Abstract

Volume estimation and Bill of Quantities (BOQ) are crucial processes in construction planning. Currently, volume and BOQ calculations are still done manually by calculating the volume of each component in the working drawings. This process is time-consuming and prone to human error. One way to improve efficiency is to implement Building Information Modeling (BIM) in volume estimation and BOQ calculation to enhance work effectiveness. Autodesk Revit is one software that can assist in 3D modeling and accurate volume calculation. This research discusses how BIM can aid in the design volume calculation process and BOQ planning for the Main Lecture Hall building within the Integrated Agricultural Research and Development Center (P4T). Compared to conventional methods, the results show that implementing BIM on this project has provided significant benefits in terms of efficiency, increased calculation accuracy, material usage, and cost savings. With an optimization of concrete material usage by approximately 1,35% and reinforcement volume by approximately 2.11%, and a cost reduction of 0,985%, BIM has proven to provide significant added value to the project.

Abstract

It is critical to comprehend religious precepts that promote tolerance in light of the world's growing religious and societal divisions. The biblical tale of the Good Samaritan is frequently used as an example of moral principles and intergroup empathy. This study attempts to identify the ways in which a more profound comprehension of this fable might promote interfaith tolerance, particularly in a multicultural society. The methodology used in this study consists of a content analysis of the biblical text together with a survey of the literature on theology and sociology that is relevant to understanding the tale. Drawing upon the theoretical frameworks of interfaith discourse and social tolerance, the research highlights the need of valuing diversity in order to foster peaceful cohabitation. The results of the study show that, despite variations in religion or ethnicity, the Good Samaritan narrative offers a universal message of compassion and assistance. The narrative demonstrates the ability of humanitarian action to cut over social divides and ideological differences, which is critical in resolving conflicts in today's multicultural society. The study's main argument is that, in the context of religious diversity, a thorough comprehension of this fable may serve as a strong basis for encouraging interfaith communication and decreasing prejudices while also fostering tolerance.

Abstract

This study aims to analyze the criteria for the dismissal of Land Deed Officials (PPAT) based on health conditions from a justice perspective. The method used is normative legal research with a statutory and conceptual approach, analyzed using a perspective analysis through grammatical and systematic interpretation methods. The results of the study show that the rules for dismissing PPATs due to health reasons refer to Article 10 paragraph (2) letter b of Government Regulation Number 24 of 2016. This regulation does not provide a health recovery period for PPATs, unlike the provisions in the Notary Position Law which grants a three-year recovery period. In conclusion, this regulation creates the potential for injustice for PPATs due to the absence of an opportunity to recover before being dismissed. Regulatory changes are needed to create a balance between public interest and the protection of individual rights.

Abstract

This study analyzes the implementation of the tripod strategy—encompassing resource-based view (RBV), institution-based view (IBV), and industry-based view (IBD)—to support the internationalization process of SMEs, with a case study on Agronesian Indonesia, an SME operating in the natural agricultural products sector. A qualitative approach was employed, utilizing a case study design where data were collected through in-depth interviews, observations, and document analysis to gain a holistic understanding of how these three perspectives are applied. The findings indicate that integrating RBV, IBV, and IBD enables Agronesian to overcome resource constraints, leverage institutional support, and adapt products to international market demands, especially regarding sustainability. Theoretical implications of this study strengthen the literature on SME internationalization by highlighting the value of a combined approach, while practical implications provide a framework for other SMEs to design adaptive and structured internationalization strategies. The limitations of this research include a focus on a single case and reliance on qualitative methods, which restrict broader generalization. Future studies are recommended to involve a wider range of SMEs from various industries and to explore the influence of global shifts, such as trade policies and sustainability trends, on the effectiveness of the tripod strategy for SME internationalization.

