Abstract

The existence of traditional law has been long before Indonesia exists and has been the law that sticks to the traditional people itself. In consequence the occurrence of traditional law runs in harmony because it is a responsive law that means that it is the law that is needed by the community. Nowadays, the traditional laws that exists are complex and has many variations between one region and other regions because we know many traditional communities. Along with the development of the state structure, than as juridical formal, since August 17, 1945, Indonesia was created. The occurrence of traditional laws were started to be used in the ordinance or Indonesian positive law.In Base Ordinance of 1945 (UUD 1945), is not written in a section but is said in the moving of section II, as it is in the Temporary Ordinance of 1950 (UUDS 1950 and in the organic law, for example, in the Ordinance no 5, 1960 about UUPA. This shows that the status of traditional law has its high place in the level of the state structure in the Republic of Indonesia. The value of the traditional law, for example; the horizontal separation, the right of traditional law in the society, the variation in the relationship is enriching the traditional law itself. And until now it is still raised up by the community itself as the special traditional law.

Abstract

In the human, there is a universal and binding standards. Thus, the principle of respect (to respect), protection (to protect) and fulfillment (to fulfill) Human Rights describes as "jus cogens". That is, a fundamental principle of international law that countries can not be refused because the collective agreement. The principle is the right to life (rigts of live). However, there is particular debate on the universality of Islam and Western standards and there are problems associated with implementing the in practice. Standard of debate in because of the universality of crossing cultural boundaries, particularly religion and each tradition has a frame of reference (frame of reference) and their respective international traditions and norms define the validity of the teachings of their own resources. In this case, the ongoing debate relating to the death penalty law in which Islam and the West has standardized the concept of human rights respectively. Death penalty law contained in the law of Islamic criminal law sharp criticism from the West. Which the death penalty, considered to have a discriminatory character, cruel, inhuman and violating human rights (right to life). This debate, would complicate the enforcement of human rights, especially related to death penalty law, as well as in the plains protection national law enforcement in Indonesia, especially modern law.

Abstract

Pluralism, a popular diversity, is not only an attitude of acknowledging and accepting a reality of pluralistic society, but also a sincere attitude to accept the reality as a positive value, as the grace of God to mankind. Therefore, it will enrich the cultural growth through the dynamic interaction and cross-diverse cultural exchanges. Pluralism is a way to push the nation's cultural enrichment. Indonesian culture or "keindonesiaan" is nothing but a result of resourceful and dynamic interaction among the diverse actors in an effective melting pot. Plurality is a diversity based on virtue (uniqueness), and distinctiveness. Hance, the existence of plurality can not be realized or imagined except as an antithesis and a comparative object of uniformity and unity encapsulating its dimensions. This paper will explore the uniqueness of Indonesian law.

Abstract

For the modern state, the constitution must be understood as a development concept. The constitution can not be viewed as a static document, but it lives and grows as the basic principle of the state organization that always followes the developments and dynamics of society. The constitution was born from constitutionalism which provides limits of state power in one side and guarantee for the rights of people through constitutional provisions in another side. During 67 years of Indonesia’s independence,the constitution give the color in the organization of state administration. Many important events woven in 3 (three) constitutions in this period, namely the Constitution of 1945, the Constitution of 1949 United Republik of Indonesia and Provisional Constitution of 1950. Departing of the view that the constitution should follow the development and dynamics of society, this paper will explore the journey of life about the constitution of the early independence to this present era. For a dynamic society, creation of awareness constitution is very important, because the constitutional talks in the future will increasingly contentious and polemical as in previous years.

