Abstract

There are many factors that can affect performance, but this study only examines factors of work discipline, work ability factors and work facilities factors. This study aims at determining the effect of work discipline variables, work ability variables and work facilities partially and simultaneously on the performance of employees at the East Medan Primary Tax Office. The population of this research is 113 employees. To determine the number of samples used the Slovin formula so that the sample is 53 employees. Data collection techniques in this study are questionnaires, interviews and documentation studies. While the data analysis technique used is the classical assumption test, multiple regression, t test, F test and the coefficient of determination. The results show that the work discipline variable has a significant effect on the performance of the employees at the East Medan Primary Tax Office, where the higher the work discipline, the better the employee's performance. The work ability variable has a significant effect on the performance of employees at the East Medan Primary Tax Office, where the higher the work ability, the better the employee's performance. The work facility variable has a significant influence on the performance of the employees at the East Medan Primary Tax Office, where the better the work facilities, the better the employee's performance. There is a significant influence on work discipline variables, work ability variables and work facilities variables on employee performance at the East Medan Primary Tax Office. The coefficient of determination is 88.40%, the variation in employee performance is explained by work discipline variables, work ability variables, and work facilities variables simultaneously, and the remaining 11.60% is explained by other factors such as organizational climate variables and leadership. It is recommended that leaders in agencies need to provide an example of discipline and assertiveness in making decisions so that work discipline in agencies can be better. In this case, every employee committing disciplinary violations, both minor and serious, must be given strict sanctions. Leaders in agencies need to make efforts so that employees have sufficient experience in their field of work and place employees in positions that are in accordance with their work experience. In this case, employees need to be given the opportunity to attend training such as training in accordance with the field of work of each employee. Agencies need to organize offices with more comfortable decorations, and also need to provide more adequate office equipment and supplies for employees to use by using the agency's budget. It is necessary to improve employee discipline and make more efforts to improve employee abilities because these variables are classified as weaker than the work facility variable. Other researchers need to do further research by using more independent variables on employee performance.

Abstract

Many companies have changed their management structure to be more effective and efficient, one of which is by outsourcing work to other parties or employing workers with a fixed-time work agreement (PKWT) system. The problem in PKWT is that there is a violation in the application of the Agreement system in the form of deviations from the implementation of the rules for the Fixed Time Work Agreement (PKWT), which isnt in accordance Law Number 13 of 2003 concerning Manpower. The method used in this research is descriptive analysis research. The data used are secondary data. Data analysis used qualitative juridical analysis. The results showed that: 1) In the outsourcing practice by PT Dipta Athiyasa Indonesia, outsourcing contracts were not clearly classified as to the nature and type of work carried out; 2) PT Dipta Athiyasa Indonesia empowerment of workers through contract extension and give priority to workers who have worked before to be rehired; 3) Constraints faced in implementing a fixed-time work agreement (PKWT) are obstacles related to existing regulations, related to agreements and supervision. The solution is that the government should immediately make improvements to the arrangements for workers / laborers on a Fixed Time Work Agreement (PKWT), so that workers / laborers get better legal protection.

Abstract

Teacher morale can be increased by improving the factors that can influence it. But what is discussed in this study is limited to the factors of principal leadership, work discipline and school facilities. This study aims to determine the effect of the principal's leadership, work discipline and school facilities simultaneously on the morale of teachers of SMP Hang Kesturi Medan. The population of this research is 34 teachers. To determine the number of samples used saturated samples so that the sample is 34 people. Data collection techniques in this study were questionnaires, interviews and documentation studies. While the data analysis technique used is the classical assumption test, multiple regression, t test, F test and the coefficient of determination. The results showed that the leadership of the principal had an effect on the morale of the teachers at SMP Hang Kesturi Medan. There is a positive influence where the better the leadership of the principal, the higher the morale of the teacher will be. This means that teacher morale can be increased by improving the leadership of the principal. Work discipline affects the morale of teachers at Hang Kesturi Middle School Medan. There is a positive influence where the better the work discipline, the higher the morale of the teacher. This means that teacher morale can be increased by improving work discipline. School facilities have an effect on the morale of teachers of SMP Hang Kesturi Medan. There is a positive influence where the better the school facilities, the higher the morale of the teachers. This means that teacher morale can be improved by improving school facilities. Simultaneously there is a significant influence of the principal's leadership, work discipline, school facilities on teacher morale. It is suggested that the principal should be more active in empowering parents and community members, schedule visits to other schools to increase cooperation in the education sector, seek to obtain funds for additional school facilities, and involve staff in managing school resources. It is advisable for the disciplined teacher to note important things in the teaching and learning process and the discipline of completing work according to the specified time. School facilities that need to be repaired with classroom decorations that provide an atmosphere of enthusiasm for learning, use props when delivering subject matter, and maintain the beauty of the school garden. The morale of the teacher can still be improved by improving the quality of teacher results in accordance with the set standards, namely planning learning techniques to improve the abilities of students. Further research is needed by other studies by examining more independent variables on teacher morale.

