Abstract

The Constitutional Court’s decisions in disputes over the results of the 2024 presidential election, which contained dissenting opinions, highlight the need to reconcile substantive justice with electoral integrity. This study analyzes whether the decisions reflect progressive legal principles and progressive interpretation, as well as their constitutional implications for democracy. This research uses a normative juridical method, with Constitutional Court Decision No. 1/PHPU.PRES-XXII/2024 and No. 2/PHPU.PRES-XXII/2024 as primary legal materials. The findings show that elements of progressive law appear in the dissenting opinions of three constitutional justices, who emphasized substantive justice and constitutional morality in resolving electoral disputes. Although the decisions did not alter the election results and the dissenting opinions are not legally binding, they strengthen discourse on electoral integrity. The decisions also indicate the need for electoral law reform and reaffirm the Constitutional Court’s role in safeguarding substantive democracy.

Abstract

Abstract

The Government Administration Act introduced the positive legal-fiction model, apparently to replace the negative legal-fiction model under the State Administrative Courts Act. However, this regulatory choice has generated legal controversy because it did not fully achieve that objective. As a result, the positive and negative legal-fiction models now coexist without a clear hierarchy or priority of application. This article examines the legal controversy arising from the adoption of these two models in different statutes. The issue is broader than a mere conflict between statutes because it concerns the legal consequences of administrative silence in administrative decision-making generally. This research employs a doctrinal legal method. It finds that the Government Administration Act and the State Administrative Courts Act regulate distinct subject matters; therefore, the positive legal-fiction model does not automatically revoke or supersede the negative legal-fiction model. Consequently, administrative silence in Indonesia may be treated under either the negative or the positive legal-fiction model, meaning that it may be deemed either a rejection or an approval of an application. A future General Administrative Law Act or General Administrative Procedure Act should adopt either the negative or the positive legal-fiction model as the general rule, with any exceptions expressly stipulated by law.

Abstract

Extra-constitutional actions arise from constitutional deadlock and states of emergency. In practice, these actions are accepted despite deviating from constitutional rules and carrying authoritarian tendencies. In Indonesia, although the Constitution has been refined through four amendments, extra-constitutional action remains a threat because of its rigid character, a weak democratic background, and the uncertainty of future emergencies. This legal research, based on a literature review, aims to examine the role of legal, social, and ethical legitimacy in justifying extra-constitutional actions and to formulate an ideal concept for limiting them; the discussion begins with a proper understanding of extra-constitutional actions. The approaches used are statutory and conceptual, with qualitative-prescriptive analysis. The results show that legal legitimacy (constitutional legality) cannot justify extra-constitutional actions because they are inherently deviant and serve merely as a formality for legalizing emergencies. Therefore, the primary role lies in social legitimacy (societal acceptance) and ethical legitimacy (the value of limiting power). Finally, to optimize the role of legitimacy, ideal limitation measures should begin with the determination of a constitutional emergency, implement measures that are closest to constitutional legal action, immediately end the emergency, and, after it ends, immediately evaluate the post-emergency constitution.

Abstract

The rules governing constitutional amendment in Indonesia still leave one crucial issue unresolved: the absence of regulations on mechanisms for public participation. Although previous studies have attempted to address this issue, the proposed ideas have not yet covered public participation at every stage of the amendment process. This article seeks to fill that literature gap by proposing mechanisms for public participation at each stage of the constitutional amendment. This doctrinal study employs comparative, statutory, and conceptual approaches. The findings lead to two conclusions. First, countries such as Chile, Ireland, and Romania have clear rules on public participation that positively affect constitutional amendment processes, making them suitable references for Indonesia. Second, Indonesia can strengthen public participation by adopting constitutional initiative mechanisms at the proposal stage, establishing a constitutional convention at the deliberation stage, and holding a referendum at the ratification stage.

Abstract

This study analyzes the philosophical, theoretical, and constitutional rationality of Indonesia’s land registration system, which adopts a negative publication system with positive elements to ensure legal certainty over land rights. Normatively, the system is based on Article 19 of the Basic Agrarian Law and implemented through Government Regulation No. 24 of 1997 and Government Regulation No. 18 of 2021, under which certificates function as strong but non-absolute evidence and may still be annulled through judicial mechanisms. This indicates that the resulting legal certainty remains limited. Philosophically, referring to Gustav Radbruch’s theory of legal values, law must balance legal certainty, justice, and utility; however, this balance has not been fully achieved because of the absence of the indefeasibility of title principle. Constitutionally, Constitutional Court Decision No. 001-021-022/PUU-I/2003 and Constitutional Court Decision No. 35/PUU-X/2012 affirm the state’s obligation to ensure public welfare and protect rights. The absence of title finality reveals a gap between norms and practice, qualifying the system as a systemic failure that requires reconstruction toward a positive publication system based on limited indefeasibility of title, alongside institutional reform and land data digitalization.

Abstract

The removal of the Functional Group Delegates (Utusan Golongan) from the institutional structure of the People’s Consultative Assembly (Majelis Permusyawaratan Rakyat, hereinafter “MPR”) following Indonesia’s constitutional amendments of 1999–2002 warrants reconsideration regarding its consistency with the founding ideals of independence. While many studies have examined changes to the MPR’s constitutional status and authority, limited attention has been given to the abolition of Utusan Golongan as a matter of constitutional and functional representation. This study aims to analyze the constitutional significance of UG and the urgency of reintroducing and repositioning it within the MPR. Using normative juridical research methods, the study concludes that Utusan Golongan in the original 1945 Constitution reflected the ideals of inclusivity, pluralism, and comprehensive representation of the Indonesian people, which were diminished after its removal. Therefore, reintroducing and repositioning Utusan Golongan are necessary to strengthen constitutional democracy and functional representation in the manifestation of popular sovereignty.

Abstract

Abstract

Abstract

Perampasan aset tanpa pemidanaan (NCBAF) memungkinkan pemulihan aset hasil kejahatan tanpa putusan pidana, namun berpotensi membatasi hak milik pribadi tanpa penetapan bersalah.
