Abstract

Abstract Shariah are religious values that are expressed functionally and have a concrete meaning in directing life. Thus, the author would like to examine An-Naim’s views regarding the concept of sharih and human rights in the constitution in Indonesia.  While the objectives of this thesis are: 1. To find out how the concepts of shariah and human rights according to An-na’im, 2. To find out about the implications of the An-na’im idea with the reality and development of sharia, especially for the life of modern society, especially in human rights issues in the constitution in Indonesia, 3. review the ides of renewal of An-Na’im in sharia deconstruction. This research method used descriptive qualitative. Thus, to collect the data, the researcher conducted the library research such as, books of Abdullah An-Na’im, journal, article, etc. According to An-Na’im the deconstruction of Syari'ah is needed interpretation, although syariah come from Allah its need to be re-interpretation.  Keywords: Syariah, Deconstruction, Constitution

Abstract

A different cultural wedding is a marriage that takes place between a couple who come from a different background. Differences in thought and way of life can lead to a conflict. So the researchers would like to describe the conflicts that developed and how different cultural couples were trying to from the perfect family. The studi uses a qualitative approach with a type of case study. Studies suggest that these cultural background differences resulted in conflict within the marriiage. So couples in different cultures make an effort to resolve these conflicts. The maariages they undergo ore due to an adjustment or adaptation to the environtment and community. And adjustments to the spouse also made.

Abstract

 AbstackThis article discusses about the analysis of judges' considerations in the case of marriage isbat application in Malang District Religious Court. Second, the analysis of decisions based on judges' considerations. The last is the impact of the decision perspective of the maslahat perspective on children. These problems arose as a result of the implementation of a marriage that was not registered at the Marriage Registrar of the Office of Religious Affairs and then submitted a marriage request to take care of the child's birth certificate. This can be demonstrated from the case of the petitioners in the copy of the judge's decision. This study uses a normative juridical method with a descriptive analysis research approach, namely by analyzing and presenting systematic facts contained in the marriage request case number 0094/Pdt.P/2019/PA.Kab.Mlg. the conclusion of this research is based on the considerations of judges article 2 and 9 the marriage carried out violated the Marriage Law and Shari'a law and in its decision the Judge rejected the petition submitted. As for the analysis of a positive legal perspective judges in terms of article 14 and article 50 section 1 of the constitution number 48 of 2009 concerning judicial authority. Keywords: Judge’s consideration, Marriage isbat, Marriage Law

Abstract

Artikel ini membahas tentang validitas Ijab Kabul melalui media sosial dalam perspektif kompilasi hukum Islam. Hal ini penting untuk diteliti secara mendalam karena pesatnya perkembangan teknologi telah menimbulkan permasalahan baru di masyarakat, seperti pernikahan online. Hasil penelitian ini akan dianalisa oleh penulis untuk memunculkan jawaban tentang sahnya perkawinan secara online dengan mendeskripsikan mekanisme keabsahan akta nikah melalui media online, keabsahannya menurut UU No 1 Tahun 1974, dan legalitasnya. hukum perkawinan menurut pelaksana KUA dalam pandangan hukum Islam. Penelitian ini merupakan jenis penelitian kepustakaan dengan menggunakan pendekatan penelitian doktrinal. Hasil penelitian ini adalah: 1) Dalam pelaksanaan Ijab Kabul yang dilakukan secara online walaupun tempat terpisah, dalam mengucapkan akad nikah tetap dilakukan secara terus menerus antara wali dengan pihak mempelai pria. Menjamin kebenaran gambar dan suara calon mempelai, sehingga tidak diragukan keabsahan perkawinan yang tidak dilaksanakan dalam satu majelis, 2) Keabsahan perkawinan melalui media sosial menurut UU No. 1. 1974 tentang Perkawinan, hukum positif Indonesia tidak memiliki undang-undang yang mengatur secara formal tentang perkawinan online, 3) Menurut hukum Islam, praktik ijab kabul yang dilakukan secara online dapat dianggap sah jika satu majelis dalam prosesi akad nikah hanya menyangkut kesinambungan waktu antara pengucapan ijab kabul.Kata Kunci: Keabsahan Ijab Kabul, Media Sosial, Perspektif Hukum Islam

Abstract

In the case of divorce, a wife who is pregnant is in a religious court case. And this problem often feels strange in society. This case will be examined by researchers at the Religious Court of Malang Regency. This type of research uses qualitative. The researcher also uses judge interviews to add validity to this case. Thus, this study results that a wife's divorce in a pregnant state is allowed. The results of the judge's interview are khulu'. There is also a verse from the Qur'an in verse At-Talak verse 4 which means: "And women who are pregnant, their iddah is until they give birth to their womb". It is clear that if there is a period of iddah then divorce during pregnancy occurs and is allowed.

