Abstract

This study analyzes changes in wage arrangements for micro and small business workers/laborers in the latest regulations, including the Job Creation Law, PP No. 7 of 2021, and PP No. 51 of 2023, using a normative legal approach and John Rawls' distributive justice theory. The study results show that, although the regulation provides flexibility for employers, there are still gaps in injustice due to weak monitoring mechanisms and the low bargaining power of workers. This regulation does not completely fulfill the principle of distributive justice, so a policy reformulation is needed that better protects micro and small business workers/laborers, such as setting sector-based minimum wage standards and strengthening monitoring mechanisms and legal protection. The application of Rawls' principle of justice can be the basis for this reformulation.

Abstract

This study aims to analyze the authority of the National Police and the National Narcotics Agency (BNN) to investigate narcotics crimes, as well as the legal implications of the overlapping authority between the two institutions. Using the normative legal method and the statute approach, this study examines the provisions of Law Number 2 of 2002 concerning the Indonesian National Police and Law Number 35 of 2009 concerning Narcotics, as well as other related regulations. A conceptual approach is also applied to explore the legal theory underlying the authority of investigators and the potential for conflict of authority in investigative practices. This study found that overlapping authority can lead to legal uncertainty, human rights violations, and ineffectiveness in the investigation process. Therefore, it is necessary to harmonize regulations, establish joint operational guidelines, and strengthen coordination between the National Police and BNN to prevent conflicts of authority and increase the effectiveness of narcotics law enforcement in Indonesia.

Abstract

This study discusses the legal protection and legal certainty provided by the state to internship participants in employment relations in Indonesia. Although internships aim to improve the competence of prospective workers, their practices are misused by companies as a form of disguised employment relations without fulfilling the normative rights of participants. Through a normative legal approach and analysis of applicable laws and regulations, this study highlights the significance of strict regulations, effective supervision by the Manpower Office, and the need for policy reformulation so that the rights and positions of internship participants are truly protected by law.

Abstract

This study explores the implementation of Integrated Governance, Risk, and Compliance (GRC) as a risk mitigation strategy in the management of pawn companies to enhance the national economy. The pawn industry in Indonesia has grown significantly, offering vital financial services, particularly to micro and small enterprises. However, challenges such as weak governance, operational risks, and regulatory gaps threaten its sustainability. The research aims to analyze the role of GRC in improving corporate governance, risk management, and regulatory compliance in pawn companies, thereby contributing to economic stability and inclusivity. Using a normative legal method, the study examines laws, regulations, and theoretical frameworks related to GRC, alongside secondary data from literature and legal documents. Findings reveal that integrated GRC strengthens transparency, accountability, and risk mitigation, fostering public trust and investor confidence. It also highlights the need for clearer regulations and technological adoption to address implementation challenges. The implications of this research underscore the importance of collaborative efforts between regulators, such as the Otoritas Jasa Keuangan (OJK), and pawn companies to standardize GRC practices. By enhancing governance and compliance, the pawn industry can better support financial inclusion, SME growth, and national economic resilience.

Abstract

Corruption in government procurement of goods and services remains a critical issue in Indonesia, undermining national development and public trust. This research examines the synergy between administrative and criminal law enforcement as a strategy to prevent and eradicate corruption in this sector. The study highlights the vulnerabilities in procurement processes, such as regulatory gaps, weak oversight, and the misuse of discretionary authority, which often lead to corrupt practices like bid rigging and fictitious procurement. The objective is to analyze the effectiveness of integrating administrative and criminal law mechanisms to create a more transparent and accountable procurement system. Using a normative juridical method, the research reviews legal frameworks, including Law No. 31 of 1999, Law No. 20 of 2001, and Presidential Regulation No. 16 of 2018, alongside secondary legal materials. The findings reveal that while Indonesia has a comprehensive legal foundation, inconsistencies in enforcement and overlapping institutional authorities hinder effectiveness. The study emphasizes the need for clear distinctions between administrative violations and criminal acts, as well as improved coordination among supervisory bodies like APIP, LKPP, and the KPK. The research concludes that a synergistic approach, combining administrative oversight as a preventive measure and criminal law as a last resort, is essential. Recommendations include harmonizing regulations, establishing joint SOPs, and enhancing training for procurement officials. These measures aim to reduce legal uncertainty and foster a corruption-free procurement environment.

