstract

The development of artificial intelligence technology, commonly referred to as Artificial Intelligence (AI), has given rise to various new phenomena, one of which is deepfake. Deepfake is an application used to falsify videos and images to make them appear realistic. It is often misused to create fake content, including the misuse of the image of public figures on social media platforms, such as Facebook. This misuse negatively impacts reputation, privacy rights, and material interests. The aim of this research is to analyze the forms of compensation that can be imposed on parties who have harmed victims as a legal sanction based on Article 1365 of the Indonesian Civil Code (Burgerlijk Wetboek/BW) concerning Unlawful Acts (Onrechtmatige Daad). This study uses a normative juridical method with a conceptual and statutory approach, supported by primary legal materials through relevant laws and secondary legal materials from literature. The results of the analysis show that using deepfake to damage someone’s reputation by spreading false information constitutes an Unlawful Act. Victims have the right to claim compensation, both material and immaterial, provided that the elements of the Unlawful Act can be proven. Furthermore, there is a need to strengthen regulations regarding the use of artificial intelligence (AI) and to provide legal protection for victims, especially public figures who are frequently targeted in cases of deepfake misuse on social media. It is also recommended that there be collaboration between the government, digital platforms, and stakeholders to prevent and address the spread of deepfake-generated content.

Abstract

In Indonesia's civil law system, judges are expected to apply legislation textually and mechanistically. However, this study shows judicial considerations are often influenced by non-juridical factors such as cognitive bias, psychological pressure, and structural limitations. The article analyzes three aspects: the influence of cognitive bias and judicial psychology, discretionary space between legality and justice based on Kelsen and Radbruch's thoughts, and structural pressures like caseload and judge shortage. Two case studies demonstrate how these factors limit legal reasoning quality. The conclusion emphasizes the need for structural reform, enhanced judicial capacity, and strengthened argumentative culture in the judicial environment.

Abstract

This paper investigates the legal recognition of Non-Fungible Tokens (NFTs) as transferable assets and enforceable collateral in Indonesia’s civil legal system. The significance of this study arises from the substantial capitalization of NFTs, exemplified by Karafuru's valuation of IDR 1.2 trillion (2024) and other collections valued at 30 Ethereum each, amid the absence of specific legal regulation concerning NFTs in Indonesia. Employing a normative juridical approach, the study analyzes the potential recognition of NFTs within the secured transactions framework. Preliminary findings suggest that NFTs qualify as objects and are eligible for collateralization under Government Regulation No. 24 of 2022, although their application requires further comprehensive legal development and reform.

Abstract

The era of globalization facilitates access to information, including negative content that can trigger sexual crimes committed by minors, such as rape and murder. Although Law Number 11 of 2012 on the Juvenile Criminal Justice System regulates sanctions, victims' families consider the penalties which are only half of those for adults to be unjust. This normative juridical research employs a literature study with statutory, conceptual, and case study approaches. The findings indicate that criminal responsibility for offenders under the age of 18 cannot be transferred to their parents, and that current sanctions lack a deterrent effect. It is recommended that the Child Protection Law be reviewed and that harsher penalties be applied to perpetrators.

Abstract

Notaries as public officials have the authority to make authentic deeds that provide legal certainty for society. This research analyzes notary liability in Decision Number 5/Pdt.G/2023/PN Btl where the notary made intentional errors in making debt and receivables agreement deeds. The research method uses a normative juridical approach with case analysis. Results show that the notary violated Article 16 paragraph (1) letters a and m of the Notary Position Law by making deeds that harmed one party. Consequently, the deed degraded to an under-hand deed. The notary was subject to administrative sanctions and potentially faced civil compensation claims.
