Abstract

The development of information technology has driven bureaucratic reform in various sectors of public service, including the field of immigration. One innovation by the Directorate General of Immigration is implementing the Molina application (Residence Permit and Immigration Status Service Module), which aims to simplify the residence permit service process for foreigners in Indonesia. However, the implementation of this application still faces various challenges, both from legal, technical, and social aspects. This study aims to analyze the legal framework and implementation of the Molina application and evaluate the extent to which it can provide legal certainty in residence permit services, particularly at the Special Immigration Office Class I TPI Batam. The research methods used are normative and empirical juridical, emphasizing statutory and sociological (socio-legal) approaches. Data was obtained through literature review and field research through interviews with immigration officers and service users. The analysis was conducted using responsive law theory (Philippe Nonet & Philip Selznick) as the grand theory, legal system theory (Lawrence M. Friedman) as the middle theory, and the theory of legal certainty (Sudikno Mertokusumo) as the applied theory. The results show that, normatively, the Molina application has not yet been fully supported by precise and uniform technical regulations, which have the potential to create legal uncertainty in its implementation. In terms of implementation, the application has improved efficiency but still faces obstacles in technical aspects, human resource readiness, and a legal culture that does not yet provide optimal support. Therefore, it is recommended that the government and relevant agencies update regulations, provide human resource training, and educate the public to realize a digital-based immigration service that is reliable, fair, and sustainable.

Abstract

The development of digital technology in immigration services has driven the modernization of inspection systems through the use of autogates, an automated system that processes biometric data to verify the identity of travelers. However, the use of this technology raises legal issues related to the protection of personal data, especially in the context of compliance with Law Number 27 of 2022 concerning Personal Data Protection (PDP Law).This study aims to analyze the legal regulations and assess the effectiveness of personal data protection implementation in the autogate system at the Class I Special Immigration Office TPI Batam.The research method used is a normative juridical and empirical juridical approach, with data collection techniques through literature review, interviews, and field observations. A sociological approach to law is employed to assess the awareness and compliance of officers and users regarding the right to privacy in the practice of using the autogate. The results of the study show that, normatively, the legal regulations for personal data protection are already adequate, but they have not yet been specifically implemented in the governance of autogate usage at immigration checkpoints. At the implementation level, various technical, legal, and sociological obstacles were found, such as limited understanding of the Personal Data Protection Law by officials, the absence of specific SOPs, and low public awareness of their rights as data subjects. Recommendations include the need to formulate technical regulations that integrate the principles of the Personal Data Protection Law into the operations of the autogate system, regular training for immigration officers on personal data protection, and public education to increase legal awareness regarding the use of technology-based immigration services.

Abstract

The Visa-Free Visit Policy (BVK) granted to foreign nationals (WNA) holding Singaporean Permanent Resident (PR) status, as stipulated in Presidential Regulation No. 95 of 2024, is part of the national strategy to encourage foreign tourist visits to Indonesia, including to Batam City as a strategic border region. However, this policy also has significant legal implications for security stability and local economic dynamics. This study aims to analyze the legal arrangements of the BVK-PR policy, its implementation in the field, and its impact on the security and economy of Batam City. The research methods used are normative legal and empirical legal, with a regulatory and sociological approach. Data was obtained through legal document studies and interviews with immigration officials, police, customs, and the Batam City Government. The theories used include John Rawls' Theory of Justice (grand theory), Lawrence M. Friedman's Theory of the Legal System (middle theory), and Sudikno Mertokusumo's Theory of Legal Certainty (applied theory). The research findings indicate that while the BVK and PR policies contribute to increased tourist mobility and economic activity, they also result in a decrease in state revenue from the visa sector and an increase in security risks such as smuggling and human trafficking. Implementation challenges were identified in the areas of ambiguous norms, weak oversight, and low legal awareness among the public. It is recommended that the BVK policy be revised with a selective approach, accompanied by strengthening inter-agency oversight structures, and legal education for local communities to maintain a balance between economic benefits and national security protection.

