HUMAYA: Jurnal Hukum, Humaniora, Masyarakat dan Budaya adalah jurnal nasional yang mendukung dosen, peneliti, dan praktisi dalam memublikasikan hasil penelitian berupa artikel ilmiah dalam bidang hukum, humaniora, masyarakat dan budaya. Jurnal ini dapat diakses publik yang diterbitkan dan dikelola oleh Jurusan Ilmu Sosial, Hukum dan Humaniora, Fakultas Hukum, Ilmu Sosial, dan Ilmu Politik (FHISIP) Universitas Terbuka sejak tahun 2021, baik untuk internal maupun eksternal. Jurnal ini diterbitkan dua kali setahun, setiap bulan Juni dan Desember. Jurnal Humaya menerbitkan artikel hasil penelitian di bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya. Jurnal Humaya melaporkan penelitian empiris tentang topik-topik yang penting bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya menggunakan desain penelitian yang tepat dan hasil yang dijelaskan dengan baik dan utuh. Artikel yang berisi analisis kritis terhadap literatur ilmiah tentang topik bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya juga dapat diterbitkan. Jurnal Humaya juga mencakup resensi buku. Tujuan jurnal ini adalah menerbitkan artikel hasil penelitian berkualitas yang mempunyai potensi memberikan kontribusi pada pengembangan ilmu di bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya. Naskah harus memenuhi karakteristik sebagi berikut. Mempunyai kerangka teori yang jelas Menunjukkan dengan jelas hubungan dan relevansi antara literatur sebagai sumber referensi dengan topik yang diteliti Mempunyai Desain penelitian yang tepat dan analisis data yang utuh. Abstract

This article explores the impact of English stories in the classroom, focusing on how storytelling unlocks students’ imagination and enhances their language development. Through a mixed-methods approach, including literature review, case studies, classroom observations, and student interviews, the study investigates the role of stories in stimulating creativity, improving language skills, and fostering critical thinking. The findings highlight how stories introduce new vocabulary in context, promote listening and speaking skills, and strengthen reading comprehension and writing abilities. Additionally, storytelling serves as a powerful tool for increasing student engagement and motivation while also developing empathy and cultural awareness. The article emphasizes the educational benefits of using narratives to not only teach language but also to encourage a deeper connection with the material and a broader understanding of diverse perspectives. The conclusion advocates for the continued integration of storytelling in English language curricula, emphasizing its potential to unlock students’ imaginations and support their holistic development as language learners and global citizens.

Abstract

Globalization has brought significant changes to various aspects of life, including economic, social, political, and cultural dimensions. Klungkung Village, located in Jember Regency, has also been impacted by globalization. Advances in technology and the rapid flow of information have brought significant changes to various aspects of life in Klungkung Village. Globalization has accelerated the dissemination of information and cultures from around the world, which then interact and integrate with the local culture. This phenomenon poses a new challenge for the community of Klungkung Village in maintaining and preserving their rich and unique cultural identity. The purpose of this study is to identify and analyze the forms of cultural shifts occurring and to understand their impact on the village's cultural identity. The research methodology uses a qualitative approach with data collection techniques through participatory observation, in-depth interviews, and literature studies. The results of the study show that although there is a shift in cultural practices, the community of Klungkung Village is able to maintain the essence of their cultural identity by adapting and integrating new elements without diminishing the cultural values. This research will make an important contribution to understanding the dynamics of local culture amidst the tide of globalization and offer perspectives on effective cultural preservation strategies in the modern era.

