Abstract

This article discusses the regulation of polygamy in Law No. 1 of 1974 and its derivative rules, as well as the Compilation of Islamic Law with an analysis of Islamic legal philosophy/maqashid al-shari’ah. This research is based on the legitimacy of polygamy as stated in Law Number 1 of 1974 concerning Marriage, article 3, paragraph 2. Polygamy also has rules that require the husband to obtain formal permission from the wife through a court process. Why do the Marriage Regulations regulate this? This research is based on a qualitative descriptive literature review. The method of analysis employed was content analysis, which involved creating an inventory of Indonesian family law norms and analyzing them using the maqashid al-shari’ah theory. This study finds that the regulation of polygamy in Indonesia is carried out to protect women's rights and children's rights. Furthermore, the rule aims to build a happy, peaceful, and prosperous family in the long run (sakinah, mawaddah, wa rahmah). This is in accordance with maqashid al-shari’ah, particularly in terms of soul preservation and descendent preservation.

Abstract

In the current context, the fiqh concepts of ulama nusantara(Nusantara Moslem Scholars) are important to be discussed as it has local wisdoms, progressivity, and adaptability in giving solutions to the society’s problems. This paper will discuss the fiqh concepts ofSyeikhArsyad al-Banjari in his book entitled SabilalMuhtadin that discusses fiqh(Islamic jurisprudence) in the perspective of Nusantara’s society, especially Banjarese society. This paper uses normative-sociological approach in analyzing the fiqh concepts of SyeikhArsyad al-Banjari, such as, zakat receivers, floating lavatory, corpse burial in coffin (tabala), and providing food for mourners. The results of the study indicate that al-Banjariwas mainly relied on “custom is law” (al-adatumuhakkamah) and “generating benefits or mashlahah and declining damage” (jalb al-mashalihwadar’ al-mafasid) in his ijtihad (independent reasoning). He also believed that law evolved according to the society’s situation and condition (taghayyur al-ahkamyata’allaqu bi taghayyur al-azminahwa al-amkinah). All of al-Banjari’s concepts are in-line with Syafi’iyyah school. Keywords: Ijtihad, Fiqh, Nusantara, and Sabilal Muhtadin

Abstract

Questions in this study are: What is the response of the board to the management of mosque-based productive waqf? The purpose of this study is to elaborate the management's response to the management of productive mosque-based waqf. The research conducted wasfield research, in the form of a mosque that met the criteria used as a research location. Mosque criteria are those that have the potential of managing a mosque-based productive waqf. Data collection is done through interviews. From the four mosques studied, the management's response had differences. The response of the mosque management and or the foundation, one mosque, the Babussalam Pekalongan East Lampung Mosque, the management objected if it was built in the front yard of the shop. The reason stated, the existence of the mosque for worship, not for business. While the management of the other three mosques agreed and strongly agreed that a mosque-based productive waqf management would be carried out by building shops in its front yard. Abstract

Abstract The findings of this study may contribute to the government’s efforts to tackle the terrorist movement in Indonesia. Education, until today, is believed to be one of the methods to conduct knowledge transformation. However, in the implementation of education, accessibility sometimes becomes one of the obstacles. Hence, this paper described several matters concerning the extension of access to education. This matter required a political policy concerning the availability of educational facilities. Set in West Papua Province, this study described higher education strengthening individual capacity. When an individual is capable and being empowered, it means that not only his/her family who enjoy that ability, but also the society and the nation will enjoy the advance and competitiveness of human resource excellence. This qualitative study also showed through data collection in descriptive way from observation during how limitations can be sources of strength. So the limitations need not be regarded as obstacles, but should even be opportunities to do innovations. The study also concluded how an unorganized higher education can have an impact on the economy that will hamper the journey to seize the opportunity to know. Finally, with the reconstruction of various resources, universities can remain the best means of providing energy to serve civilization. Keywords: Higher Education, Access, and Resources Abstrak Temuan penelitian ini berkontribusi terhadap upaya pemerintah dalam menanggulangi gerakan teroris di Indonesia. Pendidikan hingga hari ini diyakini sebagai sebuah metode untuk melakukan transformasi pengetahuan. Namun demikian, pada tataran implementasi, aksestabilitas pendidikan merupakan sebuah permasalahan tersendiri. Untuk itu, tulisan ini memberikan beberapa hal terkait dengan perluasan aksestabilitas pendidikan. Upaya perluasan harus ditopang oleh kebijakan politis terkait dengan ketersediaan fasilitas pendidikan. Studi yang dilakukan di Provinsi Papua Barat mendeskripsikan perguruan tinggi yang tengah memperkuat kapasitas individu civitas akademikanya. Manakala individu terberdayakan, tidak hanya keluarganya, tetapi masyarakat dan negaranya akan merasakan dampak positifnya. Penelitian kualitatif ini menggunakan data deskriptif dan observasi, penelitian juga menunjukkan bahwa keterbatasan aksestabilitas pendidikan adalah sumber kekuatan. Keterbatasan tersebut tidak pantas dipandang penghalang, melainkan sebagai tantangan untuk melakukan inovasi. Studi ini juga menyimpulkan bahwa sebuah perguruan tinggi yang kurang terorganisir memberikan dampak ekonomi yang menghalangi kesempatan untuk mendapatkan pengetahuan. Akhirnya, melalui rekonstruksi terhadap ragam sumber daya yang tersedia, perguruan tinggi diyakini tetap merupakan wahana penyedia energi positif bagi perkembangan peradaban. Abstract

