Abstract

Indigenous peoples have characteristics in every activity. One of the characteristics in the life of indigenous peoples, especially the indigenous people of the Lamaholot tribe, is the customary judicial institution of the Lamaholot tribe. The purpose of this study is to determine and analyse the description of the Lamaholot customary judicial institution and the role of the Lamaholot customary judicial institution in resolving customary violations during murung keneber. This research is an empirical legal research with primary and secondary data. The data were collected through interviews and literature study. The results obtained are that there is a customary judicial institution of the Lamaholot tribe that has a role in resolving customary violations during murung keneber (planting season). This institution prioritises peace and recovery efforts (mela sare). The process of resolving customary violations through the Lamaholot customary justice institution is guided by Lamaholot customary law which still believes in the power of Dewa Rerawulan Tanaekan (God) and Ama Opo Koda Kewokot (ancestors). The settlement of customary violations through the Lamaholot customary judicial institution in Leworahang, Ile Padung Village is carried out by the belen suku onen (tribal chief) Raja Tuan who is the four major tribal parts in the Lamaholot tribe consisting of the koten, kelen, hurit and maran tribes, witnessed by belen suku onen from other tribes in the village/lewotana, and attended by ata nalan (the offending party). The Lamaholot customary justice institution plays a role in resolving customary offences. The settlement has a distinctive feature because the Lamaholot customary justice institution carries out the settlement of customary violations through traditional ceremonies (loge towe tonu wujo). It is expected that the indigenous people of the Lamaholot Tribe will maintain the characteristics of the Lamaholot Tribe's customary judicial institution so that it remains effective in resolving customary violations.

Abstract

This study investigates issues related to discretionary criteria that can be classified as criminal acts of corruption. Utilizing a statutory, case, and conceptual approach, it conducts normative legal research. The findings indicate that discretion can be categorized as a criminal act of corruption if it contradicts the intent behind its issuance, as outlined in Article 22 paragraph (2) of Law Number 30 of 2014 regarding Government Administration. Additionally, it must not fall within the parameters of discretion defined in Article 23 of the same law, fail to meet the necessary conditions for its issuance stated in Article 24, and align with the elements described in Article 3 of the Corruption Eradication Law, demonstrating an abuse of authority. In the future, government officials are expected to understand the intersections between criminal law and state administrative law before implementing policies that are considered discretionary.

Abstract

Semakin maraknya politisasi birokrasi di Indonesia menjadi tantangan besar dalam menjaga netralitas dan kinerja Aparatur Sipil Negara (ASN). Netralitas ASN menjadi prinsip penting dalam mewujudkan tata kelola pemerintahan yang transparan, akuntabel, dan profesional. Namun intervensi politik seringkali menjadikan birokrasi sebagai alat politik yang merugikan kualitas pelayanan publik dan kepercayaan publik. Penelitian ini bertujuan untuk menganalisis kerangka hukum dan peran kelembagaan pengawas dalam mencegah politisasi birokrasi di pemerintahan daerah. Metode yang digunakan adalah normatif, dengan analisis pendekatan Undang-Undang Nomor 5 Tahun 2014 tentang ASN, Peraturan Pemerintah Nomor 94 Tahun 2021, serta laporan lembaga pengawas seperti Komisi Aparatur Sipil Negara (KASN) dan Ombudsman RI. Hasil penelitian menunjukkan pelanggaran netralitas ASN terus meningkat akibat lemahnya pengawasan dan intervensi politik. Strategi penegakan peraturan, edukasi bagi ASN, dan penegakan hukum diperlukan untuk mencegah politisasi birokrasi. Kesimpulannya, menjaga netralitas ASN sangat penting untuk meningkatkan kinerja pemerintah daerah dan mengembalikan kepercayaan masyarakat terhadap birokrasi yang bersih dan efektif.

