Abstract

Perubahan UUD 1945 yang telah dilakukan MPR membuktikan, bahwa ada benturan kepentingan sehingga menjadikan perubahan konstitusi yang ‘tambal sulam’ dan tidak berorientasi kepentingan jangka panjang, serta jauh dari kata memuaskan karena ‘elitis’ dan kurang partisipatif, maka perubahan konstitusi seharusnya tidak dilakukan oleh satu lembaga saja yang dalam hal ini adalah MPR. Oleh karna itu, penting kirannya melibatkan Mahkamah Konstitusi agar tercipta hasil perubahan UUD NRI 1945 yang partisipatif. Penelitian ini bertujuan untuk mengetahui tentang apa urgensi pelibatan mahkamah konstitusi dalam perubahan Undang Undang Dasar Negara Republik Indonesia  Tahun 1945, dan bagaimana prospektif pelibatan mahkamah konstitusi dalam perubahan undang undang dasar  Negara Republik Indonesia  Tahun 1945. Penelitian ini mengunakan Jenis penelitian normatif. Hasil penelitian ini menunjukan bahwa Urgensi pelibatan MK dalam perubahan Undang Undang Dasar di dasarkan pada beberapa hal, antara lain: Pertama, terdapat banyak kelemahan dalam amandemen pertama sampai dengan amandemen ke-empat; Kedua, Eksistensi MPR sebagai lembaga politik; ketiga, Pelakasanaan prinsip Checks and Balance System; Keempat, Perwujudan MK sebagai The Guardian Of Consitution. Bahwa Prospektif pelibatan MK dalam perubahan UUD NRI 1945 adalah dengan menekankan pada political good will dari MPR untuk menyusun Mekanisme perubahan UUD NRI 1945 dengan melibatkan MK sebagai lembaga negara yang memberikan Sertfikasi Konstitusi dari hasil kajian perubahan yang dilakukan oleh Komisi konstitusi sebelum mendapatkan persetujuan dari MPR untuk ditetapkan sebagai hasil perubahan UUD 1945 yang baru. hasil dari mekanisme perubahan konstitusi dengan melibatkan MK ini ditujukan untuk menghasilkan perubahan konstitusi yang bersifat the people of the constitution.The amendments of the 1945 Constitution that the MPR has done proves that there is a conflict of interest that makes constitutional changes ‘patchy' and not oriented to a long term interest and far from satisfying because of 'elitist' and less participatory. Thus, the changes to the constitution should not be carried out by one institution only which in this case is the MPR. Therefore, it is important to involve the Constitutional Court in order to create a participatory change in the 1945 Constitution of the Republic of Indonesia. This study aims to find out about the urgency of involving the Constitutional Court in the amendment of the 1945 Constitution of the Republic of Indonesia, and how prospective the Constitutional Court to involve in the amendment to the 1945 Constitution of the Republic of Indonesia. This study uses a type of normative research and several approaches, namely; law approach (statue approach), comparative approach, and conceptual approach. The results of this study indicate that the urgency of involving the Constitutional Court in amending the Constitution is based on several things, including: First, the weaknesses in the first amendment to the fourth amendment; Second, the existence of the MPR as a political institution; third, the implementation of the Checks and Balance System principle; Fourth, the realization of the Constitutional Court as the Guardian of Constitution. The prospective involvement of the Constitutional Court in the amendment to the 1945 Constitution of the Republic of Indonesia is to emphasize the political goodwill of the MPR to develop a mechanism for amending the 1945 Constitution of the Republic of Indonesia by involving the Constitutional Court as a state institution which provides a review of changes made by the constitution before obtaining approval from the MPR to be determined as a result of the amendment to the new 1945 Constitution. The result of the constitutional change mechanism by involving the Constitutional Court was intended to produce constitutional changes that have the character the people of the constitution.

