Abstract

Franchising is an agreement regarding the distribution method of goods and services to consumers, in which the business is operated according to the procedures and methods set by the franchisor, and the franchisor provides assistance to the franchisee. The author's research addresses the issue of legal protection for franchises regarding the risks of losses caused by the franchisor's mistakes. The research method used is juridical-normative, which involves examining the relevant legislation related to the underlying issues raised. The research findings indicate that the implementation of legal protection for franchises regarding the risks of losses caused by the franchisor's mistakes shows that the franchise agreement serves as the applicable legal foundation in operating the agreed-upon relationship. This agreement provides both preventive and punitive legal protection. However, there are obstacles and efforts to protect the franchisee, as the assumption that the franchisee is prohibited from transferring the received know-how to others may be less appropriate, as Article 3 of the Ministry of Trade Regulation allows for the inclusion of provisions for subsequent franchise agreements.

Abstract

One of the popular and rapidly growing social media platforms is TikTok. The platform offers live streaming features that allow sellers to interact directly with potential buyers in promoting their products. This study aims to examine the influence of TikTok live streaming (including streamer credibility, media richness, and interactivity) on the purchasing decisions of Skintific products among Generation Z followers of the official TikTok account @skintific_id. The survey method was employed, distributing questionnaires to the followers of the account who belong to Generation Z. The findings indicate that TikTok live streaming has a significant and positive influence on the purchasing decisions of Skintific products. The variables of streamer credibility and media richness have a strong and positive influence on purchasing decisions, while the interactivity variable has a moderate and positive influence. Overall, the live streaming variables collectively have a significant influence on purchasing decisions. The conclusion of this study states that TikTok live streaming can be an effective strategy in influencing purchasing decisions for products, especially among Generation Z, who are active TikTok users. This research provides a deeper understanding of the importance of TikTok live streaming in product marketing, particularly in the beauty industry.

Abstract

Based on facts that occur in society, it is often found that consumer rights as stated in article 4 of Law Number 8 of 1999 concerning Consumer Protection are not realized as they should be, such as the discovery of hazardous ingredients in 3 Madame Gie cosmetic products. The purpose of this research is to find out why 3 Madame Gie products were declared dangerous after having a distribution permit since 2018 and to find out what the consequences were. This study uses a normative juridical approach with library research data collection techniques. Based on the research results, madame gie can be withdrawn after having a distribution permit because hazardous materials were found during post-market supervision by BPOM and the resulting consequences are legal consequences in the form of administrative sanctions and non-legal consequences in the form of social sanctions

Abstract

This study aims to determine the teacher's role in stimulating the fine motor skills of group B children at Bintang Cemerlang Palembang Kindergarten. In this study, researchers used a qualitative descriptive research method. Collecting data in this study using observation, interviews, and documentation. In analyzing the data, researchers used the data analysis model of Miles and Huberman. The results of the study show that the teacher acts as a guide, facilitator and evaluator. Teachers provide facilities and infrastructure for learning, provide enthusiasm, a place for children to discuss and ask questions and teachers help children create a conducive learning environment.

Abstract

This type of research can be classified into normative research which examines the legal synchronization of the existence of KPPU Regulations before Law Number 5 of 1999 and Law Number 9 of 1981 concerning the Criminal Procedure Code in the system of proof of business competition procedural law, especially the handling of cartel cases. This study uses secondary data which is divided into primary legal materials, secondary legal materials and tertiary legal materials.Based on the results of the research, it can be concluded that the first is the use of circumtatial evidence by the KPPU in dealing with cartel cases which have been rejected by many, such as the cases of the Cooking Oil Cartel, Amplodiphine Besytale Drug, and the Fuel Surcharge Cartel on the grounds that circumtatial evidence is not evidence contained in Article 42 and different from the guiding evidence contained in article 188 (2) of the Criminal Procedure Code which means the Assembly disregards the position of the KPPU, on the other hand there are also cartel cases that use circumtatial evidence such as the Cartel for Four-wheeled Vehicles, Cartel Motor Matic and most recently the Cartel case Airline Tickets therefore circumtatial evidence has legal uncertainties in its application and there is a glimmer of hope that indirect evidence can be accepted as valid and independent evidence. Second, indirect evidence also has an effect on preventive action and therefore circumtatial evidence must be able to strengthen its position as independent evidence considering that in the current regulations there are many deficiencies such as the KPPU's limited authority, limited evidence, and not yet adhering to leniency system as a form of best practice in handling cartel cases. The author's suggestion is that the first is that KPPU Regulations must be used as material for the panel's consideration in deciding business competition cases. The two business competition procedural laws must be updated which strengthen the position of circumtatial evidence as valid and independent evidence.

