Abstract

This research examines the strategic role of social entrepreneurship in the resolution of communal conflicts in Indonesia, focusing on its use as a tool for mediation and community recovery. Utilizing qualitative methodologies and documentary studies, this study collects and analyzes data on how social entrepreneurship initiatives contribute to peacebuilding and social integration. The findings indicate that social entrepreneurship not only plays a role in generating economic profits but also promotes social coherence and improves the quality of life in communities affected by conflicts. This study also evaluates the challenges in the implementation of social entrepreneurship and provides practical recommendations for the development of policies and practices that support social integration and national stability. Consequently, this study offers valuable insights into the potential of social entrepreneurship as an effective tool in resolving communal conflicts in Indonesia

Abstract

The problem of High Social Gap in Papua is an indication of the causes of marginalization and discrimination against the Papuan people. The difference in perceptions of some Indonesian people at home and abroad regarding the armed separatist conflict is a push factor to corner the Indonesian government. Apart from that, the issue of the internationalization of the 1969 referendum mechanism, violations of Human Rights (HAM), and the management of Natural Resources (SDA) by multinational companies which did not have an impact on improving the welfare of the Papuan people also complement the opinion of the government's failure. Based on the background of the problem, this research uses qualitative research methods and a descriptive approach. The research results show that conflict resolution in Papua can be implemented through (three) things, namely the first, the gradual development of an Integrated Food Estate (IFE) according to traditional areas in Papua, which will indirectly support the realization of Territorial Resilience and the Universal Defense System (Sishanta). Furthermore, to ensure that all these processes are carried out well and continuously, it is necessary to form an Integrated Solution Center (ISC). To eliminate the issue of internationalization of Papua, it is necessary to implement International Defense Diplomacy (IDD) carried out by Indonesian government agents abroad to socialize International Laws which are the juridical basis that Papua is part of the Unitary State of the Republic of Indonesia (NKRI). By implementing all these recommendations, it is hoped that a peaceful and prosperous Papuan society will soon be realized.

Abstract

This study aims to analyze the understanding and application of eco-theology in Islamic Boarding Schools in North Sumatra. Eco-theology connects religious teachings with human responsibility towards environmental stewardship, and in the Islamic context, it is based on the teachings of the Qur'an and hadith. The research used a qualitative method involving direct observation and in-depth interviews with Islamic Boarding Schools in the South Tapanuli region. The findings indicate that although Islamic Boarding Schools serve as pillars of religious education, the implementation of eco-theology concepts remains limited, particularly in terms of environmental management, such as river cleanliness and sanitation practices. The study concludes that there is a need to enhance environmental awareness in Islamic Boarding Schools through structured greening and waste management programs.

Abstract

Chinese culture represents the rich tapestry of various ethnic traditions. The development of these diverse cultures is essential for the overall prosperity of Chinese civilization. Therefore, promoting the innovative advancement of the Zhuang ethnic group's traditional culture can bolster their cultural confidence, preserve the diversity of Chinese culture, strengthen national identity, foster ethnic unity and progress, enrich spiritual and cultural life, and support rural community development. In today's rapidly evolving integrated media landscape, driven by information technology, the innovative development of the Zhuang's traditional culture encounters significant opportunities. In this study, we first explored the value foundation of innovative development of excellent traditional culture of the Zhuang ethnic group in the era of integrated media. Then, we analyzed the promoting effect of integrated media technology on the innovative development of excellent traditional culture of the Zhuang ethnic group in the new media ecological environment. Finally, we summarized how to fully utilize new technological means, create an integrated media matrix, and leverage resource integration advantages to achieve innovative development of excellent traditional culture of the Zhuang ethnic group. The research results are conducive to deeply exploring the contemporary value of excellent traditional culture of the Zhuang ethnic group and activating its cultural vitality, continuously promoting the creative transformation and innovative development of excellent traditional culture in China, thereby promoting the prosperity and development of cultural undertakings and cultural industries.

