Abstract

Pengaturan mengenai penyelesaian di luar pengadilan melalui mekanisme mediasi di tingkat kepolisian secara konkrit belum ada tetapi dalam praktek di masyarakat sering kali digunakan oleh masyarakat mengingat penyelesaian melalui mediasi ini banyak manfaatnya baik bagi korban maupun pelakunya sendiri. Kepolisian dapat berperan penting memfasilitasi musyawarah antar pihak yang berperkara sehingga kesempatan untuk menemukan penyelesaian damai di luar pengadilan menjadi semakin besar. Rumusan masalah dalam penelitian ini adalah bagaimana penyelesaian perkara kecelakaan lalu lintas diluar pengadilan di Indonesia, bagaimana peranan Kepolisian Resor Kota Deli Serdang dalam upaya penyelesaian perkara kecelakaan lalu lintas diluar pengadilan, faktor kendala apa saja yang dihadapi Kepolisian Resor Kota Deli Serdang dalam upaya penyelesaian perkara kecelakaan lalu lintas diluar pengadilan. Adapun metode penelitian yang digunakan adalah metode deskriptif, sedangkan teknik analisis data menggunakan kualitatif. Hasil penelitian menunjukkan bahwa penyelesaian perkara diluar pengadilan di Indonesia telah banyak diterapkan di Indonesia khususnya pada perkara kecelakaan lalu lintas. Penyelesaian perkara di luar pengadilan akan lebih menjamin tercapainya penyelesaian yang menguntungkan bagi para pihak yang berperkara dalam bentuk restorative justice. Kepolisian Resor Kota Deli Serdang telah melakukan upaya yang maksimal untuk berperan dalam menyelesaikan perkara kecelakaan lalu lintas di luar proses peradilan pidana melalui mediasi antara keluarga korban dengan keluarga pelaku. Kepolisian yang menerima laporan kecelakaan lalu lintas akan segera mengupayakan musyawarah antara kedua pihak dengan dimediasi oleh penyidik kepolisian. Adapun faktor kendala yang dihadapi dalam penyelesaian perkara kecelakaan lalu lintas di luar pengadilan adalah: kesepakatan damai antara para pihak dalam musyawarah sulit dicapai sebagai akibat sulitnya mempertemukan kepentingan para pihak sehingga perdamaian dinyatakan gagal, keadaan ekonomi keluarga pelaku kecelakaan yang kemungkinan tidak mampu memenuhi ganti rugi yang relatif besar bagi keluarga korban. Kendala lain yang dihadapi adalah jika korban meninggal dunia, sehingga keluarga korban menjadi sangat sulit untuk diajak berdamai dan justru menghendaki agar pelaku dijatuhi hukuman pidana penjara yang seberat-beratnya. Disarankan perlu dipertimbangkan agar proses musyawarah tidak melibatkan terlalu banyak lembaga (orang) sehingga beban biaya yang harus ditanggung oleh keluarga pelaku tindak pidana menjadi lebih ringan. Kepolisian berupaya memberikan pemahaman bagi keluarga korban yang meninggal dunia bahwa menghukum pelaku dengan pidana penjara juga bukan merupakan penyelesaian terbaik dan justru hanya merupakan pemaksaan balas dendam bagi pelaku kecelakaan lalu lintas. Dengan demikian keluarga korban diharapkan dapat menerima penyelesaian perkara diluar pengadilan. Kepolisian perlu melibatkan tokoh masyarakat yang benar-benar dihormati ditengah masyarakat, sehingga para pihak yang terkait dengan perkara menjadi lebih mudah untuk mengendalikan emosi, serta dapat menunjukkan niat baik untuk menyelesaikan perkara melalui musyawarah mufakat.

