Abstract

Maw?l? was born from the oppression and discrimination of the Umayyad Regime. They emerged as a new political force and as an opposition which eventually helped to overthrow the Umayyad Dynasty. This is a further result of the Bani Umayyad's political policies in upholding Arab supremacy over the non-Arab Muslim community. Realized or not, sharp segregation and separation in terms of social, economic up to worship (ritual) gave birth to a new phenomenon in the world of the political arena of the Umayyad regime. Arab supremacy can indeed be enforced, but greater movement and strength in their bodies are ready to tear them down at any time. The oppression, discrimination and treatment as a second class society under the domination of the Arab Muslims they received not only made them hate the Umayyad regime but moreover they were anti-Arab; trying to oppose the Arabism system.

Abstract

In his relatively brief reign, ‘Umar ibn al-Khatthab had made many innovative breakthroughs including those relating to government administration. All of this was done in order to answer the increasingly rapid and complex developments along with the increasing breadth of the Islamic region and the increasingly plural socio-cultural community. These innovations, among others, include the fields of government administration, economics, justice, and military affairs. Interestingly, most of the breakthroughs were the result of the creativity of his thoughts, not from the textual guidance of the Prophet Muhammad SAW. In fact, some of them are contrary to the policies of the previous period.

Abstract

The reformation of family law in Somalia, which is mostly Moslem populated and Syafi’ian in fiqh, greatly affected by Its social and political constellation. The colonialization of Britain and Italy, Its political and ideological affiliation to the Soviet Union during the cold war, as well as the dictator government for about 3 decades in after Its independence. In the development, those factors have revoked the family code reformation to its traditional roots there namely some parts of customery law and Syafi’ian Islam in fiqh. Such a detachment os Islamic law tradition had evoked a long serious conflict between the government and the society, particularly the Islamic scholars. This conflict even took a toll.

Abstract

This paper talks about the system of fiqh schools in Bahtsul Masail, especially in the context of the institution-based trend of fiqh schools in the modern era. Based on historical, normative, and sociological perspectives, this paper concludes that Bahtsul Masail has created a distinctive and unique system of fiqh schools, so that it has strong arguments to be called “the NU fiqh school”

Abstract

Hadis atau sunnah merupakan segala aktivitas Rasulullah SAW. baik yang berupa perbuatan, ucapan atau diamnya beliau terhadap sesuatu perbuatan yang dilakukan oleh para sahabat. Segala aktivitas yang dilakukan oleh Rasulullah saw, sebagian ulama memandang sebagai suatu perbuatan hukum yang harus diamalkan oleh umatnya. tetapi sebagian ulama lainnya berpendapat bahwa yang mempunyai kaitan hukumlah yang ditetapkan sebagai hukum yang harus diamalkan. Sedangkan yang tidak berkaitan dengan hukum dipandang sebagai perbuatan sunnah. Hadis merupakan sumber hukum Islam kedua setelah Alquran yang dijadikan pegangan atau hujjah bagi umat Islam. Oleh karena itu, hadis menjadi pegangan atau hujjah dalam menetapkan suatu hukum yang tidak ada di dalam nash Alquran. Hadis yang dijadikan sumber hukum, para ulama sepakat memberikan kreteria yang ketat, hal ini karena hadis merupakan pedoman bagi umat Islam untuk menjalani dan melaksanakan perintah-perintah Allah baik yang berhubungan dengan ibadah ritual maupun ibadah sosial. Pengetatan yang dilakukan oleh para ulama ini bermaksud agar terhindar dari hadis-hadis palsu yang bertebaran di masyarakat yang dilakukan oleh orang-orang demi kepentingan dirinya dan golongannya. Karena itu para ulama mengklasifikasikan hadis menjadi tiga macam yaitu : hadis shahih, hadis hasan dan hadis dhaif. Abstract

Ikhw?n al-Muslim?n is one of the largest da'wah congregations that continues to carry out its various activities. The sympathizers, supporters and cadres are scattered in various regions throughout the world. They carried out their da'wah activities by referring to the various directions and thoughts that were spawned by the great thinker of Ikhw?n al-Muslim?n as well as its founder, Im?m Syah?d Hasan al-Bann?. Initially, Ikhw?n al-Muslim?n movement engaged in social and educational fields. Some of the activities include the establishment of polyclinics, mosques, schools, factories, eradication of illiteracy, publication of religious books, and daily and magazine publications. Over time, its movement began to enter into the problem of political realm. The journey of Ikhw?n al-Muslim?n is full of tribulations. Obstacles and challenges, especially from the Egyptian Government, are an integral part of the history of Ikhw?n al-Muslim?n, since the first quarter of the 20th century up to the present time with the dynamics of ups and downs and full of tragedy in realizing their ideals namely the establishment of the Islamic Caliphate.