Abstract

Purpose - Lecturer research performance is critical for university success, yet the interplay between leader expectation, coworker pressure, and organizational support remains underexplored. This study aims to investigate the effect of leader expectation and coworker pressure on lecturer performance, with organizational support as a mediating variable. A quantitative descriptive method was employed using data from 90 lecturers sampled from private universities in Cirebon City, Indonesia. Data were analyzed using Structural Equation Modeling (SEM) with SmartPLS software. The results show that leader expectation significantly impacts lecturer research performance, while organizational support mediates the relationship between coworker pressure and research performance. This study introduces a novel perspective on the positive role of coworker pressure in enhancing research performance when supported by strong organizational support. Universities should prioritize leadership development, foster collaborative work environments, and establish policies that promote research productivity through enhanced organizational support, such as accessible research facilities and effective communication channels.

Abstract

The aim of this study is to investigate: (1) the effect of income smoothing, earnings persistence, and systematic risk on ERC; (2) whether free cash flow moderates the relationship between income smoothing, earnings persistence, and systematic risk on ERC; (3) the influence of income smoothing, earnings persistence, and systematic risk on free cash flow; (4) how these factors affect free cash flow; and (5) the impact of free cash flow on ERC. The research uses a quantitative approach, drawing on secondary data from energy and mineral companies listed on the Indonesia Stock Exchange, with purposive sampling criteria for the 2018-2021 period (4 years). The findings reveal that (1) income smoothing, earnings persistence, and systematic risk do not have a significant impact on ERC; (2) free cash flow does not serve as a moderating variable, as it does not amplify the effect of income smoothing, earnings persistence, and systematic risk on ERC; (3) earnings persistence affects free cash flow; and (4) free cash flow influences ERC. The originality of this study lies in its contribution to transparency literature, demonstrating that (1) the market's reaction to earnings information is not linked to financial statement manipulation, with the market responding more to the availability of funds for investors.

Abstract

Climate change has emerged as a new business risk that must be carefully evaluated, forecasted, mitigated and managed by all corporate organizations, including banks. Climate change has a profound effect on finance and business continuity, so all sectors, including the financial industry, must plan for it. In June 2022, the Basel Committee on Banking Supervision (BAS) announced general principles for banks around the world to manage and supervise climate change risks, entitled “Principles for the Effective Management and Supervision of Climate-Related Financial Risks”. Managing Climate-Related Financial Risks requires an acceptable management structure and information tools that can be used by banks to monitor, measure and manage asset portfolios affected by Climate-Related Financial Risks. In addition, this research also aims to assess the readiness of Indonesian banks in implementing an effective BCBS management framework for climate change-related financial risks. This research utilizes a qualitative research type. The research methodology used in this study is to use in-depth and semi-structured interviews to obtain narratives and subjective reflections from the participants. The main purpose of the interviews was to uncover significant meanings and structures inherent in their professional experiences. By using a sample method involving regulators and selecting banking executives who specialize in risk management. The results of this study provide an explanation of the perspective of Indonesian banks in dealing with business risks due to climate change, OJK's policies related to banking risk management due to climate change, OJK's response to the possibility of adopting an effective management framework for financial risks related to climate change developed by the BCBS in terms of, Bank Indonesia's Perspective on the Integration of Climate Risk into Macro Prudential Supervision, Impact on Financial Stability and Economic Resilience, and Policy Recommendations, and Banks' readiness to implement an effective financial risk management framework for financial risks related to climate change based on the risk management framework developed by the Basel Committee on Banking Supervision (BCBS).

Abstract

In Indonesia, every land right, management right, waqf land and ownership right to a condominium unit are registered by recording them in a land book, which contains physical data and legal data of the land area in question and as long as there is a measurement letter, which is also recorded in the measurement letter. Normative research method. Civil Code (KUHPerdata) Article 1866 KUHPerdata: States that the legal owner of a land right has the right to prove his ownership. In cases of embezzlement, the owner can use legal proof of ownership to file a claim. Article 197: Regulates the restoration of lost rights, which can be used as a basis for filing an application for restoration of rights to embezzled certificates. Law No. 5 of 1960 concerning Basic Agrarian Principles (UUPA): Article 1 Paragraph (1), Article 37, Article 672. Government Regulation No. 24 of 1997 concerning Land Registration: Article 1 Paragraph (1). PP NO. 18 OF 2021: a series of activities carried out by the Government continuously, continuously and regularly including the collection, processing, bookkeeping and presentation as well as maintenance of physical and legal data from each plot of land owned by the community, legal entities and government agencies. In its implementation, the definition above is carried out based on the principles of simplicity, safety, affordability, up-to-date and openness. Basically, the issuance and cancellation of land title certificates can be done in two ways, namely cancellation due to a court decision and cancellation carried out by the BPN itself. because the court decision only assesses the validity / does not have legal force, while the cancellation of the certificate is the authority of the BPN, are two different things.

