Abstract

This research aims to analyze the legal regulations and implementation problems of copyright royalty governance in Indonesia and to formulate legal reforms to achieve certainty and justice for creators. This study employs both a statutory approach and a conceptual approach within a normative juridical research methodology. Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021 concerning the Management of Song and/or Music Copyright Royalties serve as the primary legal materials used in this study, while secondary legal materials include scholarly literature, academic journals, and expert doctrines. The research findings indicate that, normatively, Indonesia's copyright royalty regulation system has provided a solid legal foundation for creators' economic rights through a royalty management mechanism administered by the Lembaga Manajemen Kolektif Nasional (LMKN) and the Lembaga Manajemen Kolektif (LMK). However, a number of issues persist in practice, including the potential for overlapping jurisdiction among royalty management organizations, low levels of compliance among music users in paying royalties, and insufficient transparency in the collection and distribution of royalties. These circumstances reveal a discrepancy between the relevant legal standards and their application in practice. Legal reform is therefore needed through strengthened regulations, increased transparency in royalty management, the development of an integrated information technology system, and the reinforcement of oversight and law enforcement mechanisms. These reforms are expected to produce a more effective royalty governance system, provide legal certainty, and improve the welfare of creators, thereby supporting the development of the creative industry in Indonesia.

Abstract

The involvement of children as couriers in narcotics distribution networks presents a systemic problem in Indonesian criminal justice, where law enforcement has disproportionately targeted field-level perpetrators while failing to dismantle the economic structures controlled by intellectual actors. This research aims to analyze the normative disharmony between Law Number 35 of 2009 concerning Narcotics, Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering, and Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, and to reconstruct a law enforcement model that integrates asset confiscation with restorative justice for exploited children. This research employs a normative legal methodology with statutory, conceptual, and case approaches analyzed qualitatively. The findings reveal that existing regulations lack integration, resulting in the criminalization of child couriers without addressing the financial networks behind them. Money laundering instruments remain underutilized, and diversion mechanisms are often unavailable due to severe sentencing thresholds. The study proposes a reconstructed model that shifts the enforcement focus from "follow the suspect" to "follow the assets," positions children as victims of structural exploitation, and directs them toward restorative mechanisms. In conclusion, integrating asset confiscation against key actors with restorative diversion for children creates a fairer and more effective law enforcement system, ensuring that narcotics eradication targets network structures while safeguarding children's futures

Abstract

This study aims to analyze legal regulations and gaps in norms, and to formulate legal reforms related to restitution and compensation for victims of sexual violence against women and children in the Indonesian legal system. The research method used is normative juridical with a statutory and conceptual approach. The results of the study indicate that although victims' rights to restitution and compensation have been recognized in various laws and regulations, such as the Sexual Violence Crime Law, the Child Protection Law, and the Witness and Victim Protection Law, the regulations are still partial and not comprehensively integrated. There are gaps in norms and legal issues, including unclear restitution execution mechanisms, the absence of standards for calculating victim losses, weak state compensation schemes, and disharmony between regulations. These conditions create a gap between normative regulations and implementation in the field, such that victims' rights are not optimally fulfilled. Therefore, a victim-oriented legal reformulation is needed through strengthening restitution execution mechanisms, establishing a state compensation fund, developing victim loss standards, and harmonizing laws and regulations to achieve substantive justice for victims of sexual violence against women and children.

Abstract

The development of modern bankruptcy law has led to a paradigm shift from a liquidation approach to debt restructuring oriented toward business sustainability. The Suspension of Debt Payment Obligations (Penundaan Kewajiban Pembayaran Utang/PKPU) in the Indonesian legal system is designed as a mechanism that provides negotiation space for debtors and creditors to achieve peace through restructuring. Implementation practices demonstrate a mismatch between normative objectives and empirical reality, in which PKPU often ends in bankruptcy; thus, its preventive function has not been optimally implemented. This study aims to analyze the normative construction of PKPU, identify implementation problems that cause distortion of the restructuring function, and formulate a reconstruction model based on preventive principles. The research method used is normative legal research with a statutory, conceptual, and comparative approach. The analysis is conducted on Law Number 37 of 2004 concerning Bankruptcy and PKPU, modern bankruptcy legal doctrine, and preventive restructuring practices in other legal systems. The results of the study indicate a liquidation bias influenced by procedural design, the dominance of creditor interests in the voting mechanism, limited time for restructuring, and the absence of an adequate business feasibility assessment mechanism. Reconstruction is necessary through strengthening the preventive paradigm, reformulating the application threshold, implementing viability assessments, and balancing voting mechanisms to increase the chances of successful restructuring. Optimizing the PKPU is expected to strengthen the business rescue function, maintain going-concern value, and create a balance between economic efficiency and substantive justice within the Indonesian bankruptcy legal system.

