AL-BASHIRAH Journal of Islamic Studies is an academic journal published by the Pusat Penelitian dan Pengabdian Masyarakat (P3M) Sekolah Tinggi Ilmu Islam dan Bahasa Arab (STIBA) Makassar, Indonesia, in April and October every year. AL-BASHIRAH Journal of Islamic Studies contains Islamic studies on the Quran, hadith, jurisprudence, Islamic education, Islamic thought, and others in the form of research results, conceptual ideas, literature studies, and practical experience. The editorial team invites academics, lecturers, and researchers to contribute to this journal by submitting the scientific articles that have never been published by other journals. The manuscript is typed with Traditional Arabic font, space of 1 on A4-sized paper, with a writing length between 15-25 pages. The incoming manuscript will be evaluated and reviu by the Editorial Board and Peer-Reviewers. The Editorial Board may make changes to the articles for the uniformity of the format, without changing its substance. The Editorial Board accepts articles that meet scientific standards that conform to the theme of the journal in the field of Islamic studies. The Editorial Board receives article written only in Arabic language.

Abstract

The book I'aanatu ath-thaalibin 'alaa halli al-faazhi fathi al-mu'iin by Abu Bakr al-Dimyāthi al-Syāfi'i is one of the most important books of fiqh in the Shafi'i school, the proof is that the book is a reference in local Islamic boarding schools and the main reference for muftis as well as a scientific reference for students in our country, Indonesia. Therefore, this study aimed to identify Abu Bakr al-Dimyathti al-Syafi'i, one of the Shafi'i scholars, and reveal his scientific personality in the science of hadith by studying his method of hadith, particularly in his book I'aanatu ath-thaalibin. This study employed an inductive deductive approach. The results of the research reveal that Abu Bakr al-Dimyathti al-Syafi'i is one of the phenomenal contemporary scholars of the Shafi'i school. In his book, he uses a lot of hadiths and atsar as arguments in establishing a law of fiqh without requiring the validity of these propositions, so that there are arguments that are authentic, fine, and weak. The depth of his knowledge in the field of hadith is evident in his book I'aanatu ath-thaalibin on the following points: the number of hadith cited that he used as the proposition, the number reached approximately one thousand three hundred and eighty-three (1383) hadith marfu' without repetition. His book also shows the depth of his understanding of the science of musthalah al-hadith. Among his method of inference in the hadiths is his excessive attention to the two sahih books in postulating until the number - according to my estimation - reaches around five hundred and sixty-three (563) hadiths, this is a fantastic number, besides he does not postulate weak hadiths and ones that are munkar.

Abstract

It is said that Shia does not believe in Al-Qur'an that is available today, but we find that the Al-Qur'an that was printed by the Shia is the same Al-Qur'an which is printed elsewhere. Therefore, this study aims to explain the essence of Shia’s belief in Al-Qur'an that is currently in the hands of the Muslims and also the roots of that belief. The method used in this research is descriptive analysis namely by examining classical and modern books particularly the books of Shia’s scholars as the main source to explain and answer the problem formulations in this study. The results of this study indicate that Shia does not believe in Al-Qur'an that exists today. They are forced to read and perform its laws until the emergence of Al-Qaim, which is Imam Mahdi Al-Muntazhar in their version which would carry "the original al-Qur'an." There are two roots of this belief those are to legitimize the doctrine of Al-Wilayah or Imamat of Ahlul Bait and to deny the virtues of the companions.

Abstract

The research in front of dear readers is about the practice of the people of Medina. Among the objectives were: To identify the essence of the practice of people of Medina and its position according to Imam Malik and other scholars. The researchers focuses on two points, the first: the essence of the people of Medina, and the second: What is the position of the people of Medina according to Imam Malik bin Anas and other scholars? The type of research employed was library research that focuses on texts from books and interesting results of scientific research related to the topic. The results show: First, the practice of the people of Medina is propositions or arguments which are disputed, this is due to differences in understanding the concept. Second, the practice of the people of Medina is divided into two parts, one of which is through excerpts which consist of four types: excerpts of the speech, acts, consent and neglect, and this is an agreed statement. The second one is based on ijtihad, Imam Malik's companions differ in this respect. Third, the practice of people of Medina according to Imam Malik has a great position because of the prominence of the city of Medina and its people compared to other regions based on several narrations mentioned by the Prophet sallallaahu 'alaihi wasallam and his companions, may Allah be pleased with them all. Imam Malik had deduced the law from several problems based on the practice of people of Medina, had often referred to it in different terms in his Muwatta, and had given priority to the practice of the people in Madina if it is contradicting to khabar wahid. He has written letters against people who disagree with him regarding the practice of people of Medina in his time including his famous treatise to Al-Laits bin Saad. Fourth, in contrast to Imam Malik, the majority of scholars do not consider the practice of the people of Medina as a proposition because they see that perfection belongs to the ummah as a whole, and the people of Medina are not the whole ummat, even outside the city of Medina some scholars are more knowledgeable than the people of Medina.

