Abstract

The legal relationship between doctors and patients is a relationship based on trust. Legal protection for the medical profession in treating emergency patients without medical approval (informed consent) is regulated in Article 1338 of the Civil Code. The agreement remains binding on both parties, even though the conditions in Article 1320 of the Civil Code are not fulfilled, there are laws that specifically regulate informed consent and Article 1354 of the Civil Code, so that the therapeutic agreement or therapeutic transaction still exists and occurs. As a result, doctors are obliged to provide an achievement to the patient, namely making an effort by providing health services as an effort to cure the patient. In carrying out this effort, doctors must do it with all seriousness by using all the abilities and skills they have while being guided by standards.

Abstract

Abandoned children have many experiences that come from harsh environments and not all of them are accepted by society. Therefore, special approaches and treatments are needed to help them develop their thinking processes, teach them how to build relationships between the past, present and future, and direct them towards patterns of behavior that are acceptable to society. This study uses qualitative research methods. This study uses qualitative data where this data is obtained from selected informants who are relevant and have the competence to provide the research data selected by the researcher. Data collection techniques were collected through documentation studies, interviews and observations. The results of this study show that the number of abandoned children in Cirebon City is around 70 people. The Cirebon city social service has a program to foster abandoned children, namely GSM, social guidance, family, understanding parenting and teaching and learning activities. This study uses the implementation theory of Van Meter and Van Horn The implementation stage can be seen from 6 important variables when achieving an implementation, namely: objectives and policy size, attitudes (disposition) of implementers, infrastructure and human resources, characteristics of implementing agents, communication activities and implementers between organizations, as well as the political, social and economic environment. The results of this study show that the policy of the Abandoned Children Development program at the Cirebon City Social Service is not optimal because of low budget sources, so the implementation of the policy has not fully met the standards. Social protection is aimed at helping the poor and vulnerable population, especially those who experience other welfare problems.

Abstract

Agrarian problems in Indonesia are still complex and have not been resolved completely. Inequality of land tenure, agrarian conflicts, environmental degradation, and land conversion are some examples of problems that continue to occur. In the midst of this situation, the role of civil society becomes important in fighting for sustainable agrarian policies. This research aims to analyze the role of civil society in agrarian policy advocacy in Indonesia. This research adopts a qualitative research method. Data collection is done through literature study. After the data is collected, the analysis is carried out in three stages, namely reducing data, presenting data, and drawing conclusions. The results show that the role of civil society in sustainable agrarian policy advocacy is very important in ensuring social justice, environmental protection, and strengthening the rights of farmers or indigenous peoples related to land. Civil society, through non-governmental organizations (NGOs) and activist networks, acts as a watchdog and critic of agrarian policies issued by the government. In addition, civil society also plays a role in providing education and understanding to local communities about their rights related to land, as well as mobilizing public support to strengthen their demands for equitable agrarian policies.