Abstract

This study aims to examine the application of Income Tax (PPh) on the transfer of rights to land/buildings through a Joint Rights Division Deed (APHB) due to inheritance, focusing on the injustices arising from the Circular Letter of the Directorate General of Taxes 20/PJ/2015. Although Indonesian tax law stipulates that inheritance is not subject to tax, Circular Letter 20/PJ/2015 exempts tax liability only for heirs in a direct bloodline. This research employs a normative legal approach with an analytical perspective. The findings indicate that Circular Letter 20/PJ/2015 contradicts the principle of justice outlined in the Income Tax Law (UU PPh) as amended by the Harmonization of Tax Regulations Law (UU HPP), wherein all heirs should be entitled to PPh exemption without discrimination. This distinction not only leads to legal uncertainty but also creates administrative discrimination that can disadvantage heirs who are not in a direct bloodline.

Abstract

This research aims to analyze the legal certainty of the Constitutional Court Decision Number 46/PUU-VIII/2010 regarding the legal status of children born out of wedlock. This decision regulates the recognition of rights for children born out of wedlock, who previously often did not receive adequate legal protection. The analysis is carried out by examining the implications of the decision on legal practices in Indonesia, including how the decision can serve as evidence in resolving disputes related to the legal status of children. Additionally, this research also examines the impact of the decision on the protection of children's rights, as well as the response of society and the government in supporting the implementation of the decision. The results of this analysis are expected to provide a better understanding of the role of the Constitutional Court in upholding legal certainty and the rights of children in the social and legal context of Indonesia. The method used in this research is a normative legal research method, which is applied to examine regulations related to the protection for children born out of wedlock under Constitutional Court Decision No. 46/PUU-VII/2010 is incomplete, as the decision requires DNA testing to establish paternity but lacks enforceable regulations to compel such testing. Despite its limitations, the decision reflects the state's effort to protect these children while encouraging compliance with marriage laws to create a more conducive legal environment.

Abstract

This research aims to the meaning and limitations of a notary's obligation to “safeguard the interests of the parties involved in legal acts” as stipulated in Article 16 paragraph (1) letter a of the Indonesian Notary Position Act. This provision raises ambiguity or lack of clarity due to the insufficient explanation in the law, particularly regarding the phrase "safeguard the interests of the parties." Using a normative juridical research method with a legislative and conceptual approach, with legal materials consisting of primary and secondary legal sources to be analyzed through grammatical interpretation, this study explores the extent to which notaries are required to act neutrally, faithfully, and independently in carrying out their duties. The research finds that the ambiguity of the provision may lead to varying interpretations among notaries, which in turn affects the consistency of the law's application in practice. There is a need for more detailed or explicit guidance in the law to avoid multiple interpretations that could trigger ambiguity in the performance of a notary's duties. This study emphasizes the importance of reformulating the legal provisions to ensure that the notary's obligations in safeguarding the interests of the parties involved are clearer, thereby ensuring legal certainty and protection for all parties involved in legal acts.

Abstract

This research aims to analyze the urgency and mechanisms for affixing signatures on auction minutes, particularly for individuals with physical disabilities or limb impairments (physical disabilities) acting as auction buyerss. In the context of Indonesian law, auction minutes constitute an authentic deed requiring a signature as a legal validity condition that grants it full evidentiary strength. However, individuals with limb impairments who may have physical limitations in affixing conventional signatures face challenges in fulfilling this requirement. Therefore, legal reconstruction is crucial to provide alternative valid signatures for individuals with disabilities, such as fingerprints or electronic signatures. This research employs a normative juridical method, referring to relevant legislation and a conceptual approach to analyze legal principles and justice in fulfilling the rights of persons with disabilities. The findings indicate that affixing signatures on auction minutes for individuals with limb impairments is of high urgency to ensure legal certainty and validity. The regulation of alternative valid signatures will ensure that the rights of persons with disabilities are upheld in the legal auction process. Thus, regulatory changes to provide equal access for persons with disabilities in authentic deed transactions are essential for inclusive legal justice and certainty.