Abstract

Fishermen are often described as people whose lives depend on nature. Since the emergence of gold mines in Pancer, fishermen have had difficulty finding fish. In many cases, the presence of mines in other regions has caused environmental damage. However, there have been no scientific studies that show significant environmental damage due to gold mines in Pancer. This study aims to analyze the lives of fishermen in Pancer after the emergence of gold mines and analyze whether a sustainable society has been realized. The concept of deep ecology is used by researchers to analyze the case. The study uses a qualitative method with a case study approach. Data were obtained from the field using observation and interviews, as well as field documentation including literature studies to support research data. The research was conducted in Pancer Hamlet, especially at Pancer Beach and Pulau Merah Beach. At Pancer Beach, fishermen began to have difficulty finding fish in coastal areas, so they had to sail far to get fish. This caused a decrease in the income of fishermen at Pancer Beach. Meanwhile, at Pulau Merah Beach, the community developed the beach as a tourist destination. Some fishermen switched professions to become traders around the beach or rent boats to tourists. The Pancer community as a sustainable society can be seen from waste management to protect the coastal environment. Support for inclusive social policies from the government is by making various regulations and waste management activities that involve the local society, community groups, stakeholders, including the younger generation. Sustainable society is in line with the concept of deep ecology because it prioritizes the nature sustainability for the sustainability of human's life.

Abstract

Rapid advancements in technology have had a profound impact on educational practices, particularly in language learning, where accessibility, interactivity, and collaboration have become central themes. This paper explores the integration of digital platforms such as Padlet, into English as a Foreign Language (EFL) classroom, with a particular focus on collaborative storytelling as a means of examining cultural hybridity, tradition, and modernity. Framed through a postcolonial lens, the study investigates how digital storytelling facilitates students’ negotiation of cultural values and postcolonial dynamics within a collaborative creative process. The findings suggest that digital storytelling platform provides EFL learners with valuable opportunities to critically engage with cultural identities and power dynamics, while simultaneously enhancing their creative writing skills. This study underscores the potential of technology-assisted learning to facilitate meaningful dialogue and critical reflection on cultural hybridity in contemporary educational context.

Abstract

The college environment no longer solely concentrates on reviving efforts to treat and prevent sexual violence, but also promotes prevention as a preventive strategy through sexual education, which teaches students to maximize bystanders and cultivate prosocial attitudes. The research aims to examine the effectiveness of the sexual education (X) model at the Indonesian Educational University, the Bandung Institute of Technology, and Padjajaran University in enhancing the role of the behavior bystander (Y1) and encouraging the prosocial (Y2) attitude of students when faced with sexual violence. The research employed a quantitative approach, distributing the lift among 108 active students from the three universities. To ensure proportional representation, stratified random sampling divides students by university origin and then selects random samples from each layer of students who have received sexual education on campus. Additionally, we conducted interviews with the Prevention and Treatment Unit of Sexual Violence to gather information about the implemented model of sexual education. The research findings demonstrated the effectiveness of the university-implemented sexual education model, which enhanced bystander roles by 52.5% and prosocial attitudes by 51.9%. We regard the role of bystanders and prosocial attitudes in an incident of sexual violence as a holistic solution to sexual violence prevention, as they protect victims and prevent further sexual violence.

Abstract

Poverty is the focus of government attention in a country. One important aspect to support the Poverty Alleviation Strategy is the availability of accurate and transparent poverty data. Data accuracy is certainly balanced with cross-sectoral collaboration between OPDs, where policies are under the authority of the relevant agencies. Wonogiri, which we know has an initial poverty rate of above 13 percent, is now approaching 1 digit. This research was conducted using a qualitative method with inductive descriptive writing to obtain data. The scope of the research contains efforts to overcome poverty through collaboration. The results of research related to poverty alleviation through collaboration with the Regional Government are influenced by various factors including low levels of community income, minimal health, limited education, access to goods and services is still difficult, location or domicile, geographic location, gender, and environmental conditions. Referring to the government's strategy in poverty alleviation, poverty can be overcome through collaboration between relevant agencies in handling it and by creating a special team that focuses on dealing with poverty. The obstacles encountered when poverty alleviation efforts stagnate in ordinary programs that emphasize the ceremonial side alone rather than on needs.