Abstract

PT Bank Tabungan Negara (Persero) Tbk (Bank BTN) is a State-Owned Enterprise (BUMN) which operates in the banking sector, committed to being a bank that serves and supports housing sector financing. The mission carried out by Bank BTN is to actively support the government in advancing the welfare of the Indonesian people through home ownership and realizing the life that millions of Indonesians dream of through providing decent homes. One type of credit that is still in demand and needed by the public is KPR (Home Ownership Credit). Bank BTN as a bank that focuses on housing financing certainly fully supports the One Million Houses Program launched by the government. It is proven that currently Bank BTN is a bank with market share The largest Home Ownership Credit (KPR) in Indonesia. In order to improve and optimize services to the community with the development of the KPR business and support Bank operations both in terms of business processes and maintaining document quality, there are conditions where it is not possible to make a Sale and Purchase Deed (AJB) so that a temporary binding agreement is needed, namely a Sale and Purchase Agreement ( PPJB). This research aims to determine the implementation of KPR agreements by Bank BTN with sale and purchase binding deeds (PPJB) according to Article 42 paragraph (1) of Law no. 6 of 2023 concerning Job Creation at Bank BTN Kediri. This type of research is empirical juridical legal research and the specifications in this research are descriptive. The source and type of data in this research is primary data obtained from field studies in the form of interviews with Bank BTN Kediri employees. And secondary data was obtained from literature studies related to the theory of legal certainty. The results of this research are that the implementation of the KPR agreement by Bank BTN with the PPJB deed based on Article 42 paragraph (1) of the Job Creation Law does not fully meet the requirements stipulated in Article 42 paragraph (2) of the Job Creation Law.

Abstract

Fiduciary is a material guarantee which is a development of other material guarantees, namely Pawning. This development is a living need in society because pawning collateral which requires control of the pledged collateral object by the creditor is felt to be less supportive of business because the debtor cannot benefit from the collateral object so material collateral is needed which is more beneficial for the debtor but also the creditor's interests can still be protected. Execution of fiduciary guarantees can be carried out in accordance with article 29 UUJF, namely if the debtor or fiduciary person breaks his promise, the execution of the object that is the object of fiduciary guarantee point 1 above is the priority given by the material guarantee institution which is referred to as Parate execution, which is regulated in Article 15 paragraph (3) of the Fiduciary Guarantee Law (hereinafter abbreviated to "UUJF") which states that "If the debtor breaks his promise, the fiduciary recipient has the right to sell the object that is the object of the fiduciary guarantee under his own authority." The research method used is the Socio Legal Research Method or commonly used as empirical juridical research. Empirical legal research, namely data obtained directly from the community as the first source through field research. The research location is at the BRI Finance Malang Branch Office which is one of BRI's subsidiary entities which operates in the financing sector located in Malang City. One of the financing products from BRI Finance is Multipurpose Motor Vehicle Ownership Credit where the collateral is a motor vehicle tied to the institution fiduciary material guarantee. The results of the research show that the execution of credit collateral in the form of a motor vehicle tied to a fiduciary with the Constitutional Court decision Number 18/PUU/XVII/2019 which is confirmed by the Constitutional Court decision No.2/PUU-XIX/2021 becomes weaker because the creditor's preference rights are limited. The institution granted fiduciary material guarantees in the form of an execution parate cannot be carried out unilaterally because it must obtain the debtor's approval regarding the element of breach of contract/default and also the voluntary handover of fiduciary objects
