Abstract

Cases of sexual violence are crimes against humanity that not only physically injure the victim, but also cause deep psychological trauma. However, the phenomenon that occurred in Mataram in 2024 shows a different condition, where people with physical disabilities are actually perpetrators of sexual violence. This raises complex legal issues, especially related to the limits of criminal liability and the application of the principle of justice. This study aims to analyze the criminal liability of perpetrators with physical disabilities in cases of sexual violence based on the Mataram District Court Decision Number 23/Pid.Sus/2025/PN Mtr and review its relevance to the principles of Islamic criminal law. The method used is normative juridical with a case approach, through the study of primary legal sources in the form of the Qur'an, hadith, fiqh jinayah books, as well as laws and regulations such as Law Number 12 of 2022 concerning the Crime of Sexual Violence and Law Number 8 of 2016 concerning Persons with Disabilities. The results of the study show that in positive law, perpetrators with physical disabilities can obtain mitigating considerations, as reflected in Decision Number 23/Pid.Sus/2025/PN Mtr which imposes a lighter sentence than the prosecutor's demands. While in the perspective of Islamic criminal law, the measure of criminal liability is determined by reason (?aql) and moral awareness (ahliyyah al-ad?), not by physical conditions. Therefore, people with physical disabilities who have common sense are still seen as full mukallaf who are obliged to account for their actions. Acts of sexual violence in this context are classified as jarimah ta'z?r syadidah (heavy ta'zir), the sanctions of which can be increased according to the level of social and moral damage caused. This study emphasizes the importance of applying the principles of substantive justice and benefits in deciding cases involving perpetrators with disabilities, without removing the essence of criminal responsibility. These findings are expected to contribute to the development of inclusive and contextual Islamic criminal law on disability and sexual violence issues in Indonesia.

Abstract

The energy sector requires strong integration between business strategy and Corporate Social Responsibility (CSR), especially to maintain competitiveness in the shift toward clean and sustainable energy. This study aims to analyze how business strategy influences CSR implementation in Indonesia’s energy industry, focusing on the role of business development, corporate actions, and leadership support across subsectors such as oil and gas, minerals and coal, electricity, geothermal, renewable energy, bioenergy, and energy conservation. Using a qualitative approach with in-depth interviews, data were collected from respondents involved in strategic planning and CSR in energy companies. The findings show that business strategy has a significant positive influence on CSR practices; however, strategic integration remains weak due to limited managerial awareness of CSR’s potential to create competitiveness, strengthen reputation, and build stakeholder trust. Companies still prioritize operational and financial performance over sustainability initiatives. Practically, the study highlights the need to align CSR with national priorities and global sustainability trends, supporting market positioning and long-term value creation. Strengthening sustainability-oriented innovation, clean energy development, and community-based CSR programs can enhance competitive advantage. Leadership support is crucial in embedding CSR into business strategy and organizational culture, enabling differentiation and success in Indonesia’s evolving energy market.

Abstract

This study examines the concept of the application of a variety of decorative wood carvings in the Ndalem Keprieranan through the perspective of functional aesthetic theory. This study aims to identify the connection between aesthetic aspects, functions, and philosophical values contained in wood carving elements in traditional Javanese architecture. The variety of ornaments on the ndalem building acts as a decorative motif that contains symbolic meaning that represents the value system, social structure, and life view of the Javanese people about the relationship between humans, nature, and God. The research method uses a descriptive qualitative approach through visual observation, documentation, and literature studies, with analysis focused on the shape, motif, composition, and symbolic function of carving. The results of the study suggest that the application of functional aesthetics in the variety of decorative wood carvings in the palace displays a harmonious harmony between visual beauty and constructive function. The value of Tata-Titi-Teges is reflected in the regularity of form, the accuracy of proportion, and the firmness of symbolic meaning, while the value of Nata-Niti-Natas shows a reflective and spiritual dimension that directs human consciousness towards the order of the cosmos. Overall, this study emphasizes that traditional Javanese aesthetics are oriented towards the beauty of appearance which is a value system that combines visual, functional, and spiritual principles in an integrated manner, which makes the variety of wood carvings as an expression of harmony between material and immaterial aspects in the life of the Javanese people.

Abstract

Road safety remains a critical issue worldwide, particularly in low- and middle-income countries (LMICs) where the fatality rate from road accidents is significantly high. Excessive vehicle speed (over speeding) is one of the main contributing factors to the increasing frequency and severity of traffic accidents. This study aims to identify accident-prone locations (Black Spots) on La Ode Hadi–M. Brigadier General Yoenoes Road, Kendari City using the Sliding Windows Method combined with the Accident Equivalent Rate (AEK) weighting system based on the Indonesian National Police guidelines. Secondary data were obtained from the Integrated Road Safety Management System (IRSMS) of the National Police, Kendari City Transportation Office, and supporting literature. The analysis shows that along the 4 km road section, there were 36 recorded accidents, dominated by motorcycle collisions (42%) with minor injuries (77%), front–rear collisions (42%) and mostly occur at night (28%). The most accident-prone location identified was the Pasar Baru intersection as segment 11 (Sta 1+100) and 30 (Sta 3+000) with an AEK score of 37 points, exceeding the Black Spot threshold (>30 points). These findings confirm that the Pasar Baru intersection in Kendary City meets the criteria of a Black Spot area, emphasizing the need for targeted safety interventions such as improving the quality of intersection, improving speed management, consistent law enforcement and safety education campaigns to the public to reduce accident risks in urban Kendari.