Abstract

The purpose of this study is to find out, analyze and understand the procedures and mechanisms that are implemented in the implementation of good governance and good governance, the efforts undertaken by the government in improving the understanding of all components of stakeholders about good governance abd law enforcement against the civil servants who commit criminal acts. The data used in this study are primary data and secondary data. Primary data were obtained from the field by conducting interviews and case studies with related parties. Secondary data obtained through library research or documentation.Through this research obtained thoughts, doctrines, opinions or conceptual thoughts from previous studies relating to the object of research research In conducting research used legal materials consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The results showed that the procedures and mechanisms that are implemented in the implementation of good governance and good governance are the implementation of good governance, clean and authoritative sustainable development and social justice, functional aspects of government that are effective and efficient in making efforts to achieve national goals. The orientation of good governance is: ideal state orientation directed towards the achievement of national goals. This orientation refers to democratization in the life of the state with its constituent elements, such as: legitimacy (whether the government is elected and has the trust of its people, accountability, securing of human rights, autonomy und devolution of power, and assurance of civilian control. A functioning government ideal, that is, effective, efficient in making efforts to achieve rational goals.This orientation, depends on the extent to which the government has competence and the extent to which political and administrative structures and mechanisms function effectively and efficiently.The efforts that must be made in increasing understanding of all components stakeholders about good governance.To achieve the socio-economic conditions above, the process of forming a democratic government is absolutely necessary. management of state institutions, good and clean governance can be realized maximally if it is supported by two interrelated elements: the state and the Civil Society in which there is a private sector. Countries with their government bureaucracy are required to change the pattern of public services from an elitist bureaucracy perspective into a populist bureaucracy. Populist bureaucracy is governance that is oriented towards serving and siding with the interests of society. Realizing the principles of good and clean governance, regional autonomy policy can be used as a medium for the transformation of the realization of the model of governance that sustains the growth of democratic culture in Indonesia.

Abstract

This research aims at finding the role of the police in dealing with money laundering crime; the role of the police in solving money laundering crimes. Collecting instructions in this research was done by means of field studies and literature studies. Field studies are using the interview method, while literature study obtained principles, conceptions, views, legal doctrine and content of legal principles obtained from two main libraries, namely those that are general (Legislation, Regulations, Textbooks, Dictionaries) and those that are specific (journals, research reports, etc.) The modus operandi of the crime of money laundering is to keep secret who is the real owner and source of the money resulting from the mistake, changing its shape so that it makes tracking difficult by legal officials, so that young people are supervised by the real owner of the wealth (perpetrators of the crime). The role of the North Sumatra Regional Police (Polda) in preventing and overcoming the criminal act of money laundering, at the North Sumatra Regional Police (Polda), there are efforts that can be made, including: Pre-entative measures; Preventive Efforts; Repressive Efforts. In Handling the crime of money laundering, the North Sumatra regional police (Polda) coordinated with Financial Service Providers (PJK), Bank Indonesia, and the Financial Transaction Analysis Reporting Center (PPATK), Information from the Financial Intelligence Units (FIU) of other countries. Inhibiting factors for the North Sumatra Regional Police (Polda) in resolving money laundering crimes include: Factors covering the quantity factor of law enforcement, law enforcement that is less professional. Limited ability to place oneself in the role of the other party with whom he interacts; The level of aspiration is not high enough; Very limited excitement to think about the future, making it very difficult to make a projection; the absence of the ability to postpone the fulfillment of a particular need, especially material; This lack of innovativeness is actually a counterpart to conservatism.

Abstract

This study aims at finding the influence of organizational culture, leadership, and compensation segmentally and simultaneously on employee performance at KPP Pratama Medan Petisah. The population of this research is 105 employees working as staff employees (outside the Head of Office and Head of Section). The number of samples taken is 83 people using Probability Sampling with the Proportionate Stratified Random Sampling method. Data collection is using questionnaires, interviews, and documentation study while the data analysis technique used is the classical assumption test, multiple regressions, t test, F test, and the coefficient of determination. It is found that the better the organizational culture, the higher the performance; the better the leadership, the higher the performance; the better the employee compensation, the higher the performance. The variables of organizational culture, leadership, and compensation simultaneously have a significant effect on employee performance variables. The coefficient of determination Adjust R2 is 0.975. This means that variations in employee performance can be explained by organizational culture, leadership, and compensation of 97.5%, while the remaining 2.5% is explained by other factors such as training, work discipline, and other factors.

