Abstract

Notary as a public official with the authority to make or cancel an agreement, in this case a land sale and purchase agreement. The cancellation of an agreement unilaterally can be caused by a breach of contract or default by the parties. This certainly causes losses for interested parties. It is known that this study uses a normative yiridis method with a statutory approach, namely provisions related to the position of a notary who are associated with the concept of a land sale and purchase binding agreement and its legal consequences. In the discussion, it is known that the unilateral cancellation of the binding agreement for the sale and purchase of land on the basis of breach of contract or default is an act that is not against the law. The Notary based on his authority is obliged to ask for an explanation from the canceling party and the party deemed to have committed a breach of contract or default to discuss the legal consequences of the cancellation. Next is the process of canceling the binding agreement on the sale and purchase of land which is marked by the deletion from the list of deeds belonging to the Notary.

Abstract

This study discusses the suitability of the principles of restorative justice and conversion stipulated in the Juvenile Justice Act (UU SPPA) with the principle of equality in the Convention on the Rights of the Child. The approach used in this study is normative law to analyze the various legal regulations in Indonesia, such as Law No. 11/2012 concerning the Juvenile Criminal Justice System and the Convention on the Rights of the Child. The target of this study is to review the concept of restorative justice and the principle of diversion and assess their consistency with the principle of equality stipulated in the Convention on the Rights of the Child. This study uses two theories, namely the theory of restorative justice and equality. The results of the study indicate that the principles of restorative justice and diversion in the UU SPPA aim to provide protection and justice for children in conflict with the law. Both principles focus on child welfare and encourage a humane approach in resolving child crimes. In addition, these principles are consistent with the principle of equality in the Convention on the Rights of the Child, especially with Articles 2 and 40 paragraph (1).

Abstract

This research aims to find out whether leadership style contributes to employee performance. The research population is employees at PT. Three Creation Solutions. The sample of 48 respondents were employees at PT. Three Creation Solutions. Linear regression results for leadership style (X) of 0.477 indicate that for every 1% increase in leadership style value. The correlation between the leadership style variables has a positive influence while the r value is 0.528 (located in the correlation coefficient interval of 0.40-0.55). The correlation between Employee Performance Variables is not very good. This is indicated by the average value of the total employee performance score (Y) of 32.31, located in the class interval 35.0 – 50.0, which is very bad. The coefficient of determination that leadership style has a contribution of 26.3% to employee performance. The results of statistical tests (t test), obtained a value of tcount> ttable (4.218>2.013) with a significance level of (0.000 <0.05) so it can be concluded that Leadership Style contributes on Employee at PT. Three Creation Solutions

Abstract

This research aims to analyze the provisions regarding non-taxable income based on article 7 of Law No. 7 of 2021 concerning harmonization of tax regulations, as well as the juridical implications of changes to these provisions for Individual Taxpayers. Non-Taxable Income is an income limit that is not subject to tax by the state, which aims to provide tax relief for taxpayers with low income. Law No.7 of 2021 changes the previous Non-Taxable Income provisions in Law No.36 of 2008 concerning income tax. Apart from that, this research recommends the importance of socializing the new Non-Taxable Income provisions, as well as strengthening supervision by the Directorate General of Taxes to prevent misuse of Taxpayer data and regular evaluation of the amount of Non-Taxable Income is also needed so that it remains relevant to developing social economic conditions.

Abstract

The disciplin and employee performance are a unit in the family of human resources science which certainly affects employee performance. This research uses quantitative research. In this study, work discipline plays an important role in determining the level of performance. The performance of the employee in question can be seen from the work results achieved by employees in terms of quality and quantity in accordance with the employee's duties and responsibilities. Performance is something that can affect the achievement of the company's goals and progress in increasingly fierce competition. In this research, employee work disciplie suggests that performance is one of the elements used in employee assessment which includes discipline to their work, position and organization. This discipline is reflected by the employee's willingness to protect and defend the organization inside and outside of work from being undermined by irresponsible people.

Abstract

This research stems from the problem of not yet optimal monitoring of General Election Campaign Props in Bandung Regency, because there are still many findings of Campaign Props being installed in places where they should not be. So the researcher formulates problems related to the Process of Supervising Campaign Props in Bandung Regency and to make the research easier, the researcher uses a theoretical approach from Hadari Nawawi (1995:24) and will run optimally if the Proposition of the Process of Supervising Campaign Props for General Elections in Bandung Regency can be achieved. runs well if it is based on the Proposition dimensions of Monitoring, Supervision and Evaluation. The research method used in this research is the descriptive qualitative method and data collection techniques in the form of observation, interviews and documentation.

Abstract

The Indonesian government through Law Number 18 of 2017 has the main responsibility for providing legal protection for migrant workers, which includes the phases before, during and after work abroad. It is important for the government and law enforcement to provide education and provide information to prospective migrant workers, as well as support and assistance provided by consular services in the destination country. Despite significant efforts, challenges in implementing protection policies still need to be overcome to improve the welfare of migrant workers. The method used in this research is a normative juridical research method. Focusing and analyzing legal documents allows writers to identify and interpret relevant legal norms to analyze the impact and application of relevant laws.

Abstract

Work motivation is the best performance effort given by an employee to achieve maximum standards to the company. Performance appraisal is a management activity to evaluate employee performance behavior and determine subsequent policies. The method used in this research is a survey method, which will collect data from the company by distributing questionnaires or conducting structured interviews as part of the data collection process. This aims to make it easier for respondents to answer than statistical analysis methods. Based on the simple linear regression analysis technique, the influence of performance appraisal (X) on employee performance (Y) can be explained by the following simple linear regression equation: Y = 2.945 + 1.075X. This can be interpreted as follows: if there is no performance appraisal (X0), the value of employee performance is 2.945. If there is a performance appraisal of one unit (X1), the employee's performance will increase by 1.075X. In this study, the author created 20 questionnaire statements for the performance appraisal variable (X), and the calculated r-value from the questionnaire was greater than the r-table value, so the questionnaire was concluded to be valid, with the highest calculated r-value being from questionnaire no. 3, which had a calculated r-value of 0.498

Abstract

There are various ways a person can obtain land rights, including borrowing and borrowing by handing over land rights as collateral. The lending party also makes a power of sale agreement and follows up on the sale and purchase agreement. When the borrower breaks the contract, the lending party approaches the PPAT to have a sale and purchase deed drawn up and registered with the Land Office for name change purposes. The method used is normative juridical with a statutory regulation approach, concept approach and case approach. The research results obtained: The land sale agreement made before the PPAT is not the same as in fact it does not have legal force, does not meet objective requirements, so the result is that it is null and void/is considered non-existent. PPATs that make pseudo-agreements do not apply the precautionary principle in making deeds, namely acting untrustworthy, dishonest, not thorough, not independent, taking sides, and not safeguarding the interests of the parties involved in legal actions. The notary's actions violate the Debtor's rights which are protected by law. Debtors can sue for compensation on the basis of violating Article 1365 of the Civil Code in conjunction with Article 16 paragraph (12) UUJN, violating Article 3 point 4 of the Notary Code of Ethics.
