Abstract

Sexual violence against children constitutes a severe violation of human rights, leaving long-lasting impacts on the victims’ physical well-being, psychological state, and social life. This study examines the legal protection afforded to child victims, encompassing preventive measures, law enforcement actions, and post-incident rehabilitation. The research adopts a normative juridical approach, drawing on statutory analysis, literature review, and case examination. The findings reveal that legal instruments such as Law Number 35 of 2014 on Child Protection and Law Number 12 of 2022 on Sexual Violence Crimes provide a comprehensive framework for safeguarding victims. However, practical implementation remains challenged by limited resources, low public awareness, and the psychological barriers victims face in reporting incidents. The study recommends strengthening inter-agency cooperation, enhancing the quality of victim support services, and maximizing the use of technology in case reporting and handling.

Abstract

State control over rivers based on Article 33 of the 1945 Constitution of the Republic of Indonesia affirms the State’s role as regulator, manager, and guarantor of public welfare through water resources governance. Rivers constitute strategic natural resources because they traverse multiple administrative areas and influence ecosystem balance across regions. However, declining river carrying capacity—driven by spatial planning changes, environmental degradation, and uncontrolled human activities—can trigger flooding disasters with significant social, economic, and environmental impacts. Therefore, flood risk management must be implemented in an integrated manner through river and watershed (DAS) policies that address both flood magnitude reduction and vulnerability reduction. This study applies normative legal research using statutory, historical, and conceptual approaches to examine flood management policies in Indonesia. The findings indicate that river governance should be oriented toward sustainability, community participation, and social justice to achieve long-term public welfare.

Abstract

Transformasi digital yang semakin pesat menuntut penerapan ketahanan data sebagai komponen penting dalam keamanan siber dan pelindungan data pribadi. Penelitian ini bertujuan untuk mewujudkan ketahanan dan kepatuhan data melalui harmonisasi strategi backup 3-2-1 dengan kerangka regulasi pelindungan data pribadi di Indonesia. Metode yang digunakan adalah yuridis normatif dengan pendekatan statute dan conceptual approach, serta mengacu pada standar teknis seperti NIST SP 800-34 dan ISO/IEC 27040:2024. Hasil penelitian menunjukkan bahwa kewajiban pengendali data dalam Pasal 35 dan 39 UU PDP sejalan dengan prinsip ketahanan data, tetapi belum dilengkapi pedoman teknis minimum terkait mekanisme pencadangan, frekuensi backup, dan pengujian pemulihan. Ketiadaan standar teknis ini menimbulkan kesenjangan antara kepatuhan normatif dan kesiapan operasional. Temuan lain menegaskan pentingnya sinergi Komdigi, BSSN, dan OJK dalam membentuk ekosistem ketahanan data nasional yang harmonis. Penelitian ini menyimpulkan bahwa integrasi hukum dan teknologi melalui pendekatan Cyber Resilience Governance diperlukan untuk memperkuat kedaulatan data sekaligus memastikan efektivitas implementasi UU PDP. Rekomendasi kebijakan mencakup penyusunan peraturan pelaksana mengenai standar backup nasional, penguatan peran Badan Pelindungan Data Pribadi, serta peningkatan kapasitas teknis institusi publik dan privat.

Abstract

This study examines the binding force of Constitutional Court decisions on administrative regulations issued by the Indonesian National Police, with particular attention to the normative consistency between Police Regulation No. 10 of 2025 and the constitutional meaning articulated in Constitutional Court Decision No. 114/PUU-XXIII/2025. A normative legal research approach is employed through the analysis of constitutional norms, the hierarchy of laws and regulations, doctrines of constitutional and administrative law, and constitutional adjudication. The analysis demonstrates that Constitutional Court decisions possess substantive binding force, requiring the internalization of the ratio decidendi as a normative standard in the formulation of implementing regulations. Normative inconsistency between police regulations and constitutional standards risks generating vertical normative conflicts, undermining constitutional supremacy, and weakening the principles of the rule of law and constitutional democracy

Abstract

This study analyzes that criminal law in Indonesia is fundamentally governed by the Criminal Code (Kitab Undang-Undang Hukum Pidana/ KUHP) as the primary legal framework that defines criminal acts and determines the sanctions that may be imposed by the state. The central principle within this criminal law system is the Principle of Legality, as stipulated in Article 1 paragraph (1) of the KUHP, which affirms that no act may be subject to criminal punishment without a prior statutory basis. This study aims to examine the regulation of criminal cases under the KUHP and to analyze the implementation of the Principle of Legality in the practice of criminal law enforcement in Indonesia. The research employs a normative legal method using statutory, conceptual, and doctrinal approaches to examine relevant legal norms and principles. The Principle of Legality plays an important role in ensuring legal certainty, protecting human rights, and preventing arbitrary actions by law enforcement authorities. However, its implementation faces challenges, particularly in responding to the development of new forms of crime that are not explicitly regulated in the KUHP. Therefore, this study emphasizes the importance of continuous and adaptive criminal law reform while maintaining consistency with the Principle of Legality in order to achieve a fair criminal justice system.

