Qonun Jurnal Hukum Islam dan Perundang-undangan is an open access, peer-reviewed journal which aims to offer an international academic platform for Islamic legal stuidies. Abstract

Penelitian ini bertujuan menganalisis penetapan batas usia perkawinan di Indonesia dalam perspektif Teori Maslahat dan Maqāṣid al-Syarī‘ah berdasarkan Undang-Undang Nomor 16 Tahun 2019, dengan mengisi kesenjangan studi sebelumnya yang masih parsial dan belum mengintegrasikan pendekatan maqāṣid, maslahat, reformasi hukum keluarga, serta dinamika implementasi seperti dispensasi nikah dalam satu kerangka sistematis. Metode yang digunakan adalah Systematic Literature Review terhadap publikasi periode 2020–2024 dengan protokol PRISMA. Hasil menunjukkan bahwa batas usia minimal 19 tahun merupakan ijtihad kontekstual berbasis maslahah mursalah yang selaras dengan tujuan perlindungan dalam maqāṣid al-syarī‘ah, serta berdampak pada penurunan risiko kesehatan reproduksi, peningkatan akses pendidikan, dan stabilitas sosial-ekonomi. Namun, efektivitas implementasi masih terbatas oleh tingginya dispensasi nikah akibat faktor sosial, ekonomi, dan lemahnya pengawasan, yang menunjukkan adanya kesenjangan antara norma hukum dan praktik. Kebaruan penelitian ini terletak pada integrasi komprehensif antara analisis normatif maqāṣid al-syarī‘ah, pendekatan maslahat, dimensi implementatif kebijakan, dan perspektif komparatif lintas negara dalam satu kerangka SLR. Secara komparatif, kebijakan ini sejalan dengan reformasi hukum keluarga di negara Muslim lain dan prinsip perlindungan anak dalam kerangka hak asasi manusia. Penelitian ini menyimpulkan bahwa batas usia perkawinan merupakan instrumen regulatif sekaligus manifestasi ijtihad adaptif, yang efektivitasnya bergantung pada penguatan institusi, edukasi pranikah, dan integrasi pendekatan maqāṣid dalam implementasi kebijakan.

Abstract

Artikel ini menganalisis kontribusi prinsip keadilan retributif dan restoratif dalam hukum pidana Islam terhadap formulasi tindak pidana pembunuhan dalam Kitab Undang-Undang Hukum Pidana (KUHP) Baru Indonesia (UU No. 1 Tahun 2023). Hukum pidana Islam menawarkan model keadilan yang menyeimbangkan antara penghukuman dan pemulihan melalui konsep qisas, diyat, dan afw, yang menempatkan korban dan komunitas sebagai bagian penting dalam penyelesaian perkara. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta analisis komparatif antara ketentuan KUHP Baru dan prinsip-prinsip fiqh jinayah. Hasil penelitian menunjukkan bahwa meskipun KUHP Baru belum mengadopsi qisas secara formal, sejumlah ketentuannya terutama terkait proporsionalitas pemidanaan, pemaafan hakim, dan mekanisme keadilan restoratif merefleksikan nilai-nilai keadilan Islam secara substantif. Integrasi nilai tersebut berkontribusi dalam membangun sistem hukum pidana yang lebih humanis, kontekstual, dan berorientasi pada pemulihan sosial tanpa harus mengarah pada islamisasi hukum. Kebaruan penelitian ini terletak pada analisis objektifikasi prinsip keadilan Islam sebagai sumber nilai dalam pembaruan hukum pidana nasional, khususnya dalam pengaturan tindak pidana pembunuhan.

Abstract

The digital transformation of the judicial system has significantly influenced procedural law in the Religious Courts, particularly in resolving Muslim family disputes. This study aims to analyze the implementation of digital-based procedural law, identify normative, technical, and sociological challenges, and formulate an ideal model of procedural law for Religious Courts in the digital era. This research employs a library research method with a qualitative approach by examining statutory regulations, scholarly literature, and previous studies. The findings indicate that digitalization through e-court and e-litigation systems developed by Mahkamah Agung Republik Indonesia has improved efficiency and accessibility of judicial services; however, it has not fully addressed the complexity of Muslim family disputes. The main challenges include regulatory limitations, technological infrastructure constraints, and low levels of digital literacy among the public. Based on the analysis of legal system theory, access to justice, and maqāṣid al-sharī‘ah, this study proposes an integrative ideal model of procedural law through a hybrid approach, strengthened digital evidence regulation, optimization of value-based mediation, and inclusive access to justice. This model is expected to establish a judicial system that is not only procedurally efficient but also substantively just in resolving Muslim family disputes.

Abstract

This study examines the tradition of uang hantaran in Riau Malay marriages from the perspective of Islamic law, addressing the limited analytical discussion on its legal status and socio-religious implications. Using a qualitative ethnographic approach, data were collected through fieldwork in Siak Regency, Pekanbaru City, and Dumai City, involving interviews with community members and religious figures. The findings show that uang hantaran is a deeply rooted customary practice determined through mutual agreement, functioning as both financial support for wedding expenses and a symbol of commitment. However, excessive demands may generate financial burdens, indebtedness, and delays in marriage. From the standpoint of Islamic jurisprudence, although not prescribed in the Qur’an or Sunnah, the practice may be accommodated under the concept of ‘urf (custom) as long as it aligns with Islamic principles—permissible when it promotes maṣlaḥah and invalid when it leads to mafsadah. This study contributes by offering an integrative ‘urf-based analysis that bridges local cultural practices with Islamic legal theory, providing a more nuanced framework for evaluating customary marriage traditions in contemporary Muslim societies.