Abstract

Scholars differ about the necessity of witnesses in divorce. There are those who oblige, say the Sunnah, and while others say that divorce does not need a witness. These differences stem from an understanding of related sacred texts that are also diverse. In addition, those with their opinions hold their own logic. In Indonesia itself, the witness' obligation is regulated in positive Islamic law or KHI. Divorce must be resolved through the Religious Courts. This means that the existence of witnesses in the divorce process in Indonesia is a necessity, as a form of efforts to protect the rights of all related parties. Imam al-Shafi'i in his magnum opus, al-Umm, said that witnesses in divorce and reconciliation were the same as the position of witnesses in the sale and purchase agreement or other trade transactions that were highly recommended for the benefit of the people.

Abstract

The discussion of the division of inheritance in Islamic sharia is a dogmatic concept that has little development space, one of which is in the discussion of the concept of dzaw? al-arh?m which is not much mentioned in the Koran or al-Hadith. While the reality of cultural life encountered many problems associated with this dzaw? al-arh?m. Then of course there will be many perceptions of ijtih?diyyah related to this dzaw? al-arh?m, among them are in the opinion of Im?m Syafi'? and the Compilation of Islamic Law in force in Indonesia. Im?m Syafi'? has the concept of inheritance for dzaw? al-arh?m which can be compared to the concept of a substitute heir in article 185 KHI, although in some respects it has differences. Both have the same passion, namely to prevent harm and ensure justice and benefit.

Abstract

Kemaslahatan sebagai inti dari maqâshid al-syarî‘ah, memiliki peranan penting dalam pengembangan hukum Islam. Sebab hukum Islam diturunkan dengan tujuan untuk menghadirkan kemaslahatan manusia baik di dunia maupun di akhirat. Salah satu kemaslahatan yang diayomi adalah perlindungan nasab. Nasab adalah fitrah manusia, karena manusia memiliki naluri beregenerasi. Di sisi lain, manusia memiliki fitrah kepatuhan kepada Tuhan. Sehingga dua fitrah tersebut terakumulasi pada perlindungan nasab. Perlindungan nasab berkenaan dengan kuantitas di satu sisi, dan kualitas di sisi lain. Proporsional titik yang tepat dari keduanya dilihat dari lingkup realitas yang terikat. Perlindungan nasab tidak hanya pada regenerasi saja, tapi juga mencakup pada segala perantara (wasilah) yang menunjangnya, baik pada kuantitas maupun kualitas. Pun demikian, perlindungan nasab mengakomodir sisi potensi ke depan (janib al-wujud) untuk dioptimalkan, dan sisi riil terkini untuk dipertahankan (janib al-’adam).

Abstract

Hukum Islam diterapkan di semua tempat di mana umat Islam berada untuk menerapkan ajaran-ajaran Islam dari Al-Qur’an dan sunnah, juga qaul-qaul ulama dalam ijma dan qiyas. Penerapannya di masing-masing tempat selalu berhubungan dengan politik hukum kekuasaan dan keadaan di mana wilayah itu berada, serta adanya musyawarah dan politik hukum kekuasaan di antara para ulama dan penguasa. Khususnya di masyarakat Jawa, hal ini terlihat dengan jelas, bagaimana elit bangsawan dan ulama berperan, sehingga corak politik hukum kekuasaan di kalangan muslim Jawa memiliki dimensinya karena ada dialektika lokal daerah, prakrassa ulama dan elit bangsawan. Tulisan ini ingin melihat politik hukum kekuasaan yang dijalankan ulama dan elit bangsawan di tanah Jawa di masa-masa awal, untuk dijadikan bahan refleksi bagi pengembangan gerakan Islam kultural di Jawa, dengan tetap mengacu pada hukum Islam yang, dalam batas-batas tertentu harus diterapkan secara fleksibel, selain pada soal hukum-hukum elementer, seperti sholat, puasa, dan haji. Oleh karena itu, tulisan ini ingin melacak: politik penyebaran Islam dalam menerapkan hukum Islam di dalam masyarakat Jawa, hubungan elit bangsawan dan ulama penyebar Islam di masa awal, da hukum Islam secara kultural yanmg diterapkan di masyarakat Jawa; dan relevansinya untuk saat ini.