Abstract

Every effort of discovering the truth always faced with the possibility to slip. This possibility of slips also occurs in the Constitutional Court Decisions, specifically one which strongly related to material truth, such as in the decision related in dispute  of local general election result. Based on that certainty, this paper  attempts  to study the problems that could arise whenever the Constitutional Court manage to discover the truth, while also tries to present alternatives in the attempt to repair the aforemention slips.

Abstract

Under the provisions of Article 253 of Law No. 11 Year 2006 regarding Aceh Government insists on the transitional status of the Regional Office of the National Land Agency of Aceh and District Land Office / City into the device unit  area of  Aceh and district / city, which is limited to the budget end of 2008. However, the status of the new transition can be completed in the year 2015 with the issuance of Presidential Decree No. 23 Year 2015 on the transfer of the Regional Office of the National Land Agency of Aceh and District Land Office / City Land Agency Become Aceh and Aceh Land Office Regency / City. The problems that arise as a result of    the enactment of legislation that is related to the authority of the President of the Regional Office of the National Land Agency of Aceh are still centralized, resulting in disharmony between the legal provisions of Law No. 11 of 2006 by Presidential Decree No. 23 Year  2015. The purpose of this paper is intended to examine the form of disharmony legal provisions of Article 253 of Law No. 11 Year 2006, which refers to Memorendum of Understanding (MoU). And, examine the impact of the authority of the National Land Agency of Aceh on the enforceability of Presidential Decree No. 23 Year 2015.

Abstract

Recruitment is not an arena of  “hazing”  and  the  addition  of  bureaucracy  but a forum to explore the nature of integrity, capability, and independence of the candidates for constitutional judges. The process of recruiting candidates for constitutional judges to choose the recruitment system based on the principle of transparency, participatory, objective, and accountability to the people of the early stages and mechanisms of recruitment until the determination of the constitutional judges candidates that can lead to public confidence and form of democracy because of the position of the control and balance between state with people. Thus, the recruitment process needs to be accompanied by a written rule that can evolve as needed to create the best candidates for constitutional judges based recruitment process by filing recruitment agency and SOP (Standard Operational of Procedure). The problem is not on the persons making the recruitment, agency nominate candidates for judge, and the lack of setting the terms of the constitutional judge best candidate, but the choice of constitutional judges are recruited to promote open to the public process. DPR as one of the agency of the state to file a constitutional justice through the recruitment team can choose the right man in the right position through the selection of recruitment mechanism in accordance with the constitutional.

Abstract

Up to now, the law is still considered discriminatory and gender inequality. Though the law should be equal or sensitive to gender inequality to guarantee women’s rights. By following the principle of equality in all areas of the good men  and women have equal rights or opportunities to participate in every aspect of social life and state. so if there is discrimination against women, it is a violation of women’s rights. women’s rights violations occur due to many things, including the result of the legal system, where women are victims of the system. Reform Order is the most progressive period in the protection of human rights. Various laws and regulations come outin this period, including laws and regulations concerning women’s rights. Seen from the government’s efforts to eliminate discrimination based on sex are included in many  legislations.

Abstract

In the term of office of the legislators 2004/2009 period, a lot of the Bills which passed into legislation were not in favour of the people. Because of that, those      Bills became prejudice to the society due to the lack of conformation to what the people aspired to in the constitution (UUD 1945) which is the source and basis for the establishment of the legislation. Therefore, many legislation were tested with judicialreview by the constitutional court on the application of the public. Based on this judical review and the usage of normative research by the author, it is found that substances of the legislation are contrary to the constitution (UUD 1945). Because the legislation specified in the list of Prolegnas made by the parlement (DPR) and the President has not fully used clear, precise and consistent criteria. Therefore, the legislation established by parlement 2004/2009 period do not meet the principles of the establishment of the legislation according to the act Number  12 Year  2011 on the establishment of the legislation.

