Abstract

The purpose of this research is to identify and analyze the juridical liability of the holding company to its bankrupt subsidiary and the holding company's responsibility to its bankrupt subsidiary. The research method used in this research is normative qualitative. The holding company's juridical responsibility for a bankrupt subsidiary, in certain circumstances the holding company can be held accountable for its subsidiary based on the Piercing The Corporate Veil principle. The application of this principle to holding companies can occur either through legal agreements or based on certain agreements. Implementation of holding company responsibilities for bankrupt subsidiaries in the case of PT. Ometraco Corporation, Tbk. dar. PT. Ometraco Multi Artha pointed out that the Supreme Court is of the opinion that PT. Ometraco Corporation, Tbk. as the holding company is also responsible for the debt of PT. Ometraco Multi Artha as a bankrupt subsidiary based on an agreement.

Abstract

Collateral Free Loans is a bank loan product offered by banks as lenders with the advantage that customers as prospective borrowers are not asked to provide collateral or guarantees in the form of any assets as a condition for being able to borrow money. The advantage of this loan is that someone can apply for credit without guaranteeing their goods. However, the absence of collateral in granting credit sometimes creates problems for the parties, especially the bank as the lender. This study aims to answer the question of how the risk is in providing individual loan without collateral carried out by Bank BRI, and how the application of the prudential principle in managing the risk of individual loans without collateral at Bank Rakyat Indonesia (BRI). This is a qualitative research with a case study approach. Data collection is done by interviews, observation and documentation. The results of this study indicate that the risks faced by banks in efforts to provide individual loan without collateral are 3 factors. The first is non-compliance with the standard requirements for granting credit which includes data collection, data analysis and preparation of conclusions and recommendations. Second, the authenticity of important documents that must also be attached is sometimes doubted. Third, the occurrence of irregularities in paying debts by the payer/treasurer. To minimize the risk of lending, BRI applies the prudential principles in accordance with banking laws through credit analysis which consists of 5 (five) principles, namely character, capital, capacity, condition, and collateral, with an emphasis on 2 aspects, namely character and capacity. These two principles are in line with the fiduciary principle and prudential principle in banking law.

Abstract

Grondkaart as one of the basis of control over land owned by individuals or legal entities, one of which is PT. KAI (Persero). The unclear position of grondkaart in the systematics of laws and regulations has resulted in various land tenure disputes. The purpose of this research is to provide information and legal consequences of grondkaart as evidence of land registration in Indonesia. The method used is a normative juridical approach with literature review on laws and civil cases in court. Grondkaart as evidence of land tenure and guidance because it refers to article 97 PP Number 18 of 2021, Besluit No 3 of 1890, there is no provision for the conversion of the UUPA, and it is not mentioned in one of the proofs of new rights based on PP Number 24 of 1997.

Abstract

To find out user responses to the Satuguru Platform. One method that can facilitate this need is to use the methodTechnology Acceptance Model (TAM). The phenomenon that occurs with the loyalty of Satuguru users is quite a lot of usersmove to another platform.. In this research, Technology Acceptance Model (TAM) will be used to understand how users accept and adopt new technologies, especially in terms of security and content with Blockchain. This study aims to determine and analyze the effect of perceived usefulness and perceived ease of use on loyalty mediated by user satisfaction on the Satuguru Blockchain-based online media platform. The method used in this research is quantitative with a descriptive approach. The sample of this research is 140 rRespondents selected by customers who are users of the Satuguru Blockchainbased Online media platform.The data collection method uses a questionnaire that has been tested for validity and reliability. This study uses the SmartPLS 3 software method. The results of the study show that there is a direct or indirect influence on perceived usefulness and perceived ease of use on loyalty mediated by user satisfaction on the Satuguru Blockchain-based Online media platform.

Abstract

This research departs from the fact that there is still a lot of Al-Qur'an literacy in Indonesia, in line with the need to improve the reading ability of students who graduate from Islamic schools. Likewise with the quality of memorization. The application of the Taḥsīn and Taḥfīz Al-Qur'an learning methods has long been applied at Al Furqan Middle School Jember, but it has never been studied objectively how the advantages & disadvantages of these methods, as well as strategic solutions to produce better student reading and memorization. This research uses a qualitative approach with a case study type. The technique for determining research subjects uses a purposive technique. Data collection techniques through observation, interviews and documentation. Data analysis techniques use interactive model analysis techniques which consist of data reduction, data presentation, and drawing conclusions. The techniques used to test the validity of the data are focused on using triangulation techniques between data sources. The results showed that the taḥsīn & taḥfīz Al-Qur'an learning method used by Al Furqan Junior High School Jember was the Ummi method. The advantages and disadvantages of the method consist of three educational components, namely: the Material side, the Strategy side, and the Management side. Strategic solutions that can be implemented to overcome this shortcoming include: First, from a material standpoint, always learn from other methods and upgrade teachers, as well as provide additional hours for students who are behind on memorization targets. Second, Sisi's strategy, asatidz provides direction for spiritual motivation for students, and there is muroja'ah time between completing the halaqoh opening prayer and before adding to the memorization. Third, the management makes the achievement of students' memorization targets a condition for taking report cards, and the memorization targets are controlled in the Muroja'ah Chart.

