Abstract

The land mafia in Indonesia is a complex phenomenon that harms society and has the potential to disrupt social stability. This research aims to analyze the practices of land mafia that occur in Indonesia and evaluate the eradication efforts by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN). Land mafia practices include certificate forgery, illegal land occupation, and document manipulation that threaten the ownership rights of the community. This research uses normative legal research methods, which involve the process of finding legal rules, principles, and legal doctrines to answer the legal issues at hand. Furthermore, this research also examines the policies and strategic steps taken by the ATR/BPN in combating the land mafia, including the establishment of the Anti-Land Mafia Task Force and the strengthening of land regulations. The results indicate that despite various eradication efforts, challenges in law enforcement and inter-agency coordination remain obstacles. Therefore, better synergy between the government, society, and the private sector is necessary to create a transparent and accountable land system. This research is expected to contribute to the development of more effective policies in eradicating the land mafia in Indonesia and reinforcing legal protection for the community.

Abstract

Menstruation is a critical aspect of puberty for adolescent girls, and effective Menstrual Hygiene Management (MHM) is vital for their health and well-being. In many schools in Indonesia, however, limited access to Water, Sanitation, and Hygiene (WASH) facilities creates significant barriers to proper MHM. This study aims to explore the challenges faced by adolescent girls in managing menstrual hygiene in schools with inadequate sanitation. A Participatory Action Research (PAR) approach was employed using the photovoice method, allowing 20 female students from SMPN 3 Selemadeg Timur, a school in Bali, to document their experiences with MHM. Data were collectedthrough interviews, Focus Group Discussions, and thematic analysis of the photographs. The findings revealed that inadequate toilets, lack of privacy, poor water supply, and ineffective waste management systems significantly hindered students' ability to manage menstrual hygiene at school. As a result, many students adopted the practice of taking home used menstrual pads due to the absence of proper disposal facilities. Cultural taboos and fear of bullying further complicated the issue, preventing students from reporting sanitation problems. Barriers to improving these conditions included limited funds, low awareness of cleanliness, and low prioritization of sanitation within the school. These factors led students to normalize taking used pads home or leaving school to change pads as an adaptation to the unsatisfactory sanitation conditions. The study highlights the need for improved sanitation infrastructure, better waste management, and a more supportive school environment for managing menstrual hygiene.

Abstract

Empowerment of rural communities in Afghanistan has great potential to change the knowledge, attitudes and work practices of villagers. Empowerment is considered fundamental to achieving development, as progress without empowerment of marginalized communities is often considered impossible. The purpose of this study is to formulate a strategy for rural community empowerment in line with sustainable development in Afghanistan. This research utilizes qualitative content analysis of relevant sources, with data collection through document analysis. The research reviews existing studies and theories, and introduces the background of empowerment in the context of sustainable rural development. The results show that empowering rural communities can be done by utilizing local resources and increasing the capacity of individuals to innovate. Proposed strategies include improving access to education, skills training, as well as supporting local economic initiatives. Effective empowerment not only increases agricultural productivity, but also strengthens social ties and trust among community members. Empowerment is a multidimensional process that includes economic, social, cultural, psychological and environmental aspects. It is essential for achieving sustainable development in Afghanistan, where challenges such as poverty and social disparities are still widespread. Women's empowerment, in this context, is critical to the transformation of society as a whole. Empowerment of rural communities in Afghanistan is key to achieving sustainable development. With a focus on empowerment, Afghanistan can create a resilient rural population, which contributes to national stability and sustainable growth. Policy recommendations include developing inclusive empowerment strategies, improving access to education and resources, and actively involving communities in decision-making processes.

Abstract

Handling children in conflict with the law in the juvenile criminal justice system requires a more humane and restorative approach. The purpose of this study is to analyze the application of diversion in the juvenile criminal justice system and identify the challenges faced. This research uses normative legal research method with statutory approach and case analysis. The results show that although diversion has been regulated in the law, its implementation still faces various obstacles, such as lack of understanding among law enforcers, community stigma towards children, and resistance from the justice system itself. Efforts to overcome these obstacles include education and socialization to the community as well as training for law enforcers. This research underscores the importance of support from all relevant parties, including law enforcement, the community, and the child family, to ensure the success of the diversion process. Better knowledge of the purpose and benefits of diversion can reduce stigma and improve child rehabilitation. Diversion as an alternative to out-ofcourt settlement in the juvenile criminal justice system has great potential to protect children from the negative impacts of formal legal proceedings. However, challenges need to be overcome through education, training and community empowerment. Support from families and communities is critical to the successful rehabilitation and social reintegration of children in conflict with the law. With the right approach, it is expected that the implementation of diversion can be more effective in achieving restorative justice for children.

Abstract

This study examines the legal uncertainty faced by persons with disabilities as witnesses and victims within Indonesia's criminal justice system. Although there are regulations that acknowledge the rights of persons with disabilities, their implementation often encounters various obstacles, ranging from inadequate accommodations to limited understanding among law enforcement officials. This legal uncertainty adversely impacts access to justice for persons with disabilities, who often feel marginalized within the legal process. Therefore, this research also discusses efforts to fulfill the rights of persons with disabilities as witnesses and victims, including the importance of training for law enforcement personnel, providing appropriate accommodations, and conducting comprehensive personal assessments to meet their specific needs. This study is expected to provide recommendations for policymakers to enhance legal protection and ensure accessibility for persons with disabilities within the criminal justice system.

