Abstract

This research examines the implications of Article 193 of Law No. 17 of 2023 concerning Health, which imposes sole liability on hospitals for negligence by health workers. This provision raises concerns about fairness and justice, as it deviates from established principles of shared accountability in Indonesian civil law. The study aims to critique this legal framework, assess its alignment with international standards, and explore its impact on healthcare delivery. Using a descriptive method, the research analyzes legal documents, case law, and relevant literature to understand the complexities of liability in healthcare. The findings reveal that Article 193 undermines the principles of distributive, retributive, and compensatory justice, potentially eroding trust in the legal system and discouraging hospitals from providing high-risk services. Furthermore, the study highlights that this one-sided liability can create an adversarial relationship between hospital management and health workers, ultimately harming patient care. The implications of this research suggest the need for legal reforms that promote shared accountability among healthcare providers and individual practitioners. By advocating for a reassessment of Article 193, the study aims to inform policymakers and legal professionals on creating a balanced liability framework that fosters a collaborative healthcare environment and enhances patient safety.

Abstract

This study uses Principal Component Analysis (PCA) to analyze the stability of Indonesia's financial system using 15 indicators from banking financial institutions and financial markets. The PCA technique is applied to each variable included in the components of bank financial institutions or non-bank financial institutions into several main factors that have the same variant value. The first principal component (PC1) successfully captured around 38 percent of the total variability and became the dominant indicator for financial system stability in Indonesia. In addition, from the banking financial institution indicators, NIM and LDR became factors that had quite an influence on PC1, indicating that profitability and banking intermediation activities still played a role in the dynamics of financial system. Furthermore, the interplay between Credit Default Swaps (CDS), exchange rates, and stock market indicators like the IHGS could provide deeper insights into how these elements influence investor sentiment and overall financial stability. Therefore, more comprehensive policy steps are needed to strengthen the resilience of the financial system, including stabilizing the bond market, managing exchange rate risk, and strengthening monetary and macroprudential policies to face future economic uncertainty.

Abstract

The rapid expansion of digital health services and telemedicine introduces new dimensions to competition law enforcement in healthcare. This paper explores strategic recommendations to enhance Indonesia's competition law in healthcare by focusing on strengthening regulatory institutions, improving judicial consistency, fostering private enforcement mechanisms, and developing targeted policies for emerging digital health markets. This study employs a comparative legal analysis approach, integrating qualitative and normative research methods, to examine the effectiveness of existing competition law frameworks governing healthcare in the United States and Indonesia, identifying best practices, challenges, and opportunities for improvement. The findings reveal stark contrasts in competition law enforced between the two countries, particularly in market concentration, regulatory oversight, judicial intervention, and private litigation mechanisms. By adopting a framework that fosters industry sustainability while preventing anti-competitive behavior, Indonesia can create a more competitive, innovative, and accessible healthcare system that benefits both pharmaceutical companies and consumers alike.

Abstract

Sharia Home Ownership Financing (PPR Syariah) is an urgent need for the Indonesian Muslim community in obtaining housing according to Islamic principles. This study aims to analyze the juridical construction of PPR Syariah that is ideal for Indonesia through a normative juridical approach with descriptive-prescriptive analysis. Secondary data were collected through a literature study and reinforced primary data from stakeholder interviews. The findings show that Sharia PPR in Indonesia faces complex problems: Islamic bank mortgages are still under criticism related to sharia compliance, while non-bank sharia PPRs are weak in regulation even though they are considered more sharia by the community. The realization of Sharia mortgages has only reached 15.9% of total housing financing, far from the potential of the Muslim market of Rp. 720 trillion. The housing backlog of 12.75 million units requires financing solutions that accommodate the religiosity of the community. The ideal juridical construction requires a holistic system approach based on Maqasid Syariah by considering aspects of sharia (sharia conformity) and qonunan (positive law). The construction model must involve community participation (legal culture) in the formation of policies (legal policy) towards a comprehensive Sharia PPR Law. The study recommends the establishment of special regulations that accommodate both Islamic bank mortgages and non-bank Islamic PPRs with adequate supervision.