Abstract

The focus of this study is to analyze the development of a creative economy based on cultural capital in the culinary field in the tourist destinations of West Sumatra.This study uses a qualitative approach that takes a descriptive type. Purposive sampling was used to select research informants. Research informants are creative economic actors in the culinary sub-sector. The data collection method begins through indepth interviews, observations and document data collection. The unit of analysis is carried out from several stages, one of which is data collection, data reduction, data analysis and drawing conclusions which are referred to in the Miles and Huberman model. The results of this study indicate that in the development of the creative economy, the culinary sub-sector based on cultural capital has reached a stage that generates added value. The development of a creative economy based on cultural capital is part of how creative entrepreneurs in the culinary field gain networks with shared knowledge, skills and most importantly a high sense of culture, so that they can create many benefits for fellow citizens. In developing this creative economy, the culinary sub-sector can not only create a unique or distinctive taste, but has reached the stage of creating job opportunities for the local community, adding insight and knowledge and raising social status in society. Coupled with the culinary uniqueness provided by each creative artist, it adds value to the marketability and memory of visitors to visit again.

Abstract

Broadly speaking, coaching at the Narcotics Special Penitentiary has the same goal, namely to rehabilitate convicts so that they become good and law-abiding citizens. However, in the implementation of coaching, there are still obstacles that cause the coaching program to not run effectively. This research is aimed at answering questions related to the implementation of fostering narcotics case convicts at the Narcotics Special Penitentiary and what are the obstacles encountered in the implementation of coaching for narcotics case convicts. This is a research that uses the library research method but the data collection is also complemented by semistructured interviews with drug case convicts, coaching program instructors and also officials responsible for coaching program licenses. The results of the study indicate that the implementation of the program for fostering convicts of narcotics cases using the Criminon method cannot be said to be effective. This can be seen from a number of obstacles encountered during program implementation. These obstacles are not only in the program, but also in the inmates who are coached and the instructors who do not understand the theories of the Criminon program.

Abstract

In carrying out their worship practices, the Aboge are different from the general public: Wudu repeated three times, wirid khususiyah, qunut in every obligatory prayer and other practices. It is done in order to get closer to the creator. based on the ancestral beliefs of the Aboge itself. The methodology is qualitative, Filey Research type, philosophical and phenomenological research approach, Data collection techniques (Observation, Documentation and Interview). and Data analysis uses content analysis which tries to interpret Aboge in the perspective of philosophy and sociology. The results of the study are the Aboge people in the Kencong Jember area which in practice they adopt many of the teachings used by their ancestors. The practices that are done are: Self purification by repeating bathing and ablution with a number of 3 times to 5 times, Bedug which is beaten as a sign of prayer, Qunut which is done both for the five daily prayers and Sunnah, and Wirid Aboge which is done with two stages. The meanings they give in each practice are: Purity, Blessing, Prayer, Medicine/Syifak, and Cultural Heritage. Factors that influence the meaning of knowledge and teachings from their ancestors.

Abstract

Home Ownership Credit is an agreement that arises between the bank as the creditor and the customer as the debtor.The creditor provides services in the form of financing for the purchase of a house with the debtor paying in installments according to the chosen tenor. Interest in Home Ownership Credit is very high in the people of Karanganyar Regency, Central Java. The offer of a Home Ownership program that can be paid for by credit is the main reason Home Ownership Credit has such high interest in Karanganyar Regency. Apart from that, government support with several subsidies for Home Ownership Credit is also the reason. Home Ownership Credit will result in a credit agreement between the creditor, namely the bank, and the customer or debtor. Credit agreements are made to ensure legal certainty between the creditor and debtor. The credit agreement made by the bank is in the form of a standard agreement which then needs to be presented to the customer for approval. Clauses made unilaterally by banks result in unequal authority between banks and customers. The economic advantages possessed by banks mean that customers who need financing programs from banks must agree to the standard agreement. The standard agreement in the agreement for granting Home Ownership Credit is the result of the Principle of Freedom of Contract which is intended to ensure that agreements can be balanced. However, in reality, this implementation results in the dominance of one party, namely banking, which has economic advantages. The need factor is the main reason that causes customers to inevitably agree to the standard agreement even though the agreement in it is not balanced.

Abstract

The study aims to investigate the compact or bureaucratic accountability relationship for curriculum implementation in primary schools. To achieve this objective, an exploratory case study type and a multiple case study (holistic) research design were employed. A purposeful sampling technique was used to select sites and respondents. Data were collected from both primary and secondary sources using face-to-face structured interviews and document analysis. Primary sources of data were three district or Worda Education Offices (WEOs) and three primary schools, from which three school principals, six teachers, and three WEOs’ curriculum and instructional experts were selected. The data were analyzed qualitatively using a thematic approach. The study reveals that the compact accountability relationship between the WEOs’ curriculum and instructional experts and the curriculum implementers was collapsed by key determinants such as weak capacity, poor monitoring progress, and politicization of the WEOs’ curriculum and instructional experts’ roles and responsibilities. This study also affirms that the accountability relationship was purposefully operational for easily achievable actions and politically attractive roles such as the improvement of students’ test scores by 10%, enhancing students’ enrollment, reducing students’ dropout rates, etc. that resulted in little implementation of curriculum components into classroom practices in a decentralized education system of primary schools.
