Abstract

The Anthropocene era was marked by a decline in the quality of the environment including being influenced by the law itself, for example the Job Creation Law was considered to have a negative impact on efforts to protect the environment. This research will analyze the development of legal instruments and the role of the Constitutional Court in environmental protection. This research will be conducted by studying legal literature. The urgency of changing the environmental law political paradigm (green policy) in Indonesia based on the ecocentrism paradigm will provide stronger environmental law political guidelines. Efforts to strengthen the paradigm of environmental protection are carried out by reconstructing the 1945 Constitution of the Republic of Indonesia by granting rights to the environment and setting state obligations. There is a role for the Constitutional Court through Decision Number 32/PUU-VII/2010 and Number 18/PUU-XII/2014 by providing guidelines for the development of more comprehensive environmental law.

Abstract

This research discusses the limitations on the privatization of State-Owned Enterprises (BUMN) in the field of electricity supply and itscorrelation with the implementation of the sub holding structure inPT PLN (Persero). This discussion is crucial, given that electricity is avital sector of production for the nation and profoundly impacts thewell-being of the general populace, necessitating state control. The studyadopts a normative legal research approach, employing conceptualframeworks and secondary data. The research’s conclusion is that theconstitution restricts the privatization of State-Owned Enterprises in theelectricity supply sector, emphasizing that only State-Owned Enterprisesare authorized to manage electricity-related businesses. National orforeign private companies are only permitted to participate if invitedto collaborate by State-Owned Enterprises. The implementation of thesub holding structure in PT PLN (Persero), utilizing the shareholderscheme involving Geothermal Co and New Energy Co as subsidiaries,contradicts the 1945 Constitution because it leads to an escape fromstate control.

Abstract

The periodization system in the constitutional judges’ position has the opportunity to undermine the judges’ independence. the opportunity to be re-elected as an opening for political transactions between constitutional judges with the proposing institution. The enactment of Act No. 7/2020 is a new era for the system used in the constitutional judges’ term. The periodization of the Constitutional Court judges’ term was replaced based on the age limit of 70 years. This research examines the design of Constitutional Court judges’ terms after the enactment Act No. 7/ 2020. This article is written based on normative legal research. This study concludes that the transformation of the Constitutional Court judges’ term into non-periodization aims to strengthen the independence of Constitutional judges from any intervention. At the same time as a fortress from external pressure and ensures that judges do not face conflicts of interest arising from the possibility of extending the term.

Abstract

The act of giving and receiving has been a practice since feudal times. Gifts or tributes to kings or officials, among other forms of giving, are part of traditional customs and are considered social etiquette. To address these issues, the authors analyze the theory of criminal liability, lawlessness, legal pluralism, and the legal system. This research uses a normative juridical research methodology. The findings reveal that there are no clear boundaries concerning regulations related to bribery and gratuities, specifically regarding gifts or promises in which civil servants or public officials can or cannot accept. The application of the bribery and gratuity clause was misdirected, resulting in innocent individuals being punished while the guilty were acquitted.

Abstract

The shift in the role of the Constitutional Court, which has tended tobecome a positive legislator in the last 11 years, began with the existenceof Constitutional Court Decision Number 48/PUU-IX/2011, which, in itsessence, eliminated the limitations on the role of constitutional judges inrendering decisions with a regulatory nature. Consequently, in the last11 years, out of 198 accepted decisions, 107 positive legislative decisionswere identified, and when presented, these positive legislative decisionsconstituted a majority of 54% of the total decisions. The practice ofpositive legislation itself appears to be ineffective, primarily due tothe fact that out of the total 107 decisions, only 26 decisions wereimplemented by the addressees of the decisions. Through normativejuridical research using a statute approach and conceptual approach,this study is focused on understanding why the practice of positivelegislation is not optimal. This is because there is no legal basis, it doesnot fall within the Constitutional Court’s domain to decide cases witha regulatory nature, and there is no obligation for the addressees ofthe decisions to implement positive legislative decisions.

