Abstract

Hingga saat ini, dualisme kelembagaan lembaga pengawas pemilu dan pilkada di Aceh masih terjadi. Kondisi tersebut masih menyisakan masalah dalam pelaksanaan pengawasan pemilu dan pilkada di Aceh. Artikel ini memfokuskan bahasan pada aspek pilihan kebijakan hukum yang dapat diambil untuk menyelesaikan dualisme tersebut. Penelitian ini merupakan penelitian hukum normatif yang sepenuhnya menggunakan data sekunder berupa bahan hukum primer dan sekunder. Kajian ini berkesimpulan bahwa akar persoalan dualisme lembaga pengawas pemilu dan pilkada di Aceh disebabkan tidak sinkronnya pengaturan UU Pemilu dan UU Pilkada dengan UU Pemerintahan Aceh. Hal itu juga diperkuat dengan Putusan MK yang menyatakan Pasal 557 dan Pasal 571 huruf d UU Pemilu bertentangan dengan UUD 1945 karena pembentukannya tidak sesuai dengan ketentuan perubahan UU Pemerintahan Aceh yang dimuat dalam UU Pemerintahan Aceh itu sendiri. Penelitian ini merekomendasikan agar dualisme kelembagaan lembaga pengawas pemilu dan pilkada di Aceh segera diakhiri melakukan perubahan terhadap UU Pemilu, UU Pilkada dan UU Pemerintahan Aceh

Abstract

The arbitrariness of creditors in carrying out parate executions is very disturbing and causes material and immaterial losses for debtors, this is because there are inappropriate norms in a quo article in the form of the phrase that the strength of a fiduciary guarantee certificate is equal with a valid court decision. fixed law and the phrase breach of contract. This research aims to describe changes in the implementation of parate execution as regulated in Article 15 paragraph 2 and paragraph 3 of Law 42/1999 before and after the Constitutional Court Decision and the implications of the Constitutional Court decision for the current fiduciary concept. This research uses a type of normative juridical research. The research results show that Article 15 paragraphs 2 and 3 conflict with the 1945 Constitution, this is because the basic norms contained in this Article do not have a single interpretation so they can be misused by creditors against debtors. With the Constitutional Court’s decision regarding the material review of the a quo article, it provides a clear picture of the current fiduciary guarantee mechanism. In order to follow up on justice and equality between debtors and creditors, it is necessary for the government to play a role in regulating it more efficiently.

Abstract

Artikel ini bertujuan untuk melihat bagaimana dampak Putusan Mahkamah Konstitusi di bidang Pengujian Undang-Undang terhadap perkembangan politik kriminal dan memberikan rekomendasi bagaimana seharusnya MK menguji Undang-Undang pidana di masa yang akan datang. MK sejak berdiri telah menguji berbagai Undang-Undang Pidana di Indonesia, baik dari segi materiil maupun formil. Dalam hukum pidana materiil, MK senyatanya masih konsisten untuk bertindak hanya sebagai negative legislature dan tidak menjadi criminal policy maker. Dalam hukum pidana materiil, MK hanya menjatuhkan putusan untuk dekriminalisasi tindak pidana yang diatur dalam Undang-Undang, seperti dalam pengujian Pasal Penghinaan Presiden dan Perbuatan tidak menyenangkan dalam KUHP. MK juga menolak menghapus unsur “ikatan perkawinan” dalam Pasal 284 KUHP karena berpotensi menjadi kriminalisasi, bukan dekriminalisasi. Namun, pada hukum pidana formil MK bertindak menjadi positive legislature, sebagai contoh dalam putusan penambahan kompetensi praperadilan. Sehingga menunjukan inkonsistensi pada pandangan bahwa MK bukanlah criminal policy maker. MK sejatinya memang tidak memiliki konsistensi dalam menerapkan jucial activism atau judicial restraint dalam menguji suatu Undang-Undang. Dalam konteks hukum pidana yang berkaitan dengan HAM, seharusnya MK hanya bertindak sebagai negative legislature dan dibatasi pada proses dekriminalisasi. Sehingga MK hanya menerapkan judicial restraint ketika menguji Undang-Undang Pidana.

Abstract

The proposal to extend the presidential term has emerged as a significant issue within Indonesia’s constitutional discourse. This study aims to examine the concept of a “presidential term anomaly” in relation to the republican form of government, employing a normative juridical approach. The findings indicate that Indonesia’s constitution implements a closed-norm framework, explicitly limiting the presidential term to two periods. Any effort to prolong this term is deemed unconstitutional unless the pertinent constitutional provisions are formally amended. More fundamentally, the limitation of the presidential term is closely tied to the republican model, wherein sovereignty resides with the people and executive power is held by a president. In a republic, governance is conducted by and for the people’s interest, necessitating that the exercise of power always aligns with the will and welfare of the broader community.

Abstract

Election Supervisory Body (Bawaslu) plays a vital role in ensuring that elections in Indonesia are conducted in compliance with legal regulations. The complexity of implementing simultaneous elections is a challenge for Bawaslu as one of the core institutions in the 2024 simultaneous election process, requiring strict adherence to the provisions set forth in Law No. 7 of 2017 on Elections. This study examines how Bawaslu can optimize its oversight role in the 2024 simultaneous elections and explores its authority in managing this electoral process. Using a normative juridical approach, the study finds that Bawaslu has effectively strengthened its capacity to fulfill its duties and functions in line with its founding objectives. Bawaslu’s optimization efforts include issuing updated Bawaslu Regulations (Perbawaslu) and implementing refined operational mechanisms, which aim to ensure a smooth electoral process that aligns with constitutional mandates.

