HUMAYA: Jurnal Hukum, Humaniora, Masyarakat dan Budaya adalah jurnal nasional yang mendukung dosen, peneliti, dan praktisi dalam memublikasikan hasil penelitian berupa artikel ilmiah dalam bidang hukum, humaniora, masyarakat dan budaya. Jurnal ini dapat diakses publik yang diterbitkan dan dikelola oleh Jurusan Ilmu Sosial, Hukum dan Humaniora, Fakultas Hukum, Ilmu Sosial, dan Ilmu Politik (FHISIP) Universitas Terbuka sejak tahun 2021, baik untuk internal maupun eksternal. Jurnal ini diterbitkan dua kali setahun, setiap bulan Juni dan Desember. Jurnal Humaya menerbitkan artikel hasil penelitian di bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya. Jurnal Humaya melaporkan penelitian empiris tentang topik-topik yang penting bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya menggunakan desain penelitian yang tepat dan hasil yang dijelaskan dengan baik dan utuh. Artikel yang berisi analisis kritis terhadap literatur ilmiah tentang topik bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya juga dapat diterbitkan. Jurnal Humaya juga mencakup resensi buku. Tujuan jurnal ini adalah menerbitkan artikel hasil penelitian berkualitas yang mempunyai potensi memberikan kontribusi pada pengembangan ilmu di bidang sosiologi hukum, humaniora, bahasa, sosiologi, masyarakat, dan budaya. Naskah harus memenuhi karakteristik sebagi berikut. Mempunyai kerangka teori yang jelas Menunjukkan dengan jelas hubungan dan relevansi antara literatur sebagai sumber referensi dengan topik yang diteliti Mempunyai Desain penelitian yang tepat dan analisis data yang utuh. Membahas secara komprehensif dan kritis data dalam kaitan dengan konteks penelitian Mempunyai kebaruan (Novelty) Jurnal Humaya menerima artikel dalam Bahasa Indonesia dan Bahasa Inggris.

Abstract

Social conflicts between religious communities are a social and cultural issue that still needs to be addressed. They pose a challenging phenomenon within society, creating tension and fractures between individuals and groups with different beliefs. These tensions often pose a threat to the harmony and cohesion among religious communities in Indonesia. Therefore, this study aims to examine the phenomenon of social conflicts among religious communities from the perspective of sociology of religion. Employing a qualitative method with a literature study approach, it explores social conflicts among religious communities from the viewpoint of sociology of religion. The research findings indicated that interfaith dialogue is recognized as an evolving effort to foster associational and social interactions among religious believers. The significant role of the sociology of religion lies in its integral part in the continuous social process, shaping tolerance among religious followers.

Abstract

Penelitian ini bertujuan untuk menganalisis idiom, menjelaskan strategi penerjemahan, serta mengetahui strategi penerjemahan idiom yang banyak digunakan dalam menerjemahkan idiom pada novel “I Rise” karya Marie Arnold. Masalah yang dihadapi oleh penulis adalah idiom tidak dapat diterjemahkan secara harfiah maka diperlukan strategi penerjemahan yang tepat untuk menerjemahkannya. Metode penelitian yang digunakan adalah metode penelitian deksriptif kualitatif. Ditemukan data sebanyak 30 idiom dalam novel. Penelitian ini menggunakan novel karya Marie Arnold yang bejudul “I Rise”. Hasil penelitian menunjukkan bahwa berdasarkan empat strategi penerjemahan teori Baker, ditemukan bahwa 30 idiom yang ditemukan pada novel “I Rise” terdapat tiga strategi yang digunakan, yaitu; 1). Strategi penerjemahan idiom similar meaning and form sebanyak 6 idiom; 2). Strategi penerjemahan idiom similar meaning but dissimilar form sebanyak 13 idiom; 3). Strategi penerjemahan parafrase sebanyak 11 idiom. Strategi penerjemahan yang paling banyak digunakan adalah strategi penerjemahan idiom similar meaning but dissimilar form.

