Abstract

Pengadaan barang/jasa pemerintah merupakan instrumen penting dalam mewujudkan tata kelola pemerintahan yang baik, sehingga Pejabat Pembuat Komitmen (PPK) memiliki peran strategis dalam menjamin efisiensi, transparansi, dan akuntabilitas. Namun, masih terdapat penyimpangan yang menunjukkan kesenjangan antara norma hukum dan praktik di lapangan. Penelitian ini bertujuan menganalisis tanggung jawab hukum pejabat pengadaan dalam pelaksanaan kontrak pemerintah serta mengidentifikasi faktor-faktor yang mempengaruhinya. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa tanggung jawab hukum pejabat pengadaan meliputi dimensi administratif, perdata, dan pidana. Pelaksanaannya dipengaruhi oleh regulasi, kompetensi SDM, pengawasan, tekanan eksternal, dan kondisi kelembagaan. Oleh karena itu, diperlukan penguatan regulasi, peningkatan kapasitas pejabat, serta optimalisasi pengawasan guna mewujudkan pengadaan yang transparan, akuntabel, dan bebas penyimpangan.

Abstract

This empirical-legal qualitative study examines the reconstruction of Islamic covenant law in digital transactions of featured commodities across the Sula Islands. The background of this study is the shift of conventional trade toward Facebook and WhatsApp platforms in Sanana, which has created friction between the flexibility of cyber-market technology and the classical fiqh doctrine of ittihad al-majlis. This study aims to answer two questions, namely the extent to which Islamic covenant law is effectively applied in such transactions, and how an ideal legal reconstruction formula can be developed. Data were collected through social media observation and in-depth interviews with local MSME actors and legal practitioners, then analyzed inductively through the lens of sociology of law and Maqashid Shariah. The results show that the application of Islamic covenant law is sociologically effective, as the principle of mutual consent (an-taradhin) is fulfilled through trust-based social capital, yet remains legally weak due to the absence of written contracts and down-payment systems, leaving business actors vulnerable to gharar and unilateral breach of contract. As a reconstruction formula, this study proposes an integrative three-pillar model: legitimizing digital footprints as a modern form of Al-Kitabah, reorienting the contractual session into a virtual majlis, and perfecting qabdh through the strengthened role of local couriers as wakil al-mushtari. This study contributes a more operational legal model compared to previous studies, which generally addressed these three aspects separately.

Abstract

Inheritance disputes among rural Muslim families are often triggered by one party's unilateral control over productive assets, such as land, houses, or plantations, before a division is agreed upon. Prior studies extensively examine dispute resolution through Religious Courts or formal sub-district mediation, yet empirical accounts of family deliberation and village mediation in archipelagic regions such as the Sula Islands remain scarce. This study describes the forms of inheritance dispute resolution in Waibau Village, Sanana, and examines them from an Islamic legal perspective. Using a qualitative descriptive case study approach, data were collected through in-depth interviews with the village head, a religious leader, and disputing parties, supported by observation and documentation. Findings reveal a tiered pattern: family deliberation first, mediation by the village head and religious leader when deliberation stalls, and litigation as a strongly avoided last resort. From an Islamic legal standpoint, this pattern reflects ishlah and wasathah, prioritizing hifzh al-nasl over hifzh al-mal. This study contributes an empirical account of inheritance law values practiced in a coastal village community