Abstract

Penelitian dengan judul Analisis Yuridis Pembentukan Peraturan Daerah Kabupaten Asahan Nomor 12 Tahun 2013 tentang Rencana Tata Ruang Wilayah Kabupaten Asahan Tahun 2013 – 2033: Studi Revisi Peraturan Daerah. Fokus penelitian yang menjadi permasalahan adalah bagaimana analisis hukum pembentukan Peraturan Daerah Kabupaten Asahan Nomor 12 Tahun 2013 tentang Rencana Tata Ruang Wilayah Kabupaten Asahan Tahun 2013 – 2033 (Perda RTRW Asahan), bagaimana pelaksanaan peninjauan kembali, dan upaya pemerintah kabupaten Asahan. Kesimpulan penelitian 1. Aspek substansi dan aspek struktur kaidah hukum telah sesuai materi muatan teknis Peraturan Daerah RTRW Kabupaten Asahan dengan: a. Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang (UUPR), b. RTRW Nasional Beserta Rencana Rincinya, c. RTRW Provinsi, tetapi aspek formal belum sempurna karena tidak tersedianya Naskah Akademik, 2. Berdasarkan Peninjauan Kembali RTRW Kabupaten Asahan, perlu Revisi karena hasil penilaian yang telah dilakukan kurang dari nilai yang menjadi ketentuan yaitu 77,85 (< 85), dan rekomendasi revisi yaitu perubahan peraturan perundang-undangan dikarenakan memiliki total nilai tingkat perubahan < 20 % yaitu 13,96 %, dan 3. Upaya-upaya Revisi Peraturan Daerah oleh Pemerintah Kabupaten Asahan belum dilengkapi Naskah Akademik dan Kajian Lingkungan Hidup Strategis (KLHS).

Abstract

Judul penelitian ini adalah Analisis Yuridis Penegakan Kode etik Polri di Kepolisian Daerah Sumatera Utara. Adapun yang menjadi tujuan penelitian yakni: pertama untuk mengetahui dan menganalisis upaya yuridis dan teknis yang dilakukan oleh Polri untuk meningkatkan penegakan hukum Kode Etik Profesi Polri, kedua untuk mengetahui dan menganalisis penegakan hukum Kode Etik Profesi Polri terhadap anggota Polri yang melakukan tindak pidana di Kepolisian Daerah Sumatera Utara.Hasil penelitian pertama Upaya yuridis dan teknis yang dilakukan oleh Polri untuk meningkatkan penegakan hukum Kode Etik Profesi Polri adalah pembaharuan Peraturan Kode Etik Profesi Polri, memantapkan kiprah Propam Polri sebagai garda terdepan penegakan hukum disiplin anggota Polri dan tranparansi serta melakukan penegakan supremasi hukum untuk mewujudkan program Kapolri menuju Polri yang Profesional, Modern dan terpercaya serta mewujudkan Good Governance; kedua Realitas penegakan hukum Kode Etik Profesi Polri terhadap anggota Polri yang melakukan tindak Pidana di Kepolisian Daerah Sumatera Utara, sudah terlaksana dengan baik, terbukti pada Keputusan Komisi Kode Etik Polri PUT KKEP/33/XI/2019/KKEP tanggal 14 November 2019, yang merekomendasikan AKP RADEN HERU SULISTIO NRP 65020301, diberhentikan tidak dengan hormat dari dinas Kepolisian Negara Republik Indonesia.

Abstract

Law in Indonesia provides protection for a person's freedom, namely strictly prohibiting the deprivation of a person's freedom, with the existence of criminal sanctions. Freedom of a person is a universal right from the law. But a person's freedom has also been limited for the sake of law enforcement, as stated in article 50 of the Criminal Code which states that if someone acts on the basis of a law, he will not be penalized. If we connect it with the main duties and responsibilities of an investigator, who can arrest, detain and carry out the process of examining the criminal suspect, the investigator will carry out it according to the criminal procedure law, which eliminates the universally recognized rights of freedom of people. is a normative-empirical legal research, because the researcher uses statutory regulations as a study in solving problems, and the researcher also directly interviews the parties involved. The judiciary is a general court under the Supreme Court of the Republic of Indonesia which is the front guard of judicial power carry out the judiciary to achieve justice and law enforcement. The duties and powers of the Court, to receive, examine and decide on every case that falls within the jurisdiction of the court; Courts in Indonesia carry out an integrated function that is represented by judges. Judges bear the responsibility of bringing justice to the people and truth (searching for the truth) in order to create social integration, not creating social disintegration otherwise. Therefore it is hoped that judges can become independent judges, integrity, honesty, accountability, responsibility, openness, impartiality, and equal treatment before the law according to the main values​of the MA - RI. The obstacle factor faced by pretrial in controlling investigators is that there is no sanction for investigators who ignore pretrial decisions; the pretrial process is very short, negative interpretations of the rule of law, the behavior of individual judges, and different interpretations of judges.

