Abstract

The motivation and employee discipline are a unit in the family of human resources science which certainly affects employee performance. This research uses quantitative research. The results of the study are, it can be seen that the results of testing the work motivation hypothesis have a significance level of 0.000 and a calculated t value of 5.351 > t table 1.66757. So it can be concluded that Ha is accepted, so it can be said that motivation (X) has a positive and significant effect on employee discipline because the level of significance of the motivation variable is < 0.05 (0.000 < 0.05) and the calculated t value is > t table ( 5.351 > 1.66757) In this research, employee work motivation suggests that discipline is one of the elements used in employee assessment which includes motivation to their work, position and organization. This discipline is reflected by the employee's willingness to protect and defend the organization inside and outside of work from being undermined by irresponsible people.

Abstract

The environment and employee loyalty are a unit in the family of human resources science which certainly affects employee performance. This research uses quantitative research. The results of the study are, it can be seen that the results of testing the work environment hypothesis have a significance level of 0.000 and a calculated t value of 5.351 > t table 1.66757. Abstract

Tourism constitutes a vital economic sector for numerous countries, including Indonesia, with Bali serving as a prominent destination. However, the expansion of this industry has precipitated significant environmental challenges, particularly concerning waste management and environmental sanitation. The right to a clean and healthy environment is recognized as a fundamental human right under various international legal instruments, including the Stockholm Declaration (1972) and the Rio Declaration (1992). In Indonesia, this right is enshrined in Article 28H of the 1945 Constitution and further reinforced by Law No. 32 of 2009 on Environmental Protection and Management. This study employs normative legal research with a comparative approach to assess the consistency of legal frameworks governing the right to a clean tourism environment in Bali and the legal challenges encountered in its implementation compared to other jurisdictions. The findings indicate that despite regulatory measures such as Bali Governor Regulation No. 97 of 2018, which prohibits the use of single-use plastics, enforcement remains hindered by deficiencies in public compliance and waste management infrastructure. A comparative analysis with Japan, Palau, Norway, and Germany underscores that the efficacy of environmental policies is contingent upon a combination of stringent regulations, consistent enforcement mechanisms, and active public participation. Accordingly, an integrative approach—comprising regulatory reinforcement, enhanced public awareness, and innovative environmental management—is imperative to ensure the sustainability of tourism in Bali.

Abstract

BPJS is an entity that functions as the organizer of social security programs, structured as a public legal entity. Any policy issued by the Government is not always smooth or free from obstacles as desired by the Law. The current issue faced by BPJS is related to the outstanding BPJS contributions from employers or businesses. The purpose of this writing is to determine the position of the BPJS contribution arrears in relation to State Finance. The methodology used in this journal writing is Normative Methodology. Regarding State Finance, a fundamental aspect is the contribution from the State Budget (APBN) as stated in Law No. 17 of 2003 concerning State Finance. The connection with the arrears of BPJS Employment contributions is that when these contributions are not paid by employers or businesses, it leads to indirect losses to State Finance, because when BPJS Employment was established, the State had initial capital sourced from the APBN placed in BPJS Employment according to Law Number 24 of 2011 from the APBN. Therefore, in relation to the arrears of BPJS Employment contributions, the relevant authorities in the legal field can assist BPJS Employment in recovering State finances.

Abstract

Restorative justice merupakan suatu pendekatan yang lebih menitik-beratkan pada kondisi terciptanya keadilan dan keseimbangan antara pelaku tindak pidana dengan korban. Mekanisme dan tata acara peradilan pidana yang berfokus pada pemidanaan diubah menjadi proses dialog dan mediasi untuk menciptakan kesepakatan atas penyelesaian perkara pidana yang lebih adil dan seimbang, baik bagi pihak korban, maupun pelaku. Tujuan penelitian untuk mengetahui pelaksanaan dan penerapan Restorative Justice dalam perkara pidana oleh penyidik kepolisian. Penelitian ini menggunakan jenis penelitian yuridis-normatif. Pendekatan yang digunakan dalam penelitian ini meliputi pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Adapun hasil penelitian ini dapat disimpulkan bahwa pelaksanaan dan penerapan restorative justice dalam perkara pidana oleh penyidik kepolisian biasa ditempuh menggunakan dua model, yakni model Victim-Offenders Mediation dan Family and Community Group Conferences yang berfokus pada pemidanaan bisa saja diubah menjadi proses dialog dan mediasi untuk menciptakan kesepakatan atas penyelesaian perkara pidana yang lebih adil dan seimbang bagi pihak korban dan pelaku. Penerapan prinsip restorative Justice juga memberikan peluang bagi pelaku tindak pidana untuk mengakui kesalahan mereka, memperbaiki perilaku, dan memperbaiki hubungan dengan korban dan masyarakat secara keseluruhan.

