Abstract

The purpose of this study is to determine the position of mudharabah contracts in fiqh and the practice of mudharabah contracts in Islamic banking in Indonesia in general. The research method used by the author in this research is literature review, data collection through several journals, and several other references, then data analysis uses review analysis using data reduction, systematic and objective. The results of this study reveal that the mudharabah contract is a collaboration between the owner of the funds or investors (shaihb al-mal / rabb al-mal / investors) and the manager of capital (mudharib) to do business on the basis of a profit sharing ratio. Although mudharabah contracts have no basis in the Koran or implicit sunnah, they were used to carry out trade by the early generations of Muslims. Contracts are developed by the Fuqaha under conditions on his behalf based on general sharia principles of fairness. Islamic banking practices in carrying out mudharabah contracts as financing in the case of mudharabah contracts are one of the banking products, namely in the form of time savings, for example hajj savings, sacrifices, and special savings (special investments)

Abstract

The purpose of this research is to examine the mortgage financing products (KPR) at BSI with a review of the contestation between roles and risks. The research results are expected to contribute well to the development of further research. This type of research is descriptive qualitative by explaining in a narrative manner the results of more concrete and in-depth research relating to the technical aspects of Indonesian Islamic Bank (BSI) in channeling sharia-based KPR housing finance. The research subject is the Indonesian Islamic Bank (BSI) Parepare Branch. The research results were obtained by observing and using participatory interview instruments with the Consumer Processing Head. The results of the study show that Islamic banking is faced with a dilemma between carrying out its role in creating a conducive economy nationally and at the same time responding to the needs of society collectively. Through this role, banks obtain returns in the form of profits (profitability). However, in addition to obtaining profits, banks are also faced with a higher level of risk. With it, to maintain the existence of Islamic banking, it must receive collective support from all existing stakeholders. Consideration of risk in Islamic banking must also necessitate the management of financing in banks which pays more attention to the principle of prudence with good risk management and analysis, because between profit and risk, the two have an inherent (inherent) relationship that cannot be avoided.

The results reveal that Siri' culture fosters high moral responsibility among customers, enhancing their commitment to fulfilling financial obligations. Islamic work ethic strengthens accountability and transparency among bank employees, while the 5C principles provide a structured framework for financing decisions.. Practical implications – Banks can incorporate cultural dimensions, such as Siri' values of honesty (ada' tongeng), respect (sipakatau), and adherence to principles (getteng), into their credit analysis frameworks. This approach can enhance the quality of financing decisions by integrating ethical and moral considerations with technical assessments.. Originality/value – holistic approach, integrating cultural, ethical, and technical dimensions to mitigate financing risks

Abstract

Purpose – This study investigates whether the regulatory framework governing Sharia banks effectively enforces their distinctive characteristics and fulfills the objectives of maqashid sharia, amid concerns about their perceived similarity to conventional banks. Method – Using a normative legal approach, the research employs qualitative descriptive methods to analyze primary legal frameworks and validate findings through secondary sources. Findings –. The study finds that Indonesia pioneered the concept of Islamic banking in the 1970s, requiring financial intermediation based on a profit-sharing system in accordance with Sharia principles. Despite these mandates, some Sharia banks continue to adopt practices resembling conventional banking markup schemes. Practical implications – The findings highlight the need for legal reforms to reinforce Sharia banks' adherence to their foundational principles, thereby promoting a genuine partnership culture based on the principle of taawun (mutual cooperation). Originality/value – This research underscores the gap between regulatory mandates and practical implementation, offering insights into how legal adjustments can align Sharia banking practices more closely with their philosophical roots