Abstract

One that influences the success of the company is the system that is implemented in a company. Payroll accounting system is very influential for the company to support the effectiveness of internal control. This study aims to find out how the payroll system is applied to companies and how internal controls are implemented in the employee salary payment system. The type of research conducted by researchers is qualitative research, which focuses on the payroll accounting system at PT. XYZ and internal control system at PT. XYZ. Data collection techniques were carried out using interviews, documentation, and observation techniques. Data analysis in this study begins with analyzing related functions, supporting documents, accounting records used, network procedures and assessing the effectiveness of internal controls. The results of research at PT. XYZ researchers concluded that internal control in the implementation of the payroll accounting system has been carried out quite well overall because the separation between recording and implementation functions is carried out by dividing the duties and authorities of each employee concerned such as functions, procedures, documents and the necessary records have been formed and have been well coordinated. Internal Control at PT. XYZ is in accordance with SOP (standard operational procedure) this is evident from the implementation of attendance by system not manually. Attendance using an RFID card cannot be manipulated, the placement of the RFID card tap is guarded by a security guard, employees who do not carry an RFID card cannot enter so that cheating in the attendance process does not occur. The documents used consist of payroll, payroll recap, proof of cash out. The network of procedures used which consists of attendance record procedures, procedures for making payroll and wages and procedures for paying salaries and wages, PT. XYZ also has a payroll system flowchart, so that the payroll system can be seen clearly. Basically the system at PT. XYZ has been implemented properly according to the Internal Control System both in the control environment, risk interpretation and company supervision

Abstract

This study explores how students critical thinking abilities are affected by web based liveworksheets that are based on the Think Talk Write learning model approach, which is based on online live worksheets. The purpose of this study is to ascertain how Think Talk Write (TTW) learning model, which is bades on online liveworksheets, affect critical thinking abilities. This study employs a quantitative methodology, nonequivalent control group research design, and quasi experimental study research methods. In this investigation, random sampling was chosen as the sample method. 15 multiple choice questions and 5 description questions made up the test served as the study instrumen. The findings of this study demonstrate how the aviability of liveworksheets for a web based TTW learning paradigm might influence the development of critical thinking abilities. This is demonstrated by the considerable difference in test outcames between the experimental class and the control class following the implementation of the liveworksheets based TTW learning model.

Abstract

Minimum Competency Assessment (AKM) which is in line with 21st century skills that require students to be able to keep up with the times, but AKM has serious weaknesses, namely, a discrepancy between what is taught and what is assessed, so teachers should be able to work around these things this is for the smooth running of students in working on AKM questions by familiarizing students with questions based on numeracy literacy and in accordance with the context being taught, based on observations obtained an explanation that students seem less able to follow when faced with material that combines literacy and numeracy, In this regard, research on the development of biological numeracy literacy instruments in science learning in the subject of the respiratory system in humans is very important to do. This research is a development type research using the Research and Development (R&D) research method. The research design used is the ADDIE model research design (Analysis, Design, Development, Implementation, Evaluate). The results obtained for the development of the instrument are in accordance with the stages of the ADDIE model research design, the feasibility of the instrument which is classified as valid and reliable, and has a level of difficulty from easy to difficult categories and item discrimination from less to good categories and there are differences in terms of functionality. The conclusion of the instrument developed is feasible to use to familiarize students with questions based on numeracy literacy and according to the context that is being taught to improve students' numeracy literacy skills.

Abstract

Clinic licensing is an important part of public service. Permenkes 9 of 2014 concerning Clinics is a means of control related to . After the visitation process is complete, the Health Office will issue a Standard 3 Certificate issued by the Health Office and then the clinic verification process continues on the DPMPTSP website. Prior to the OSS agency, the clinic approval process in Indonesia often involved several different government agencies, such as the Food and Drug Administration (BPOM), the Ministry of Health and the local Health Office...Each agency has different requirements and procedures, which can be time-consuming and costly for clinic owners...OSS allows clinic owners to enter information and attach the required documents to a single application, which is then reviewed by the relevant authorities...This licensing process, which gives birth to a standard certificate, protects clinics that want to build buildings and business licenses so that if there are problems, they can show the standard certificate as proof that the clinic is licensed.

Abstract

The music industry is growing rapidly, but many musicians face difficulties in promoting themselves and their skills, especially amid the pandemic. Many music events have been postponed or canceled, resulting in an overall decline in income. For musicians who are paid based on projects and have a limited understanding of marketing strategies, this situation becomes very challenging. Agus Astika, the founder of Akustika Enterprise, is a successful musician who provides top-tier musician/band services in Bali. This research aims to analyze Agus Astika's personal branding strategies on Instagram and YouTube, the reasons for choosing these platforms as the venue for designing strategies, also the implications of soft skills on client loyalty and demand for services from Akustika Enterprise as a musician. This research combines qualitative and quantitative data to analyze Agus Astika's personal branding (Akustika Enterprise). The study draws on personal branding theories from Montoya dan Rampersad, digital marketing from Beridze & Mamuladze, and sociology of art concepts, focusing on soft skills from Andriyadi, Attitudes and Behaviors by Sarlito and Eko, and Art Entrepreneurship by Scherdin and Zander. Data is collected from human informants and non-human sources, with informants serving as key subjects providing valuable soft data. Qualitative data sources include documents, images, and other relevant materials. Data collection methods involve observation, in-depth interviews, literature review, and documentation following Bogdan & Biklen's approach. The data is then analyzed using Miles & Huberman's methodology, including data collection, reduction, presentation, and verification. The research findings indicate that Agus Astika (Akustika Enterprise) has fulfilled six out of eight characteristics of personal branding according to Montoya, as well as eight out of eleven characteristics according to Rampersad. Akustika Enterprise targets potential clients through Instagram, one of the most popular social media platforms, and utilizes YouTube as a showcase for their work. Possessing strong soft skills offers various benefits, including enhancing brand image, fostering client loyalty, and building relationships with potential clients.