Abstract

Data forgery in passport management is a form of crime that has serious implications for the integrity of the immigration system and national security. The Class I Special Immigration Office TPI Batam, as one of Indonesia’s international gateways, is highly vulnerable to identity abuse by individuals or organized networks.This study aims to analyze the legal regulations governing sanctions against data forgery offenders, assess the effectiveness of their implementation in the field, and identify obstacles as well as formulate solutions that immigration officials can undertake to address these issues. This study employs normative juridical and empirical juridical research methods, using statutory and sociological (socio-legal) approaches. Data were obtained through literature reviews of regulations such as Law Number 6 of 2011 on Immigration, Government Regulation Number 31 of 2013 and its amendments, as well as Minister of Law and Human Rights Regulation Number 8 of 2014 in conjunction with Minister of Law and Human Rights Regulation Number 18 of 2022, and combined with interview results and field observations involving officials and the community at the Batam Immigration Office. The research findings indicate that although legal norms regarding the enforcement against data forgery have been formally established, the effectiveness of their implementation is still hindered by internal factors such as limited human resources, technology, and officer competence, as well as external challenges such as increasingly complex crime modes and weak inter-agency coordination. Law enforcement has also not fully reflected substantive justice nor been responsive to the social dynamics of the community. Therefore, it is necessary to strengthen institutional capacity, integrate national data systems, and enhance public legal literacy as more effective preventive and repressive measures in the future

Abstract

This study aims to analyze the influence of employee competence, management information systems, and participative leadership on employee performance at the Public Works, Spatial Planning, and Land Agency (PUPRP) of the Riau Islands Provincial Government, with organizational commitment as a mediating variable. The research is motivated by the strategic role of PUPRP in infrastructure development and spatial planning, which requires optimal employee performance. The study employs a quantitative approach with data collected through questionnaires distributed to civil servants within the agency. The analysis uses Structural Equation Modeling (SEM) to test both direct and indirect effects of the independent variables on employee performance. The results indicate that employee competence, management information systems, and participative leadership significantly influence employee performance. Furthermore, organizational commitment partially mediates the relationship between these variables and employee performance. The findings highlight the importance of enhancing employee competence through continuous training, optimizing management information systems, and implementing participative leadership to improve organizational performance. These results provide practical recommendations for government institutions to develop strategies that strengthen organizational commitment and foster sustainable performance improvement.

Abstract

The Regional Revenue Agency (BAPENDA) of Batam City plays a strategic role in supporting regional revenue through tax and fee management. However, employee performance in recent years has shown a discrepancy between targets and actual results, influenced by various internal organizational factors such as discipline, organizational culture, competence, and employee commitment levels. This study aims to analyze the influence of discipline, organizational culture, and competence on employee performance through organizational commitment as a mediating variable. The study uses a quantitative approach with the Partial Least Square (PLS) method. The results show that discipline, organizational culture, and competence have a significant direct effect on performance and organizational commitment. Organizational commitment also has a significant effect on employee performance. The indirect influence of organizational culture and discipline on performance through commitment is insignificant, while competence has a significant influence through commitment. These findings emphasize the importance of improving competence and strengthening organizational commitment in supporting employee performance. The results of this study are expected to serve as a basis for the management of BAPENDA Kota Batam in formulating strategies to improve the quality of human resources to support more optimal public services.

Abstract

Marriage is a legal act that has legal consequences for both husband and wife and for the status of children. Marriage registration, as regulated in Law Number 1 of 1974 concerning Marriage in conjunction with Law Number 16 of 2019 and Law Number 23 of 2006 concerning Population Administration in conjunction with Law Number 24 of 2013, is crucial to ensure legal certainty and protection. However, in practice, some marriages are not promptly registered, leading to legal issues, one of which is the case of late marriage registration validation, as decided in Decision Number 24/Pdt.P/2023/PN Tpg at the Tanjungpinang District Court. The purpose of this study is to determine and analyze the judge's legal considerations in granting requests for late marriage registration validation, examine the legal consequences of these decisions on marital status and the status of children, and identify obstacles and solutions to implementing late marriage registration validation. This study employed a normative-empirical legal research method with statutory, case-based, conceptual, and sociological-empirical approaches. Data were obtained from legislation, doctrine, court decisions, and interviews, then analyzed qualitatively to assess the consistency of the application of legal norms in judicial practice. The results show that the Panel of Judges, in Decision Number 24/Pdt.P/2023/PN Tpg, granted the applicant's petition, considering the fulfillment of formal and material requirements according to civil procedural law, and for the sake of legal certainty. The decision affirmed that a valid marriage according to religion can still obtain formal legality through late registration with court permission. In conclusion, the validation of late marriage registration provides legal protection for the legal status of husband, wife, and children. The author recommends that the public be more disciplined in registering marriages from the outset, and that the government improve public awareness and marriage administration services to prevent similar cases in the future.