Abstract

The purpose of this study is to examine the level of mediation success at the Karangasem Regency Manpower Office. The selection of the research location was chosen deliberately, on the grounds that Karangasem Regency currently has quite good tourism development in Bali. So that it has an impact on the absorption of labor in the tourism sector. To answer the research objectives, the respondents determined were mediators at the Karangasem Regency Manpower Office and labor law practitioners. The data were analyzed using qualitative analysis, namely the data and facts found would be described. Furthermore, it will be reviewed based on existing references or based on logic. The results of the study showed that out of 13 industrial relations disputes, 11 of them were successfully reconciled. Only two disputes failed in mediation. So that the percentage of mediation success reached 84.62%. The fairly high level of success is driven by several factors, namely: compliance with mediation procedures by stakeholders; a massive and intense approach by the mediator to the parties; an approach from the mediator which is also carried out informally or outside the mediation schedule; and an explanation by the mediator to the parties regarding the benefits of peace.

Abstract

The current Aviation Law does not regulate the binding of mortgage guarantees on aircraft, causing legal uncertainty regarding aircraft as collateral. There are differing opinions on which guarantee institution is appropriate for imposing guarantees on aircraft according to Indonesian law. To date, mortgage collateral is considered the most relevant for binding aircraft because aircraft have special characteristics. Aircraft are registered and have a country mark, so they can legally be used as collateral for debt repayment. Therefore, the binding of aircraft and helicopters is done with a mortgage. The research method used is a normative juridical descriptive method with the object of research being guarantees on aircraft. The results of this study indicate that there are no government regulations concerning the imposition of security rights on aircraft, making the process unclear. Notaries are authorized to make aircraft mortgage deeds, providing certainty and legal protection. Notaries can also make SKMH, which has perfect legal proof. The existence of SKMH in the guarantee of aircraft security rights is the choice of the related parties. In essence, the imposition of mortgages must be done with an authentic deed made before a competent official, in this case, a notary, according to Article 1338 of the Civil Code (BW) and Article 1171 of the Civil Code (BW).

Abstract

Human resources have a major role in every organization. Even though it is supported by facilities and infrastructure and other resources, it is not supported by reliable human resources. And this research are use quantitative method. Based on the results of research and discussions that have been carried out in this research regarding the influence of human resource development on employee performance at PT.  Eka Bogainti, Jakarta City, the researcher drew several conclusions and suggestions as follows, Human resource development partially has a positive and significant effect on employee performance PT. Eka Bogainti, Jakarta City. This states that the hypothesis is accepted and proven to be accepted as true, Formal development partially has a positive and significant effect on employee performance PT. Eka Bogainti, Jakarta City. This states that the hypothesis is accepted and proven to be true. Based on the conclusions that have been obtained, the following suggestions can be given, for the leadership of PT Asuransi Jiwa Prudential Medan Branch to pay attention to the informal development of employees, For the leadership to pay attention to and improve the formal development of employees.

Abstract

preamble of the 1945 Constitution is a very important declaration in the formation of the Indonesian state. This preamble is not only the opening of all articles in the 1945 Constitution, but also reflects the ideals and goals of the Indonesian nation. It contains the basic principles that form the basis of the state, such as independence, unity and social justice. The link between Article 1(2) and (3) of the 1945 Constitution lies in the strengthening of the principle of democracy within the framework of the rule of law. In this case, popular sovereignty (paragraph 2) is not only articulated in the form of elections or political decision-making alone, but must also be implemented within a fair and binding legal framework as stated in (paragraph 3), and political parties play a very important role as infrastructure in a democratic system. As institutions that unite people's aspirations, political parties have a major function in facilitating citizens' political participation. Political parties act as a bridge between the people and the government, by absorbing, organizing, and conveying the interests of the community into public policy.

Abstract

The research aims to determine how is the effectiveness public services at Sidoarjo’s Population and Civil Registrations service are in meeting needs population of administration document on weekend. Theoretical concept that used by researcher is from Joseph W. Duncan’s theory of effectiveness at Husna & Mayarni (2022) where the indicators of effectiveness is included: Achievement on the goals, Integration and Adapt of public service. Type of research used by researcher is descriptive qualitative method within sources and the type of data are divided into primary and secondary data through tooks activities documentation, employee interviews, and activity observe that’s can be used to draw a conclusion.  Finding of the effectiveness research in the weekend activity are IKD activation and KTP recording on beginner are considered to haven’t been implemented properly in terms of factor that influence service regarding the lack of availability of facilities and infrastructures when activities take place and lack of communication, both to community and to stakeholder that maintain the system.