Abstract

Gambang Kromong is a traditional Betawi art combining gamelan elements with Chinese musical instruments. Currently, this art faces a cultural shift, neglected by the younger generation as they favor western music to traditional one. The youth’s efforts highly contribute to the preserved existence of traditional arts, one of which is through the Jali Putra art studio. This study strengthens the local cultural identity and maintains the existence of the Gambang Kromong traditional art. This study aims to contribute to the progress of preserving local cultures and traditional arts. It employed an ethnographic method with a holistic approach. The data were collected by means of direct observation, in-depth interviews, documentation, and literature reviews. The findings showed that strengthening local cultural identity is a pivotal role for art studios as it preserves the cultural heritage for the younger generations. Through cultural education, the youth’s involvement in cultural festival activities appears to be an effective endeavour in preserving the Gambang Kromong traditional arts. Finally, this study expectedly advances the preservation of local culture, especially traditional arts.

Abstract

The refusal of patients in emergency conditions by hospitals that they do not meet the emergency criteria as stipulated by BPJS Kesehatan regulations raises critical legal and medical ethical issues. This study aims to analyze the juridical aspects and professional medical ethics related to such practices by examining the Indonesian Medical Code of Ethics as well as the legal provisions in Law Number 17 of 2023 on Health and Law Number 24 of 2011 on the Social Security Administering Body (BPJS Kesehatan). The research method used is a normative juridical approach through literature study. The findings indicate that, from a legal standpoint, hospitals and medical personnel are obligated to provide medical services to all patients in emergency situations without delay regardless their administrative status. Refusal to provide such services may be classified as a legal violation and may be subject to criminal, civil, and administrative sanctions. From the perspective of medical ethics, such actions are contrary to the principles of beneficence and non-maleficence and violate the Medical Code of Ethics. Therefore, BPJS administrative regulations must be aligned with legal and ethical principles in handling emergency cases to ensure the protection of patients’ rights and the continuity of equitable and professional health services. The study concludes that the refusal of emergency patients by hospitals due to unmet BPJS Health emergency criteria contradicts Indonesia’s positive law and the fundamental principles of medical ethics.

Abstract

This article explores the implementation of double taxation avoidance within the framework of international taxation and its interaction with Indonesia’s domestic tax law. Double taxation arises as two countries assert tax rights over the same income, creating a financial burden for cross-border taxpayers. To address this issue, Indonesia has established Double Taxation Avoidance Agreements (DTAAs) with numerous treaty partners and ratified the Multilateral Instrument (MLI) through the Presidential Regulation No. 77 of 2019, as part of the OECD/G20 Base Erosion and Profit Shifting (BEPS) minimum standards implementation. This research used a qualitative research approach with a normative juridical method on Foreign Direct Investment (FDI), the tax-to-GDP ratio, and the effectiveness of the compliance gap. The findings indicated that DTAAs and the MLI play a critical role in ensuring legal certainty, boosting foreign investment, and strengthening the national tax system. Nevertheless, challenges persist, such as treaty shopping practices and misalignment between domestic regulations and international standards. Legal harmonization, enhanced tax administration capacity, and stricter enforcement are essential for achieving a fair and sustainable global tax system.

Abstract

Participatory oversight in elections is an important instrument to maintain the integrity of electoral democracy, where Bawaslu, in particular, plays a role in activating public involvement through various communication strategies. However, the effectiveness of public relations practices at the local level, such as in Mojokerto district, still faces structural and cultural challenges, so it needs to be examined as a social practice influenced by the local context and actor dynamics. This study examines institutional relationships and inter-actor dynamics in public relations practices at the Mojokerto District Election Supervisory Agency (Bawaslu) in the context of participatory election monitoring. Using a qualitative approach and a single case study design, data collection was conducted through observation, interviews, and document analysis with informants from Gakkumdu, ad hoc supervisors, and local officials who were then validated through triangulation and member checking, and analyzed using a thematic approach. The findings show that the Mojokerto District Bawaslu's public relations practices are influenced by the institutional structure, the capacity of local actors, and the socio-cultural context of the community. Social media is used not only to disseminate information, but also to build an image and mobilize public participation, although its effectiveness is still constrained by limited human resources, the digital divide, and weak institutional coordination. Using structuration and practice theory, this study confirms that PR communication strategies are adaptive and relational, reflecting local actors' negotiations in responding to digital habitus and democratic dynamics at the grassroots level.