Abstract

Globalization has driven an increase in the intensity of international business cooperation involving various cross-border entities. In this context, international cooperation agreements play a crucial role as legal instruments capable of regulating relations between parties and mitigating potential disputes. Batam City, as a strategic free trade and free port area (KPBPB), plays a vital role in supporting cross-border business cooperation. However, in practice, the drafting of international cooperation agreements faces complex challenges in terms of regulation, implementation, and harmonization of the legal system. This research focuses on three main research questions: how the drafting of international cooperation agreements is regulated in Indonesia, how the drafting of international cooperation agreements is implemented, specifically in Batam City, and the obstacles and solutions encountered in drafting such international cooperation agreements. These three aspects are examined to understand the extent to which national and local legal systems can anticipate and facilitate the need for equitable and effective cross-border cooperation. The research methods used are normative juridical and empirical. Data were obtained through a literature review of legal regulations, doctrines, and theories, as well as fieldwork through interviews with notaries, legal practitioners, and relevant agencies in Batam City. This research employed a descriptive-analytical approach with qualitative analysis to describe the reality of legal practice and evaluate the effectiveness of drafting international cooperation deeds. The results indicate that regulations for drafting international cooperation deeds in Indonesia are not yet specifically regulated, leading to differing interpretations in the field. Implementation in Batam City still faces limited human resource capacity and a lack of synchronization between government agencies. The main obstacles include differences in legal systems, language, and a lack of international contract drafting standards. Therefore, it is recommended that the government develop comprehensive technical regulations, increase training for notaries, and strengthen cross-agency coordination to create legal certainty and prevent disputes in international business cooperation.

Abstract

Land sale and purchase transactions are a form of agreement that plays an important role in the Indonesian agrarian legal system and requires legal certainty and protection for the parties involved. However, in practice, there are still many cases of land sale and purchase cancellations due to legal defects, such as document forgery, overlapping ownership, legal subject invalidity, or procedural violations. These legal defects not only harm the buyer and seller, but also give rise to liability for the notary as the maker of the authentic deed. This study aims to analyze the legal regulations, implementation, obstacles, and solutions related to the cancellation of land sales due to legal defects from the perspective of protecting the rights of the parties in notarial deeds. This study uses a normative juridical and empirical juridical approach. Data was obtained through a literature study of laws and regulations as well as field studies through interviews with notaries, land officials, and parties who had been involved in the cancellation of land sales in Batam City. The research was analyzed using positive law theory (John Austin), legal system theory (Lawrence M. Friedman), and legal certainty theory (Sudikno Mertokusumo). The results of the study show that although legal regulations are available in theory, the implementation of legal protection for the parties still faces serious challenges, especially in terms of the verification of document validity by notaries, the weak land administration system, and the lack of inter-agency integration. It is recommended that the government strengthen the digitization and supervision systems for notarial and land practices, as well as improve the legal literacy of the community in conducting land transactions so that legal protection can be guaranteed in a fair and proportional manner.

Abstract

The contribution of the Karimun Regency Transportation Agency in efforts to increase local revenue in the parking service program for 2023 to 2024 was not realized as targeted, due to problems in handling complaints receiving the lowest score in the SKM and there were significant differences in the achievement of targets in each location zone and at each parking time. Furthermore, the parking management supervision system by the Transportation Department has not been optimally implemented across all areas. This mixed-method research is limited and focused on examining the influence of location zones, time, and supervision with complaint handling as an intervening variable on the effectiveness of parking management. It is concluded that supervision and complaint handling have a significant effect on the effectiveness of parking management, while location zones and time are not significant. Furthermore, location zones and supervision have a significant effect on complaint handling, but time does not. Furthermore, complaint handling is able to significantly intervene in the effect of location zones and supervision on the effectiveness of parking management, but it is not able to significantly intervene in the effect of time on the effectiveness of parking management. It is recommended that the Karimun Regency Transportation Agency optimize officer responses to parking-related issues and balance the duration of vehicle parking with the fees that must be paid by the public.
