Abstract

The aims of this study is to identify and analyze unsecured loan agreements, especially in the Activity Management Unit (UPK). This study uses an empirical normative research method with conceptual approach, statute approach, and sociological approach. The agreement without any guarantee is one of the Community Empowerment Trust Fund (DAPM) programs in poverty reduction efforts. Based on the results of the research, the problems that arise are default in the form of bad loans and transfer of loan payments that occur due to several factors. The solution is to carry out several stages without giving a fine to the debtor.

Abstract

This research has the purpose to find out the legal relations between the parties like guarantor (bank) and insured (customer) through telemarketing offering bank insurance to the customers. This bank insurance is an agreement to give rights and duties to the parties. The type of this research is normative-empirical legal research which uses the statute approach, the conceptual approach, and the sociological approach. Based on the result of this field study, the study showed that there are problems like the bank not clearly explaining the insurance products when they offered to the customers. The legal protection for the bank customers regulated in Act Number 8 of 1999 concerning Consumer Protection and Financial Services Authority Regulation Number 23/POJK.05/2015 concerning Insurance Product and Insurance Product Marketing.

Abstract

This study aims to determine the implementation and responsibility of buying and selling imitation pearls at UD Ocin Pearl to- the consumer. This research applies empirical legal research methods using facts that occur in the field, and normative legal methods, namely legal research that defines law as a building system of norms such as legislation and various data. The implementation of this imitation pearl sale and purchase agreement is carried out by small traders who take the imitation pearl at the UD Store. Ocin. This imitation pearl was then traded in front of the hotel visited by out-of-town and local guests at an affordable price.

Abstract

This research has the purpose to find out the legal basis, the rights, and duties of the businessman of a beauty salon and the legal responsibility of the businessman against consumer tooth damages because of dental braces. The type of this research is empirical-legal study, the approach method in this study uses the statute approach, the conceptual approach, and the sociological approach. The result of this study showed that the beauty salon has no legality to install a dental brace, this contrasted with their rights and duties. The beauty salon legality is only for beauty care. Moreover, the general doctor practitioners have also no legality to install a dental brace, the dentist (orthodontist) is the only medic who has legality to install a dental brace. Consequently, the beauty salon in the installment of dental braces has been done the malpractice, it has no legality to install, and it is the default in contract categorical, and torts. The businessman of the beauty salon has committed torts, disobeyed against freedom of contract, disobeyed halal requirements, and disobeyed certain thing principles. Because of this, there is no responsibility for a beauty salon in the installment of dental braces, because the agreement is null and void.

Abstract

This research has the purpose (1) to find out the judge's legal consideration in the court decision number No. 03/Pdt.G.S/2020/PN.Sel concerning contract default in the PT. Bank Perkreditan Rakyat (BPR) Segara Anak Kencana credit agreement, and (2) to find out the legal consequences against the court decision number 3/Pdt.G.S/2020/PN.Sel concerning contract default in the credit agreement. The research method in this study uses the normative legal research method, which uses the statute approach, the cases approach, and the conceptual approach. The result of this study in this research that the judge's legal consideration is considering the defendant has contract default based on the agreement they made according to Article 1243 Indonesia Civil Code. Furthermore, the legal consequence, in this case, the agreement can be null and void, and the defendants must give compensation, change of risk in the guarantee object based on the substance of the agreement, and paying the court duty fee administration.

Abstract

This research aimed to reveal the legal arrangements of cosmetic products that are distributed without valid permission from the authority and to find out efforts undertaken by BPOM in supervising these products. The investigation is carried out by applying the normative-empirical legal research method. It is evident that BPOM has supervised these cosmetics by conducting inspections of distribution, taking cosmetics samples and laboratory testing to ensure their safety and quality. Moreover, the consumer is also protected through several preventive policies including direct in-field visitation to vendors and the public on the importance of understanding cosmetical products standard and socializing potential sanctions of selling illegal and hazardous cosmetics. In terms of repressive legal enforcement, the criminal law system and subsystem are involved, including relevant institutions such as police, judiciary, court and correctional institutions to tackle the distribution of illegal cosmetics.

