Abstract

This research aims to evaluate the effectiveness of the implementation of restorative justice by the District Court of Medan in achieving legal certainty for all parties involved in the legal process. The research method used is normative juridical legal research, focusing on written regulations and other legal materials. Data collection is conducted through literature review to explore concepts, theories, or opinions regarding Legal Certainty in the Implementation of Restorative Justice. The analysis is qualitative, explaining the relationship between types of data, selection, and data processing to be systematically outlined. The conclusion of the analysis will include answers to the issues raised and evidence of the truth or falsity of the hypotheses proposed. The results of the research indicate that the Indonesian Criminal Justice System has undergone renewal with the introduction of the concept of restorative justice. This involves perpetrators, victims, and other stakeholders in seeking fair solutions and peace after criminal events. The Public Prosecutor's Office plays a crucial role in prosecution, and the principle of "enn en ondeelbaar" asserts its functional unity. Restorative Justice has been regulated in laws and regulations, providing opportunities for victims and perpetrators to participate in peaceful case resolution. Restorative Justice offers an alternative to criminal case resolution outside the courtroom, focusing on restoration and reconciliation. In the District Attorney's Office of Medan, the process requires detailed administration. The regulation of victim protection in criminal law is stipulated in Indonesian positive law. Restorative Justice is applied in the general court environment with the aim of creating legal certainty and justice for all parties involved. Legal certainty in the application of Restorative Justice allows for various alternative handling of criminal offenses outside the courtroom, such as out-of-court settlements. This can reduce case backlog and high costs, as well as shorten the resolution process compared to litigation. Restorative Justice also prioritizes substantive justice with a focus on the interests of victims and restoring conditions to pre-criminal levels.

Abstract

The aim of this scientific writing is to find out the legal implications of the AoA/WTO for trade in the Indonesian agricultural sector, as well as to find out how Indonesia provides legal protection for trade in agricultural products due to the liberalization of world trade. This scientific research uses normative juridical research methods, and the data collected will be analyzed juridically qualitatively, then the results of this research will be described descriptively analytically. From the research results, the author obtained data that to implement the AoA/WTO provisions, Indonesia updated its legal provisions in the agricultural sector through several national provisions. However, this implementation has implications that have a negative impact on farmers, as a result trade in the Indonesian agricultural sector decreases, such as imports of food products increasing, farmers' income decreasing, there are no subsidies for farmers, food insecurity and hunger, Bulog becomes a company, and etc. To anticipate the negative impact of trade liberalization on the agricultural sector, the Indonesian government has made such efforts, such as enacting Law No. 29 of 2000, concerning the protection of plant varieties, Presidential Decree No. 77 of 2005, concerning the procurement and distribution of subsidized fertilizers, at the beginning of September 2007, The Decree of the Coordinating Minister for the Economy gave full authority to Bulog, in May 2007, the government issued a Draft Government Regulation (RPP) concerning the National Agrarian Reform Program (PPAN) / Landreform, and at the international level, Indonesia created the SP (Special Product) and SSM (Special Product) programs. Abstract

In 2021 the government issued Minister of Health Regulation Number 14 of 2021 concerning Standards for Business Activities and Products in the Implementation of Risk-Based Business Licensing in the Health Sector (hereinafter abbreviated as Minister of Health Regulation No. 14 of 2021). In this regulation there are several changes, one of which is that the pharmacy must be owned by a pharmacist. If the pharmacy is not owned by a pharmacist, the capital owner may collaborate with the pharmacist by agreement before a notary. With this provision, there have been several changes for a pharmacist, one of which is regarding the fulfillment of tax obligations. Tax obligations for pharmacists who work only as pharmaceutical technical personnel, their tax obligations that must be fulfilled are only based on the KUP Law and Article 21 of the Income Tax Law Number 36 in 2008, which was most recently refined by Law Number 7 of 2021 concerning Harmonization of Tax Regulations. namely tax deductions by third parties, in this case by pharmacies. Meanwhile, with the Pharmacist's status as a Pharmacy owner, the fulfillment of his tax obligations will increase in accordance with Tax regulations, namely Business Entities. The problem is what if, during the course of the pharmacy business, the pharmacist who owns the pharmacy which was established based on the agreement resigns, what happens to fulfilling his tax obligations. In this regard, there are three problems that the researcher raises, first, what is the description of pharmacy ownership by pharmacists in West Sumatra, second, how to fulfill tax obligations for pharmacists as pharmaceutical workers and pharmacy owners in West Sumatra. third, problems encountered in fulfilling tax obligations by pharmacists who own pharmacies. In West Sumatra, the research uses research methods with an empirical juridical approach, descriptive research type, the data required is primary and secondary data as well as data collection techniques, interviews and document studies, data processing is carried out using qualitative analysis methods. The results of research on pharmacy ownership in West Sumatra are currently in various forms of business, namely Limited Liability Companies and Individual Businesses such as CVs and Firms so that ownership of Pharmacies is still owned by investors and currently there are 5 Pharmacies which are processing the extension of their Pharmacy Business Licenses and some have transferred their ownership to Children of financiers because they have completed their pharmacy studies, and there are also those who are currently processing business permits in the form of individual PT. Meanwhile, the tax obligations carried out by pharmacists as pharmacy business owners have not yet been implemented because currently pharmacies that use pharmacists as pharmacy owners with non-legal entity business forms are still in the process of processing their permits and legal entities. Problems encountered in fulfilling the tax obligations of pharmacists as business owners Pharmacies are still not visible, because the current status of Pharmacists still has the status of a Pharmaceutical Personnel, so their tax obligations are only limited to Income Tax Article 21.

