Abstract

Wiretapping, the act of intercepting conversations, is often viewed as a violation of human rights, particularly within law enforcement contexts. This research investigates the stages involved in implementing wiretapping as a means to uncover criminal offenses, while also identifying the challenges faced by the Bali Police in this process. Employing a normative research method complemented by empirical analysis, the study gathers data from various primary and secondary legal sources. This research aims to determine the stages of wiretapping implementation in uncovering criminal offenses and identify the obstacles faced by Bali Police in the process. The study reveals that while legal frameworks governing wiretapping exist, their practical application remains hindered by these obstacles. The mastery of advanced technology is essential for effective wiretapping, yet many investigators lack adequate training and resources. Additionally, external constraints, such as outdated equipment or insufficient legal support, further complicate the implementation process. In conclusion, this research highlights the dual nature of wiretapping as both a valuable tool for law enforcement and a potential infringement on individual privacy rights. Addressing the identified challenges is crucial for enhancing the effectiveness of law enforcement while ensuring the protection of citizens' rights. By improving technological proficiency and overcoming external limitations, Bali Police can better utilize wiretapping in their efforts to combat crime while respecting the principles of privacy and human rights.

Abstract

The Covid-19 pandemic that began in late 2019 has had a significant impact on economies around the world, including Indonesia. In an effort to handle the pandemic, the Indonesian government has refocused the budget, one of which is through the transfer of funds to the regions. This study aims to analyze the effect of fund transfers to regions on economic growth during the Covid-19 pandemic in Indonesia. This research uses a quantitative approach with an exploratory case study method. The secondary data used includes local government financial reports and Gross Domestic Product (GDP) data from 34 provinces in Indonesia during 2020 to 2022. The analysis was conducted using statistical techniques with the help of SPSS. The results of the analysis show that the transfer of funds to the regions has a significant positive effect on economic growth, with an R-square value of 24.8%. However, 75.2% of economic growth is influenced by factors other than transfers. Fund transfer allocations that were originally intended to support regional development have been diverted to handling the impact of the pandemic. This study indicates that while financial transfers contribute to economic growth, there are many other factors that need to be considered. Therefore, further research is needed to understand the more complex dynamics in the effect of transfers on economic growth.

Abstract

The legal status of foreign creditors in the Republic of Indonesia remains ambiguous due to unclear norms and inconsistent regulations regarding land ownership. This uncertainty is an obstacle to foreign investment and creditor relations. This study aims to clarify the legal status of foreign creditors and the process of validating roya letters, and propose a regulatory framework that can improve legal certainty. This research uses normative legal research methods, by analyzing relevant regulations, laws, and legal literature to assess the existing legal framework. The research findings show that existing legal provisions lack clear guidance for foreign creditors, especially regarding the validation of roya letters. This creates barriers to foreign investment. To improve the legal landscape, it is important for policymakers to develop concrete regulations governing the validation of roya letters for foreign legal documents. Further research is needed to explore the implications of this regulation on the rights of foreign creditors and investment in Indonesia.

Abstract

The theft of sacred objects, especially Pratima in Bali, is a pressing issue that involves legal complexities between customary and national legal systems. This problem is not only materially damaging, but also threatens the continuity of religious traditions and practices. This research aims to analyze the settlement process of Pratima theft cases from the perspectives of customary and national law, and to identify the challenges faced in integrating the two legal systems. The approach used in this research is a qualitative method with in-depth interview techniques with traditional village leaders and police investigators. The data obtained was analyzed using a thematic analysis method to identify emerging patterns and themes. The results showed that there is a mismatch between the practice of customary law and national law in the resolution of Pratima theft cases. Many cases remain unresolved due to a lack of understanding and cooperation between the two legal systems. This research concludes that a more integrative approach between customary and national law is needed to improve the effectiveness of Pratima theft case resolution. Recommendations for policy makers and law enforcers are also provided to create a more sustainable solution for the protection of Bali's cultural heritage.

