Abstract

Pasal 28 Ayat (2) Undang Undang Informasi dan Transaksi Elektronik Tentang Perubahan Kedua Atas Undang-Undang Nomor 11 Tahun 2008 mengatur larangan penyebaran informasi bermuatan kebencian. Namun, terjadi perbedaan penafsiran terkait makna “mentransmisikan” yang masih membingungkan. Tujuan penelitian ini adalah menganalisis penafsiran makna “mentransmisikan” berdasarkan gramatikal, sistematis, teleologis dan autentik. Hasil analisis menunjukkan secara gramatikal, mentransmisikan berarti mengirim informasi dari satu pihak ke pihak lain. Secara autentik, mentransmisikan adalah pengiriman informasi hanya ke satu orang penerima, bukan disebarluaskan. Secara sistematis, teleologis dan sosiologis, mentransmisikan perlu ditafsirkan hanya ke satu orang untuk memberikan perlindungan memadai dan selaras dengan penafsiran secara autentik. Kesimpulannya, mentransmisikan perlu ditafsirkan secara tegas hanya dikirim ke satu orang untuk memberikan kepastian hukum dan mencegah ujaran kebencian melalui dunia maya.

Abstract

The practice of Surrogate Mothers according to Indonesian law gives rise to the problem that Positive Law in Indonesia does not yet recognize provisions regarding renting a womb (Surrogate Mother). This research aims to understand and comprehend Surrogate Mothers according to Indonesian law. This writing uses normative legal research methods with a type of legislative analysis approach (State approach). This research resulted in research that Indonesian law does not have regulations regarding the implementation of Surrogate Mother engagements. According to the provisions of the health law, surrogate motherhood cannot be carried out because of the clear regulations of the health law. Likewise with regulations in the realm of civil law, even though Article 1338 of the Civil Code states that "All agreements made legally apply to the law for those who make them," Article 1320 of the Civil Code provides conditions for the validity of an agreement, one of which is the existence of a halal cause. So that an agreement made must not conflict with legal regulations. So the implementation of Surrogate Mother cannot be implemented.

Abstract

Comparative study of the expiration of mail forgery in Law No. 1/1946 on Criminal Code and Law No. 1/2023 on Criminal Code. This comparative study is intended to understand the differences and similarities of expiration in the prosecution of criminal cases, so that expiration can be a legal instrument that can realize justice for all parties to criminal cases. The method used is normative legal research, normative legal research is also to inventory positive law, find legal principles and doctrines, synchronize existing laws and regulations and conduct research by studying and examining and tracing various existing literature. With several approaches, namely the Legislative Approach, Historical Approach, Comparative Approach and Conceptual Approach. The findings in the results of this study are a comparative study of the expiration of mail forgery, in Law/1/1946 / Criminal Code and Law/1/2023 / Criminal Code it can be concluded that the authority to prosecute a criminal offender can be abolished regulated in Article 78 paragraph (1) of the Criminal Code, regarding Forgery in general is regulated in Article 263 paragraph (1) of the Criminal Code. After the reform of criminal law, the authority to prosecute is declared void due to expiration is regulated in Article 163 of Law No. 1/2023 / Criminal Code, but regarding the explanation of the offense of forgery of letters is contained in Articles 391 and 392 of Law No. 1/2023 / Criminal Code. Comparison of the expiration of mail forgery in the Criminal Code and the New Criminal Code from the aspect of offense formulation and expiration limitation is very different, but there is a similarity in placing the object that can be subject to the crime of mail forgery, namely a person who makes a fake letter and uses a fake letter.

Abstract

Kepartaian yang solid harus mempunyai dua kemampuan. Pertama, aktivitas dan partisipasi melalui jalur partai politik, ini artinya semua aktivitas politik harus melalui jalur kepartaian, semua aktivitas atau partisipasi politik harus melalui partai, sehingga anomali dan kekerasan politik bisa dihindari. Kedua, berkaitan peran partai politik dalam memobilisasi partisipasi politik, partai politik harus mampu memobilisasi partisipasi politik yang datang dari kelompok, sehingga mengurangi tekanan dalam pelaksanaan sistem politik yang ada. Banyaknya partai politik, menunjukkan banyaknya keanekaragaman latar belakangnya budaya dan tradisi anggota partai politik. Rekrutmen kader-kader politik partai politik ini sendiri tentunya diisi oleh kader-kader partai yang didasarkan pada kualitas yang kelak dipersiapkan untuk menjadi pemimpin masa depan. Tidak hanya itu saja, dengan memiliki kader politik yang berkualitas dan berkompeten diharapkan mampu menerjemahkan apa yang menjadi visi, misi dan tujuan partai politik sehingga paham kemana arah gerak partai dan manuver politiknya. Namun, kenyataan di lapangan menunjukkan kesenjangan antara harapan memilih kader yang berkualitas dengan kader yang pragmatis yang hanya sekedar mementingan kepentingan individu dan kelompok, dimana kesenjangan tersebut memungkinkan melahirkan berbagai makna reformasi partai politik. Asumsi seperti ini menarik untuk dibuktikan di lapangan, sehingga memotivasi peneliti untuk melakukan penelitian dengan fokus pada reformasi partai politik yang dimaksudkan untuk turut meningkatkan profesionalitas dari anggota DPR RI di masa depan

Abstract

Penelitian ini bertujuan untuk mengetahui apakah pengaturan penetapan tersangka dalam Peraturan Kapolri Nomor 6 Tahun 2019 Tentang Penyidikan Tindak Pidana sesuai dengan ketentuan dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Penelitian ini menggunakan metode penelitian normatif dengan pendekatan preskriptif. Data yang digunakan dalam penelitian ini adalah data sekunder yang diperoleh dari bahan pustaka, seperti buku, jurnal, dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa terdapat perbedaan penafsiran “bukti permulaan” pada Peraturan Kapolri Nomor 6 Tahun 2019 dan KUHAP yang telah disempurnakan melalui Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 menyatakan bahwa terhadap suatu penyidikan haruslah terdapat 2 alat bukti yang cukup beserta keyakinan penyidik secara objektif untuk memenuhi dalam penetapan tersangka. Namun berbeda dengan ketentuan yang ada dalam PERKAP 6/2019 yang pada proses penyidikan, terdapat SPDP yang memuat identitas tersangka. Hal ini menjadi konflik norma, namun ketentuan yang berlaku pada PERKAP 6/2019 haruslah selaras dengan ketentuan dalam KUHAP.

Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis ratio legis ketentuan pembatasan usia anak dari narapidana perempuan di lembaga pemasyarakatan perempuan pada pasal 62 ayat (1) Undang-Undang Pemasyarakatan Nomor 22 Tahun 2022 . Metode dalam penelitian ini menggunakan penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa hak-hak anak usia dini dari narapidana perempuan belum sepenuhnya terjamin dalam kerangka hukum yang ada. Dalam pengaturan ketentuan perlindungan hukum ini masih belum maksimal dalam menentukan batasan usia anak dari narapidana perempuan. Penelitian ini mengusulkan perbaikan kebijakan pembatasan usia perlindungan hukum bagi anak usia dini dari narapidana perempuan dan memberikan kontribusi terhadap pemahaman yang lebih baik tentang pembatasan usia perlindungan hukum bagi anak usia dini dari narapidana perempuan di lembaga pemasyarakatan.

Abstract

Pursuant to Article 24 paragraph (2) of the 1945 Constitution of the Republic of Indonesia (1945 Constitution of the Republic of Indonesia) it is stated that judicial power is exercised by a Supreme Court and judicial bodies under it within the realm of general courts, religious courts, military courts, state administrative courts and by a Constitutional Court. Based on Article 1 number 8 of Law Number 48 of 2009 Concerning Judicial Power (UU 48/2009) there is a special court that has the authority to examine and hear and decide on certain cases which can only be formed within one of the judicial bodies under the Supreme Court. regulated in laws and regulations. The limitation of judicial institutions as stipulated in Article 24 paragraph (2) of the 1945 Constitution of the Republic of Indonesia does not allow for judicial institutions that are not within the scope of the Supreme Court and/or the Constitutional Court. However, there is a judicial institution, namely the Tax Court as stipulated in Article 2 of Law Number 14 of 2002 concerning the Tax Court (UU 14/2002), which is a judicial body that exercises judicial power for taxpayers seeking justice in tax disputes. Regarding the Tax Court, the guidance is carried out by the Supreme Court and the Ministry of Finance. This makes the tax court not completely independent as a judicial institution in general that carries out a judicial function (there is still interference from the executive branch, namely the ministry of finance), plus that the Supreme Court, in order to be able to fully supervise the tax court both technically and administratively, the tax court should be under the judicial institutions under the Supreme Court. This research is a normative juridical research using statutory and conceptual approaches with the aim of finding an ideal arrangement regarding the institutional structure of the tax court in Indonesia

Abstract

In general, credit extended by banks to customer requires a guarantee (collateral) as Credit is carried out first by agreeing to the clauses in the credit agreement. One of these clauses is Cross Collateral which will have an impact on Cross Default if the debtor defaults. Cross Collateral and Cross Default clauses in credit agreements can potentially weaken and cause injustice to debtors. Abstract

This research aims to examine the judge's considerations in resolving disputes regarding the execution of Supreme Court Decision Number 2553 k/pdt/2016. The research method uses a qualitative approach with a normative juridical research type and library data collection techniques regarding legal sources related to this research, then concluded with deductive analysis. The research results show that the source of law in the judge's consideration refers to statutory regulations, namely Article 6 UUHT which states that executions are carried out without the fiat of the Chief Justice. The decision also took into account the facts presented at the trial and decided that one of the parties had committed an act of breach of contract or breach of contract and that the actions taken by the creditor did not constitute an unlawful act. However, the judge's considerations in this decision did not refer to the general explanation of number 9 UUHT which explains that the execution of mortgage rights is based on the fiat of the Chief Justice. So that the implementation of the UUHT execution still contains confusion and vague diction which results in legal uncertainty.

Abstract

This jurnal explores the significance of boycotting products suspected of supporting genocide within the framework of international law. The complex relationship between human rights, state responsibility to prevent genocide, and the international community's response to violations of international norms is at the heart of this investigation. The study defines boycott as a form of isolation undertaken by individuals or groups against an entity, encompassing actions like blacklisting, embargoes, and blockades, targeting various products from consumer goods to academic and sports products. Governments, either individually or collectively, issue boycott resolutions, as exemplified by Arab countries' historic boycott against Israel. The paper also introduces other forms of boycotts, such as investment withdrawal, divestment, and sanctions, citing examples like Sudan. Framing the discussion within the context of the United Nations Genocide Convention, the jurnal argues that product boycotts can serve as tools for enforcing compliance with the convention, holding states accountable for preventing genocide. Moreover, product boycotts play a vital role in the international public sphere, mobilizing global public opinion and exerting social, economic, and political pressure on perpetrators of genocide. The study addresses critical questions, focusing on the role of product boycotts as sanctions in international law and their impact on garnering global support and pressuring perpetrators, while providing a voice to victims. The research methodology employed is normative legal research, relying on literature review and secondary legal sources, including journals, articles, and news related to the international legal analysis of the boycott of products suspected of supporting genocide. The jurnal concludes by emphasizing the importance of boycotting products suspected of supporting genocide within the international legal framework, not only as a form of protest but as a
