Abstract

This study examines the intellectual biographies of the founders of the Raden Fatah State Islamic University (UIN) Palembang and their intellectual legacy in the development of Islamic education in Indonesia. This research uses a qualitative approach with historical methods, encompassing heuristics, verification, interpretation, and historiography. The results indicate that the founders of UIN Raden Fatah envisioned a moderate, integrative, and scientifically advanced vision of Islamic education. Their thinking became the foundation for the institutional transformation of IAIN into UIN and strengthened the integrative-interconnected scientific paradigm within the university. This intellectual legacy has not only been influential locally but has also contributed to the development of Islamic education discourse in Indonesia in general.

Abstract

The development of information technology has encouraged the emergence of increasingly complex e-commerce transactions that require legal certainty. This study aims to analyze the legality of e-commerce transactions through a comparison of Islamic law and Indonesian civil law perspectives. The method used is normative juridical research with a descriptive-analytical approach based on literature review, using primary sources in the form of the Qur'an, hadith, the Civil Code, the ITE Law, and fatwas of contemporary scholars, and secondary sources in the form of related academic literature. The results of the study indicate that in Islamic law, e-commerce transactions are permitted as long as they fulfill the pillars and conditions of a valid sale and purchase, are free from elements of gharar, usury, and fraud, and uphold the principles of justice, honesty, and openness. Meanwhile, Indonesian civil law views e-commerce as valid if the conditions of an agreement as stipulated in Article 1320 of the Civil Code are met, namely the existence of an agreement, legal capacity, a specific object, and a lawful cause, and are based on the principles of freedom of contract and good faith. Thus, both Islamic law and civil law emphasize the importance of transparency, agreement, and justice, although with different emphases. This study recommends strengthening regulations and legal education to protect consumers while creating a safe and equitable digital transaction ecosystem.

Abstract

This research is useful in exploring legal protection for creditors in property security law through a comparative study of Fiduciary and Mortgage Laws. Using a normative method, a literature review serves as the primary instrument for collecting secondary data, with primary legal materials in the form of Fiduciary and Mortgage Laws, as well as laws on consumer protection and bankruptcy. Primary sources are supplemented by implementing regulations. Through analysis using legal and conceptual approaches, it was found that both laws provide protection for creditors, which can be further refined with implementing regulations to ensure equitable access to credit or debt and facilitate all parties to remain within the legal protection corridor.

Abstract

This study examines the competence of the district court in resolving election disputes based on the Central Jakarta District Court Decision Number 757/Pdt.G/2022/PN Jkt Pst, which granted the People's Justice and Prosperity Party (PRIMA)'s lawsuit against the General Elections Commission (KPU) and ordered the suspension of the election stages. The lawsuit was constructed as an unlawful act (PMH), thus the District Court declared itself authorized to adjudicate the case. However, the KPU's actions in verifying political party administration constitute public legal action and fall within the scope of state administrative disputes. Based on Law No. 7 of 2017 concerning Elections, resolving disputes over election processes and decisions falls under the authority of the Elections Supervisory Agency (Bawaslu) and the State Administrative Court (PTUN), while disputes over election results fall under the jurisdiction of the Constitutional Court. This District Court decision demonstrates a conflict of jurisdiction and ignores the principle of lex specialis derogat legi generali.

Abstract

The problem with village development generally lies in the low level of community participation in planning, resulting in decisions that tend to be elitist and do not reflect the community's real needs. This study aims to examine participatory planning practices through Hamlet Consultative Meetings (Musdus) and Village Consultative Meetings (Musdes) in Pejengkolan Village, Kebumen Regency, as well as the village government's strategies to increase participation and strengthen development governance. The research used a descriptive qualitative approach with observation, in-depth interviews, and documentation analysis techniques. The results show that Musdus and Musdes function as deliberative spaces allowing community aspirations to be gathered, discussed openly, and formalized into official documents, strengthening transparency and social legitimacy. The village government also implemented strategies to increase the capacity of officials, strengthen communication forums, and utilize data-based information systems to support objective and accountable decision-making. The integration of deliberation and information technology was able to strengthen local democracy, expand the space for participation, and realize inclusive, adaptive, and responsive village development governance to the socio-cultural needs of the community