Abstract

This research was conducted at the Pirngadi Hospital in Medan. This research was focused on non-medical employees as research objects. Based on the data and reports obtained, the researcher hypothesized that there were four non-medical civil servant behavior that was the cause of the low quality of service, namely discipline, job satisfaction, motivation and performance. These four behaviors are then called variables. Researchers classify the discipline and job satisfaction variables into independent variables, motivation into intervening variables and performance into the dependent variable. This study aims at analyzing how the influence of the independent or independent variables on the dependent or dependent variable, and how the indirect effect of the independent variable through the mediating or intervening variables on the dependent variable. The research data were obtained through primary sources and filling out questionnaires by ninety-six samples. Hypothesis testing used path analysis using statistical analysis software. Based on the results of the path analysis method, it was concluded that the discipline variable had no effect on employee performance while the job satisfaction variable had an influence on employee performance. And indirectly there is an effect of discipline and job satisfaction through motivation on employee performance.

Abstract

The application of legal sanctions against perpetrators of narcotics crimes can be subject to rehabilitation sanctions. The purpose of punishment in narcotics crime as stipulated in Article 127 of Act Number 35 of 2009 must be carried out selectively regarding whether the perpetrator is a user or distributor. The conflict or norm conflict against the Law occurs in Article 127 where in Article 127 paragraph (1) the Judge can convict a narcotics abuser while in paragraph (2) and paragraph (3) it is stated that the Judge must rehabilitate addicts and victims of narcotics abuse. But in fact not all judges provide rehabilitation decisions. As happened in the Purwokert District Court.. The research conducted is normative legal research with the nature of descriptive analysis. This study used secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the study, it was found that the determination of sanctions against narcotics addicts, whether to impose criminal sanctions or sanction rehabilitation, this determination was in the hands of the judge. in accordance with the provisions of Article 127 and Article 103 of Law Number 35 of 2009. In the Indonesian criminal system, a double track system is known where the criminal system consists of criminal sanctions (sanctions) and sanctions for action (maatregel) so that based on article 54 of the Law Number 35 of 2009 for users and victims of narcotics abuse, medical and social rehabilitation is required.

Abstract

The purpose of this study was to find out and understand the factors that led to gambling crime in the Regional Police of North Sumatra, the efforts of the North Sumatra Regional Police in overcoming gambling in the North Sumatra Regional Police, the obstacles experienced by the North Sumatra Regional Police overcoming gambling crime in the Regional Police of North Sumatra.The results of the research show that the factors of the occurrence of criminal gambling are factors in the individual (internal) which include the level of education, religious factors, psychology. Factors originating from outside the individual (external) Economic factors, social factors, family environment. The efforts of the police in overcoming the crime of gambling in the Regional Police of North Sumatra include: Preventive prevention efforts, Rehabilitation efforts, Refresive mitigation efforts.

Abstract

yang menghambat proses peradilan (contempt of court) dalam sistem hukum pidana Indonesia; bagaimana perlindungan hukum terhadap korban (dalam hal ini hakim) atas perbuatan yang menghambat proses peradilan (contempt of court) dalam sistem hukum pidana Indonesia; dan bagaimana upaya dalam mencegah terjadinya perbuatan yang menghambat proses peradilan (contempt of court) dalam sistem hukum pidana Indonesia. Adapun metode pengumpulan data dalam penelitian ini ditempuh dengan cara Studi Kepustakaan. Menggunakan metode studi kepustakaan diperoleh asas-asas, konsepsi-konsepsi, pandangan-pandangan, doktrin-doktrin hukum serta isi kaidah hukum yang diperoleh dari dua referensi utama yaitu yang bersifat umum (perundang-undangan, peraturan, buku-buku teks, kamus) dan yang bersifat khusus (jurnal, laporan penelitian, dan lain- lain).Hasil penelitian menunjukkan bahwa prosedur pernyataan pailit dan pihak-pihak dalam kepailitan secara umum diajukan ke Pengadilan Niaga melalui panitera, Panitera menyampaikan permohonan pernyataan pailit kepada Ketua Pengadilan Negeri (Niaga) dalam waktu paling lambat 1 x 24 jam. Pemanggilan Sidang 7 hari sebelum sidang pertama di mulai. Sidang pemeriksaan atas permohonan pernyataan pertama di selenggarakan dalam jangka waktu paling lambat 20 hari terhitung sejak tanggal permohonan di daftarkan. Akibat hukum yang timbul terhadap perseroan terbatas yang dinyatakan Pailit bahwa seluruh harta kekayaan dari PT tersebut jatuh dalam penyitaan oleh Balai Harta Peninggalan, dan yang melakukan pengurusan dan pemberesan harta pailit adalah kurator dan Hakim pengawas. Pemberesan dan pengurusan harta pailit dan yang menyebabkan berakhirnya kepailitan yakni harta debitur pailit di likuidasi yang di lakukan oleh kurator atas hasil likuidasi kurator mendistribusikannya kepada masing-masing kreditur tersebut yang piutangnya telah diakui dalam proses pencocokan hutang sebagaimana ditentukan oleh Undang- undang, maka berakhirlah kepailitan itu.

