Abstract

This study examines the intellectual biographies of the founders of the Raden Fatah State Islamic University (UIN) Palembang and their intellectual legacy in the development of Islamic education in Indonesia. This research uses a qualitative approach with historical methods, encompassing heuristics, verification, interpretation, and historiography. The results indicate that the founders of UIN Raden Fatah envisioned a moderate, integrative, and scientifically advanced vision of Islamic education. Their thinking became the foundation for the institutional transformation of IAIN into UIN and strengthened the integrative-interconnected scientific paradigm within the university. This intellectual legacy has not only been influential locally but has also contributed to the development of Islamic education discourse in Indonesia in general.

Abstract

The development of information technology has encouraged the emergence of increasingly complex e-commerce transactions that require legal certainty. This study aims to analyze the legality of e-commerce transactions through a comparison of Islamic law and Indonesian civil law perspectives. The method used is normative juridical research with a descriptive-analytical approach based on literature review, using primary sources in the form of the Qur'an, hadith, the Civil Code, the ITE Law, and fatwas of contemporary scholars, and secondary sources in the form of related academic literature. The results of the study indicate that in Islamic law, e-commerce transactions are permitted as long as they fulfill the pillars and conditions of a valid sale and purchase, are free from elements of gharar, usury, and fraud, and uphold the principles of justice, honesty, and openness. Meanwhile, Indonesian civil law views e-commerce as valid if the conditions of an agreement as stipulated in Article 1320 of the Civil Code are met, namely the existence of an agreement, legal capacity, a specific object, and a lawful cause, and are based on the principles of freedom of contract and good faith. Thus, both Islamic law and civil law emphasize the importance of transparency, agreement, and justice, although with different emphases. This study recommends strengthening regulations and legal education to protect consumers while creating a safe and equitable digital transaction ecosystem.

Abstract

This research is useful in exploring legal protection for creditors in property security law through a comparative study of Fiduciary and Mortgage Laws. Using a normative method, a literature review serves as the primary instrument for collecting secondary data, with primary legal materials in the form of Fiduciary and Mortgage Laws, as well as laws on consumer protection and bankruptcy. Primary sources are supplemented by implementing regulations. Through analysis using legal and conceptual approaches, it was found that both laws provide protection for creditors, which can be further refined with implementing regulations to ensure equitable access to credit or debt and facilitate all parties to remain within the legal protection corridor.

Abstract

This study examines the competence of the district court in resolving election disputes based on the Central Jakarta District Court Decision Number 757/Pdt.G/2022/PN Jkt Pst, which granted the People's Justice and Prosperity Party (PRIMA)'s lawsuit against the General Elections Commission (KPU) and ordered the suspension of the election stages. The lawsuit was constructed as an unlawful act (PMH), thus the District Court declared itself authorized to adjudicate the case. However, the KPU's actions in verifying political party administration constitute public legal action and fall within the scope of state administrative disputes. Based on Law No. 7 of 2017 concerning Elections, resolving disputes over election processes and decisions falls under the authority of the Elections Supervisory Agency (Bawaslu) and the State Administrative Court (PTUN), while disputes over election results fall under the jurisdiction of the Constitutional Court. This District Court decision demonstrates a conflict of jurisdiction and ignores the principle of lex specialis derogat legi generali.
