Abstract

In general, the purpose of this study is to analyze the strategy of strengthening social capital in farming communities in dealing with disasters in Lake Village. In particular, the purpose of this study is to analyze the forms of social capital of rubber farmers and strategies for strengthening social capital of rubber farmers in dealing with landslides in Danau Village. This study uses a qualitative approach with a descriptive type. The informants of this research are people who experience disasters in Danau Village. The unit of analysis is at the community level or including the meso level. The data collection method was carried out in several stages, namely non-participant observation, in-depth interviews and document studies. Data analysis uses Miles & Huberman model thinking. The results of this study indicate that the form of social capital that is built in disaster areas is to strengthen norms in society, cooperate with each other, conduct mutual social interactions, build government-level networks and have a caring attitude among disaster victims. The strategy for strengthening social capital is built on the value of togetherness and mutual trust based on disaster-safe areas as a source of economic strengthening for rubber farmers. Novelty in this study is social capital to build disaster-safe areas.

Abstract

Children as the nation's buds in building the nation and state for the future of the child itself. restorative justice is an approach that focuses on the conditions for creating justice and balance for the perpetrators of criminal acts and their victims. The mechanism for criminal justice procedures focusing on sentencing is transformed into a process of dialogue and mediation to create an agreement on a more just and balanced settlement for victims and perpetrators.Problems 1. How is the Implementation of Police Policy in the Use of Restorative Justice Methods Against Child Criminal Actors? with descriptive-analytical research specifications and sources of secondary and primary data. the results of police policy research in using the method of restorative justice against perpetrators of child crimes, police policies in carrying out settlement efforts through mediation and recovery consultations with non-punitive decisions prioritizing solutions in the best interests of the perpetrators, victims, and the community. The policy of the Police of the Republic of Indonesia is to issue a Circular Letter of the Police of the Republic of Indonesia Number: 8 of 2021 concerning the Application of Restorative Justice. prioritizing the interests of the victim and the perpetrator in order to reach an agreement together to seek a solution to the crime by emphasizing on recovery, not retaliation. It is through law enforcement that this becomes a reality. However, in enforcing the law there are 3 (three) elements that need to be considered, namely: legal certainty, expediency and justice.

Abstract

A criminal act is an unlawful behavior carried out by an individual and must be punished for the wrongdoing as stated in the law. Criminal acts committed by children or known as juvenile delinquency are now increasingly widespread and varied, both in frequency in quantity or in seriousness in quality in the form of crime. If child crime develops rapidly and widely, what happens is that children who commit crimes will grow into adults and have the potential to become criminals if there is no serious response early on. This study uses an approach with a normative juridical method with a descriptive analytical research specification. The data used is secondary data. Based on the research results, the conclusions in this study include 1) The factors that cause children to commit the crime of theft include internal factors (personality), environmental factors and economic factors. 2) Implementation of restorative justice in handling the crime of motorcycle theft which is in accordance with the Implementation of the Diversion Child Criminal Justice System Law Number 11 of 2012. In applying restorative/diversion justice, there are always efforts for every child who commits a crime. In some cases, diversion can be carried out with the consent of all parties, so that the case does not reach the prosecution level. Restorative justice only applies to petty crimes, with mediation through deliberation. The application of restorative justice has not been effective, because there are still people who fail to implement the purpose of diversion in the investigation of criminal cases of theft of children's motorcycles, especially the police have not implemented the purpose of restorative justice. Everything from the number of children who steal motorcycles. 3) Obstacles in overcoming the crime of motorcycle theft by children through restorative justice, namely the difference in perceptions related to the meaning of justice by restorative justice actors and the existence of an incosystem in the implementation of regulations, especially those regulated in article 7 paragraph (2) of law number 11 of 2012 about the juvenile criminal justice system.