Abstract

The regulation of criminal conspiracy in corruption crimes in Indonesia, especially under Article 15 of the Corruption Eradication Law, raises various fundamental issues that have the potential to disrupt the principle of justice in law enforcement. This research aims to identify and analyze problems in the regulation of criminal conspiracy and provide recommendations for improvements that are fairer and in accordance with legal principles. The method used is normative research with a legal approach and qualitative descriptive analysis. Data was collected from primary, secondary, and tertiary legal sources to provide a comprehensive overview of the issues studied. The study found that the definition of criminal conspiracy in the GCPL is unclear, the sanctions are disproportionate, and the merging of the provisions with attempt and aiding and abetting has resulted in difficulties of proof. Recommendations include the need for a clear definition, separation of rules based on the nature of the act, application of the principle of proportionality in sanctions, and rewards for perpetrators who disclose conspiracies. With the proposed reforms, the law on criminal conspiracy should better reflect the principles of justice, provide legal certainty and support efforts to fight corruption effectively and humanely.

Abstract

This study entitled “The effect of Product Development on Operational Performance: A Case Study of Ultimate Motors Plc" examines the relationship between product development initiatives and operational performance at Ultimate Motors. The research employed a mixed-methods approach, combining a quantitative survey of 98 employees across product development, manufacturing, and operations functions at Ultimate Motors. The data was collected through an online questionnaire distributed via email and Telegrams. Using Partial Least Squares Structural Equation Modeling, the results indicate that four key product development elements - assembly line, product design, research & development, and product innovation - collectively account for 78.3% of the variance in Ultimate Motors' manufacturing costs and production efficiency. A standout finding is the outsized influence of assembly line optimization, which alone explains 47.7% of the operational performance outcomes. Product design also emerges as a critical factor, contributing 21.6% of the variance. However, the study reveals that inadequate employee training limits the full utilization of advanced design tools. While research & development and product innovation show positive impacts, their relationships with manufacturing costs and production time are not statistically significant. In contrast, effective assembly line management proves to be a crucial lever, driving improved efficiency, reduced costs, and faster timelines. To enhance its operational competitiveness, the study recommends that Ultimate Motors should: adopt advanced CAD software, invest in design team training, leverage CASE tools for innovation, upskill the R&D function, and embrace automation and flexible production technologies.

Abstract

This research discusses the concept of "Islamic Civilization 2.0," which aims to build a dynamic and relevant vision of Islamic civilization in the 21st century. In the context of global challenges such as social inequality, environmental degradation, and cultural polarization, it is important to integrate Islamic values with an inclusive and cosmopolitan approach. The purpose of this study is to develop a holistic framework that integrates Islamic epistemology, cosmopolitan values, and inclusive approaches, and to provide practical recommendations for policy makers, educators, and academics in applying those values to face contemporary challenges. This study uses a qualitative approach with a literature study design, analyzing the works of Husein Heriyanto, Bruce Lawrence, and Supriyanto Abdi. Data were collected from books, journal articles, and relevant documents, then analyzed using thematic analysis to develop a holistic framework. The research found that integrating Islamic epistemology, cosmopolitan values and inclusive approaches can form a comprehensive framework for the revitalization of Islamic thought and practice. This framework emphasizes the need for engagement in intercultural dialogue and the development of human values-based science inspired by Islam. This research provides guidance for policymakers, educators and academics to implement policies and curricula that are in line with maqasid al-syariah (the higher purpose of Islamic law). It concludes that "Islamic Civilization 2.0" offers a balanced approach to contemporary challenges by integrating Islamic values in a global context.

Abstract

The application of the National Health Insurance (JKN) membership requirement in the process of issuing a Certificate of Good Conduct (SKCK) has resulted in various problems, especially for those who are not registered as members. The purpose of this study was to evaluate the impact of the JKN membership requirement in the SKCK issuance process and identify the obstacles faced by the community. This study used a normative research method with legal analysis based on applicable regulations. The data used includes primary and secondary legal materials. The results showed that the regulation requiring JKN membership is contrary to the applicable law, namely Law Number 25 of 2009 concerning Public Services. This requirement creates obstacles in accessing public services that should be inclusive. This study examines the various challenges faced by the community in meeting these requirements and assesses their compliance with the principles of good public service. Policies that require JKN membership as a condition for issuing a Certificate of Good Conduct (SKCK) should be reviewed because they create barriers to accessing public services. Recommendations are made to remove these requirements in order to improve the inclusiveness and efficiency of public services.