Abstract

This study aims to analyze the influence of social media on zakat awareness among the young generation of Muslims using a netnography approach. The development of digital technology has changed the way the younger generation interacts, obtains information, and understands religious values, including the obligation of zakat. Through a netnography approach, this study observes the interactions, conversations, and representation of zakat values on various social media platforms such as Instagram, TikTok, and X (Twitter). Data was collected through online observations, upload documentation, and content analysis related to zakat campaigns, Islamic influencers, and digital amil zakat institutions. The results of the study show that social media plays a significant role in increasing awareness and participation of zakat among the younger generation, especially through visual narratives, personal testimonials, and humanitarian value-based campaigns. However, it was also found that this level of awareness is still emotional engagement and has not completely transformed into behavioral engagement (the behavior of paying zakat regularly). This research emphasizes the importance of authentic, educational, and interactive digital-based zakat communication strategies to strengthen zakat literacy in the social media era.

Abstract

Curcuma longa (turmeric) is a medicinal plant widely used for its anti-inflammatory, antioxidant, and antimicrobial properties. Cream formulations are ideal for topical delivery due to their ease of application, good absorption, and patient acceptability. The maceration method is a simple and cost-effective technique for obtaining plant extracts without compromising bioactive compounds. This study aimed to evaluate the physical stability of a cream formulation containing 5% Curcuma longa extract prepared using the maceration extraction method. The extract was prepared through maceration of dried turmeric rhizome using ethanol, followed by evaporation to obtain the concentrated extract. The cream was formulated with stearic acid, cera alba, vaselin album, triethanolamine, propylene glycol, and distilled water as base components. Physical stability parameters were tested over seven days, including pH, dispersion, and adhesion tests. Statistical analysis was performed using the Friedman test. The pH values ranged from 7.33 to 7.50 (p = 0.006), indicating mild alkalinity but remaining within an acceptable range for topical application. Dispersion remained stable throughout the observation period (p = 0.452), while adhesion increased significantly from 182.71 to 200.04 seconds (p = 0.006), suggesting improved cohesiveness. The 5% Curcuma longa extract cream demonstrated good physical stability, indicating that the maceration method is a viable approach for developing stable topical herbal formulations.

Abstract

This study aims to analyze the implementation of Government Regulation Number 45 of 1990 concerning divorce permits for Civil Servants (PNS) within the Regional Government of North Barito Regency. This research is motivated by the continued large number of State Civil Apparatus (ASN) who file for divorce without going through the permit mechanism according to the provisions, as well as the less than optimal implementation of the regulation at the regional level. The method used is empirical legal research with a sociological juridical approach, through interviews with ASN, the BKPSDM, and the Muara Teweh Religious Court. The results of the study indicate that the process of issuing Decrees (SK) permitting divorce by the Regent in North Barito Regency is inconsistent, with a time span varying from two weeks to two years. This difference is caused by the absence of Standard Operating Procedures (SOP), the issuance of Circular Letters or Regent Regulations that regulate the technical implementation of the PP, and weak coordination between agencies in the implementation of mediation as stipulated in Article 6 of PP Number 45 of 1990 in conjunction with PP Number 10 of 1983. In addition, the mediation process often does not run effectively due to the lack of presence of related parties, so that the purpose of the regulation to prevent early divorce and maintain harmony in ASN households has not been achieved. Based on these findings, this study recommends the preparation of SOPs and Regent Regulations regarding ASN divorce permits, increasing legal socialization for ASN, and strengthening the role of BKPSDM as a supervisor of the implementation of regulations in order to create an effective, transparent, and fair licensing system in accordance with the principle of benefit in Islamic law.

Abstract

This research examines the capital flight of foreign direct investment (FDI) from Indonesia to Vietnam against the backdrop of escalating U.S.-China tensions and restructuring global supply chains. Employing a qualitative-comparative methodology, we analyze secondary data from UNCTAD, ASEAN Investment Reports, and World Bank indicators, complemented by policy documents from both nations. Through comparative content analysis and case studies of firms such as Samsung and Foxconn, we identify key drivers of FDI diversion, including trade policy frameworks, geopolitical positioning, and industrial ecosystems. Our findings reveal that Vietnam’s strategic trade diplomacy exemplified by its participation in the CPTPP and EVFTA has bolstered its geopolitical neutrality and FDI attractiveness. In contrast, Indonesia’s resource nationalism, particularly its nickel export ban and rigid downstreaming policies, has discouraged high-tech investments, redirecting capital toward Vietnam’s integrated supply chains and special economic zones (SEZs). For instance, Samsung’s $18 billion investment in Vietnam highlights the shift of labor-intensive manufacturing away from Indonesia. This research contributes to the international political economy literature by demonstrating how policy competition and geopolitical hedging influence FDI redistribution in Southeast Asia. It underscores the trade-offs between resource sovereignty and FDI retention, offering policymakers insights into balancing industrial ambitions with global investor expectations. Future studies should explore firm-level decision-making dynamics and illicit financial flows, such as trade misinvoicing, to further elucidate capital flight mechanisms.