Abstract

The TNI is required to be able to carry out its duties and functions in accordance with applicable laws. In this case, the TNI must be able to carry out its role in guarding the Indonesian nation's democratic party so that it can run smoothly and safely. It is undeniable that there are still unscrupulous members of the TNI who commit violations in the Pilkada, resulting in public statements related to the existence of government institutions that are not neutral, thus forming public opinion on the performance of the TNI. The formulation of the problem in the research is (1)What is the role of the TNI in realizing the Election of the Regional Head of the Governor of Central Java which is direct, general, free, confidential, honest and fair? (2) Why does the TNI need to maintain and realize a direct, general, free, secret, honest and fair election for the Regional Head of the Governor of Central Java? (3) What is the ideal concept expected for the TNI to realize the Election of the Regional Head of the Governor of Central Java which is direct, general, free, confidential, honest and fair? The approach used is sociological juridical, which means that this research is studied with laws and regulations and legal norms in accordance with the problems that exist in the field. Based on the results of the study, data were obtained that (1) The role of the TNI in the Regional Head Elections in Indonesia in the field of security was in principle an assistance to the Police. (2) The TNI needs to carry out its role in the Pilkada to protect against threats and disturbances that may arise in the holding of the Pilkada together with the National Police based on the law to carry out the duties of Kamtibmas. (3) The TNI must be able to put forward its professionalism as a TNI soldier in accordance with its identity, based on state politics and not taking sides with any group. Therefore, it is necessary to create ideal conditions so that they can be used to increase public trust and increase soldiers' understanding of the neutrality of the TNI.

Abstract

Human life is always discrimination between humans and other humans. Human civilization always develops every age with various technologies and paradigms of people's lives that have an impact on certain superior and minority human groups. The Indonesian state still has a calculation in discriminatory behaviour in accordance with legal, economic and socio-cultural policies to provide preservation of certain political policies only, therefore the state must increase the perception of individual views to the community and certain groups. The State of Indonesia is committed to upholding and respecting human rights which have been regulated in the 1945 Constitution of the Republic of Indonesia. The 1945 Constitution has provided arrangements related to constitutional rights with the statement that everyone has the right not to get discriminatory treatment from others or certain parties. Discriminatory treatment in the State of Indonesia has a fairly high potential, due to the very large population of Indonesia and different ethnicities, races, cultures and languages, plus the level of education and the economy is relatively low. Therefore, a legal umbrella is needed to avoid the behaviour and consistency of people who discriminate against a person or group in the State of Indonesia by establishing laws and regulations as an effort to protect the law and increase public awareness in dealing with one another.

Abstract

The transfer of land rights can occur in accordance with the provisions of Article 20 paragraph (2) of the UUPA which contains provisions that property rights can be transferred and transferred, for example the death of the land owner. This legally makes the ownership rights to the land transfer to the heirs as long as they meet the requirements as the subject of property rights. The formulation of the problem: (1) Is buying and selling land under the law legal? (2) What are the factors that cause the sale and purchase of underhand land to still occur? (3) What are the legal consequences of both parties with the sale and purchase under the hand?. The research method used is normative juridical. The data source is primary data, secondary data. Data were collected by interview and literature study, data were analyzed using qualitative analysis. The results of this study (1) Although customary law confirms the legality of buying and selling land rights that are not carried out before the Land Deed Maker Official, in this case the buyer has difficulty proving his rights to the land he has purchased. (2) Factors that cause the sale buying land with ownership rights through private deeds for village communities: the community avoids quite expensive costs, second: community knowledge regarding the procedures for buying and selling land, third: community motivation related to the high level of mutual trust between each other in buying and selling land. (3) Village communities do a lot of buying and selling under their hands, namely buying and selling carried out in front of the village head, but if there are people who want to get a land certificate in his name, then resale is carried out in accordance with the applicable legal rules.