Abstract

The Regional Development Planning Agency is an institution that assists regional heads in determining regional development policies. The John M. Bryson concept emphasizes a systematic approach to formulating, implementing, and evaluating development policies with formal authority, information centers, and strategic decision-making. This research aims to analyze Bappeda’s role through its formal authority, function as an information center, and strategic decision-making, while identifying supporting and inhibiting factors in the policy formulation process. This study uses a descriptive qualitative research approach, employing data collection techniques through interviews and related documents. The results show that the role of the institution in formulating policies—through formal authority, information centers, and strategic decisions—runs well based on bottom-up principles. The supporting aspects include the commitment of regional leaders and the active involvement of the community, while the inhibiting aspects are the lack of human resources and supporting facilities. The research contributes to the theoretical understanding of regional development planning and offers practical recommendations for local governments to strengthen Bappeda’s role in achieving sustainable development goals.

Abstract

This study investigates the impact of Flexible Working Arrangements (FWA) on Job Satisfaction, mediated by Work-Life Balance (WLB), among organic employees of PT Angkasa Pura Indonesia at I Gusti Ngurah Rai Airport, Bali. The research addresses concerns regarding job satisfaction in the context of shift work systems that are perceived as disorganized and disruptive to employees' personal lives. The objective is to examine whether FWA directly influences job satisfaction and indirectly through WLB. Utilizing a quantitative approach with an associative causal design, the study involved a saturated sampling of 128 employees. Data were collected through structured questionnaires and interviews and analyzed using path analysis via SPSS, including regression tests, normality, multicollinearity, heteroscedasticity, and Sobel test. The findings indicate that FWA has a significant positive effect on both WLB and job satisfaction, and that WLB significantly mediates the relationship between FWA and job satisfaction. These results support the social exchange theory, suggesting that employees respond positively to organizational flexibility by enhancing their commitment and satisfaction. The practical implication highlights the need for companies to evaluate and implement flexible scheduling policies to improve employee well-being and performance. Theoretical implications reinforce the role of WLB as a crucial mediator in organizational behavior studies. Future research could explore comparative models across different industries or regions.

Abstract

This study discusses the importance of standards and norms of human rights-based land administration services within the framework of the Indonesian state of law. Land administration services as part of public services must meet the principles of legal certainty, justice, and non-discrimination as mandated by Law Number 25 of 2009 concerning Public Services and Law Number 39 of 1999 concerning Human Rights. This research highlights the challenges of implementing land administration services that have not been fully handed over to local governments, thus causing a gap between regulations and practices in the field. It was also emphasized the need to implement Minimum Service Standards (SPM) that ensure access and quality of services to the community, especially in ensuring legal protection of land owned or controlled by citizens.

Abstract

This study aims to analyze the public procurement services at the Regional Implementing Unit IV of the Bureau of Procurement Services and State-Owned Goods Management (BLPPBMN) under the Ministry of Transportation, focusing on service quality, efficiency, transparency, and user satisfaction. A qualitative descriptive method with a case study approach was used. The findings indicate that while the e-procurement system has been implemented to enhance efficiency and transparency, several challenges remain, including process delays, technical issues, and limited personnel competence. The quality of service is considered adequate but still needs improvement, particularly in responsiveness and communication clarity. Key factors influencing procurement effectiveness include personnel competence, proper planning, and active participation from service providers. The study recommends strengthening human resource training, optimizing the electronic system, and improving supervision and accountability at all stages of the procurement process. The results are expected to contribute to enhancing procurement systems at BLPPBMN and other related government institutions.

Abstract

Digital transformation has changed consumer behavior patterns, including an increase in marketplace users that encourage compulsive buying behavior among generation Z. Data from the Ministry of Trade of the Republic of Indonesia in 2024 shows that the number of marketplace users will increase from 38.72 million in 2020 to 58.63 million in 2023 and is predicted to reach 99.1 million in 2029. This study aims to determine the influence of hedonic motivation on compulsive buying and test the role of fear of missing out (FoMO) as a mediating variable. The research was conducted in Denpasar City with a quantitative approach and purposive sampling method on 100 marketplace user respondents. The analysis technique used is path analysis. The results of the study showed that hedonic motivation had a positive and significant effect on compulsive buying and FoMO. FoMO also has a positive and significant effect on compulsive buying and partially mediates the relationship between hedonic motivation and compulsive buying. The conclusions of this study show that hedonic motivation and FoMO play an important role in encouraging excessive shopping behavior in the marketplace.
