Pada prinsipnya tersangka atau terdakwa yang menghadapi proses hukum dalam perkara pidana akan bersebrangan kepentingan hukum dengan negara melalui para penegak hukumnya. Untuk melindungi hak-haknya dalam proses tersebut, sistem hukum memberikan perlindungan melalui hukum acara, salah satunya adalah hak bagi tersangka atau terdakwa untuk didampingi oleh penasehat hukum dalam menjalani proses peradilan pidana. Bahkan pada perkara-perkara dengan ancaman hukuman tertentu penunjukan seorang penasehat hukum guna mendampingi pembelaan tersangka atau terdakwa adalah wajib sifatnya, sebagaimana dinyatakan dalam Pasal 56 ayat (1) dan ayat (2) KUHAP

Feminist Legal Theory is a legal theory that was born during the second wave of the feminist movement in America. The main object of study of the Feminist Legal Theory (FLT) is criticism of patriarchal and discriminatory legal products. Legal products in Indonesia are not immune from such problems, even though the constitution has mandated in Article 27 paragraph (1) of the 1945 Constitution which confirms that every citizen has the same position before the law. However, there are several articles or verses that are enigmatic and not in favor of women. The purpose of this study is to analyze law in Indonesia, especially criminal law with the study of Feminist Legal Theory to find out how far criminal law accommodates justice for women. In addition, it can also be seen where the problem of injustice for women is in the formulation of criminal law in Indonesia. This study uses a normative legal research method with the approach used in solving the problem is a statutory approach (statute approach) and conceptual (conceptual approach). The results of this study indicate that although there are problems in the Criminal Code as a positive law in Indonesia, the presence of the TPKS Law is able to provide justice for women in handling and protecting criminal acts of violence against women.

Today's child crime has grown rapidly and is heavily influenced by technological developments. Various kinds of child crimes are problematic with the law so that the swift advancement of information technology presently holds a beneficial influence on society by easily obtaining the information needed and has a negative impact because there is a lot of misleading information circulating and websites, pornographic sites. So that children who are just about to grow up or teenagers will feel curious and will most likely take actions beyond reason. So legal action is needed to safeguard minors from the impact of the conventional judicial proceedings granted to offenders of such offenses, thereby allowing the criminal justice system to prosecute the culprits of sexual assault, it is necessary to do a better alternative justice for children. However, it must be balanced for the victims as well, so that the alternative referred to as "diversion" or what is referred to as restorative justice does not feel shielded.

This research examines the importance of regulating Non-Conviction Based Asset Forfeiture (NCB) in corruption cases in Indonesia. NCB is a mechanism of asset forfeiture that allows the state to seize assets without a prior criminal conviction. The study argues that the regulation of NCB is necessary to ensure the effectiveness of asset recovery in corruption cases and to prevent abuse of power by law enforcement agencies. The research uses a qualitative approach and analyzes relevant laws and regulations, court decisions, and academic literature. The findings suggest that the current legal framework for NCB in Indonesia is inadequate, leading to the misuse of NCB by law enforcement agencies. The research recommends the enactment of a specific law on NCB in corruption cases that provides clear criteria and safeguards for the use of this mechanism.

International law plays a crucial role in the lives of the international community. Its role is essential in the current era of globalization to bridge any existing issues. Through international legal provisions, states prevent disputes from arising and settle those that have already occurred. In practice, international trade is often equated with exports and imports. Considering the increasingly complex processes of export and import, it would be challenging to apply the regulations of only one country. That is why international law exists, to provide solutions in minimizing differences in regulations between parties. The processes of unification and harmonization of laws come into play. The research questions in this study are: What is the role of international law in regulating exports and imports in Indonesia, and what is the influence of export-import activities on Indonesia's national economic growth? The research method used is normative juridical with a descriptive-analytical research specification. From the results of this study, the following conclusion is obtained: The legal aspects of international trade agreements for exporting and importing goods in Indonesia involve contractual aspects in accordance with the Civil Code Book III on obligations and principles of international law regulated in the Vienna Convention of 1986 and UNIDROIT on the harmonization of international civil law. Meanwhile, the organization of exporting and importing goods follows the provisions issued by the Indonesian government regarding export-import payment procedures and implementation methods in accordance with foreign exchange laws.