Abstract

Dalam Putusan PN No. 796/Pid.B/2022/PN Ferdy Sambo dijatuhi hukuman mati atas tindak pidana yang ia lakukan terhadap mendiang Brigadir Nofriansyah Yoshua Hutabarat, Ferdy Sambo terbukti melakukan pembunuhan berencana serta upaya obstruction of justice. Disisi lain, Hukuman mati masih terus menjadi perdebatan dikalangan pengamat HAM maupun umat beragama khususnya Islam. Penelitian ini akan menjawab bagaimana konstitusionalitas hukuman mati atas Ferdy Sambo ditinjau dari perspektif HAM maupun hukum Islam secara mendalam. Hasil dari penelitian ini mengatakan bahwa penjatuhan hukuman mati atas pelaku pidana Ferdy Sambo didasarkan pada hukum nasional yang berlaku di Indoensia yang meyakini HAM bisa saja dibatasi dalam kasus tertentu (extra ordinary crime), namun tetap tidak bisa dibenarkan secara HAM internasional. Sedangkan dalam Islam, penjatuhan pidana mati tersebut telah dianggap memenuhi syarat pelaksanaan qishas, kerena dalam kasus tersebut, keluarga korban memilih menuntut hukuman yang sama atas apa yang dialami korban dibanding memberikan maaf dengan atau tanpa diyat kepada pelaku.

Abstract

The dissenting opinion of Constitutional Court judges in conducting judicial reviews of laws against the 1945 Constitution represents the freedom of Constitutional Court judges. These dissenting opinions are essentially aimed at seeking legal truth. This research addresses two main issues: First, the legal politics behind the occurrence of dissenting opinions by Constitutional Court judges in reviewing laws against the 1945 Constitution. Second, the methods of legal interpretation used by Constitutional Court judges in reviewing laws against the 1945 Constitution. This study uses normative legal methods, with statutory and conceptual approaches. The findings of this research are as follows: First, the provisions of Article 24, paragraphs (1) and (2) of the 1945 Constitution provide the constitutional basis for the dissenting opinions of Constitutional Court judges in reviewing laws against the 1945 Constitution. Second, Constitutional Court judges are not restricted nor bound by any single method of legal interpretation. The use of legal interpretation methods by Constitutional Court judges in reviewing laws against the 1945 Constitution is their prerogative, as, in principle, the use of such methods is aimed at seeking legal truth.

Abstract

The authority of the Constitutional Court to conduct judicial review against the 1945 Constitution often generates both support and criticism, particularly among those who feel disadvantaged by the existence of Law No. 1 of 1974. This study employs a qualitative research method with a normative juridical approach. The findings indicate that the Constitutional Court frequently engages in ijtihad (independent reasoning) when adjudicating cases. Additional considerations underlying these decisions include developments in science, technology, reform, and the renewal of Islamic thought, all of which influence the dynamic application of Islamic law in Indonesia. The implication of this study is that the Constitutional Court not only serves as an institution that tests statutory laws against the 1945 Constitution, but also plays an active role in legal interpretation (ijtihad), particularly concerning religious and matrimonial law. Consequently, the Court takes on a more prominent role in directing the development of Indonesian law in line with contemporary changes. Following the Court’s decisions, stricter oversight is necessary to ensure that legal amendments are effectively implemented in practice, so that the benefits of these reforms are truly felt by the public.

Abstract

The dismissal of Constitutional Court Justice Aswanto and the appointment of Guntur Hamzah as his replacement by the DPR, ratified by the President, have sparked public outcry over alleged violations of the Constitutional Court’s (MK) independence. This study aims to analyze the phenomenon of democratic regression and the erosion of MK’s independence resulting from the replacement of Constitutional Court Justices in violation of the Constitutional Court Law. The study addresses two main research questions: First, how does the non-procedural replacement of Constitutional Court Justices contribute to democratic regression? Second, what are the implications of such non-procedural actions by the DPR on the independence of the Constitutional Court? This research employs a doctrinal legal method, analyzing relevant regulations and literature. The findings reveal that, first, the non-procedural replacement of Constitutional Court Justices constitutes a symptom of constitutional backsliding that poses significant risks to democratic governance. Second, the independence of the MK’s judicial authority has been increasingly marginalized due to the non-procedural dismissal and appointment of Constitutional Court Justices, ultimately distorting the principle of checks and balances.

Abstract

Pembentukan Undang-Undang Cipta Kerja dinilai bertentangan dengan Undang-Undang Dasar 1945 dan tidak memiliki kekuatan hukum mengikat secara bersyarat, namun masih berlaku selama dua tahun tanpa perbaikan. Penelitian ini menganalisis kekuatan hukum putusan inkonstitusional bersyarat Mahkamah Konstitusi dalam kasus Nomor 91/PUU-XVIII/2020 dan Ius Constituendum untuk pengujian Undang-Undang. Metode penelitian yuridis normatif digunakan dengan analisis deskriptif kualitatif. Hasilnya menunjukkan bahwa kekuatan hukum putusan inkonstitusional bersyarat adalah mengikat dan wajib dilaksanakan. Ius Constituendum dalam putusan Mahkamah Konstitusi menekankan perbaikan Undang-Undang terkait dan kolaborasi lembaga negara. Rekomendasi penulis termasuk pembentukan dasar hukum melalui revisi undang-undang Mahkamah Konstitusi untuk menambahkan jenis putusan bersyarat sebagai landasan pelaksanaan kewenangan lembaga peradilan konstitusi.