Abstract

Children in Conflict with the Law have become a significant concern in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System (UUSPPA). This normative juridical research will delve deeper into the legal and conceptual approaches, incorporating qualitative data analysis to formulate conclusions. Restorative justice differs from other legal approaches that focus on retribution or compensation. In the UUSPPA, the first approach aims to prioritize the interests of ABH in balance with the community's need for public order. Therefore, the resolution involves not only law enforcement officials but also community elements, families, and child protection practitioners, particularly through diversion. Therefore, prioritizing this approach is part of the legal reforms recommended to be balanced with the strengthening of legal culture.

Abstract

This study aims to examine the influence of learning mentoring activities on improving the learning motivation of undergraduate students in the Educational Psychology course on the topic of Educational Motivation and Continuous Learning. The approach used is a descriptive qualitative approach using the Participatory Action Research (PAR) method, involving active interaction between undergraduate students in Islamic Religious Education Management and postgraduate students as learning mentors. Data were collected through observations, limited interviews, documentation, and simple questionnaires, then analyzed. The results indicate that an interactive, participatory, and collaborative learning approach involving mentors can increase student motivation, engagement, and reflective attitudes. These findings emphasize the importance of integrating collaborative learning strategies across levels in building continuous learning motivation in religious higher education.

Abstract

The main focus of this study is to analyze the influence of exchange rates, interest rates, and Gross Domestic Product (GDP) on Foreign Direct Investment (FDI) in Indonesia during the period 2004-2024. The method used is multiple linear regression analysis with quantitative data obtained from official sources and economic databases. The results of this study indicate that simultaneously, all three variables have a significant effect on FDI in Indonesia. Partially, interest rates have a positive and significant effect on FDI, while exchange rates and GDP do not show a significant relationship or influence. This finding indicates that monetary policy that maintains interest rate stability can increase the attractiveness of foreign investment. In addition, other factors such as political stability and security also play an important role in attracting FDI. This study provides policy implications for increasing Indonesia's economic competitiveness and supporting sustainable growth by strengthening these important factors.

Abstract

Concerns about environmental damage and destruction in the Mount Klabat conservation area in North Minahasa Regency have prompted this normative-juridical research to identify national legislation and regional regulations (perda) that can protect the area sustainably. The primary sources, including laws, presidential decrees, ministerial regulations, and regional regulations, were analyzed using a legislative, linguistic, and conceptual approach. It was concluded that synchronizing legal norms with regional regulations has ensured applicable laws for legal protection of the Mount Klabat area, even with clear regulations regarding the empowerment of indigenous communities within it. However, it is recommended that general and adaptive principles be developed for stronger synchronization and ease of legal implementation in the community, which requires further research involving multiple parties, including environmental law practitioners and academics.

Abstract

This research arose from the low realization of PBB (land and building tax) despite the significant potential of village taxes. This study aims to analyze the role of the Sumorame Village Government, Candi District, Sidoarjo Regency in increasing Land and Building Tax (PBB) revenue. The study used a qualitative descriptive method with interview, observation, and documentation techniques, as well as data analysis using the Miles, Huberman, and SaldaƱa model. The results show that the village government has three main roles: regulator, dynamicator, and facilitator. As a regulator, the government sets policies and conducts tax socialization. As a dynamicator, the government motivates the community through innovative programs such as providing door prizes. As a facilitator, the government provides payment services through BUMDes and the jemput bola program. Obstacles faced include low public understanding, limited time, and suboptimal distribution of SPPT. Optimization of education, service innovation, and the use of technology are needed to improve compliance and PBB revenue.