Abstract

Vacancies in the position of regional heads have a significant impact on public services in the regions, which have implications for access, quality and responsiveness of services to the community. This study aims to identify and analyze the impact of vacancies of regional head positions on the delivery of public services and formulate strategies that can be done to improve the quality and responsiveness of public services in the regions. The research method used is normative legal research, with a focus on analyzing legal norms written in legislation and relevant legal literature. This approach is carried out by studying various regulations relating to public services and the authority of regional heads. The results showed that the vacancy of the regional head position caused serious disruption in the delivery of public services. This has resulted in a decline in service quality, delays in decision-making, and policy uncertainty that has a negative impact on public satisfaction. In addition, the vacancy poses challenges in maintaining public trust in the government. This research emphasizes the need for the transformation of public administration services to overcome the problems arising from the vacancy of the regional head position. Innovation and the use of information technology are expected to improve service efficiency and transparency. Recommendations are also given to develop human resource capacity and analyze community needs.

Abstract

This research aims to explore a clean public procurement system through criminal liability reform for Commitment Making Officials (PPK). PPK plays an important role in maintaining accountability, transparency, and integrity in the public procurement process. The research method used is a statutory approach and a conceptual approach. This research analyzes the regulations governing PPK's responsibilities and how they can be held criminally liable if proven to have abused their authority. It was found that PPK is often the party fully responsible for irregularities in procurement, despite the important role of other parties such as the Budget User (PA) and the Budget User Authority (KPA). This research shows that to prevent corrupt practices, stricter monitoring mechanisms and increased legal awareness among PPKs are needed. Criminal liability reform for PPKs is essential to create a more transparent and accountable public procurement of goods and services. Better understanding of legal responsibilities and training for PVRs can reduce the risk of abuse of authority. Achieving a clean procurement system requires improvements in regulation and oversight, as well as capacity building for PVRs. These reforms will support corruption prevention efforts and maximize benefits for society and the state.

Abstract

Corrections play a vital role within the integrated justice system, providing a recovery process for law violators. Correctional institutions aim not only to punish but also to rehabilitate and guide offenders toward social reintegration. This study aims to evaluate the effectiveness of assimilation programs in restoring the lives and livelihoods of prisoners and to explore how correctional institutions implement community-based corrections through these programs. A qualitative research approach was employed, utilizing data from relevant journals and regulations. An empirical legal analysis was conducted to examine the impact of assimilation programs on the rehabilitation of prisoners. The findings indicate that assimilation programs significantly enhance the self-improvement and social reintegration of prisoners. These programs provide essential skills training and community engagement opportunities, which are crucial for reducing recidivism. The study concludes that assimilation programs are effective in facilitating the recovery of prisoners and promoting their reintegration into society. This underscores the need for on-going support and enhancement of such programs within correctional institutions to ensure their success and the safety of the community.

Abstract

Judges play a vital role in upholding justice and public trust within the judicial system. This study examines the importance of the Judges' Code of Ethics in Indonesia, emphasizing its influence on the accountability and integrity of judicial decisions. The primary objectives are to analyze how the code serves as a guideline for judges and to assess its impact on public confidence in the legal system. Utilizing a normative juridical research method, the study relies on both primary and secondary legal materials, including legislative documents and case studies. The research involves a comprehensive literature review and a legislative approach to understand the ethical standards expected of judges in their professional conduct. The findings reveal that adherence to the Judges' Code of Ethics is crucial for maintaining impartiality, avoiding conflicts of interest, and ensuring fair trial processes. Ethical violations can significantly undermine public trust, leading to skepticism regarding judicial impartiality and the effectiveness of the legal system. The study highlights that judges must conduct themselves with integrity, uphold the principles of justice, and avoid any actions that could compromise their role. In conclusion, the Judges' Code of Ethics not only serves as a regulatory framework for judicial behaviour but also acts as a foundation for public confidence in the judiciary. For the legal system to function effectively, it is imperative that judges adhere to these ethical standards, ensuring that their decisions are perceived as fair and just.

Abstract

Exports of resin commodities significantly affect Indonesia's economy, particularly in terms of Gross Domestic Product (GDP) and employment. This study aims to analyzethe effects of resin commodity exports on Indonesia's GDP and employment opportunities, and to provide recommendations for enhancing the sector's contribution through strategic initiatives. The research employs the Error Correction Model (ECM) to assess the relationship between resin exports, GDP, and employment, utilizing secondary data over the past decade. Results indicate a strong positive correlation between resin exports and GDP growth, with the latter significantly influenced by export revenue. The findings also reveal that the resin sector creates numerous job opportunities, benefiting not only the industry itself but also related sectors such as logistics and manufacturing. Enhanced export capabilities can lead to increased national income and reduced trade imbalances, further stabilizing the economy. In conclusion, the study highlights the importance of resin commodity exports in driving economic growth in Indonesia. It provides actionable insights for policymakers to strengthen the resin sector, improve product quality, and expand market access. By focusing on sustainable practices and technological advancements, Indonesia can capitalize on its natural resource wealth, fostering job creation and elevating living standards across local communities.
