Abstract

Corporate crimes often result in significant losses to society and victims. Therefore, an ideal regulatory direction is needed to ensure adequate legal protection for victims of corporate crimes in Indonesia. The ideal regulation is by implementing a cumulative punishment system for corporate crime perpetrators according to the Criminal Code, which is a cumulative sanction in the provision of two equal sanctions that add up or stack up in accordance with Article 14c paragraph (1), Article 14a, and Article 14b which contain the understanding that the law (as a cumulative policy) and/or Criminal Code Article 100 regarding the death penalty as an alternative route to maximizing criminal sanctions against corporations. This is intended to achieve justice for the victims and create a deterrent effect for perpetrators. The problem that often arises is the difficulty in upholding justice in the enforcement process of corporate crimes. The numerous cases of corporate perpetrators escaping legal action prove that legal protection for victims in Indonesia is still far from the principle of justice. This study aims to analyze the ideal regulatory direction to realize legal protection for victims of corporate crimes from the perspective of justice. This study uses a descriptive-analytical approach with a normative juridical method and examines legislation and court decisions related to corporate crimes. The results show that legal protection for victims of corporate crimes is still inadequate, especially in terms of receiving criminal sanctions in the form of imprisonment or compensation. In addition, law enforcement processes are often hindered by the economic and political power of corporations, which can influence the course of legal proceedings. This creates injustice for victims who feel they are not being treated fairly in the legal decision-making process. Therefore, an ideal regulatory direction is necessary to ensure that victims receive adequate legal protection and balanced justice.

Abstract

As the primary source of income for the Philippines, remittances have increased in the past few years. This study employed the gravity model to determine the extent of the definition of the gravitational and controlled variables of remittances. This study is the first in the literature to examine remittances in the Philippines using the gravity model. Using data from 15 key host nations from 1996 to 2017, panel least squares data with a fixed effect model was adopted using the Housman test to tackle the time-invariant problem. The analysis found that the GDP of the sending country, population, and labor productivity are statistically significant and positively affect the remittance inflow in the Philippines. Whereas distance, the GDP of the recipient country, migrant stock, and political stability are statistically insignificant factors in the remittance inflow into the Philippines.

During the Covid-19 pandemic, almost all economic sectors are experiencing a downturn, so the district and city governments in Madiun are taking tactical steps, namely accelerating economic recovery through optimizing Village-Owned Enterprises (BUMDes) and Micro, Small, and Medium Enterprises (UMKM). which is seen as effective in sustaining the community's economy. So this research wants to examine the governance of BUMDes, which drives alliance business collaboration with MSMEs and other business managers to improve marketing performance. Descriptive quantitative research collected data using a questionnaire that was distributed to 78 administrators and documented data on the management of BUMDes and UMKM in the Madiun area. The results of the descriptive statistical analysis show that the management of BUMDes to improve market performance is carried out by strengthening collaboration with UMKM, using IT and innovation in the procurement of joint business stalls. Business collaboration with UMKM and individual businesses has also proven capable of improving marketing performance, which since collaboration has increased profitability, expanded marketing areas, and increased the number of market segments. So it can be concluded that improving business governance and alliance business collaboration driven by BUMDes can improve marketing performance.