Abstract

Bureaucratic reform is an important priority in efforts to improve good governance in Indonesia. The merit system, which focuses on individual qualifications, competencies and performance, offers a strategic approach to improving the professionalism, accountability and effectiveness of the state civil apparatus (ASN). However, the implementation of this system faces various challenges, including political intervention, nepotism, and low understanding of meritocracy. Through a state administrative law approach, this research analyzes the role of the merit system in bureaucratic reform, explores implementation challenges, and proposes strategic solutions. This research uses a literature review method by integrating various sources of law, government policies, and previous research. The results show that strengthening regulations, technology-based supervision, and socialization of meritocratic principles are important steps to overcome existing obstacles. Thus, consistent implementation of the merit system is expected to create a bureaucracy that is more transparent, professional, and responsive to the needs of the community.

Abstract

The importance of synergy between administrative law and criminal law in overcoming corruption is that administrative law has a preventive and corrective role through internal supervision mechanisms and administrative sanctions, while criminal law is present repressively to prosecute violations that have fulfilled the elements of a crime with the criminal justice system. The increasing number of corruption cases in Indonesia shows that the weaknesses in the administrative system are opening up loopholes for corruption to occur. The lack of integration between the two legal systems causes ineffectiveness in early detection and law enforcement in Indonesia. This article recommends regulatory updates, strengthening coordination between institutions, and building an integrated information system as strategic steps towards more effective and equitable corruption eradication. This article analyzes the synergy of state administrative law and criminal law in overcoming corruption in Indonesia, evaluates the synergy practices that have been running, and offers a more effective and efficient legal collaboration model through efforts to synergize state administrative law and criminal law in overcoming corruption in Indonesia. With a juridical-normative approach and case studies, it is hoped that this study can contribute to strengthening the national legal system that is oriented towards the principles of clean and authoritative governance.

Abstract

This study explores the effectiveness of employment access policy models for persons with disabilities in Indonesia, Singapore, and Germany, with the objective of ensuring equal rights and opportunities comparable to those of other citizens. Employing a juridical-comparative methodology, the research examines each country's legal framework, implementation strategies, and practical challenges. Indonesia adopts a mandatory employment quota system as stipulated in Law Number 8 of 2016 on Persons with Disabilities; however, its application across various employment sectors remains limited and faces notable challenges. In contrast, Singapore employs a non-mandatory, inclusive approach supported by incentive-based programs, while Germany enforces a larger quota system complemented by stringent sanctions and comprehensive rehabilitation services. The findings indicate that the effectiveness of these policies is significantly influenced by state commitment, consistent legal enforcement, supervisory mechanisms, policy evaluation, and the development of an inclusive work environment. The study recommends that Indonesia strengthen its policy by imposing clear sanctions, enhancing oversight mechanisms, and integrating incentives to improve education and vocational skills for persons with disabilities, thereby contributing to the overall improvement of their quality of life.

Abstract

The rapid development of information technology has brought both positive impacts and significant challenges to public governance, particularly in addressing digital crimes (cybercrime). In Indonesia, the handling of cybercrime is not solely within the domain of criminal law but also requires the active involvement of state institutions within the framework of administrative law. Institutions such as the Ministry of Communication and Digital Affairs (Komdigi), the National Cyber and Crypto Agency (BSSN), as well as other agencies like the Indonesian National Police (Polri) and the Attorney General's Office, play strategic roles in maintaining the security and order of the national digital space. However, bureaucratic realities reveal persistent issues, including overlapping authorities, weak inter-agency coordination, and suboptimal implementation of administrative functions. Therefore, the harmonization and synchronization of administrative regulations have become urgent to ensure policy alignment, clear division of institutional responsibilities, and the reinforcement of transparency and accountability principles in digital governance. This article aims to analyze how the harmonization and synchronization of administrative regulations can enhance the accountability of public institutions in addressing digital crimes in Indonesia, using a normative juridical approach and descriptive-analytical methods.
