Abstract

Wages are a form of appreciation given by employers for the services that have been done by workers. Wages are able to ensure the welfare of workers. However, in reality there are still wage violations in Indonesia, such as in terms of nominal wages. Nominal wages that are not in accordance with the provisions will interfere with worker welfare and reduce worker productivity. Wages must be guaranteed by law so that the essence of the function of wages can be realized. Therefore, research is needed on criminal sanctions as law enforcement of employers' violations of workers' wages in Indonesia. The objectives of this study include (1) explaining the forms of employer violations against workers' wages in Indonesia and (2) explaining the forms of criminal sanctions for employers' violations of workers' wages as an effort to enforce the law in Indonesia. This research is based on qualitative and uses an analytical descriptive approach, and is normative juridical. Forms of employer violations against workers' wages in Indonesia consist of nominal wage violations, late payment of workers' wages, and employers' unwillingness to pay workers' wages. Criminal sanctions as an effort to enforce the law are realized through Government Regulation in Lieu of Law of the Republic of Indonesia Number 2 of 2022 concerning Job Creation paragraphs (1) and (2) for violations in the event that the nominal wage is less than the provisions. The forms of violations of late payment of wages and the unwillingness of employers to pay workers' wages are subject to criminal sanctions listed in paragraph 61 paragraph (1) of Government Regulation (PP) concerning Wages.

Abstract

The dodger building is one part of the dam component that serves to divert the flow of the river during construction work. One of the requirements for evasive buildings is to be able to drain river water well, so that the characteristics of the flow in the dodger channel need to be known to see how the flow conditions that occur in the dodge channel. This study aims to examine the flow characteristics of the Tapin Dam circumvention channel due to the design of the channel tunnel using a tooth shape, by modeling the relationship between the flow characteristics (velocity profile, pressure drop profile, and turbulent kinetic energy profile) of the jagged channel dimension shape using numerical computational analysis with the help of CFD (Computational Fluid Dynamics) software. From the modeling results, it will be known the influence of channel dimensions on flow characteristics in the dodger channel.

Abstract

The purpose of this study was to analyze the performance of Seskoal lecturers by observing the influence of the aspects of Transactional Leadership, Transactional Leadership, Competence, and Motivation of the lecturers as mediating variables. The research was conducted within the scope of the Naval Staff and Command School with 105 respondents consisting of Seskoal lecturers and structural officials involved in teaching, training, and nurturing activities. The data obtained were analyzed using Structural Equation Model-Partial Least Square (SEM-PLS) software. The independent variables Transformational Leadership and Transactional Leadership were found to have no direct effect on performance. Instead, the independent variables Competence and Motivation positively and significantly affected performance. This argument is due to the fact that the performance dimension in the form of the Tridarma of Higher Education has yet to be widely understood. The working period of lecturers is generally short, so the impact of the transformation has yet to be felt. It is also very rare for transactions to occur in this performance. Variable influence. The effect of the independent variable Transformational Leadership also has no positive and significant effect on motivation as the dependent variable, whereas Transactional Leadership and Competence have a positive and significant effect on Motivation. This result shows that transactions will increase lecturers' motivation, and lecturers with high competence will automatically increase their motivation. Interestingly, the indirect effect, where motivation acts as an intervening variable, shows that there is no effect of Transformational Leadership on Performance through motivation. However, vice versa for the variables Transactional Leadership and Competence affect Performance through Motivation. This result shows that the effect of the transformation has not been felt directly or indirectly as explained otherwise, for transactions will increase motivation which indirectly increases performance and competence.

Abstract

Margatiga Dam is located at Lampung Province. The potential of high land acquisition cost may affect the total construction cost of the dam. A simulation needs to be conducted to calculate the volume of the dam reservoir with optimum reliability and benefit value. Calculation of the dam reservoir uses the storage capacity curve based on topographic map to derive the size area and reservoir volume on each elevation, a simulation is done afterwards to obtain the exact elevation of the optimum volume of reservoir. Simulation is conducted with three elevation alternatives; the spillway crest’s initial elevation of +22m, the raised elevation of +22,5m, and the lowered elevation of +21m. It can be concluded from the evaluation that spillway crest’s elevation with most benefit value is at an elevation of +22m with the reservoir reliability of 99,64%, BCR of 1,63, and the IRR of 13,34% with the total cost of Rp1.929.918.493.283.

Abstract

Public service reform has demanded personnel reform to ensure that public services are carried out effectively. The success of personnel reform then needs to be assessed to know how far it has worked in a country to find out how effectively the reform effort has been implemented. This paper aims to conduct a comparative review of the extent to which personnel reform has been implemented in Indonesia and Malaysia. This research was conducted by qualitative method with a comparative study approach. Secondary data were used in the study by taking from databases provided by the United Nations and the World Justice Project. The comparison was carried out using five indices, namely E-government development index (EGDI), E-Participation Index (EPI), Rule of Law Index, Corruption Perceptions Index (CPI), and Democracy Index. In addition, secondary data are also obtained from literature studies of books, research journals, and other sources that are in accordance with the research problem. The results showed that overall Malaysia is superior in the successful implementation of personnel reform when compared to Indonesia in terms of implementing e-government and ensuring its public services are delivered accountably. However, in involving public participation in e-government operators, Indonesia is superior when compared to Malaysia. The implication of the research for the Indonesian government is the demand to better develop its personnel reform policies to ensure more effective and accountable public services in the future.