Jaringan Islam Nusantara yang terhubung dengan Haramayn telah merangsang berkembangnya tradisi intelektual Islam di sejumlah wilayah Nusantara. Di wilayah ini, tradisi Islam ditandai beragam kreatifitas lokal keagamaan dalam mengartikulasikan beragam elemen lokal ke dalam tradisi keilmuan Islam. Puisi guguritan Sunda atau dangding merupakan salah satu bentuk elemen lokal yang menghiasi tradisi keilmuan Islam di Jawa Barat. Dengan menggunakan pendekatan strukturalisme sastra, kajian ini memfokuskan pada penggunaan guguritan sebagai bagian dari eskpresi kreatifitas keilmuan Islam tersebut. Pembahasan diarahkan pada masalah pengaruh Islam terhadap sastra Sunda, perkembangan puisi guguritan, dan posisinya dalam tradisi keilmuan Islam di Jawa Barat. Guguritan digunakan sedikitnya dalam tiga tradisi keilmuan Islam, yakni tasawuf, terjemah dan tafsir Al-Qur’an, dan catatan tentang perjalanan haji. Guguritan sufistik menghasilkan kreatifitas sufistik Sunda yang menitikberatkan pada citra simbolis lokal. Terjemah dan tafsir Al-Qur’an berbentuk guguritan mampu menghadirkan sebuah nuansa puitisasi terjemah dan tafsir sufistik yang jauh lebih kompleks dibanding terjemah puitis lainnya. Sedangkan guguritan haji mampu merekam perjalanan historis haji sekaligus mengekspresikan pengalaman spiritual ibadah haji secara individual. Elemen spiritual kiranya menjadi pengikat utama dari ketiga tema keislaman tersebut, karena bahasa guguritan lebih dekat dengan eksrepsi pengalaman batin yang suci dan sakral dibanding bernuansa hiburan dan profan. Studi ini menegaskan bahwa beragam tema keislaman tersebut menjadi bukti bahwa sastra keagamaan memiliki pengaruh besar dalam proses indigenisasi Islam dan perkembangan bahasa dan sastra Nusantara. Sebuah warisan keagamaan Islam Nusantara yang menjadi bagian dari kekayaan khasanah keagamaan Islam di dunia.The network of Islam in Indonesia which is connected to Haramayn has stimulated the development of the Islamic intellectual tradition in some regions of the archipelago . In this region, the Islamic tradition was marked by diverse local creativity in articulating some local elements into the intellectual tradition of Islam. Guguritan or Sundanese metrical poetry is a form of local elements that marked the intellectual tradition of Islam in West Java. Using a literary structuralism approach, this study focused on the use of guguritan as part of the expression of the tradition. The discussion highlights the influence of Islam to Sundanese literature, the development of guguritan, and its position in the intellectual tradition of Islam in West Java. Guguritan is used in at least three intellectual tradition of Islam: sufism, translation of the Qur’an and its commentaries, and story on the pilgrimage to Mecca. Sufi’s work in the form of guguritan generates a creativity of Sundanese sufi on local symbolic imagery. Translations and commentaries of the Quran in the form of guguritanpresents a poetic translation and interpretation which more complex than others. While the hajj story in the form of guguritan shows the recording historical journey and express spiritual experience of hajj individually. Spiritual element is the main binder of the three themes of the guguritanworks, because it is closer to express the inner experience of the holiness and sacred rather than a profane and entertainment. This study suggests that a variety of guguritanthemes of local Islamic literature greatly influences in the process of indigenization of Islam in the archipelago. It is an Islamic religious heritage in the archipelago which at once becomes a part of Islamic religious heritage in the world..

