Abstract

This research aims to analyze criminal law enforcement policies in combating cyber gambling offenses in Indonesia. Through a normative legal approach and qualitative research, this study refers to legal norms found in legislation and relevant literature materials. The research findings indicate that law enforcement policies in combating cyber gambling offenses require the codification and unification of legal fields, as well as the development of new legislation. These legal instruments are crucial in supporting development in various sectors, in line with the demands of development, legal awareness, and societal perspectives on behavioral assessments. The application of criminal sanctions against perpetrators of gambling offenses utilizes the general minimum and specific maximum systems. However, within this framework, judges do not have full discretion in determining the appropriate type of punishment for the offenders. Instead, they must adhere to the criminal penalty provisions established in the legislation. In conclusion, regulating cyber gambling offenses within the legal framework in Indonesia requires an improvement in the quality and quantity of investigators specializing in Information Technology and Electronics (ITE) at both the National Police Headquarters and Regional Police Offices. Investigators face challenges in identifying online gambling agents who use false identities and effectively apprehending and detaining offenders.

Abstract

The purpose of this study is to ascertain and evaluate the legal viability of the power of attorney to sell from the Sale and Purchase Binding Agreement used by the power of attorney to transfer ownership rights to land after the power of attorney's death. It also seeks to determine and evaluate the power of attorney to sell's validity period. Because this legal study employs normative-empirical techniques, it comprises of both field research—that is, research that is conducted directly on the ground to gather primary data—and literary research—that is, research that involves document studies to gather secondary data. The data that has been collected is qualitatively examined, i.e., issue solving is produced by merging the two data. This study reveals that even though the power of attorney to sell technically no longer exists due to the Sale and Purchase Binding Agreement (PPJB), its use is restricted by the land office's systems, such as the electronic checking system that verifies the identity of the authorizer during the registration process. To protect the interests of the buyer who had paid off all his obligations at the time of signing the PPJB, the power of sale does not specify the specific duration of validity and is only valid until the power of attorney is used. This allows the buyer to process the transfer of land rights at the Land Deed Making Office (PPAT) at any time after the ongoing processes have been finished

Abstract

Gold jewellery is one essential art form by which the people of Asante express their sociocultural identity and distinctiveness. It is perceived however that this heritage is being eroded in recent times through the rhythm of globalization. This study provides empirical evidence on the persistence or otherwise of the sociocultural significance of gold jewellery in Asante. The study employed the explanatory design approach. Data was obtained from a total of 198 respondents comprising traditional rulers, goldsmiths and the general public through the use of questionnaire designed in open and close ended patterns and personal observations. The statistical package for the social sciences (SPSS) computer package was used for data analysis, whilst descriptive statistical tools such as frequency and percentage were used to analyze the facts sought from the questionnaire. The study observed that a lot of myths that surrounded gold jewellery have been demystified as a result of education, religion, trade liberalization, ICT and the current political dispensation which gives people the right of choice and makes it difficult to control production, designing and sale of products. While this trend of change is of great significance to national building, on the other hand it offsets the preservation objective of the Asante culture, by which the Asante historical culture may lose its value.

Abstract

Siri' na pacce' has lived, developed, and is believed to be a cultural value of the people of South Sulawesi. Siri' na pacce' culture has an important role in maintaining civil society. In society, there is a growing perception that this culture is starting to be abandoned and forgotten due to deviations that occur and external influences that eliminate its existence. This research aims to identify efforts to preserve siri' na pacce' culture through re-actualization, based on considerations such as supporting and inhibiting factors, culture dynamics, development trends, and the sense of urgency. This research uses a qualitative methodology and library research. Re-actualization is carried out with a collaborative approach between various parties using the penta helix model. Based on the analysis, siri' na pacce' has an important role in building community knowledge so it needs to be preserved. Preservation efforts are carried out by re-actualization by involving the government as a regulator, academics acting as drafters, business actors as presenters of economic markets with community participation, the community as intermediaries, providing input, and maintaining cultural values, and the media as a means of promotion to carry out preservation efforts.
