Abstract

Thuggery remains a social ill that can disrupt public order and security, necessitating effective, measurable, and sustainable measures. This study aims to analyze the role of the Bali Regional Police and the obstacles faced in combating thuggery within its jurisdiction. This study uses a juridical-empirical method, combining literature studies, laws and regulations, and field data through interviews and observations. The results show that the Bali Regional Police have implemented various strategies, one of which is Operation Pekat Agung. This police operation is supported by strategies such as a preemptive approach by providing counseling regarding thuggery, a preventive approach through community development, and repressive law enforcement against perpetrators of thuggery. However, several obstacles remain, both in terms of structure, substance, and legal culture. This study concludes that the police's role has not been effective, but that strengthening coordination, improving human resources, and community participation are needed to create a safe and orderly environment in Bali on an ongoing basis

Abstract

Land registration through the proof of old rights may be conducted based on physical possession of land for twenty years or more, as evidenced by a sporadic statement letter and supported by the testimony of at least two witnesses. However, this provision allows the use of testimonium de auditu testimony, namely statements based on hearsay that cannot be materially verified. In practice, the assessment of proof of old rights as regulated under Article 24 paragraph (1) of Government Regulation No. 24 of 1997 contains the phrases “degree of truth” and “deemed sufficient” without clear parameters, thereby creating legal uncertainty. This normative juridical research employs the theory of legal certainty and the theory of evidence to analyze two main issues: the regulation of land registration in Indonesia and the evidentiary strength of testimonium de auditu testimony. The findings indicate that testimonium de auditu testimony does not meet the criteria of a valid witness and fails to provide legal certainty, while the ambiguity of the norm necessitates further regulatory clarification

Abstract

This study aims to analyze legal certainty regarding the implementation of Minister of Energy and Mineral Resources Regulation Number 14 of 2024 in the licensing process for groundwater utilization. The regulation of groundwater licensing has undergone significant changes following Law Number 6 of 2023 on Job Creation, which emphasizes simplification and integration of business licensing through the Online Single Submission (OSS) system. This research employs a normative juridical approach using primary legal materials, namely Law Number 17 of 2019 on Water Resources and Ministerial Regulation Number 14 of 2024, supported by relevant secondary literature. The findings indicate that Regulation number 14, 2024 simplifies procedures and integrates licensing mechanisms, including provisions requiring approval from the Ministry of Energy and Mineral Resources for groundwater usage exceeding 100,000 liters per month. However, potential normative ambiguities remain in its implementation. Therefore, strengthened supervision and regulatory harmonization are necessary to ensure legal certainty and sustainable groundwater management.