Abstract

Regional development is an effort to utilize all regional potential to support development activities. Regional potential is the basic capital for the development of a community in improving its welfare. The existence of regional potential is a means that supports various development activities, both in terms of infrastructure potential, natural potential, population potential and business potential of the population as well as the potential of integrated cultural areas that can be exploited and used to improve development results in the context of justice and equity. area. A developed and developing regional area is strongly supported by regional potential. Regional territory is a geographical condition of an area that provides various opportunities for a region to manage regional potentials within a region. Community business activities also include the potential of productive areas in contributing to development activities and their results. The existence of sources of livelihood and employment owned by a community in a region will make a major contribution to development activities, especially in economic sectors that have the potential to increase a region's ability to become independent. Based on the description above, it becomes a concrete reference that every spatial planning activity carried out by the West Sumatra Regional Government, both in the Pariangan district of Tanah Datar Regency, the Harau district of Lima Puluh Kota District and the South Tiku District of Agam Regency have prepared spatial planning in order to increase tourism but not working as it should. This is due to the lack of clear coordination between nagari, tourism and spatial planning offices in order to increase tourism.

Abstract

Indemnity is a civil case, but damages can be pursued simultaneously with criminal cases when criminal law is applied. Although criminal law laws allow claims to incorporate damages in criminal cases, this type of case is rarely found in court as not all criminal cases can be sought for damages. This situation arises when the basis of the charges in a criminal case is an act committed by the accused. The study primarily utilizes a normative juridical approach, which entails studying existing problems based on applicable laws and regulations. In legal matters related to compensation, civil law is the governing jurisdiction. On the other hand, criminal matters are regulated by the Criminal Procedure Code. In cases involving both civil and criminal actions, the judge has the power to decide whether the compensation case should be merged with the criminal case. Based on the description provided, the paper will discuss the application of Article 98 of the Code of Criminal Procedure in compensating for unlawful acts under Article 1365 of the Civil Code. The paper will also explore the legal certainty of applying Article 98 of the Code of Criminal Procedure in compensating for unlawful acts under Article 1365 of the Civil Code.

Abstract

It is the duty of the government to ensure the safety and order of the citizenry. Order and security are vital elements that shape a society that is psychologically healthy and prepared for global competition. This is because environmental factors strongly influence individual character. The Indonesian criminal justice system must be adequately enforced to realize this ideal. Nevertheless, there are occasions when the effectiveness of law enforcement is uncertain, resulting in a state of unrest among the public and the persistence of criminal activity. This study was therefore undertaken to ascertain the impact of implementing criminal legislation on enhancing community security and order. The methodology employed comprised a descriptive qualitative approach utilising interviews, observations and the distribution of questionnaires via the online platform Google forms. The findings indicated that the enforcement of criminal law has a constructive influence on the advancement of community security and order.