Abstract

Islamic contents and English were taught at Islamic Boarding School (IBS) Haramain Nahdlatul Wathan (NW) Narmada. English is taught as a general subject and compulsory subject as well. An English community (Language Asrama) is established by Kiai. It is aimed at practicing speaking English and exercising public speaking skills. IBS Haramain NW Narmada includes one of the IBSs in Indonesia in which it reflected Islamic values, cultures, and indoctrination in its teaching and learning. The pieces of evidence showed that this institution taught English for students (Santri) as a tool to gain global information around the world. Dealing with the ELT classrooms, IBS Haramian NW Narmada employed some learning strategies reflecting Islamic cultures and values such as syawir, Lalar, Hafal (memorizing), and Setoran (deposit). The strong emphasis on Arabic and English in daily communication addresses the immersion language program. It is a method applied to teach foreign languages. Based on the application, the IBS Haramain NW Narmada applied a total immersion program, in which Arabic and English are the target languages.

Abstract

Abstract This paper unpacks the management of local independence owned by the indigenous people of Lampung. The local independence of the indigenous people of Lampung in the form of Piil Pesenggiri philosophy of life needs to be managed as an asset or capital in shaping the character of the community. Piil Pesenggiri which includes four pillars, namely juluk adok, nemui nyimah, nengah nyappur and sakai sambayan contains noble values is important to be passed on and transformed to society. The focus of this study is on the role of traditional leaders (penyimbang) in building the character of ulun (people) Lampung based on the management of local independence. The data used this paper were obtained through observation, interviews and text analysis. Traditional leaders (penyimbang) manage their local independence through several sectors such as education, customary institutions, government institutions, community organizations, and religious institutions. Meanwhile, the role of traditional leaders (penyimbang) includes reconciling disputes, transforming and instilling the noble values ​​of Piil Pesenggiri, encouraging local languages ​​to be local content in education, and taking part in physical and non-physical development to advance the Lampung region. Abstract

Abstrak Pare merupakan salah satu daerah koordinator kecamatan di Kabupaten Kediri. Pare termasuk daerah yang telah berkembang secara pesat, dan dikenal sebagai Kampung Bahasa, atau Pusat Pelatihan Bahasa Asing terbesar diIndonesia. Paper ini adalah kajian yang berbasis penelitian lapangan (field research) Paper ini bertujuan untuk mengetahui peranan keagamaan didalam pendidikan kursusan berbasis bahasa pada siswa di Kampung Inggris. Penelitian ini sangat menarik karena Pendidikan kursus berbasis bahasa dikaji dalam hubungan nya dengan ke agamaan, dimana peserta didik sebagai objek sentralnya. Selanjutnya, penelitian ini adalah jenis penelitian deskripstif kualitatif yang dilakukan selama 3 bulan pada tanggal 1 Juni 2015. Populasi dari penelitian ini adalah semua kursus lembaga yang ada di kampung Inggris Pare Kediri. Data penelitian diperoleh melalui wawancara, observasi dan dokumentasi. Pada paper ini terdapat tiga persoalan yang hendak di kaji pertama, sejauh mana proses belajar agama di Kampung Inggris setelah banyaknya warga pendatang?Kedua, sejauh mana proses belajar agama dikawasan yang wajib berbahasa Inggris? Ketiga, sejauh mana peranan lingkungan Kampung Inggris terhadap proses belajar agama di kampung Inggrs? Maka dihasilkan beberapa hal, yaitu pertama, mengetahui sejauh mana proses belajar agama di Kampung Inggris setelah banyaknya warga pendatang. Kedua, mengetahui sejauh mana proses belajar agama dikawasan yang wajib berbahasa Inggris, ketiga mengetahui peranan lingkungan Kampung Inggris terhadap proses belajar agama di kampung Inggris. Kata Kunci : Keagamaan, Pendidikan Bahasa, dan Kampung Inggris. Abstract Pare is one area in Kediri district coordinators. Pare including areas that had been growing rapidly, and is known as Kampung Language, Foreign Language Training Center or the largest companies . This research is very interesting because of the language -based education courses examined in its relations with all religious, where the learner as the central object. Furthermore, this study is the kind of qualitative research conducted deskripstif for 3 months on June 1, 2015. The population of this research is all of course agencies in the village Pare. Data were obtained through interviews, observation and documentation. In this paper, there are three issues to be investigated The first, the extent to which the process of religious learning in Kampung Inggris after the immigrant population? Secondly, how far has the area of religious study is required to speak English? Third, the extent to which the role of the British village environment to the learning process in the village Inggrs religion? Then produced a couple of things: first, determine the extent of religious learning process in Kampung Inggriss after the immigrant population. Second, determine the extent of religious learning process that must speak English region, three British Kampung know the role of the environment on the process of religious learning in the British village. Abstract

