Abstract

The results of the study are as follows: the application of current criminal sanctions against perpetrators of illegal logging in the forestry sector, hereinafter known as illegal logging, is imposed as formulated in Article 78 regarding criminal provisions. The sanctions imposed are: 1). imprisonment 2) Fine 3). confiscation of all forest products and tools used for crimes or violations. This shows that the criminal threat in this crime belongs to the severe category, in its application this article is generally applied indiscriminately, to the perpetrators of the crime of illegal logging who utilize forest products just to cover economic needs with the perpetrators of the cukong, as well as the owners. capital and who actually take large profits from the use of forest products without permission from the competent authorities. The philosophy underlying the intent and purpose of imposing severe criminal sanctions on anyone who violates the law in the forestry sector is to create a deterrent effect for violators of the law in the forestry sector. The intended deterrent effect is not only for perpetrators who have committed forestry crimes, but also for other people who have activities in the forestry sector who are reluctant to commit acts that violate the law because the criminal sanctions are severe.

Abstract

Since its independence, Indonesia has declared itself a state governed by law, as stated in the Preamble of the 1945 Constitution of the Republic of Indonesia. This noble ideal asserts that Indonesia is a state based on the rule of law, not merely power. However, the journey to realizing this ideal is fraught with challenges. Law enforcement in Indonesia faces serious issues such as weak rule of law, lack of accountability among law enforcers, low legal awareness among the public, and an inefficient judicial system. These problems lead to negative public perceptions of law enforcement in Indonesia. The public often sees law enforcement as unjust, with laws frequently "weak on the powerful and harsh on the powerless," where those in power often escape legal consequences while the underprivileged are easily punished. Additionally, the professionalism and integrity of law enforcement officials are often questioned, further tarnishing the image of law enforcement. This negative perception has severe implications for the stability and security of the nation, fostering public distrust that can lead to criminal and anarchic actions. addressing these issues requires continuous and comprehensive efforts involving all elements of the nation. The government needs to enhance transparency and accountability in law enforcement processes and enforce laws fairly and indiscriminately. The public also needs to actively supervise and criticize the performance of law enforcers. Surveys indicate that the majority of Indonesians have high hopes for the enforcement of laws in Indonesia, despite existing doubts and dissatisfaction with the slow and convoluted judicial process and the professionalism of law enforcers. The majority of respondents also acknowledge that corruption remains a serious issue requiring primary attention.

Abstract

The division of power into three branches put forward by two experts called trias politica which is generally divided into legislative, executive, and judicial powers, the fourth branch put forward by Hans Kelsen in the statement of ensuring regime stability requires a fourth branch referred to as the Constitutional Court which is believed to be the guardian of the stability of the other three branches by maintaining the constitution in the party government and with this function can determine many other characteristics. By using a normative method that aims to understand and interpret the rules of law contained in the constitution of state administration in Indonesia, ensuring the suitability of each rule of law with the norms that apply in the context of writing articles on constitutional law. The data used in this paper is secondary data. This existence of a balanced government in the state administration ensures that there is a fair contribution of power in each power-sharing system with the aim of monitoring and balancing each other to prevent abuse of power and ensure the fulfillment of citizens’ rights.

Abstract

Human trafficking is a very serious violation of human rights which includes using someone through fraud, coercion, prostitution, slavery, organ harvesting and even coercion for work purposes. Handling human trafficking really requires a comprehensive legal framework and policyy implementation at the of national and international levels. But sometimes in the process of its journey it often goes through challenge after challenge in law enforcement and victim protection is still the main obstacle factor that must continue to be fought and efforts Sustainable cross-border collaboration and the role of international organizations are important drivers in enforcing effective prevention of human trafficking. The role of laws and regulations in countries including Indonesia has not yet become an important basis for preventing human trafficking.

Abstract

The principle of fairness is an important principle in various matters. In drafting legislation, it is necessary to require the principle of justice to create social welfare. In this paper we raise the formulation of problems related to the implementation of the principle of justice in drafting legislation and the urgency of the principle of justice in drafting legislation. The method we use is a normative research method with the aim of finding out the implementation of the principles of justice in statutory regulations as well as conducting library research by collecting data, previous journals and legal regulations which are used as material in this writing. Based on the implementation of the principle of justice in drafting laws and regulations, the principle of justice is very important and reflects various aspects that exist within the Indonesian state. The urgency of this principle of justice is that it can create social welfare without anything that conflicts with morals, ethics and culture in society so that society can accept these regulations if they have been ratified.

Abstract

The aim of this research is to provide an overview of the role of BAWASLU in realizing free and fair elections, as well as providing an analysis of how to hold a quality regional election by involving various stakeholders who have the same goal in making a fair regional election a success. This research uses the PAR method, namely Participation in Action Research, using two methods of data collection, namely observation and interviews. A total of 30 people were the subjects of the research, the 30 people were 5 BAWASLU Regency commissioners. Mandailing Natal and 25 sub-district supervisory officers spread across Mandailing Natal district. The results of this research are first, there is an effort from the BAWASLU commissioner of Mandailing Natal Regency to provide awareness to members of the sub-district supervisory committee in enforcing neutral post-conflict local election activities, so that there is an effort to continue to supervise post-conflict local election activities in a neutral manner. Second, there are monitoring and awareness efforts carried out by sub-district supervisory supervisors in providing education to always carry out neutral and balanced supervision to sub-district/village supervisory supervisors in the Mandailing Natal district.