Abstract

AbstrakSebagai bentuk dukungan kepada pelaku ekonomi kreatif yang sangat diharapkan dapat menjadi tumpuan pertumbuhan ekonomi nasional, Pemerintah memberi kemudahan pembiayaan atau kredit dengan menjadikan sertifikat Kekayaan Intelektual (KI) menjadi agunan atau jaminan pinjaman dari lembaga keuangan bank maupun non bank. Dalam pelaksanaannya pihak lembaga keuangan akan memberikan pinjaman menggunakan KI sebagai objek jaminan utang dalam bentuk jaminan fidusia, kemudian melakukan penilaian terhadap nilai komersialisasi kekayaan intelektual yang dimiliki. Semakin tinggi nilai dan potensi ekonomi dari karya cipta, merek atau paten yang dimiliki tersebut, maka nilai pinjaman yang diberikan pun akan semakin besar. Penelitian ini bertujuan untuk mengetahui bagaimana implementasi pembiayaan Atau kredit dari lembaga keuangan dengan jaminan kekayaan intelektual (KI) sebagaimana diatur dalam Peraturan Pemerintah (PP) Nomor 24 Tahun 2022. Metode yang digunakan dalam penelitian ini menggunakan metode analisis yuridis kualitatif dengan pendekatan yuridis normatif atau penelitian hukum kepustakaan Berdasarkan hasil kajian diperoleh kesimpulan bahwa KI yang dapat dijadikan sebagai objek jaminan utang harus memenuhi dua syarat. Pertama, KI tersebut telah tercatat atau terdaftar di DJKI Kementerian Hukum dan HAM. Kedua, produk KI tersebut sudah dikelola dengan baik secara sendiri atau telah dialihkan haknya kepada pihak lain. Kekayaan intelektual yang sudah dikelola maksudnya adalah kekayaan intelektual yang sudah dilakukan komersialisasi oleh pemiliknya sendiri atau pihak lain berdasarkan perjanjian.AbstractAs a form of support for creative economy actors who are expected to become the foundation for national economic growth, the Government provides financing or credit facilities by making Intellectual Property (IC) certificates a collateral or loan guarantee from bank and non-bank financial institutions. In practice, financial institutions will provide loans using IP as objects of debt guarantees in the form of fiduciary guarantees, then evaluate the value of the commercialization of intellectual property owned. The higher the economic value and potential of the copyrighted works, brands or patents owned, the greater the value of the loans granted. This study aims to find out how the implementation of financing or credit from financial institutions with guaranteed intellectual property (IC) as stipulated in Government Regulation (PP) Number 24 of 2022. The method used in this study uses a qualitative juridical analysis method with a normative or juridical approach. library law Based on the results of the study; it was concluded that IP that can be used as an object of debt guarantees must fulfill two conditions. First, the IP has been registered or registered with the DJKI of the Ministry of Law and Human Rights. Second, these IP products have been managed independently or their rights have been transferred to other parties. Intellectual property that has been managed means intellectual property that has been commercialized by the owner himself or another party based on an agreement.

Abstract

This study explores the protection of personal data-appealing discourse these days. Globally, 132 countries already have special arrangements to protect personal data. The Bill on the Protection of Personal Data in Indonesia is already in the National Legislation Program. Indonesia does not yet have special regulations regarding protecting personal data. Furthermore, it also discussed personal data protection regulations in several countries, both Europe and Asia. This study uses a comparative study that compares personal data protection among countries for further studies on what matters should be included in the Data Protection Bill for Indonesia. The study showed that personal data protection arrangements certainly differ. Most Data Privacy Protection regulates the same stuff, such as principles, protection mechanisms, rights of data subjects, transfers to third countries, and sanctions. It also showed that the regulation of Personal Data Protection in Indonesia is still not adequately controlled compared to the regulations in other countries

Abstract

Tersurat dan tersirat dalam Konstitusi Indonesia, penegasan bahwa selain sebagai negara hukum seperti tertera dalam ketentuan Pasal 1 ayat (3) UUD 1945, maka Indonesia adalah juga negara demokrasi, yaitu negara yang berkedaulatan rakyat seperti tertuang dalam ketentuan Pasal 1 ayat (2) UUD 1945. Sebagai negara berpostur negara hukum demokratis tentunya segala langkah kebijakan yang diambil akan bermuara pada tujuan bagaimana mewujudkan tata kehidupan masyarakat hukum yang bersendikan nilai-nilai demokrasi. Merayakan 77 tahun kemerdekaan Indonesia, serta diilhami oleh fenomena meningkatnya kesadaran pentingnya negara hukum dan tegaknya demokrasi, maka perlu dikaji bagaimana derap politik hukum dalam tata hukum Indonesia guna mewujudkan masyarakat hukum yang demokratis. Politik hukum sebagai bagian dari sekian banyak kebijakan penguasa negara akan sangat menentukan warna tata hukum yang berlaku dalam kehidupan bernegara dan bermasyarakat. Tata hukum yang merupakan wujud dari aspirasi publik, juga akan menentukan tercapai tidaknya suatu masyarakat hukum ideal dalam ukuran dan ranah demokrasi.