Abstract

The purpose of this research was, first, to determine and understand the validity of land rights certificates issued without a certificate of land deed official (Pejabat Pembuat Akta Tanah or PPAT); second, to learn and understand the judge's considerations on land rights certificates without a land deed official in verdict of the Raba Bima District Court Number 13/PDT.G/2020/PN.RBI, how the law decides right or wrong, with a statutory approach, conceptual approach, and case approach. Data was collected by using sources of primary, secondary and tertiary legal materials. The technique of obtaining legal materials was conducting a literature study by examining various legal materials related to the subject matter. Furthermore, legal material was conducted using a card system, either with a summary card; quote card; and review cards. The data was compiled in a qualitative descriptive matter, problem solving procedures studied by describing the data obtained both primary and secondary data. Based on this research, according to law, Certificates issuedas an evidence of land rights without an authority of PPAT, are legal. And the judge's opinion in case number 13/Pdt.G/2020/PN.Rbi was invalid, illegitimate and not legally binding, it also cannot be justified by the law because the issuance of land rights certificates is not only proven by the existence of the notarial deed of sale which issued before PPAT, but can also use other evidence which is the Head of National Land Agency (Badan Pertanahan Nasional or BPN). It has the level of validity that is considered sufficient to register the transfer of land rights.

Abstract

This research was conducted with the aim of knowing the implementation of legal protection for children as victims of sexual violence in West Lombok Regency. This research is empirical legal research with approach methods, namely the statutory approach, conceptual approach and sociological approach. Sources of data are from library data and field data. The types of data are primary data and secondary data. Data collection techniques are by means of document studies and field studies in the form of interviews. Data analysis with descriptive quantitative analysis. The result of the research is that the implementation of protection for children who are victims of sexual violence in West Lombok Regency is in accordance with what is mandated in the Child Protection Act. As for the obstacles in the implementation of legal protection for children who are victims of sexual violence in West Lombok Regency, among others, the lack of parental supervision from both the victim and the perpetrator, the social environment including the family environment, limited child psychologists, especially in mentoring whose parties involve children who are still young. very small, remote place of residence and in West Lombok Police itself there is no Special Room for Children (RKP).

Abstract

The utilization of the coastal border area for business in Senteluk Village Batulayar District usually make a conflict, especially between the businessman and the people who claim to be land owners, in a lease agreement legal relationship. Based on this case, the study's purpose is to find out the status of the land or lease agreement object in the coastal border area. The research method in this research is normative-legal research. The result of this study showed that first, land or lease agreement objects in Tanjung Bias could be analyzed based on two perspectives. In the first perspective, If we analyze the legislation, the land is a coastal border, it is meant that the area should be possessed and managed by the state. In the second perspective, the coastal border is the private land owner and not the state owner because the owner has a certificate or authentic evidence to prove her land. The court decision showed that the land or lease agreement object at the coastline border area is the owner of the plaintiff or individual rights. If the party default so the lessee or the landowner has the right to null and void the lease agreement or they could make another legal action based on the legislation

Abstract

Undang Undang Dasar 1945, Pasal 27 ayat (2) menetapkan bahwa, “tiap-tiap warganegara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan”. Guna mewujudkan ketentuan pasal tersebut maka Pemerintah mengeluarkan UU. Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI). Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI), pada intinya mengatur tentang bagaimana cara bekerja di Luar Negeri yang baik atau sesuai dengan ketentuan peraturan perundang-undangan. Dalam rangka memasyarakatkan tentang bagaimana prosedur bekerja yang baik di luar Negeri sebagaimana diatur dalam Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI) di atas Tim Penyuluh Fakultas Hukum Universitas Mataram dengan Surat Tugas No. 3340/UN18.F3/PP/2021 tanggal 5 Juli 2021 melakukan penyuluhan di Desa Kekeri, Kecamatan Gunungsari, Kabupaten Lombok Barat, tanggal 9 September 2021. Penyuluhan dilakukan dengan tatap muka secara langsung dengan para audience yang terdiri dari para pemuda, tokoh masyarakat dan aparat Kampung dan desa.