Abstract

This study aims to analyze the need for reform and reconstruction of Law Number 20 of 2003 concerning the National Education System in order to realize a new paradigm of national education that is adaptive to current developments. This research is motivated by the gap between the legal norms in the 1945 Constitution of the Republic of Indonesia and the implementation of education in the field. The method used is a qualitative approach with a normative juridical research type combined with a socio-legal approach through literature study. The results of the study indicate that the national education system still faces various problems, such as inequality in access to and quality of education, suboptimal budget management, discrimination between public and private educational institutions, and a dichotomy between general and religious education. Furthermore, existing regulations are deemed unable to accommodate the principles of modern education that are inclusive, flexible, and oriented toward lifelong learning, especially in facing the era of digital transformation and artificial intelligence. Therefore, reform and reconstruction of the national education system are needed through regulatory updates, strengthening governance, and changing the educational paradigm to be oriented toward developing 21st-century competencies. This research is expected to contribute to the development of a more responsive and sustainable national education policy.

Abstract

The development of information technology has encouraged the widespread use of electronic evidence in tax disputes, including proceedings before the Tax Court. Although the recognition of electronic evidence within the national legal system has been established through general legislation, these regulations have not been specifically designed to address the procedural requirements of tax law, which is characterized by strict liability and emphasizes legal certainty. This situation grants Tax Judges broad discretion in assessing the validity and evidentiary value of electronic evidence. On the one hand, such discretion is necessary to fill a normative gap; on the other hand, it has the potential to result in inconsistent judicial decisions and legal uncertainty. This study aims to critically analyze the existing normative framework, the judicial practice of assessing electronic evidence, and the implications of Tax Judges' discretion for protecting taxpayers' rights while safeguarding the state's fiscal interests. The research employs a normative legal research method using statutory, conceptual, and case-based approaches. The findings demonstrate that the absence of standardized criteria for assessing electronic evidence has caused judicial discretion to shift from an instrument for achieving justice into a legal loophole that threatens legal certainty. This study proposes an ideal framework for limiting judicial discretion by formulating normative parameters and judicial guidelines that balance the principle of judicial independence with the strict liability nature of tax law. This normative reconstruction is expected to strengthen the consistency of judicial decisions, ensure proportional justice, and enhance public trust in the tax adjudication system.

Abstract

The purpose of this study is to investigate the legal loopholes concerning the use of false identities in Indonesian notarial practice, as well as the legal provisions governing a notary’s verification of an appearer’s identity in the preparation of an authentic deed. Notaries are public officials authorized to prepare authentic deeds with perfect evidentiary force, as stated in Articles 1868 and 1870 of the Civil Code. In practice, verification of the appearer’s identity is a crucial aspect of ensuring the validity of a deed and providing legal certainty for the parties. However, the provisions concerning the identity verification mechanism under Law Number 2 of 2014 concerning the Position of Notary remain general in nature and do not regulate in detail the standard procedures for verifying an appearer’s identity, thereby potentially leading to identity misuse, such as the use of false identities or identities belonging to other persons in the preparation of deeds. This study analyzes laws and regulations, legal theory, and relevant literature using a normative juridical legal research method with statutory and conceptual approaches. The results of the study indicate a legal gap in the mechanism for verifying an appearer’s identity by a notary, which has the potential to create legal uncertainty and the risk of legal liability for notaries. Therefore, a more comprehensive reconstruction of legal regulations is needed by strengthening identity verification obligations, developing standard verification procedures, and utilizing the national population administration system to ensure the authenticity of the parties’ identities in the preparation of authentic deeds, thereby increasing legal certainty and legal protection in notarial practice.