Abstract

This research explores the roles of translators and interpreters in the 21st century, focusing on their differences in work methods, language type focus, context understanding, translation style, processing time, translator tool assistance, role in communication, and additional skills. This research is library research. The analysis shows that both professionals require a deep understanding of culture and language, expert knowledge, and clear communication. Translators must understand cultural knowledge for negotiations, while interpreters facilitate communication between people speaking different languages. They must consider non-verbal cues, and have excellent language skills, quick thinking, effective information processing, and in-depth knowledge of the culture and business practices associated with the languages they translate. Interpreters can use the SIS (Simultaneous Interpretation System) tool or not. In the 21st century, translation and interpretation are complex professions that require adaptability and diverse abilities to navigate globalization. Technical and non-technical factors influence translation continuity, with technical factors like sound systems and lighting affecting quality. Training programs for translators and interpreters have emerged, with certification being a key requirement for recognition.

Abstract

Dialog ini menyelidiki hubungan antara inovasi dan kepatuhan yang sah dalam lingkungan yang sah secara sosiologis. Masyarakat telah memanfaatkan inovasi sebagai alat untuk mengatasi tantangan dan mencari kenyamanan dalam taraf hidup. Kemajuan mekanis, yang sejalan dengan dorongan dalam sains, telah mengubah cara kita menciptakan dan mengubah inovasi menjadi divisi generasi yang menghasilkan produk dan layanan berteknologi tinggi. Bagaimanapun, kemajuan teknologi juga membawa tantangan yang belum dimanfaatkan, seperti depresi yang meluas dan pengurungan sosial, serta dampak negatif pada kesejahteraan mental dan hubungan antarpribadi. Ilmu pengetahuan manusia, sebagai ilmu yang mempertimbangkan hubungan antara manusia dan lingkungannya, merupakan kunci untuk memahami pengaruh inovasi terhadap masyarakat. Ilmu Hukum Manusia, yang menganalisis simbiosis mutualisme antara hukum dan masyarakat, dapat berupa bidang ilmu pengetahuan yang signifikan dalam menghadapi tantangan-tantangan ini di masa maju. Ini menanyakan tentang metode penelitian subjektif ketenagakerjaan, berpusat pada pengumpulan informasi melalui pertimbangan tertulis dan pemeriksaan yang jelas. Diskusi tersebut mencakup tantangan hukum yang muncul di era komputerisasi, seperti perlindungan dan kebebasan dari bahaya informasi, kelimpahan mental dalam komputerisasi, kejahatan dunia maya, dan arah ekonomi berbagi. Penelitian ini juga menyelidiki strategi-strategi yang dapat diambil beberapa negara untuk menanggulangi tantangan-tantangan ini, serta saran-saran sah dan moral yang muncul dalam menghadapi kemajuan teknologi. Prosedur yang diusulkan mencakup perubahan pada kontrol dan undang-undang, penerapan standar sah yang relevan dalam pengaturan inovasi, dan bagian dinamis dari keluarga, sekolah, komunitas, dan negara dalam mengatasi dampak negatif dari alat penggerak mekanis. Dengan kesadaran dan partisipasi, diyakini era masa depan akan lebih cerdas dan gagah dalam menghadapi tantangan inovasi.

Abstract

Despite its abundance of cultural and natural resources, the Special Region of Yogyakarta continues to grapple with poverty. A significant portion of the population in Yogyakarta continues to experience poverty and has not yet completely reaped the advantages of the special autonomy along with its regulations. This study seeks to investigate the issue of poverty and evaluate the efficacy of special autonomy and regulations. A descriptive qualitative method was employed using a desk study to analyze literature from scientific journals, books, and online sources. The findings indicated that the use of special funds and restrictions has not yielded complete efficacy in mitigating poverty. Enhancing collaboration between the government and the community is necessary, and legislation should be tailored to local knowledge and practices. Efforts should be made to enhance the management of dedicated funds with a specific focus on enhancing human resources so as to achieve a more efficient reduction of poverty.

Abstract

The term “buzzer” was initially employed in business marketing to promote a product or service by initiating a broader discourse and increasing popularity and sales. However, the function of buzzers has evolved from business to politics, where they are utilized by politicians for political campaigns and maintaining power. This article endeavors to propose a novel concept for contemporary Indonesian political buzzers. The new concept is introduced with the term “Neofeudalistic Buzzers.” The term “Neofeudalistic” is derived from the characteristics of the actions of political buzzers who attack critics of the government and its officials, which resembles the practice of feudalism in the era of precapitalism. This conceptual article has identified that the use of buzzers in Indonesian politics has become a significant propaganda tool. Furthermore, it has been found that government-supporting buzzers are often involved in intimidating government critics. The actions of government-supporting buzzers can discredit freedom of speech and create fear among people who are critical of the government. Theoretically, neofeudalistic buzzers add a new vocabulary to the politics of citizenship studies. Meanwhile, neofeudalistic buzzers can provide practical insights for policymakers and democracy activists to regulate and supervise the activities of political buzzers.