Abstract

This study aims to identify the extent to which the historical roots of the Shafi'i school in Indonesia in terms of its arrival and spreading and to determine the extent of the influence of the Shafi'i school in the lives of Muslims in Indonesia and whether it plays a role in the codification of laws in Indonesia? The researcher employed the historical inductive approach and the descriptive-analytical approach. Among the results of the research are that the entry of the Shafi'i school in Indonesia was accompanied by the entry of Islam in it by Arab traders from the Arabian Peninsula - or the Indies (Malibar and Gujarat). Based on reliable documents, I can confirm that Islam entered Indonesia in the seventh century AD (first century in Hijriyah), yet began to spread strongly in the tenth century AD through the emergence of Islamic kingdoms in the archipelago which adopted the Shafi'i school as the official school of the state. The influence of the Shafi'i school is evident in Indonesia on the educational curriculum taught in the era of the Islamic kingdoms and the era of independence in several institutions and Islamic boarding schools. The Shafi'i school also shows its influence in the law of Islamic governance in Indonesia, although it is limited to matters of marriage, inheritance, and waqf.

Abstract

This study aimed to identify and describe the best method of teaching rules of nahwu for beginners and advanced students for foreign speakers (non-Arabic). This research was a qualitative descriptive study with a type of library research by tracing references in data collection. The results of this study indicate that the best method of teaching rules of nahwu for foreign speakers is of two methods, namely: The first one is the aural-oral method (sam'iyyah syafawiyyah) for the beginner level. This method uses patterned training techniques (pattern drill) through activities of istimā' (listening) and kalām (speaking) to form behavior (habits) for beginner-level learners in using language along with learning rules of nahwu through sentence structure (applied nahwu); The second one is the method of al-istiqra'iyyah (inductive method) for advanced students. This method is one that makes the dialogue/reading text the center of learning all language skills, both speaking and reading related to the rules of nahwu by using three training techniques (drill) that do not come out of the dialogue/reading text, namely the pattern drill (patterned training), meaning drill (exercise of the meaning) and communicative drill (communication exercise). These three techniques combine the formation of behavioral habits in using language along with understanding the meaning and ability to communicate with native speakers (Arabs) by paying attention to the theoretical principles of nahwu (nahwu concept) and applied nahwu (applied nahwu).

Abstract

Research presented in front of dear readers talks about the law of using and disclosing the niqab in necessity in implementing the rules of al-dharuratu tubiihul mahzhuraat. Among the objectives are identifying the laws of wearing the niqab, the dhabith of necessity, and the application of the principle of al-dharuratu tubiihul mahzhuraat. Researchers limit the application of the principle to four situations, namely: First, in the making of ID cards, passports, or other things that required photographs. Second, in the medical field and when a disaster strikes. Third, the husband and his family forced the wife to remove the veil. Fourth, what has recently emerged is the coercion of several universities or company directors on students or employees to remove their niqab. The scientific method that the researcher followed in this study to achieve the results of these problems were as follows: descriptive method, inductive method, and deductive method. The results showed: First, the preponderant one concerning wearing the niqab is that it is obligatory based on the strength of this argument, and it is closer to chastity in the time of fitnah spreading and the amount of immorality that is happening today. Second, the basic principle of a woman when she leaves her home or appears to strangers is the obligation to cover her face and the prohibition of opening it, whether she is worried about temptation in herself or against her, or even though she feels safe from temptation, but is allowed to remove it in a necessity because in a necessity, forbidden things are allowed, but it is important to know consideration of a situation so that it is called a necessity by which it can be known to what extent the implementation of the rule regarding the permissibility of showing one's face so that it is not used as an excuse for committing forbidden acts.