Abstract

This thesis analyzes sedimentation in the Cihaur irrigation canal within the Manganti Irrigation Area (D.I. Manganti), Cilacap Regency, which irrigates 700 hectares of agricultural land from an irrigation system covering a total of 26,153 hectares. The study examines the impact of sedimentation on the capacity and efficiency of the 22.62 km long irrigation canal. The analysis of sedimentation-causing factors is based on Sasrodarsono’s theory (1989), which includes the area of erosion, geological and topographical conditions, meteorological factors (particularly high rainfall intensity), hydraulic characteristics (a flow rate of 136.524 m³/second), vegetation, and human activities within the Citanduy River Basin (DAS Citanduy). The impacts of sedimentation include a reduction in canal capacity, decreased hydraulic efficiency, and increased maintenance costs. The research method uses a descriptive analytical quantitative approach, includingmeasurements of discharge, sedimentation volume (20.405 m³/second), granulometric analysis (dominated by fine sand and silt with a silt content of 58%), and water content (86% for settled sediment, 292% for floating sediment). Correlation analysis indicates a relationship between high rainfall and increased sedimentation. The results show that sedimentation significantly reduces irrigation capacity and efficiency. For example, the flow in the Simpellu I primary canal decreased from 136.524 m³/second to 116.119 m³/second due to sedimentation amounting to 20.405 m³. Recommended solutions include sediment dredging, canal normalization, upstream erosion control (reforestation, terracing, mulching), the construction of sediment control structures (sediment traps, settling basins, check dams), proper canal design, regular cleaning and maintenance, and active participation from farmers. The study is limited by a lack of historical data and the narrow scope focused solely on the Cihaur irrigation canal. Irrigation Efficiency For example, the discharge in the Simpellu I primary canal decreased from 136.524 m³/second to 116.119 m³/second due to sedimentation of 20.405 m³. Recommended solutions include sediment dredging, canal normalization, erosion control upstream (reforestation, terracing, mulching), construction of sediment control structures (sediment traps, settling ponds, check dams), appropriate canal design, routine cleaning and maintenance, and active farmer participation. This research has limitations regarding historical data and the study’s scope, which is limited to the Cihaur irrigation canal.

Abstract

Road performance needs to be taken into consideration because side obstacles, namely human activities, affect the performance of the road. The problem in this study is traffic congestion on the road, and the objective of this study is to evaluate the performanceof the road. The analysis method uses the 2023 PKJI guidelines. The data collection in this study consists of primary and secondary data. Primary data was obtained through observations, including: data surveys of vehicle volume (traffic counters), and observations of external obstacles. Meanwhile, secondary data was obtained through Google Earth. The research results show that the performance of the Kalitanjung road section has a service level of 0.8, derived from the analysis of the degree of saturation (DJ) as a reference for road service level or LOS (Level of Service) PKJI 2023, categorized as LOS “D,” meaning it is approaching unstable with decreasing speed. The survey results over 6 days showed a peak hour vehicle count of 4,583 vehicles/hour or a traffic flow rate (Q) of 2,104.65 vehicles per hour. Additional supporting analyses include: free-flow speed (VB) value of 34.776 km/hour, capacity (C) value of 2,646 vehicles per hour, travel time (WT) of 0.016 hours or 57.6 seconds per 400-meter road segment length. The analysis also indicates that the road is currently operating at 70% of its capacity, with a free-flow speed of 34.776 km/hour.

Abstract

Population growth in urban areas has resulted in a decrease in agricultural land and an increase in food dependence from outside the region. This poses a risk to the city's food security. This study aims to analyze the effect of the implementation of automation-based vertical farming systems on improving the food security of urban communities. The research was conducted in a quantitative descriptive manner with a survey approach on 100 respondents of urban farming households in Jakarta. Data were collected through questionnaires and analyzed using simple linear regression to measure the relationship between the use of automation technology (X) and food security levels (Y). The results of the study show that automatic vertical farming systems have a positive and significant influence on household food security, especially in the aspect of food supply availability and sustainability. These findings strengthen the argument that technology-based urban farming is the future solution for big cities in maintaining food security in a sustainable manner. Therefore, the integration of technology in the urban agricultural system needs to be expanded and supported through public policies.