Abstract

Law enforcement against money laundering crimes currently refers to the provisions of Law Number 8 of 2010 concerning Prevention and Eradication of Money Laundering Crimes (UU No. 8/2010 concerning PP-TPPU), which is the legal basis (umbrella law) for enforcers law in preventing and eradicating criminal acts of money laundering. Regarding reporting parties who are burdened with the obligation to report suspicious financial transactions to PPATK, this has been explicitly stipulated in the provisions of Article 17 of Law no. 8/2010 concerning PP-TPPU, where the parties consist of Financial Services Providers and Goods/Services Providers. There are inconsistencies in the formulation of the articles of Law no. 8/2010 concerning PP-TPPU and PP no. 43/2015 as an implementing regulation, will of course have implications for the legal certainty of protection for whistleblowers, which will have an impact on the implementation of reporting not being optimal and ultimately will also have an impact on efforts to prevent and eradicate money laundering crimes. This research is normative research. The research was carried out by researching the literature using a statute approach. The ideal regulation which is more legal and just, is to include several matters relating to whistleblowers in the Special Law on Whistleblowers or the revision of Law no. 31/2014 concerning PSK, namely: regarding information criteria, whistleblower rights, report substance, reporting system, technical protection and rewards for whistleblowers. Barriers to protection for whistleblowers of money laundering crimes, consisting of juridical factors and law enforcement factors . Juridical factors, protection of whistleblowers have not been clearly regulated in Law no. 31/2014 concerning prostitutes. Meanwhile, as a law enforcement factor, there are still differences in perception between law enforcers who are members of the criminal justice system and whistle blowers.

Abstract

Sebagai peradilan konstitusi, mahkamah konstitusi memiliki peran fundamental dalam menyelesaikan berbagai permasalahan yang menjadi kewenangannya. Untuk dapat beracara di Mahkamah Konstitusi, warga negara harus terlebih dahulu diakui sebagai pemohon yang memiliki kedudukan hukum (legal standing) dan memiliki kerugian atau potensi kerugian akibat berlakunya suatu norma. Kedudukan hukum para pihak menjadi syarat formil dalam setiap perkara di mahkamah konstitusi, terutama yang menjadi pokok perhatian adalah kedudukan hukum para pihak dalam perkara pengujian undang-undang terhadap UUD 1945. Permasalahannya ialah terkait dengan legal standing para pihak, tidak mempunyai parameter yang jelas dan Mahkamah Konstitusi diberikan kewenangan penuh untuk menafsirkan kedudukan hukum dari para pihak tersebut sehingga banyak permohonan yang dijatuhi putusan tidak dapat diterima karena pemohon tidak memiliki legal standing yang jelas. Kedudukan hukum para pemohon seharusnya tidak dibuat begitu rumit untuk menjamin bahwa para pihak yang merasa hak konstitusionalnya terlanggar bisa mendapatkan kepastian hukum.

Abstract

This research aims to determine the application of franchise agreements in a modern context. The research method used is normative juridical which is descriptive analytical in nature, using primary, secondary and tertiary data. A normative juridical approach with a systematic analysis of the legal provisions governing the phenomenon under study using various types of data such as relevant laws and legal literature. The conclusion obtained is that the application of the Franchise Agreement in the Modern context is made online and is legally valid and has the power of proof as per Article 5 of Law Number 11 of 2008 concerning Electronic Information and Transactions in conjunction with Article 46 of the Government Regulation of the Republic of Indonesia Number 71 of 2019 concerning Implementation Electronic Systems and Transactions. Then, if there is a settlement between the parties by means of non-litigation or outside court based on the provisions of Law of the Republic of Indonesia Number 30 of 1999 concerning Arbitration and Dispute Resolution or by litigation through a general court, namely a district court whose jurisdiction or area of ??authority has been determined by the parties. party. Legal provisions that can be used when disputing through court refer to Article 1243 of the Civil Code relating to compensation for losses due to broken promises or default. And termination of the agreement by one of the parties can be subject to sanctions in accordance with Article 16 paragraph (2) Government Regulation no. 42 of 2007 concerning Franchising.

Abstract

The crime of maltreatment often occurs and is spread through social media or direct observation, including in Indonesia, including in small cities such as Batam City. Maltreated children suffer from psychological and physical effects, such as physical, emotional, and sexual abuse, which frequently takes place in public settings such as households, schools, and other locations. Among the traits of restorative justice are its emphasis on future accountability, use of discussion and negotiation as the normative foundation, and healing-oriented approach. This study, which employs an empirical legal and social methodology, looks at how Batam City handles child abuse crimes and considers restorative justice. The primary and secondary data make up the research object. Interviewing connected parties in-depth yields primary data, such as the prosecutor's office, police, victims, women and children's offices, and judges. Meanwhile, secondary data involved primary legal materials, such as the 1945 Constitution, Criminal Code, Juvenile Justice System Law, Child Protection Law, in addition, additional legal materials in the form of books and scientific publications, as well as prosecution and police regulations for discontinuation of prosecution based on restorative justice and treatment of criminal cases based on the same principles. The findings and conclusions of this study indicate that the Batam City government and law enforcement organizations strongly believe in the application of restorative justice. Although it faces challenges and differences in views, the hope is to provide long-term benefits for the community, victims and perpetrators, so that restorative justice in Batam City becomes a progressive step in responding to violence against children.