The unconstitutional dismissal of Aswanto as a constitutional judge by the DPR has faced much opposition from legal scholars. The actions of the DPR stem from its inherent authority as an institution that can propose three constitutional judges. Therefore, the DPR believes that as a proposing institution, it can oversee and dismiss constitutional judges during their term, which is not part of its authority. The mechanism of selecting constitutional judges with the three-branch model of government has caused problems and confusion in the constitutional law. This article will focus on discussing the Quo Vadis of the legal politics of filling the position of constitutional judges, which comes from the three branches of government and the reconstruction of the mechanism for filling the position of constitutional judges in the future. This research has produced several discussion points, including: (1) the legal politics of filling the position of constitutional judges by the three branches of judicial power, which is a reflection of the checks and balances, has been misused by the DPR as an instrument to weaken the body of the Constitutional Court, especially the independence of constitutional judges. (2) The reconstruction of the institution proposing constitutional judges can be carried out by the Judicial Commission by aligning the proposing institutions of the Supreme Court and the Constitutional Court.

Idealitasnya dasar pertimbangan hakim dalam penetapan dispensasi pernikahan di bawah umur ini sesuai dengan Undang-Undang No. 16 Tahun 2019 yaitu membatasi usia pernikahan minimal 21 Tahun untuk usia pria dan 19 Tahun untuk usia wanita. Pernikahan menurut Undang-Undang No. 16 Tahun 2019 adalah ikatan lahir batin antara seorang pria dan seorang wanita sebagai suami dan isteri dengan tujuan untuk membentuk keluarga (Rumah Tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Rumusan masalah Faktor-faktor Penghambat untuk memberikan dispensasi kepada perkawinan di bawah umur menurut Undang-Undang NO. 16 Tahun 2019 tentang perkawinan?. Penelitian ini menggunakan metode pendekatan empiris. Kesimpulan yang kami ambil di penelitian ini adalah Adapun faktor-faktor penyebab dari peningkatan kasus tersebut adalah hamil diluar nikah, lemahnya pendidikan agama, faktor budaya, faktor ekonomi, faktor media sosial, khawatir timbul fitnah, faktor perubahan UU usia perkawinan. Dari banyaknya kasus yang dikabulkan oleh hakim dengan alasan agar terhindar dari kemudoratannya.

The purpose of this study is to determine and analyze the effectiveness of the application of Article 22 of the Regulation of the Chief of the Indonesian National Police Number 14 of 2011 concerning the Code of Professional Ethics of the Indonesian National Police in the Gorontalo Regional Police and to determine and analyze what factors affect the effectiveness of the application of Article 22 of the Regulation of the Chief of the Indonesian National Police Number 14 of 2011 concerning the Code of Professional Ethics of the Indonesian National Police in the Gorontalo Regional Police. The research used is empirical research. Empirical legal research is conducted by examining directly into the field to see directly the application of legislation or rules of law relating to law enforcement, as well as conducting interviews with several respondents who are considered to be able to provide information regarding the implementation of law enforcement. The application of the Regulation of the Chief of the Indonesian National Police (Perkap) is not yet effective, because from the results of the interview that the Gorontalo Regional Police prioritizes the Circular Letter (SE) rather than the Regulation of the Chief of the Indonesian National Police (Perkap), moreover that the debate regarding the application of legal norms does not only occur among law enforcers in general but within the internal police also becomes a debate caused by the existence of conflicting legal norms between high legal norms and low legal norms. Factors affecting the effectiveness of the application of the article on the Regulation of the Chief of the Indonesian National Police regarding the Police Professional Code of Ethics within the scope of the Gorontalo Regional Police, which is the formulation of the problem in this study, including; 1) Legal Substance, 2) Legal Structure, 3) Legal Culture.

Criminal Policy in criminal law or commonly known as Criminal Police is the attitude of a country in implementing criminal law in a country. The aims of this s study to analyze Development MSME infrastructure through Implementation Regulation President Number 12 of 2021. This Approach Study, is Descriptive Qualitative: Data source: Secretary of Tidore City Islands area, Head of ULP Tidore Islands, Chief Field Cooperative Department of Industry, Trade and Cooperatives . Planning for MSME development in Tidore City Island is not yet appropriate and not unidirectional with Regulation President Number 12 Year 2021.