Abstract

Pancasila maupun Putusan Mahkamah Konstitusi keduanya sama-sama berkedudukan sebagai sumber hukum dalam pembentukan peraturan perundang-undangan. Oleh karena itu, tulisan ini bermaksud untuk menganalisis bagaimana relasi yang harus dibangun antara Pancasila dengan Putusan MK sebagai sumber hukum. Penelitian ini merupakan penelitian hukum normatif, data dalam tulisan bersumber pada bahan-bahan hukum baik bahan hukum primer, sekunder, maupun tersier. Oleh karena itu, teknik pengumpulan data yang dipilih adalah studi pustaka. Hasil penelitian ini menunjukan bahwa Putusan MK yang bersifat mengatur (konstitusional-inkonstitusional bersyarat dan yang merumuskan norma baru) menjadikan Putusan MK sebagai sumber hukum mengikat yang memiliki implikasi besar dalam mengkonstruksi pembentukan peraturan perundang-undangan. Pada titik ini, Hakim Konstitusi harus bisa merelasikan dan mensinkronkan putusan yang dibuatnya dengan Pancasila, mengingat sebagai sumber hukum Pancasila merupakan sumber hukum dasar nasional dan sumber segala sumber hukum di Indonesia.

Abstract

Public participation is the heart of the legislative process. Participation is crucial to ensure that the laws produced genuinely reflect the needs and aspirations of society, as well as to embody democracy and strengthen legitimacy. Through a normative juridical approach, the research aims to compare public participation in law-making in five democratic countries, namely Indonesia, the United States, the Philippines, South Africa, and South Korea, by analyzing their Constitutions and laws and regulations. The findings can then be used as best practices that can be adopted by Indonesia. The results of the study show that the Constitutions of the United States, the Philippines, South Africa, and South Korea guarantee public participation in the legislative process. In contrast, the Indonesian Constitution only affirms People’s Sovereignty. However, normatively, Indonesia regulates the role of the public more comprehensively and technically in the law-making process at every stage, further reinforced by the Constitutional Court Decision No. 91/PUU-XVIII/2020, which mandates that the role of the public be more meaningful in law-making, as participation is a constitutional right held by citizens.

Abstract

Renewable energy has great potential in Indonesia, but Indonesia does not have integrated regulations related to renewable energy considering that these regulations are still in the process of the 2022 Proleges Draft Law (RUU). This research aims to outline views on renewable energy through the concept of central and regional government authority in managing renewable energy and analyzing it through the prospects for state control and decentralization, in order to see the potential readiness of regions in Indonesia. This research was conducted using normative juridical research. The results of this research show that the concept of state control has an intersection with decentralization in the management of energy resources. Indonesia has enormous potential for renewable energy, but regions in Indonesia still have challenges regarding readiness. Therefore, it is necessary to accelerate the EBT Bill as a legal basis to support the acceleration of renewable energy in Indonesia and the importance of carrying out the five functions of state control based on decentralization ideally for the development of renewable energy.

Abstract

This research focuses on the constitutionality of the Regional-Owned Enterprises authority in the management of New and Renewable Energy. There are two research objectives to be obtained. First, the classification of EBT in the major production branches and the dominance over people’s lives refers to the dynamics of laws and decisions of the Constitutional Court. Second, the determination of BUMD's authority over the management of EBT refers to the state's control rights according to MK. This research is normative legal research based on secondary data. This research showed two conclusions. First, the classification of EBT includes nuclear, coal methane gas, liquefied and gasified coal, geothermal, and water flows and waterfalls. Second, the position of BUMD is classified into two models; (1) BUMN is prioritized over BUMD; and (2) BUMD is equivalent to BUMN. However, for SDA which are not included in this qualification, the position of these entities are equal.

Abstract

Hak Menguasai Negara (HMN) memberikan otoritas kepada pemerintah dalam melakukan pemanfaatan terhadap bumi, air, dan kekayaan alam. HMN merupakan refleksi atas Pasal 33 ayat (3) UUD NRI tahun 1945. Kerusakan lingkungan yang semakin masif bahan bakar fosil mensyaratkan pentingnya transisi energi di Indonesia. Penggunaan energi terbarukan dapat menjadi sumber energi sekaligus mendukung pembangunan berkelanjutan. Penggunaan energi terbarukan yang ramah terhadap lingkungan seharusnya tidak menjadikannya sebagai suatu pilihan, melainkan sebagai kewajiban untuk digunakan secara meluas di Indonesia. Pokok permasalahan tersebut melahirkan pertanyaan yakni bagaimana konsepsi HMN dan hubungannya terhadap peran pemerintah dalam menciptakan iklim energi terbarukan di Indonesia. Penelitian hukum normatif digunakan dalam penelitian ini. Pada akhirnya diketahui bahwa konsep HMN telah memberikan kewenangan kepada pemerintah dalam melakukan peruntukan dan pemanfaatan sumber daya alam di Indonesia. Kewenangan pemerintah melalui HMN dapat menjadi sarana dalam membuat regulasi maupun kebijakan atas penggunaan energi terbarukan di Indonesia, serta ditujukan untuk menciptakan sebesar-besar kemakmuran rakyat.