Hubungan sosial merupakan kebutuhan dasar manusia, manusia mungkin tidak dapat meniadakan interaksi mereka dengan manusia lain. Sayangnya realitas menunjukkan bahwa beberapa orang, ketika membangun hubungan, lupa bahwa ada perbedaan antara mereka, tetapi perbedaan adalah sesuatu yang mustahil dihilangkan dan dalam membangun hubungan sosial, toleransi diperlukan untuk mempertahankan perdamaian dan kebahagiaan secara sistematik. Islam melalui Muhammad Saw telah memberikan contoh nyata. Ia membangun kerjasama dan memperlakukan semua orang baik dengan Yahudi, Muslim atau Kristen; dengan perlakuan yang sama tanpa diskriminasi, perdamaian universal akhirnya dapat diwujudkan pada saat itu. Dalam perkembangannya, perdamaian universal mulai memudar, terulangnya diskriminasi berdasarkan agama dan kepercayaan. Sekarang, semua Muslim di dunia memiliki kewajiban sama untuk mencapai dan mempertahankan perdamaian universal yang sebelumnya telah dicapai.Social relations is a basic need of all human beings, human beings cannot possibly negate their interactions with other humans. Unfortunately the reality of some people when building a relationship they forget that there are differences between them, but the difference is something impossible is eliminated and in building social relationships, tolerance is necessary in order to maintain peace and happiness with the system. Islam through Muhammad has given a real example. He built a degree of cooperation and treat everyone well with Jewish, Muslim or Christian;, with equal treatment without discrimination slightly, so that at the end of universal peace is created at that time. In its development, universal peace began to fade, the recurrence of discrimination based on religion and belief. Now, all Muslims in the world have the same obligation to achieve and maintain universal peace that has previously been achieved.

Abstract

Membangun sebuah tatanan dunia baru yang produktif dan sejahtera sangat ditentukan oleh kerjasama yang saling menyelamatkan antarumat beragama dan lintas peradaban melalui dialog. Tulisan ini bertujuan untuk mengetahui dialog yang dilakukan oleh Nabi Muhammad dengan non muslim yang humanis, saling menyelamatkan dan mensejahterakan, yang kemudian dapat dijadikan contoh membangun peradaban agama masa kini. Metode yang digunakan adalah dengan mengumpulkan literatur klasik Islam, yang kemudian dilakukan content analisis sesuai konteks kekinian. Hasil telaahan menunjukkan bahwa dialog di sini dipahami sebagai suatu cara berjumpa atau memahami diri sendiri dan dunia pada tingkatan yang terdalam, membuka kemungkinan-kemungkinan untuk memperoleh makna fundamental dari kehidupan secara individu maupun kolektif dan dalam berbagai dimensinya. Dialog dipahami dan dipraktikkan pada masa lalu oleh para manusia pilihan, terutama Nabi Muhammad adalah untuk mensejahterakan umat manusia. Dialog tersebut berisi kesimpulan bahwa tidak ada suatu tatanan dunia yang sukses jika tidak dilengkapi dengan etika dunia, tidak ada perdamaian antar negara-negara tanpa adanya perdamaian antar agama-agama. Inilah saat yang tepat untuk mengambil kekuatan dialog Nabi Muhammad dengan non muslim pada tingkatan yang baru di mana ia dapat membuat perbedaan struktural untuk menghadapi problem-problem dunia. Building such a new system of world which productive and prosperous is profoundly determined by collaborating that mutually save among religious communities and across civilization through dialogue. This article aims to know the dialogue has been done by the prophet Muhammad SAW with non muslim community humanely, mutually,saving and bringing welfare. Then, it can be created pattern of building religious civilization nowdays. The usedmethod is collecting clasical islamic literature which is done through analysis based-content on current context. The outcome of study shows that dialogue here is understood as a way encountering and understanding one self and earth on the deepest of level, exposing possibilities to get fundamental sense of living individually and collectively on various demensions. In the past, dialogue is understood and practiced by choice people mainly the prophet Muhammad SAW is to bring welfare to whole of people. The dialogue consists of inference that none of system of world that actually get success if it is not completed with world values, no reconciliation among countries without having peace between the beliefs. Right now is right time to remove the power of the prophet Muhammad’s dialogue with non muslim communities on such new level where he was able to make distinct of structural to face worlds’ issues.