Abstract

As mandated by Article 33, paragraph (3) of the 1945 Constitution of the Republic of Indonesia, this study aims to examine and reconstruct Indonesia’s mineral and coal mining (minerba) law enforcement, which has not yet fully realized public welfare. This study employed a normative legal research method using statutory and conceptual approaches. The findings show that, despite the provisions contained in Law Number 3 of 2020 concerning Mineral and Coal Mining and Law Number 32 of 2009 concerning Environmental Protection and Management, several significant legal gaps remain, including the lack of integration of strict liability, weak administrative sanctions, the absence of an effective mechanism for restoring community rights, and fragmented supervisory institutions. These gaps have contributed to an imbalance between natural resource exploitation and community welfare, as well as increased environmental degradation. Therefore, a comprehensive reconstruction of law enforcement is needed through the strengthening of administrative sanctions, the integration of the principle of strict liability into the minerba regime, the establishment of a community compensation mechanism, and the reinforcement of integrated cross-sectoral supervision. Furthermore, law enforcement approaches should be directed toward restorative justice and ecological justice, emphasizing environmental restoration and community well-being. Thus, mineral and coal mining law enforcement is expected to serve as an instrument of social justice and environmental sustainability in achieving public prosperity.

Abstract

Penelitian ini membahas perbandingan model tata kelola kepolisian di berbagai negara serta implikasinya terhadap posisi Kepolisian Negara Republik Indonesia (Polri) dalam sistem ketatanegaraan. Latar belakang penelitian ini berangkat dari perdebatan akademik dan kebijakan mengenai efektivitas model komando kepolisian, khususnya antara penempatan langsung di bawah Presiden atau melalui kementerian. Tujuan penelitian ini adalah untuk menganalisis model tata kelola kepolisian secara normatif, komparatif, dan kontekstual guna menilai relevansi posisi Polri di bawah Presiden. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif melalui studi literatur dari berbagai negara. Hasil pembahasan menunjukkan bahwa sebagian besar negara menempatkan kepolisian dalam struktur eksekutif dengan variasi tingkat sentralisasi, namun model komando langsung Presiden tetap digunakan di beberapa negara seperti Indonesia, Thailand, dan Filipina. Selain itu, model tersebut dinilai memperkuat akuntabilitas dan koordinasi dalam kondisi negara kepulauan dengan kompleksitas tinggi. Kesimpulan penelitian ini menyatakan bahwa penempatan Polri di bawah Presiden masih relevan secara normatif, empiris, dan kontekstual, serta mendukung efektivitas tata kelola keamanan nasional.

Abstract

Penelitian ini bertujuan untuk menganalisis perbedaan abnormal return dan trading volume activity pada periode sebelum dan sesudah peristiwa pengumuman pemberlakuan Program Makan Bergizi Gratis terhadap saham sektor konsumsi di Bursa Efek Indonesia. Pendekatan penelitian ini adalah kuantitatif dengan menggunakan metode studi peristiwa (event study). Sampel penelitian yang digunakan diperoleh dengan menggunakan metode purposive sampling berjumlah 80 perusahaan sektor konsumsi yang terdaftar di Bursa Efek Indonesia. Periode pengamatan berlangsung selama 11 hari bursa, yaitu 5 hari sebelum, 1 hari pengumuman (6 Januari 2025), dan 5 hari sesudah pengumuman. Analisis data dilakukan dengan menggunakan uji non-parametrik Wilcoxon Signed Rank Test yang didukung dengan Robustness Test. Hasil penelitian menunjukkan bahwa tidak terdapat perbedaan yang signifikan pada abnormal return dan trading volume activity antara periode sebelum dan sesudah pengumuman pemberlakuan Program Makan Bergizi Gratis. Temuan ini menunjukan bahwa kebijakan nasional yang masih baru dan belum pasti dampaknya belum cukup kuat sebagai sinyal bagi pasar modal. Kesimpulannya, program Makan Bergizi Gratis belum cukup kuat sebagai sinyal informatif bagi pelaku pasar modal untuk mengubah perilaku investasi pada saham sektor konsumsi, sehingga diperlukan komunikasi kebijakan yang lebih jelas serta kemitraan strategis antara pemerintah dan sektor swasta agar program ini dapat memberikan dampak ekonomi yang lebih terukur dan tercermin pada pergerakan pasar.