Abstract

Families are the members consisting of father, mother and child is a strong unity if a good relationship is established between the father-mother, mother-son and father-daughter. Good relations is characterized by the harmony in the mutual relationships between individuals within the family. The interaction between each family member affects the state of happiness (harmony) or unhappy (disharmonies) on one or a family member. And when a family experiencing disharmony it will have an impact for all family members child. In this study will be presented How social development of children from families that are not harmonized and how the social impact on a child or family relationships are not harmonious in the village Plososari District of Puri Mojokerto. This research is a descriptive qualitative research with in-depth interviews on the subject which is then analyzed to obtain the results. These results indicate that the association of children who are victims of family disharmony largely towards negative as is often out at night, and become the bad boy in school, this is because the child was finding comfort in the world of relationships rather than on his family but also some children still grow up to be a positive person just as patiently, this is because the strong environment of the child is a positive environment. And the focus of the second study showed that children who are victims of family disharmony tend to close themselves off from the social environment so that it becomes being personally hard and do arbitrarily, but it will be different when the child is in an environment that is positive child would also be a positive person anyway, like being a private patient.Kata Kunci: Dampak Ketidakharmonisan Keluarga, Perkembangan kehidupan anak, Perspektif Sosiologis

Abstract

Marriage isbat is a marriage that is held again because its validity is doubtful, the goal is to obtain a marriage certificate. In general, it is not explained in detail how to apply for a contentious marriage isbat application to a deceased spouse, in practice there are similar cases that were granted by the Malang Regency Religious Court Judges, such as case number 5457/Pdt.G/2021/PA.Kab.Mlg. This study focuses on the basis of the judge's consideration in granting the case and how the views of Islamic law are. The research used is descriptive qualitative using a case study strategy, which intends to understand the phenomena experienced by the research subjects by describing them in words and language. The results showed that in granting the case, the panel of judges was guided by KHI article 7 paragraphs 2 and 3, besides that the panel of judges received testimony from witnesses de auditu. Meanwhile, the marriage isbat in Islamic law is not explained in detail, but is confirmed with Surah Al-Baqarah verse 282 which explains that every muamalah must be recorded, so that couples who are married but do not have a marriage certificate can apply for a marriage isbat.Kata kunci: Contentious Marriage Isbat, Witness De Auditu, Judge's Decision

Abstract

This study discusses about the role of nadzir wakaf in terms of positive law and Islamic fiqh. As well as how to manage wakaf asset and the result of that wakaf asset This study was conducted to fulfil one of the requirements in completing the undergraduate program (S-1) islamic family law. Qualitative method was used in this study with asociological approach and the instruments were used there were interview and documentation. The result of this study conclude that the role of nadzir in managing wakaf property is very important, because nadzir is an important part of the management of productive wakaf, and the way of managing it was done by agriculture that the result then given completely to the mosque of Miftakhul Jannah for the prosperity of the mosque. Abstract

The family is the smallest institution that has leaders and members, has responsibilities between individuals. Every human being desires a family full of love and compassion that is built without oppression without any dominating one party, according to what is commanded in Islam, namely the sakinah, mawaddah and warohmah families, how happy a family is filled with mutual love, affection, protection and mutual respect. . Families like this are formed by themselves and are not inherited from their ancestors, but thanks to the efforts of all members in the family who interact and communicate with each other in one household. To be able to carry out the functions, duties and responsibilities of each in the family with the provisions ordered by Allah SWT so that the whole family is able to live life in the world in accordance with the times. Based on initial observations, that the development of the sakinah mawaddah warahmah family, DKM Agung Jami' Malang City uses a strategy by taking a personal approach to the guidance participants, this is a special strategy used by DKM in fostering sakinah, mawaddah, and warahmah families. This personal approach was taken because the problems of the participants who took the guidance were different, such as those who were married and those who were about to get married. From the background of the research above, the researcher formulates the problem, namely how the strategy used by DKM Agung Jami' Malang City in fostering a sakinah, mawaddah, warahmah family for converts and what are the supporting and inhibiting factors of DKM Agung Jami' Malang City in fostering a sakinah, mawaddah family. , warahmah for converts. The purpose of this study is to describe the strategies used by DKM Agung Jami' Malang City in fostering sakinah, mawaddah, warahmah families for converts and to describe the supporting and inhibiting factors of DKM Agung Jami' Malang City strategies in fostering sakinah, mawaddah, warahmah families for converts. To achieve the above objectives, the research was carried out with the type of research being a case study, the approach used in this study was a qualitative approach. As for the data sources in this study, DKM, who is the head of the Mualaf Center management at the Great Mosque of Jami' Malang City, penghulu, extension workers, treasurer kua, kua staff, and the administration. The method used is observation, interviews and documentation, then the data processing and analysis techniques are carried out in three stages, namely data reduction, data presentation and conclusion drawing. The results showed several DKM strategies in fostering sakinah, mawaddah, warahmah families for converts, namely through lecture strategies, demonstration strategies, individual approaches, settlement discussions. The supporting factors of DKM in fostering include: facilities and infrastructure, readiness of DKM time in providing guidance, the existence of a translation book guide, the existence of self-motivation, the motivation of other colleagues, and the inhibiting factors are the absence of an official structure, the absence of a place to work. specifically in conducting coaching, lack of awareness from converts' families, work and distance traveled. Things that need to be considered as suggestions are the need to establish a center converting institution with an official structure so that the guidance converts can be more focused and maximized in receiving material, it is necessary to have a recruitment system through electronic media owned by the Jami' Great Mosque institution.Kata kunci: Strategi, Dewan Kemakmuran Masjid, Keluarga Sakinah Mawaddah Warahmah, Mualaf