Abstract

Pendahuluan; Komunikasi adalah kegiatan yang dilakukan setiap orang dalam kehidupan sehari–hari. Begitu pula dengan komunikasi interpersonal dalam proses pembelajaran. Selain memberikan materi pelajaran juga penting dalam proses komunikasi pembelajaran untuk dapat mengkomunikasikan harapan yang ingin dicapai, tujuan dan hasil pembelajaran, umpan balik juga evaluasi. Tujuan; untuk mengetahui pengaruh komunikasi interpersonal dosen dengan mahasiswa terhadap prestasi belajar mahasiswa di Politeknik Negeri Media Kreatif Medan. Metode; Dalam penulisan tesisi ini menggunakan metode yang bersifat korelasional. Mahasiswa Politeknik Negeri Media Kreatif Medan jurusan desain grafis semester II, IV, VI berjumlah 194 orang dengan sampel sebanyak 66 orang. Dalam penelitian ini menggunakan analisis data uji hipotesis dengan uji t dan uji koefisien determinasi. Hasil; Mayoritas responden meyatakan komunikasi antara dosen dengan mahasiswa berada dalam kategori cukup sebesar 56,1% , mayoritas prestasi akademik mahasiswa cukup sebesar 62,1%. Berdasarkan Hasil uji statistik regresi linear berganda diketahui nilai p = 0,000 < 0,05. Kesimpulan; Terdapat pengaruh yang sinifikan variabel Komunikasi antara Dosen dengan Mahasiswa terhadap prestasi akademik pada mahasiswa Politeknik Negeri Media Kreatif Medan. Saran; disarankan agar dosen meningkatkan kemampuan berkomunikasi interpersonal yang efektif dengan mahasiswa, sehingga dosen dapat menyampaikan materi kuliah dengan menyenangkan, jelas dan terarah serta mahasiswa dapat menerima pesan tersebut dengan baik.

Abstract

The support of the West Nias Regency DPRD (Regional People's Representative Assembly) secretariat is urgently needed so that the DPRD's performance can run well in order to absorb and carry out the aspirations of the people of West Nias Regency to carry out the Legislation, Budget and oversight functions. This study aims at: (i) finding the role of the West Nias Regency DPRD Secretariat in enhancing the performance of the West Nias Regency DPRD (ii) analyzing the factors that support and hinder the West Nias Regency DPRD Secretariat to improve the performance of the West Nias Regency DPRD. This research is descriptive with a qualitative approach. Research informants: key informants: West Nias DPRD Secretariat and key informants: DPRD members West Nias Regency. Data analysis technique used by the qualitative method Results: the role of the West Nias Regency DPRD Secretariat in the Improvement of the West Nias Regency DPRD shows 82% or between 80% to 100% good performance. Supporting factors are: optimization of available budget, cooperation and solid teamwork, maximizing facilities and infrastructure facilities. Inhibiting factors are lack of coordination and division of tasks is not optimal and scheduling of activities that almost coincides with implementation time especially in the procurement of facilities and infrastructure that supports the smooth administration of offices as well as several other activities in the capacity building program for regional people's representative institutions and limited staff of the DPRD Secretariat