Abstract

The position of Regional Representative Council in the context of the implementation of the legislative function has an important role in order to create the principle of checks and balances between state institutions which include the House of Representatives and the President. Contextually Constitutional Court Decision No. 92/PUU-X/2012 reinforce the DPD position both in terms of national legislation program planning, delivery of opinions, views, list of inventory issues,  and discussion of a draft law. Much progress has been achieved but in the political realm seems legislative authority of the DPD is still not perfect when not reached the stage of deciding to join a draft law being discussed. In order to strengthen    DPD as part of regional representation, the amendments to the Constitution of  1945 was important to conduct state institutional arrangement holistically and comprehensively.

Abstract

The Pro’s – Con’s of the Constitutional Court in the review of law in a regulated of the authority, since, it was a conflicting of procedural principles between “ius curia novit” with “nemo judex idoneus in propria causa”. Morever, the background by implication of Constitutional Court decisions, sometimes Constitutional Court making a “rule breaking”,  for examples: nullify of some of law if had reduction of  the authority, addition of constitutional authority to review of law before the 1945 Constitution amendment, additional authority to review of Government Regulation in lieu of law, and used non-constitution as a standard in the formal review, and others. On the other hand, the Constitutional Court also sometimes to choose a   legal logic doesn’t precise and anti-accountability principle. The Conflicts of the procedural principles can  be  resolved  by  understanding  philosophy  of  purposes of law (justice value, legal certainly, utility principle), so that, the Court will have been prioritizing to “ius curia novit” principle and it ignored “nemo judex idoneus  in propria causa”principle, it is intended that the enforcement of the constitution (values) and the state of the Indonesian rule of law, as well as for the Court to aims decided of constitutional issues and to aim the protection of constitutional rights.

Abstract

Soal syarat minimal dukungan pencalonan presiden (presidential threshold) di Indonesia terus diperdebatkan, terutama soal konstitusionalitas dari persyaratan tersebut. Artikel ini bertujuan untuk mengkaji Putusan MK terkait persoalan presidential threshold sekaligus melihat apakah negara lain juga menerapkan sistem tersebut. Kajian dilakukan dengan menggunakan metode yuridis normatif. Kajian ini menyimpulkan sebagai berikut. Pertama, MK telah dua kali memutuskan konstitusionalitas ambang batas pencalonan presiden. Dalam putusan Nomor 51-52-59/PUU-VI/2008, MK menyatakan bahwa pengaturan ambang batas adalah open legal policy, yang kemudian dikuatkan kembali dalam Putusan Nomor 53/PUU-XV/2017. Kedua, di negara-negara yang menganut sistem presidensil, seperti Amerika, Brazil, Peru, Meksiko, Kolombia, dan Kyrgyzstan, ambang batas tidak dikenal. Mereka menerapkan sistem terbuka pencalonan tanpa dipersyaratkan dukungan. Meski demikian, sistem pemerintahan mereka juga tergolong stabil, seperti yang dicontohkan oleh Amerika Serikat.Dispute on presidential threshold required for the Presidential election in Indonesia remains intense, particularly in regard to the constitutionality of this requirement. This study examines decisions given by the Constitutional Court on the Presidential Threshold as well as analyses if other countries have applied a similar system. The method used in this study is juridical normative. It can be concluded that the Constitutional Court has made two decisions on the constitutionality of the Presidential Threshold. Stated on Decision Number 51-52-59/PUU-VI/2008, the Constitutional Court regarded the threshold requirement for the presidential election as an open legal policy, strengthened by Decision Number 53/PUU-XV/2017. Meanwhile, in other presidential countries such as United State of America (USA), Brazil, Peru, Mexico, Columbia, and Kyrgyzstan, there is no place for presidential threshold. They apply an open candidacy without setting any threshold of supports. Nevertheless, USA for example, has successfully demonstrated a stable form of the government under that system.

Abstract

The development and implementation of a relationship leading to the birth of anomalous friction decision Judicial review to collide against the lawmaking function. The absence of a follow-up mechanism  to cancel the decision of the norm, led to   the birth anomaly judgment. Friction Judicial Review with Law making Function was born in the form of vague and superficial to the lack of follow-up mechanisms. Efforts to reduce the friction between the two of them was done to achieve the ideal relationship between judicial review with lawmaking function.