Abstract

Many factors affect performance, including organizational culture, commitment, work discipline, leadership, compensation, and so on. However, the factors studied are organizational culture, work discipline and commitment. This study aims at finding the effect of organizational culture and work discipline and commitment simultaneously to the performance of employees at the Medan Kota Primary Tax Office. The population of this research is 116 employees. In determining the sample, the Slovin formual was used and 54 people are obtained. The data collection techniques of this research are questionnaires and documentation study while the data analysis technique uses the classical assumption test, multiple regression, t test, F test and the coefficient of determination. The results showed that organizational culture showed a significant influence on the performance of employees at the Medan Kota Primary Tax Office. The better the organizational culture, the higher the performance. Work discipline shows a significant influence on the performance of employees at the Medan Kota Pratama Tax Office. The better the work discipline variable, the higher the performance variable. Commitment shows a significant effect on the performance of employees at the Medan Kota Pratama Tax Office. The better the commitment, the higher the performance. Simultaneously there is a significant influence on the influence of organizational culture, work discipline, and commitment to employee performance.

Abstract

Sexual gratification as a criminal act of corruption is widely discussed in discussion forums in Indonesia. It has to do with how difficult it is to prove it. It is a Criminal Law Study of Sexual Gratification as a Corruption Crime. The problem formulations are: 1) Can sexual gratification be linked as a criminal act of corruption?; 2) How can the proof of the wrongdoing of the recipient of sexual gratification be a criminal act of corruption. The research method used is the normative juridical legal research method. Abstract

Perkembangan dan peningkatan laba tidak selamanya dialami oleh suatu perusahaan, karena perusahaan memiliki banyak resiko bisnis yang berdampak kepada kesulitan finansial perusahaan. Akibat adanya resiko-resiko tersebut seringkali yang dikorbankan adalah tenaga kerja. Kasus pemutusan hubungan kerja terjadi pada PT Macan Yaohan Group. Berdasarkan putusan perkara Nomor 158/Pdt.Sus-PHI/2015/PN Medan atas gugatan pihak karyawan PT Macan Yaohan Group, memutuskan bahwa pihak tergugat wajib membayarkan uang pesangon 2 kali, uang penghargaan masa kerjasebanyak 1 kali, dan penggantian hak 15 % sesuai pasal 156. Namun sampai diputuskannya perkara, pihak tergugat belum membayarkan sepeserpun hak para pengugat. Maka dari itu perlu dilakukan analisis hukum terhadap perusahaan yang mengalami kesulitan finansial dalam penyelesaian hak-hak tenaga kerja korban PHK. Hasil penelitian menunjukan bahwa: 1) Sebab-sebab PT Macan Yaohan melakukan PHK karena mengalami kesulitan keuangan. 2) Penyelesaian hak pekerja atas PHK PT Macan Yaohan yang mengalami kesulitan keuangan sudah sesuai undang-undang ketenagakerjaan 3) Undang-undang memberikan perlindungan hukum pemutusan hubungan kerja oleh PT Macan Yaohan Medan.

Abstract

This study aims at analyzing the effect of academic supervision, the effect of work motivation and the effect of academic supervision and work motivation on increasing the pedagogical competence of teachers at SMP Parulian 2 P. Mandala Medan. The population used in this study are all 68 teachers and all of them are used as research samples. The data were collected using a questionnaire technique for the variables of academic supervision, work motivation and teacher pedagogical competence variables and documentation to obtain biographical data for the private SMP Swasta Parulian 2 P. Mandala Medan. Data were analyzed using product moment correlation and multiple correlation analysis. The results of the analysis show that there is an effect of academic supervision on teacher pedagogical competence with a coefficient of r = 0.611 or having moderate and positive strength. There is an effect of motivation on teacher pedagogic competence with a coefficient value of r = 0.694 or having moderate and positive strength. There is an effect of academic supervision and motivation on teacher pedagogical competence which is stated by the regression equation, namely Ŷ = 14.571 + 0.434 X1 + 0.737X2 with a contribution of 55.4%. The strength of the relationship is moderate and positive with a coefficient value of r = 0.744. Teachers can improve pedagogical competence through various activities, including teaching innovative learning techniques according to student character so that students understand the material presented more easily.
