Abstract

This article discusses the conflict between Imam Syafi'i's opinion and the Law. No. 1 of 1974 concerning triple talaq. Imam Syafi'i is of the opinion that triple talaq cannot be referred to again, whereas the law and KHI provide confirmation that divorce only occurs in front of a court hearing. In conducting this research, the author used a type of library research where the types and sources of data used were primary and secondary. Primary data consists of scientific work that is directly related to the main research theme, while secondary data is supporting data. After carrying out a long process, the results of this research show that Imam Syafi'i's opinion regarding Ba'in Qubro talak is not relevant for use in Indonesia, because in reality its implementation uses the basis of law. No. 1 of 1974 and the Compilation of Islamic Law, which clearly explains that there is no legal power for people who have triple divorced outside of court, even though they have been triple divorced, there will still be mediation efforts to reconcile, according to the orders of the Law. No. 1 of 2016 concerning mediation and the divorce pledge only exists before the court.

Abstract

This research is driven by the disparities in the eradication of violence against women as outlined in Law Number 12 of 2022, which pertains to Criminal Acts of Sexual Violence (UU-TPKS), and the teachings of Imam Syafi'i. The research methodology employed is library research, utilizing primary and secondary sources as data sources. Primary data is derived from scholarly sources that are directly relevant to the central topic, such as articles, newspapers, books, and scientific journals. Secondary data refers to additional data that complements and supports primary data. After conducting extensive investigation, the author discovered many findings: Law no. 12 of 2022 was enacted to safeguard the rights of those who have experienced sexual violence, as such crimes frequently manifest in society as physical, psychological, and sexual abuse. In addition to overseeing the enforcement of criminal penalties, such as monetary fines. Furthermore, Imam Syafi'i strongly highlighted that Islamic law unequivocally forbids any and all manifestations of sexual aggression. According to Shafi'i scholars, sexual assault can be penalized with Qishash, diyat, and ta'zir, depending on the specific offense

Abstract

This article explores the oral interpretation of amar makruf nahi mungkar from the perspective of ḥabā`ib in Pontianak City, West Kalimantan. The study is qualitative in nature and adopts a field research model with descriptive-analytic data analysis. The findings suggest that local ḥabā`ib interpretations of amar makruf nahi mungkar can be classified into two groups: those that specifically focus on Quranic texts containing the phrase, and those that interpret verses of the Quran without the phrase. The discussion of the term ‘munkar’ predominantly revolves around issues relating to Muslim and non-Muslim leaders, the criminalization and humiliation of ulama, and LGBT-related cases. The oral tradition plays a crucial role in shaping the interpretation of ḥabā`ib, which is characterized by three key aspects: a) a focus on local issues, b) an agonistic tone, and c) conservative or traditionalist views. These characteristics have a significant impact on the interpretation of amar makruf nahi mungkar by ḥabā`ib, resulting in an interpretation that differs from that found in traditional interpretation literature.

Abstract

This article aims to analyze the development of Nagham in Indonesia by taking the historical context and discourse on its implementation. This study is more popularly known as style, even though the essence of the object is the same, namely about the melody or rhythm of reading the Al-Qur'an. This article uses a qualitative method by explaining it descriptively-analytically from document data. This article finds that the development of nagham in Indonesia cannot be separated from the articulation of the command to read the Al-Qur'an in a beautiful voice. Beauty itself is born from elements of art that are related to beauty and communal culture. As for the history in Indonesia, the development of this science also received support from the government through MTQ activities, universities that concentrate on this science such as PTIQ, IIQ, and others. Meanwhile, the implementation discourse is still being debated regarding the use of non-Arabic styles. Although this debate will gradually reach its own meeting point. This article also provides input related to government policy in accommodating Nagham developments for official events such as MTQ, etc. Without interfering with majority-minority views, because that is part of the development of the art of reading the Al-Qur'an.

The author collected data in the field using three techniques: observation, interviews, and documentation. These three strategies generate primary sources. Meanwhile, secondary sources include scholarly publications such as journals, dissertations, scientific periodicals, and survey findings. After completing research, the author discovered that religion was politicized in East Lombok Regency through the use of religious symbols such as the imamah and white peci as traditional apparel that represents piety. Politicians also employ the narrative of friendship, politics as a platform for da'wah, ukhuwah Islamiyah, piety, and sami'na wa atho'na to politicize religion. Aside from that, their identity as a Tuan Guru is also used on pamphlets, billboards, stickers and even on ballot papers.

Abstract

The dilemma of applying DSN-MUI fatwa with the fatwa of teachers in the community on the application of sharia economic law is caused by many factors. This study uses a qualitative approach with socio-legal study methods to analyze the dilemmas of DSN-MUI fatwa and Tuan Guru's fatwa in sharia economic law. The implementation of the DSN-MUI fatwa received rivalry from local religious leaders not to look for weaknesses but to find common ground between the two. At the local level, the authority of Tuan Guru has great influence in determining the legal practice of sharia economics. The difference in interpretation between the DSN-MUI fatwa and the Tuan Guru fatwa often raises dilemmas, especially in the practice of people's economic life. The dilemmatic fatwa is a challenge for the existence of DSN-MUI fatwa because the legal determination taken by the teacher is considered more authoritative and based on strict prudence.