Abstract

This research aims to identify the structure of post-modifier noun phrases and analyze translation techniques of post-modifier noun phrases in ‘The Frog Prince’ subtitles that translated by EFL learners. This research is a descriptive qualitative method to compare the uses of translation techniques of post-modifier noun phrases translation between A class students and B class students of English Literature at STIBA Invada.  This research used the theory of post-modifier noun phrases based on Aarts (2001) and translation techniques are proposed by Molina & Albir (2002). Then, the technique of collecting data is document analysis. The findings of this research show that there are 4 data of post-modifier noun phrases found in ‘The Frog Prince’ subtitles. Next, there are 4 translation techniques are applied by the A class students and B class student including established equivalent, adaptation, discursive creation, and reduction generally. It can be concluded that translation techniques that we chose between A class student and B class students can influence the meaning and form (structure) of post-modifier noun phrase from source language into target language.

Abstract

E-commerce is believed to have enormous potential to develop business volume in cyberspace. Apart from the many benefits felt by the public, the emergence of e-commerce transactions also creates problems. One of the problems that consumers often experience is that the goods ordered do not match the catalog photos in the e-commerce application. The problem that will be discussed in this research is how legal protection is for consumers for seller defaults in buying and selling transactions in e-commerce and the resolution of defaults for parties in buying and selling transactions in e-commerce. This research uses an empirical juridical approach where the data used is primary legal material and secondary legal material. Data was collected using the literature study method which was then analyzed qualitatively. From the research results, it is known that legal protection for consumers due to defaults committed by sellers can be found in Law Number 8 of 1999 and Law Number 11 of 2008. Apart from that, it can also be seen that the resolution if a business actor commits a default is that the consumer is entitled to receive responsibility in the form of compensation for defaults committed.

Abstract

Aceh is known for its culture, which is closely related to Islamic laws. Islamic law itself developed in Aceh since the beginning of the entry of Islam into the archipelago, which began with the kingdom of Samudera Pasai. Since then, Islamic law has become the basis for the norms and rules of law that apply to the land of Rencong, which ultimately affects the life of society in Aceh. This foundation has become the motto and philosophy of life of the Acehnese people in the westernmost province of Indonesia, namely “hadih madja, adat ngon syari'at lagee dzat ngon sifeut” which means that sharia law and adat are like substance and nature. The customs and culture of the Acehnese people are diverse and correspond to the ethnic sections of each region in Aceh. This diversity reflects the richness and ethnic diversity of the Acehnese population. Customary law, in line with the implementation of Islamic Law applied in Aceh, has transformed into a unifying and adhesive in the structure and parts of the life of the Acehnese community, which in turn can serve as capital in the development structure in Aceh. Therefore, the joints and values of Aceh's customs and culture must be preserved, empowered, and cared for in the frame of unity and unity of social life towards the end of Aceh's special autonomy in 2027. This study discusses the perspective and role of customary law in Aceh, the definition of adat and customary law in terms of terminology, and the history of the application of adat and customary law in Aceh.

Abstract

Dispute can occur in medical practice if patient(s) feel their interests are being damaged or they received results not as expected. This study is a normative, qualitative research using secondary data on dispute resolution in accordance to Act Number 17 Year 2023 on Health, compared to before the Law was enacted. According to the Act, patients or their representatives who felt aggrieved can report the doctor(s) to Professional Disciplinary Council, to the authorities for suspected criminal act, and/or to the court for civil act violation. The Council’s recommendation that states there is a violation on current standards is required for criminal investigation to proceed, and for civil lawsuit to go to court. Such requirement is nonexistent in Act Number 29 Year 2004 on Medical Practice. This could be observed in the case of dr. Dewa Ayu Sasiary Prawan, et al in 2010 where patient Mrs. Julia Fransiska Makatey that they treated was deceased. They were found not guilty in district court, sentenced to imprisonment in Supreme Court cassation, and finally ruled not guilty in Supreme Court judicial review verdict because no proven standard violations. Learning from this, such Council that has utmost integrity and works profesionally is needed for a fair dispute resolution.