Abstract

Traffic problems are a problem that often gets the public's attention, because traffic has a very strategic role in supporting development and national integration as an effort to promote public welfare, as mandated in the 1945 Constitution which is part of the national transportation system. The formulation of the problem is what is the definition and form of traffic violations? What are the factors that cause people to violate traffic? What is the role and strategy of the Traffic Police of the Central Java Police in reducing the number of accidents? The type of research used is empirical juridical research or field research, namely examining applicable legal provisions and what is happening in reality in society. Or in other words, a research conducted on the actual situation or real conditions that occur in the community with the intention of knowing and finding the facts and data needed. The conclusion is the role and strategy of the Ditlantas Polda Central Java in reducing the number of traffic accidents includes pre-emptive efforts which are basically in the form of coaching, education on positive activities and socialization about traffic safety for the community, Implementing preventive efforts in the form of controlling, regulating traffic , and monitoring accident-prone lanes, and collaborating with relevant stakeholders such as the Department of Transportation, the TNI, and the Satlantas Polres from the Central Java Regional Police and repressive efforts, namely by enforcing the law for traffic violators in the form of warnings, tickets, fines and confiscation,

Abstract

The effectiveness of the 2020 Simultaneous Local Elections in the midst of the COVID-19 pandemic has both positive and negative impacts. The positive impacts include the implementation of the mandate of the applicable regulations, the fulfillment of the constitutional rights of the Pilkada participants and the community, reducing the practice of local government leadership which is led by too many temporary officials, and preventing budget swelling. While the negative impacts include the higher risk of COVID-19 transmission, the potential for fraudulent practices that are increasingly vulnerable, the refusal of the Regional Head Elections has the potential to increase the number of abstentions. Efforts so that the 2020 simultaneous regional elections can be carried out properly include increasing the supervision of health protocols, maintaining integrity in the implementation of regional elections, there must be a commitment for both Pilkada participants and implementers, community discipline, there are 55 countries postponing national or local elections and national referendums. However, there are 21 countries that have not postponed elections, 9 of which have been held in the midst of the COVID-19 pandemic. South Korea became one of the countries that successfully held elections on April 15, 2020 (International Institute for Democracy and Electoral Assistance, 2020). In Indonesia, the scheduling of the simultaneous regional elections to be held in December 2020 is considered unrealistic. Due to the fact, until December 2020, the number of positive cases of COVID-19 continued to increase nationally. Many people are worried that if the local elections are held in December 2020, it will become a new cluster for the spread of COVID-19. there are 21 countries that have not postponed elections, 9 of which have been held in the midst of the COVID-19 pandemic. Abstract

An absolute requirement in military life is to comply with TNI regulations and official orders from each superior in order to uphold a life in the military that is full of high awareness. If these things are violated (desertion), it will only shake the joints of discipline and order in the TNI. The formulation of the problems in this study are: 1) What is the criminal law policy on desertion crimes committed by members of the Indonesian National Armed Forces? 2) What are the obstacles to criminal law policies against desertion crimes committed by members of the Indonesian National Armed Forces and what are the solutions. The author uses a normative juridical approach. The sociological juridical approach emphasizes research that aims to obtain legal knowledge empirically by going directly to the object related to this research. The results of this study are: 1) The criminal law policy against the criminal act of desertion in Indonesian military law is clearly regulated in Article 87 of the Criminal Procedure Code and the punishment for members who become the perpetrators of desertion is regulated in Article 88 of the Criminal Procedure Code. The application of military law against the perpetrators of the crime of desertion as a Military Member (TNI) carries a heavier penalty than the threat of punishment found in the general public, because the military is not only armed to maintain security but must be disciplined, instead of using desertion. Desertion in this case is absence without permission, intentionally for 30 consecutive days. 2) Obstacles in the implementation of military law against members of the Indonesian National Armed Forces (TNI) who commit the criminal act of desertion in general because the investigations carried out by Military Police investigators still often do not meet the formal and material requirements.

Abstract

The purpose of this study was to determine the assimilation program launched by the Ministry of Law and Human Rights in order to overcome the spread of Covid-19 in prisons so that it does not over capacity. The type of research method used is normative juridical. Based on the results of the study, it is known that if assimilation and integration continue to apply, there are at least two additional requirements, namely; The provision of assimilation and integration must involve supervisory judges and observers for their consideration and risk assessment. Furthermore, for the long term, in anticipating overcapacity in correctional institutions, immediately ratify the Draft Criminal Code which has the concept of Criminal Individualization and Criminalization which is expected to be able to provide protection and welfare for the community and still pay attention to the interests of criminal acts.