Abstract

Pencarian kebenaran materiil dalam suatu perkara pidana merupakan tujuan utama hukum acara pidana di Indonesia, dengan memastikan bahwa pelaku tindak pidana dapat diadili secara adil dan tepat. Namun, dalam pelaksanaannya, sering terjadi kesalahan penangkapan (error in persona) yang mengakibatkan kerugian besar bagi korban. Kesalahan ini biasanya disebabkan oleh ketidaktelitian dan kesalahan administrasi penyidik. Di Indonesia, korban penangkapan salah tangkap masih belum mendapatkan perlindungan hukum yang memadai, meskipun regulasi seperti KUHAP telah menetapkan mekanisme untuk ganti rugi dan rehabilitasi. Penelitian ini mengevaluasi regulasi dan prinsip hukum yang terkait dengan perlindungan korban salah tangkap, serta menganalisis efektivitas implementasinya. Teori yuridis normatif diterapkan dalam metode penelitian deskriptif kualitatif penelitian ini untuk menganalisis jaminan ganti rugi serta rehabilitasi terhadap korban error in persona. Melalui analisis dokumen dan tinjauan literatur, data yang digunakan dalam penelitian ini dikumpulkan. Hasil penelitian menunjukkan bahwa masih banyak hambatan dalam pelaksanaan hak-hak korban, termasuk rendahnya kesadaran hukum dan etika profesional aparat penegak hukum. Perbaikan regulasi dan penegakan hukum yang lebih tegas diperlukan untuk memastikan perlindungan hak asasi manusia dan keadilan bagi korban salah tangkap di Indonesia.

Abstract

The purpose of this study is to analyze the perceptions of students of the Faculty of Law, Nusa Cendana University about body shaming in the campus environment and social media and how the regulation of criminal acts of body shaming in review of the Criminal Code and Laws outside the Criminal Code. This research method is an empirical juridical approach, namely research whose data is obtained through efforts to investigate existing realities in social life. The results of this study are that the perceptions of students are very diverse, most students know about body shaming, many students have been victims of body shaming, and some are often the perpetrators of body shaming. The acts of body shaming that are experienced form the thoughts of some students to fight back but more choose to remain silent. This thought causes a response where some students choose to shut down and close themselves, some become insecure and others choose to withdraw from their social environment. According to most students, body shaming is a dangerous thing. The regulation of the criminal offense of body shaming in terms of the Criminal Code, the relevant article is Article 315 of the Criminal Code and if it is reviewed from laws outside the Criminal Code, the relevant articles are Article 27 Paragraph (3) of the ITE Law, Article 5 of the TPKS Law and Permendikbud Ristek No.30 of 2021.

Abstract

Legal protection against fraud against consumers in online business has been regulated in the Criminal Code Articles 378 and 379 and Article 28 paragraph (1) jo. Article 45 paragraph (2) of the ITE Law regulates false news that results in consumer losses in Electronic Transactions. This research is a research that uses an empirical approach method, namely an approach based on the type of data and data analysis. The results of this study found (1) Law enforcement against criminal acts of fraud against consumers in the online buying and selling business in Kupang City runs based on existing legal rules, namely both the Criminal Code and the ITE Law, namely Article 378 of the Criminal Code and Article 28 paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. (2) Efforts to protect consumers in criminal acts of fraud on e-commerce sites in Kupang City are preventive efforts to prevent the occurrence of such criminal acts. Then repressive efforts to provide criminal sanctions in accordance with applicable regulations. This effort can be done by the way victims can report criminal acts of fraud by visiting law enforcement agencies for further processing.

Abstract

Along with globalisation, economic development continues to change dynamically in order to achieve success in national economic development. National economic development is the development of equitable economic growth for the greatest prosperity of all Indonesian people based on the principle of kinship in accordance with Pancasila and the 1945 fourth amendment of the Republic of Indonesia. This economic development is marked by the development of a variety of transactions or economic activities, one of which is investment or capital activities through the capital market such as mutual fund investments made through the role of investment managers. In carrying out its business activities, there is a risk of default that can result in a Suspension of Payment against the Investment Manager, one of which is the case of Central Jakarta District Court Decision Number 78/Pdt.Sus-PKPU/2020/PN Niaga Jkt.Pst. This research aims to examine the accuracy of the consideration of the Central Jakarta District Court judge in the related decision regarding the qualification of investment losses as a default charged to the Investment Manager, as well as the judge's consideration in accepting the suspension of payment application against PT Emco as the Investment Manager by the Investor. This research uses the juridical-normative method, which prioritises the use of literature material from positive law as a source with the results of the research described descriptively. The results of this study show conclusion that can be drawn. The judge's consideration in the relevant decision is not correct because the responsibility for default should be borne by the issuer, in addition, the judge's consideration does not conduct further investigation regarding the origin of the compensation agreement between the Investment Manager and the Investor.