Abstract

The presence of BMTs as MFIs in Indonesia has colored economic growth as supporting funding for the small and medium enterprise sector. The status of BMT legal entities in Indonesia is the majority as cooperative legal entities, but there are also those that are PT legal entities, foundations, and not yet legal entities, in customer protection. There are two protection models, namely implicit deposit protection and explicit deposit protection. The implicit protection model is carried out through supervision of banks, while explicit supervision is carried out by the deposit insurance agency. Until now, the existence of LPS for BMT has not been known, although in Article 19 of Law no. 1 of 2013 stipulates that MFIs can also establish deposit insurance institutions (LPS). This research is a normative legal research that refers to various sources of primary legal materials and tertiary legal materials. The conclusion of this paper is, Legal protection for BMT customers is contained in Article 54 of Law no. 25 of 1992 regarding settlements in conditions where cooperatives experience dissolution. In addition to Law no. 1 of 2013 legal protection for customers is regulated in Article 24 and Article 25, and complaint services are regulated in Article 26. However, legal problems for BMTs are not only in explicit customer protection but in the form of BMT itself there is no regulation that stipulates that BMTs must what kind of legal entity? The government should have issued special rules for BMTs considering that BMTs are in principle different from cooperatives. BMT carries out two functions, namely collecting ZIS and running business in the micro sector.

Abstract

Artikel ini mengkaji tentang teori dan pendekatan rekognisi dan redistribusi yang gagas oleh dua ilmuan kritis, Nancy Fraser dan Axel Honneth. Kedua orang ini melakukan kritik terhadap teori sosial yang selama ini dianggapnya tumpul dalam melihat persoalan ketidakadilan social. Kedua orang ini menganggap bahwa teori social selama ini melihat suatu problem hanya dalam bingkai perspektif tunggal, sehingga yang terjadi ketidakmampuan melihat ketidakadilan social yang di luar jangkaun keilmuan ataupun perspektif yang bersangkutan. Oleh karena itu, kedua orang ini menawarkan gagasan teoritis perspektif yang luas dengan beragam pendekatan. Nacy Fraser menawarkan konsep dualism-perspektif, yaitu melihat ketidakadilan social dengan dua kaca mata keilmuan yang tak terpisahkan yaitu rekognisi dan redistribusi secara bersamaan. Sedangkan Axel Honneth menawarkan monism perspketif, yaitu melihat ketidakadilan social dengan rekognisi yang menjangkau hukum dan ekonomi secara blended.

Abstract

Tulisan ini membahas mengenai PT. Santara Daya Inspiratama yang merupakan salah satu platform Layanan Iuran Dana dengan konsep Equity Crowdfunding yang telah mendapatkan izin dari Otoritas Jasa Keuangan (OJK) dalam Peraturan No.37/POJK.04/2018 tentang Layanan Urun Dana melalui Penawaran Saham Berbasis Teknologi Informasi (Equity crowdfunding). Layanan ini bertujuan mempertemukan pemodal/investor (yang akan membeli saham bisnis UKM) dengan penerbit (UKM atau startup) yang membutuhkan modal untuk pengembangan usahanya. Oleh karenanya, dibutuhkan keamanan dalam berinvestasi bagi segala pihak. Lalu bagaimana perlindungan hukum bagi para pihak, baik penerbit, platform penyelenggara, maupun pemodal, dalam berinvestasi melalui equity crowdfunding di Santara Yogyakarta? Hasil analisis menunjukkan bahwa peraturan OJK hanya memuat ketentuan umum mengenai hak kewajiban bagi penerbit dan pemodal. Sedangkan pelanggaran atas perjanjian dan pelaksanaan equity crowdfunding hanya berupa sanksi administratif dan belum mengatur mengenai sanksi pidana atas tindak pidana para pihak. Sedangkan untuk risiko bisnis, Santara masih berupaya untuk meminimalisir risiko usaha, investasi, likuiditas, dan kelangkaan dividen guna mewujudkan kepastian dan perlindungan hukum bagi para pihak, baik penerbit, platform penyelenggara, maupun pemodal dalam berinvestasi melalui equity crowdfunding.