Abstract

This study aims to reveal the various patterns of belief in the internal of the Shafi'i school and also to explain the history of the emergence of these various forms of understanding after the early development of the Shafi'i school which is oriented towards pure salafi Sunni understanding. This research used the deductive inductive method. The results of this study show that the Shafi'i school as it develops in the aspect of fiqh through the hands of its figures, it also develops in the aspects of aqidah with quite rapid development. The Shafi'i school is no longer pure as it was in the days of its founder, Imam Al-Shafi'i, and his early figures. In the internal of the Shafi'i School, various forms of belief emerged which later became many different madrasas. Each madrasah produces a variety of views that are similar and are bound by the same ushul (principle) and their figures are connected with similar thoughts. The Shafi'i school was originally a pure Sunni school and could be called the Madrasah Syafi'iyyah Ahlussnnah. Then within the school, there appeared various types of understanding of the people of Kalam and Sufi. Then it became several madrasas with different styles of understanding. Within the schools, the concept of Kullabiyah Asy'ariyah emerged in the third century of hijriyyah where in the same century the people of Kalam and Sufi also emerged. Then in the fifth century, the concept of Asy'ariyah Muktazilah emerged. Then the concept of understanding of the Asy'ariyah Falsafi emerged and became grounded in the Shafi'i School in the sixth century of hijriyyah during the emergence of the concept of Kuburiyah which has survived to this day. However, the pure Sunni Salafi style remains in the internal Shafi'i school.

Abstract

This study aims to introduce one of the leading scholars in fiqh and hadith, Majdu al-Din Abu al-Barakat Abdu al-Salam Ibn Taymiyyah al-Harrani al-Hanbali and introduce his book al-Muntaqa. Among the objectives of this research are to remind the ummah and the students about the greatness of his position which may not be known by many people as well as to read the biographies of the role model of the ummah by imitating and following in the footsteps of his life journey. It also explains one of the most important literature in the hadith al-ahkam, namely muntaqa al-akhbar. In this study, the researchers employed a descriptive approach. Among the most important results of this research are that Imam Majdu al-Din Ibn Taymiyyah was born in Harran in 590 AH and died there in 653 AH. Majdu al-Din Abu al-Barakat is an expert in many disciplines including fiqh, hadith, al-nahw, al-qira'at, and ushul al-fiqh. He studied with many scholars and had traveled to Baghdad several times to recite knowledge in front of the scholars. Abu Al-Barakat wrote many books among which his phenomenal books are al-Muntaqa min al-Ahkam. His reason for writing the book was a request of a judge, Bahauddin bin Shaddad, to Imam Majd al-din to write it in Aleppo. The scholars differed in determining the name of this book and the strongest opinion is al-muntaqa fi al-akhbar fi al-ahkam. This book has many prominences yet does not free from some criticism even though it is in a small number. Abu Al-Barakat has quoted many references in his book. The scholars have an interest in this book by explaining its contents in the form of writing and lectures.

Abstract

Surah An-Nisa is one of the longest madaniah surah, and is one full of provisions of sharia laws that govern all matters both internal and external ones for Muslims. Among the prominence of this noble surah is that it tells a lot about important things related to women, household, family, country, and social life. In this surah, there are commands and prohibitions in various matters. The purpose of this study was to extract imperative sentences related to family life and then briefly identify the rules that became the base for these commands. The researcher employed an inductive and analytical approach by extrapolating Surah Al-Nisa, taking imperative sentences related to family life, and explaining the law which is concluded from it. Researcher finds, among the most important of the most important ones are as follows: understanding the meaning of al-amr (command) which is a request to do something in the form of superiority. There are two types of amr: direct and indirect. The number of amr related to the family in the surah is seventeen.

Abstract

Several scholars of fiqh of the Shafi'i School in presenting fiqh issues used the method of deciphering aspects of the differences between legal issues that had a similar picture but had differences in terms of the law, which was later known as al-furuq al-fiqhiyyah. Since the beginning of the writing of al-furuq al-fiqhiyyah, there had been some literature that discussed it specifically or which specializes it in a sub-discussion. However, the researcher found in this literature that there are significant differences in the method of presentation among the authors. Because of that, it is considered important to formulate a separate method of approach as a general standard to recognize the character of scientific works on al-furuq al-fiqhiyyah. In this study, the researcher used the inductive istinbat method of approach, by inducing possible and representative works of literature related to al-furuq al-fiqhiyyah in the Shafi'i School. This study found that the Fuqaha of Shafi'i school used four ways in presenting the discussion of al-furuq al-fiqhiyyah, namely: Describing the discussion of al-furuq al-fiqhiyyah in one separate literature, describing it in the literature related to al-farq (differences), and al-istisna' (exception), describing it in the literature that specifically discusses a particular problem or issues, and describes it in the literature that simply inserted a discussion of al-furuq al-fiqhiyyah as a complement.