Abstract

Pesatnya perkembangan teknologi digital memberikan kemudahan bagi masyarakat dalam mengakses berbagai bentuk informasi dan hiburan digital. Namun, kemajuan tersebut juga membuka celah terjadinya praktik streaming ilegal yang melanggar hukum, khususnya pelanggaran hak cipta. Penelitian ini bertujuan untuk mengkaji tanggung jawab hukum pengelola streaming ilegal dengan menelaah ketentuan dalam Undang-Undang Informasi dan Transaksi Elektronik serta Undang-Undang Hak Cipta. Studi kasus yang dianalisis adalah Mola TV sebagai pemegang lisensi resmi siaran Liga Inggris di Indonesia yang hak siarnya disiarkan secara ilegal oleh pihak tidak bertanggung jawab. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan untuk menganalisis pengaturan hukum dan penerapannya terhadap pengelola streaming tanpa izin yang bertujuan memperoleh keuntungan komersial melalui iklan digital. Hasil penelitian menunjukkan bahwa perbuatan tersebut dapat dikenai sanksi pidana dan perdata. Meskipun regulasi hukum telah tersedia, penerapannya masih menghadapi kendala berupa rendahnya kesadaran hukum masyarakat serta penggunaan teknologi anonim oleh pelaku. Oleh karena itu, diperlukan penguatan penegakan hukum digital dan peningkatan edukasi hukum guna mencegah pelanggaran hak cipta melalui streaming ilegal.

Abstract

Pengaturan hakim ad hoc dalam Undang-Undang Nomor 46 Tahun 2009 tentang Pengadilan Tindak Pidana Korupsi masih bersifat sentralistik dan belum sepenuhnya mampu menjawab kebutuhan keadilan di tingkat daerah. Pola rekrutmen yang terpusat menyebabkan konsentrasi hakim ad hoc di kota-kota besar, khususnya ibu kota provinsi, sehingga menimbulkan ketimpangan distribusi Pengadilan Tindak Pidana Korupsi (Tipikor). Kondisi ini berdampak pada terbatasnya akses keadilan bagi masyarakat di kabupaten/kota yang jauh dari pusat pemerintahan. Penelitian ini bertujuan untuk menganalisis kelemahan pengaturan hakim ad hoc dalam Undang-Undang Nomor 46 Tahun 2009 yang menghambat pemerataan pembentukan Pengadilan Tipikor di daerah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, menggunakan bahan hukum primer dan sekunder yang diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa mekanisme rekrutmen hakim ad hoc yang bersifat nasional belum mendukung prinsip desentralisasi peradilan Tipikor. Reformasi pengaturan diperlukan melalui penerapan rekrutmen berbasis kebutuhan daerah dengan mempertimbangkan jumlah perkara, tingkat kerawanan korupsi, dan ketersediaan sumber daya manusia lokal. Selain itu, dibutuhkan model kelembagaan yang lebih fleksibel, transparan, dan akuntabel guna memperkuat pemerataan akses keadilan.

Abstract

This study aims to examine the concept of guaranteeing women's political rights and the importance of women's representation in the formation of inclusive regulations. Based on normative legal research, this article attempts to present doctrinal and fundamental arguments using literature review techniques. The results show that, first, women's political rights in filling legislative positions have been guaranteed in the election law in the form of a quota system for legislative candidate representation of at least 30 percent; second, women's representation in parliament can encourage the formation of inclusive regulations because the quantity of women might influence decision-making in parliament.

Abstract

Sejak diterbitkannya UU 5/2014 jo UU 20/2023 tentang ASN, pegawai di instansi pemerintah terdiri dari Pegawai Negeri Sipil (PNS) dan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Penentuan jabatan dalam ASN yang dapat diisi oleh PPPK diatur dalam Perpres 38/2020, yang mencakup Jabatan Fungsional (JF). Salah satu jabatan fungsional yang dapat diisi oleh PPPK adalah JF Penggerak Swadaya Masyarakat (JF PSM). Namun, terdapat ketidaksinkronan dalam pengertian dan syarat pejabat PSM yang diatur dalam Pasal 1 angka 6 jo Pasal 10 ayat (1) huruf a jo Pasal 11 ayat (1) huruf a Peraturan Menteri PANRB No. 3 Tahun 2024. Ketidaksesuaian ini menimbulkan masalah hukum, karena bertentangan dengan ketentuan Pasal 8 jo Lampiran Perpres Jabatan PPPK. Berdasarkan prinsip sinkronisasi hukum vertikal dan asas lex superiori derogat legi inferiori, ketentuan tersebut harus dikesampingkan atau dinyatakan tidak berlaku dan disinkronkan dengan ketentuan dalam Perpres Jabatan PPPK.

Abstract

Penelitian ini mengkaji disharmoni regulasi dalam pengaturan penilaian Pajak Bumi dan Bangunan Perdesaan dan Perkotaan (PBB-P2) pasca berlakunya Undang-Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan antara Pemerintah Pusat dan Pemerintahan Daerah (UU HKPD). UU HKPD memberikan kewenangan penuh kepada pemerintah daerah dalam pengelolaan PBB-P2, yang menandai perubahan signifikan dari sistem sebelumnya yang merujuk pada Peraturan Menteri Keuangan Nomor 186/PMK.03/2019. Meskipun PMK 186/2019 masih berlaku, substansinya hanya mengatur sektor PBB selain PBB-P2, sehingga menimbulkan potensi disharmonisasi norma, khususnya terkait kewenangan penilaian dan metodologi penetapan Nilai Jual Objek Pajak (NJOP). Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan dan konseptual, melalui kajian terhadap peraturan, doktrin, dan literatur ilmiah. Hasil penelitian menunjukkan bahwa UU HKPD dan PMK 186/2019 belum mengatur secara komprehensif mengenai kedudukan hukum, kompetensi, dan independensi penilai pajak pada sektor PBB-P2. PMK 186/2019 masih menempatkan penilai sebagai aparatur administratif, sementara UU HKPD menuntut profesionalisme tanpa mekanisme pelaksana yang jelas. Oleh karena itu, diperlukan harmonisasi regulasi melalui revisi PMK 186/2019 atau pembentukan regulasi turunan baru guna menjamin kepastian hukum dan meningkatkan kualitas penilaian PBB-P2 di daerah.
